TUESDAY, JULY 13, 2021 JUDGE DELAYS RULING IN BAFFERT-NYRA FASIG-TIPTON JULY CASE by Bill Finley LAUNCHES BROOKLYN--After an-hour-and-forty minute hearing Monday in the United States District Court for the Eastern District of New YEARLING SEASON York, in which lawyers representing Bob Baffert argued for a preliminary injunction that would allow the trainer to once again race at the New York Racing Association tracks, Judge Carol Bagley Amon did not render a decision and did not give a time frame for doing so. The hearing came on the heels of a May 17 announcement from NYRA in which the racing organization said Baffert had been temporarily suspended, which meant he could not stable at the New York tracks or race there. The decision came shortly after Baffert announced that the Kentucky Horse Racing Commission had informed him that Medina Spirit (Protonico) had tested positive for Betamethasone following his win in the GI Kentucky Derby. Baffert=s legal team has argued that the NYRA ban is causing him irreparable harm for a number of reasons, among them the fact that he currently cannot race at Fasig-Tipton July graduate Kimari winning the GI Madison S. Saratoga, one of the premier meets in the sport. Saratoga opens Coady Thursday, July 15. AWe've always had a lot of young stallions represented at this sale and that will be the case again this year, however, after several years of absence, we brought back the Freshman Sire Showcase,@ said Browning. AThere is a group of yearlings by freshman crop sires, who overall, are quite exciting.@ When asked why a formal session dedicated to first-season sires was shelved for a few years before returning for the 2021 renewal, Browning explained, AAs the market evolved, it had shifted for a little while where being 'new' or 'unproven' was not popular and not in vogue around 2009-11. [In recent times] we have seen tremendous success on the racetrack and in the sales ring by horses by these younger sires and we thought it was an opportune time to bring back this showcase, which was so popular for so many years.@ Boyd Browning, Jr. | Fasig-Tipton photo Although the younger sires will head the action Tuesday, the elder statesmen of the game also enjoy ample representation in this year's catalog. AWe also have a tremendous group of yearlings by proven stallions, some of the best stallions in the world,@ he added. AI think we have a very good combination of a very well-balanced catalog and most importantly, we have a group of physicals that we love.@ And while the stallion representation remains diverse, the foundation that the sale has built its reputation on since the early days when Triple Crown hero Seattle Slew--by Bold Reasoning, who was relatively unproven at the time--was secured for a mere $17,500 in 1975 remains largely unchanged. AThe July sale has built its reputation for over 40 years of being a great place to showcase an early, precocious, mature, athletic individual,@ Browning said. While serving as a launching point for yearling sales season, the July sale also fulfills a need for breeders and sellers looking for an appropriate spot to bring their yearlings to market. AI think this sale sets a tone,@ offered Browning. AI think the most important thing about the yearling sales in particular is that horses mature and thrive at different times. Throughout the foaling season, we will have foals born from January through June and there are certain times on the calendar which suit certain horses better than others. What we are trying to do is to give sellers and breeders the opportunity to maximize the opportunity with their horse. That is to sell when he or she is going to be at its best, for itself, but also within its peer group that it's competing against. Not every horse matures, prospers or thrives at the same time. So, it's important to have multiple options and venues for sellers.@ Echoing that sentiment, Brookdale's Joe Seitz, offering horses in both the yearling and HORA portions of the July sale, said, AThe July sale is timed really well because it allows anybody who wants to buy something to campaign in the summer and fall, so it hits the calendar just right. And it seems to be growing every year. We have had some fun offering horses out here over the past few years. Bob Baffert | Benoit photo Flanked by three lawyers, Baffert appeared in court, but was not called on to testify. Among the Baffert team, Robertson was clearly in charge and pounded away at what have become common themes from the trainer=s defense. Robertson argued that, by issuing a suspension without affording Baffert a hearing, NYRA had deprived him of his due process rights. He also alleged that, in the case of Baffert, NYRA does not have the legal right to exclude the trainer. ANYRA jumped the gun and decided to be judge, jury and executioner and suspend him,@ Robertson said. AIt was a case of fire, ready, aim. They acted outside of their authority and they violated his constitutional right to due process. He has a trainer=s license issued by the New York Gaming Commission and that is a constitutionally protected property interest which cannot be taken away without due process. And there has been zero due process.@ While Judge Amon was careful not to tip her hand, she did pepper Greenberg with questions about NYRA=s failure to give Baffert a hearing. Greenberg said one of the reasons NYRA did not do so was because Baffert never asked for one. AHe has to ask for one?@ she asked incredulously. Noting the importance of the Saratoga meet and the number of important stakes races run there, Robertson said that Baffert would be subject to irreparable harm if not allowed to race there. AThe opportunity to participate [at Saratoga] is vitally important. ASaratoga is the premier race meet in the country. Saratoga is the crown jewel, and has 43 graded stakes races. These races come around only once a year and if he is denied the opportunity to participate in them, he cannot get back that opportunity. That is irreparable harm.@ Cont. p6

Greenberg zeroed in on integrity issues and a need for NYRA to suspend someone who had not only the Derby positive but four others within the course of a year. He said Baffert has smeared some of the biggest events in the sport, mentioning not only Medina Spirit in the Derby, but another Betamethasone positive, with Gamine in the GI Kentucky Oaks. AThere=s never been anyone else who has managed to smear the Kentucky Derby and the Kentucky Oaks and has had five violations within the span of a year,@ Greenberg said. AThat=s what NYRA was presented with...He continues to race and all the while, the reputation of the sport suffers.@ Greenberg also attacked the way Baffert handled the dispute in its earliest days, which included an impromptu press conference at Churchill Downs and several media appearances in which he first maintained that Medina Spirit was never given Betamethasone. He later reversed course and said it likely got into the horse=s system because it was an ingredient in an ointment used to deal with a skin problem. AHe never accepted responsibility or said he was sorry,@ Greenberg said. AIn a 14-minute interview, he attacked regulators, their integrity and their credibility and he said the horse was never given Betamesthasone.@ Greenberg also attacked Baffert=s clumsy assertion that the Medina Spirit positive and the ensuing uproar was a matter of Acancel culture.@ Baffert, Robertson and Greenberg all declined to comment afterward. So did NYRA President and CEO Dave O=Rourke, who was in attendance along with a cadre of NYRA officials. BERT FIRESTONE PASSES AWAY Bert Firestone, who along with his wife Diana, enjoyed international success at racing=s top level for decades, passed away Monday at JFK Medical center in West Palm Beach. He was 89. Firestone, a successful industrial real estate developer, was a hands-on horseman--he spent a summer in the early 1950s galloping for trainer Charlie Whittingham--whose American racing successes led to seven Eclipse Awards. Honest Pleasure (What a Pleasure) earned the couple=s first Eclipse statue as champion 2-year-old of 1971 and he was followed by 1977 champion sprinter What a Summer (What Luck). In 1980, the Firestones enjoyed perhaps their greatest stateside success when Genuine Risk (Exclusive Native) became only the second filly to win the GI Kentucky Derby. Cont. p7

Bert and Diana Firestone lead Winchester into winner's circle Coglianese The filly=s victory on the First Saturday in May bettered the previous runner-up efforts of Firestone colorbearers Honest Pleasure and General Assembly (Secretariat) and earned the couple, not just an Eclipse statue as leading 3-year-old filly, but also contributed to a championship as leading owners. Already a champion in France, April Run (Ire) (Run the Gauntlet) earned the Eclipse Award as the top turf mare in the U.S. in 1982 and the great Theatrical (Ire) (Nureyev) reeled off six Grade I victories in 1987 to become the first Eclipse champion and Breeders= Cup winner for future Hall of Fame trainer Bill Mott. AThey are great horse-people,@ Mott told TDN=s John Berry last year. AThey understand horses, understand racing. They are people who are passionate about the horses themselves and when people are passionate about the horses as individuals, then it makes it easy for everything to go well.@ Firestone=s Eclipse champions also include Jimmy Lorenzo (GB) (Our Jimmy), the top steeplechaser of 1988. The Firestones success in the U.S. was matched or exceeded by their achievements in Europe, where they enjoyed their first top-level victory when King=s Company (Ire) (King=s Troop {GB}) won the 1971 Irish 2000 Guineas. The following year, the colt retired to the couple=s newly purchased the 1,200 Gilltown Stud in Co. Kildare. A year after Genuine Risk was named the top 3-year-old filly in the U.S., the Firestones ran the table in that division in Europe when Blue Wind (Ire) (Lord Gayle) was named champion in both England and Ireland, while April Run was named top 3-year-old filly in France and Play it Safe (Ire) (Red Alert {Ire}) was that country=s champion 2-year-old filly. Genuine Risk | Horsephotos The Firestones, who owned both Gulfstream Park and Calder Racecourse from 1989 to 1991, began scaling back their racing ventures in the late 1980s, selling Gilltown back to the Aga Khan in 1989. They also downsized from their 2,000-acre Catoctin Stud in Waterford, Virginia and acquired Newstead Farm in Upperville in 1991. Clement continued, AIt was also a touch intimidating, as Mr. Firestone had a great knowledge of racing through his time as a trainer and in racetrack ownership. Mr. and Mrs. Firestone are wonderful owners. They are great horse-people and the horses always come first.@ Cont. p9 Theatrical | Horsephotos The Firestone homebred Winchester (Theatrical {Ire}) became the couple=s final top-level victor with four Grade I wins from 2008 to 2011 and they completed the dispersal of their bloodstock in January 2020. Two of his children, Matt and Alison, rode for the U.S. Equestrian team. VIBRANT MARKET AT FASIG JULY HORA & BREEDING STOCK SALES By Christie DeBernardis & Christina Bossinakis Sales-topping Front Run the Fed | Fasig-Tipton photo LEXINGTON, KY--There was plenty of buzz at Newtown Paddocks Monday with a lively day of trade for Fasig-Tipton's July Breeding Stock and Horses of Racing Age Sales. The popular Horses of Racing Age Sale was back for its ninth straight year and there was plenty of demand for promising or accomplished runners. Stakes winner Front Run the Fed (Fed Biz) topped the auction, selling to George Sharp for $440,000 off a third-place finish in the GIII Poker S. The second highest-priced horses was recent Iowa Derby romper Stilleto Boy (Shackleford), who brought $420,000 from owner Steve Moger, who did his bidding on the internet. AThis was as vibrant of a racehorse sale as we ever participated in,@ said Elite's Brad Weisbord, who consigned the topper. AThere is a lot of money and a lot of demand for active, in-form horses now. A horse like Front Run the Fed can top the sale. He was third in the [GIII] Poker [S]. For a 5-year-old to bring $440,000, that's top money. Top to bottom, this was a very, very good market and we found it as vibrant as we ever have.@

While six of the top nine sellers came from Elite's barn, those horses were also purchased by different entities, all of which were domestic, but spread from coast-to-coast. AI had about 10-12 horses I was going to bid on, but it was difficult,@ said Sharp. ABy way of example, I won a race at Lone Star with a horse that I claimed for $20,000 in California. I won the race by 9 3/4 lengths and the horse that finished third that day brought $75,000 today. That was a little nutty because my horse was a $20,000 claim. That tells you all you need to know." George Sharp | Fasig-Tipton A total of 79 racehorses changed hands Monday for a gross of $5,905,500. The average was $74,753 and the median was $50,000. There were 26 horses who did not meet their reserves for an RNA rate of 24.8%. Last year at this auction, 81 head brought $5.072 million in the middle of the COVID-19 pandemic and without the Fasig-Tipton July Yearling Sale, which typically follows. The average in 2020 was $62,617 and the median was $30,000. Thirty-eight horses failed to sell last term for an RNA rate of 31.9%. AI was really surprised with how well some of the in-foal mares sold that were not part of the dispersal and how some of the broodmare prospects sold. I was a little surprised that some of the mares with foals at their sides did not bring a little more money. However, it is a big commitment to buy a mare who has had four of five foals. We have seen that be an area of weakness in the marketplace, whether it be at January, February or November. We all know the carrying costs are not cheap. Once again, it goes back to there needs to be a certain level of quality to attract significant attention.@ Action returns to Newtown Paddocks Tuesday for the Fasig- Tipton July Selected Yearling Sale. Bidding gets underway at 10 a.m. Fasig-Tipton photo Fed Biz Colt Tops F-T HORA Sale... In the waning stages of Monday's Fasig-Tipton July HORA Sale, it was Front Run the Fed (Fed Biz) who stole the show with a sale-topping final bid of $440,000 from owner George Sharp. Offered by Elite, Hip 647 earned his first black-type badge in Saratoga's Better Talk Now S. in 2019 for trainer Chad Brown and Klaravich Stables. AI decided that I got tired of being outbid, and I decided to go to [$440,000] because I want to go to the Breeders' Cup this year,@ explained Sharp. AThis one is hopefully going to get me there. I'm very pleased with the purchase.@ He added, AThis horse was the best one in the sale, bar none. This one vetted out perfectly and it showed in the price he brought. The flashy chestnut was offered as Hip 557 by agent Paramount Sales on behalf of John and Iveta Kerber, Michael Coleman, Doug Anderson and Aaron Kennedy.
