1. Introduction 1.1 This Statement of Common Ground (SOCG) has been prepared by DMH Stallard, acting as planning consultant for Welbeck Strategic Land (II) LLP (“WSL”), who are promoting the land south and west of Imberhorne Upper School, East Grinstead (the Site), allocated within the Mid Sussex Site Allocations DPD (SA DPD) at Policy SA20. 1.2 It is prepared in response to the Mid Sussex SA DPD Examination and the Inspectors Initial Matters, Issues and Questions (MIQs). In particular, this SOCG responds to Matter 3 and demonstrating the deliverability of the proposals as allocated at Policy SA20. 1.3 The land shown edged red and blue at Appendix A is land in WSL’s control and owned by the landowner of Imbehorne Farm (“Farm Owner”). The land shown edged blue on the plan at Appendix B is land owned by WSCC and currently used as school playing fields associated with Imberhorne Secondary School. 1.4 The Farm Owner and WSCC will enter into a land swap agreement whereby: • the land edged blue (1.69ha) on Appendix B, is transferred to the Farm Owner, to provide an alternative point of access to the land allocated at Policy SA20. • the land edged green (5.81ha) on Appendix B, is transferred to WSCC for use as playing fields associated with Imberhorne Secondary School. 1.5 The Heads of Terms for the land swap are agreed and the legal documentation will shortly be negotiated. 1.6 The land swap will provide a net increase of 4.12ha of land to WSCC/Imberhorne Secondary School, which land will deliver additional playing fields, thereby enabling the future consolidation of Imberhorne Lower School and Imberhorne Upper School onto a single campus. The Imberhorne Lower School site is allocated for residential development at Policy SS3 of the East Grinstead Neighbourhood Plan (extract at Appendix C). The consolidation of the school campuses onto a single site is an aspiration of WSCC. 1.7 Additionally, Policy SA20 requires that land is provided for a Two Form Entry Primary School, with early years provision. WSCC have identified a need for the primary school, arising from future growth in the locality and from the development proposal. 2
2. The Site 2.1 The Site, known as ‘land south and west of Imberhorne Upper School, Imberhorne Land East Grinstead’ is allocated in the SA DPD at Policy SA20. 2.2 The land edged red and blue (“Residential Land”) on the plan at Appendix A is owned by a single landowner and is under the control of WSL through a Promotion Agreement. The land edged red is allocated at Policy SA20. 2.3 The land edged blue (“School Land”) on the plan at Appendix B is land owned by WSCC and forms part of the playing fields at Imberhorne Upper School. 3
3. Matters Agreed Land Transfer 3.1 Heads of Terms for a land swap agreement between WSL, the Farm Owner and WSCC have been agreed and the contract documents will be negotiated shortly. 3.2 The land swap will provide an alternative point of access to the Residential Land. 3.3 The land swap will also provide a net increase of 4.12ha of playing fields for Imberhorne Secondary School. This could facilitate the consolidation of the school campuses which is a long held aspiration of the school, supported by WSCC, and reflected in the allocation of the Imberhorne Lower School site in the East Grinstead Neighbourhood Plan for residential development (Policy SS3). 3.4 The land swap agreement will: • Transfer ownership of the School Land to the Farm Owner. • Transfer ownership of the land edged green (5.81ha) on Appendix B, to WSCC. 3.5 The transfer of land under the land swap agreement will be triggered on the later of the completion of the playing field works (paragraph 3.6 below) and the grant of outline planning consent. The transfer of the land under the land swap agreement is subject to WSCC Cabinet Member approval, DfE approval and valuation approval. 3.6 The land swap agreement requires the new playing field land to be delivered to a pre-agreed specification, prior to the transfer of the land edged blue (Appendix B), ensuring the ongoing provision of playing fields. Two Form Entry Primary School with Early Years Provision 3.7 Policy SA20 provides land for a two form entry primary school with early years provision. WSCC confirm that there will be need for a new primary school as a result of background growth as well as the development itself. 4

East Grinstead Neighbourhood Plan November 2016 Imberhorne Lower School, Windmill Lane 9.7 At present Imberhorne Lower School is located over two separate campus sites: Imberhorne Lane and the other in Windmill Lane. However, strategic proposals by West Sussex County Council have been put forward for the consolidation of the site and closure of the Windmill Lane site. The site is well located and suited to the provision of new housing and the continued provision of an area of open space for community use. The site is identified in figure 9 overleaf. 9.8 The Imberhorne School Head Teacher, Board of Governors, West Sussex County Council, and East Grinstead Town Council are working together in partnership to support and deliver the objective of achieving one consolidated School campus at the existing Imberhorne Lane site. A development consultant team has been appointed by the School to prepare initial designs for a single school on the site of the Upper School. This will involve the incorporation of the eight hundred and ten students currently at the separate Windmill Lane lower school building, thereby releasing this land for future housing development as allocated within Policies EG6B and SS3. 9.9 Significantly, this will support the creation of a new school that is fully fit for purpose on single unified campus. A joint venture development delivery board will be formed to agree design proposals, coordinate the joint site planning process and deliver the new school buildings. SS3 – Imberhorne Lower School, Windmill Lane Planning permission will be granted for the redevelopment of the site for residential uses, provided that: (1) A development brief has been prepared, which explains the design approach for the site, including the mix of uses, any phased development and highway mitigation; (2) The school site can be demonstrated to be surplus to requirements and alternative school provision has been secured elsewhere; (3) The proposals include an element of public open space and children’s play facilities; and (4) The proposals include a mix of dwelling types including a meaningful proportion of 46
