Indoor Masking Requirement
    • After March 11th, masks no longer required in indoor spaces and K-12
      • Shift to local discretion
      • The rule permits programs or individuals to have more restrictive masking
        requirements
      • CDC no longer requires masks on school/childcare program buses and vans
      • Office of Head Start is reviewing its mask requirement

Mask Recommendations
    • Support programs & individuals who choose to continue to wear masks
    • Recommend people 2yrs and older wear a mask while indoors at
      childcare when:
      • Day 6-10 of isolation, if have returned to childcare
      • Medium COVID-19 Community Level: those unvaccinated and at risk for
        severe COVID-19
      • High COVID-19 Community Level: all people, regardless of vaccination status

ELD Isolation and Quarantine Update
     • Isolation for those with COVID-19
       • At home for 5 days and symptoms resolving, fever free for 24hr, then 5 days
         wearing a mask at childcare, in public settings

     • Quarantine for those exposed to COVID-19:
       • After March 11th, ELD & K-12 quarantine requirement will be paused
          • Quarantine has limited impact when there is rapid, asymptomatic transmission of the
            virus and the community has high levels of vaccine or infection-induced immunity
       • Recommend notifying cohort of exposure, but children/staff should not be
         excluded from childcare setting
          • Permits families & staff to take precautions, watch for symptoms, get a test if have
            symptoms
          • ORS 333-019-0010 will be updated

Infection Prevention Considerations
 • Each childcare program should consider policies and practices that best support
   every child and staff’s health and well-being, recognizing that individual health
   conditions and social inequities place some people at higher risk for severe
   COVID-19. Some childcares may choose to implement universal masking to
   promote the culture and climate of the program.

 • Layered prevention strategies remain effective:
      • Vaccinations and booster doses
      • Staying home and getting tested when sick
      • Masks when indicated and cohorting
      • Ventilation
      • Handwashing, respiratory etiquette, and cleaning

Rulemaking Engagement Process

HOW does ELD create rules?
  1. Optional interested party engagement (workgroups, focus
     groups, engagement sessions) (if necessary)
  2. Rulemaking Advisory Committee (RAC) to evaluate fiscal or equity impacts
     of rule language as required by the Secretary of State (if necessary)
  3. Internal review by lawyers, Policy Team, and Equity Advisory Committee
  4. Public comment period – find draft rules on the ELD website by first of the
     month of submission to Early Learning Council
  5. Final vote by Early Learning Council

Tonight we will give an overview of two sets of proposed rules:
• CCDF Required Allergic Reaction Rule
• CCDF Required Child Development Training Rule

and one set of current temporary rules:
• Certified Family (CF) and Registered Family (RF) Fire Safety Rules
Allergic Reaction Rule Overview
Proposed Rule Overview

ELD must update policies around children in care who are at risk of allergic reactions to comply with federal
CCDF requirements.
This rules enhances our existing rule regarding children with allergies, which currently require a general
written plan.
Public Comment Period will be March 1-23, 2022. Public Hearing will be March 15, 2022 at 5:30pm.

Draft rules are on the ELD website and public comment can be submitted to Remy Watts.

The Early Learning Council will vote on March 30, 2022, and the rule will go into effect when passed.

OCC will update any relevant forms to assist with compliance with these rules.
Child Development Training Rule Overview

ELD must update policies around training to comply with federal CCDF requirements.
General Rules clean up and organization (compiling all training requirements in the “Training Requirement”
sections)
All staff will be required to take this training, which will be available online this July. New staff will have 90 days
after hire to complete the training. Existing staff members must complete the training by September 30, 2022
Public Comment Period will be March 1-23, 2022. Public Hearing will be March 15, 2022 at 6pm.

CF/RF Fire Safety Rule Overview
Temporary Rule Overview

The Early Learning Division’s (ELD) temporary fire safety rules provide changes that are significantly cheaper
than installing residential sprinklers in new programs. These temporary rule changes serve as an alternative to
the DCBS sprinkler requirement. These are temporary rules that will be finalized in May 2022.
Temporary rules were passed on January 26, 2022 by the Early Learning Council.

Rulemaking Advisory Committee (RAC) applications are available now on the ELD website and will be accepted
until March 11, 2022. https://oregonearlylearning.com/news-resources/blog/

Public Comment Period will be May 1-20, 2022. A public hearing will be scheduled for mid-May (TBD).

The Early Learning Council will vote on May 25, 2022, and the rule will go into effect once passed.
