May 2018 The mission of DTSC is to protect California’s people and environment from harmful effects of toxic substances by restoring contaminated resources, enforcing hazardous waste laws, reducing hazardous waste generation, and encouraging the manufacture of chemically safer products. Proposed Post-Closure Permit Renewal for United Technologies Corporation, Pratt & Whitney (UTC) The California Department of Toxic Substances Control (DTSC) invites you to Public Comment Period review and comment on a draft Hazardous Waste Facility Post-Closure Permit (draft Permit) renewal for United Technologies Corporation, Pratt & Whitney (UTC). The facility is located at 600 Metcalf Road, San Jose, California 95138. What is a Post-Closure Permit? California law requires a permit when a facility leaves hazardous waste at the May 7, 2018—June 25, 2018 location of a previously permitted facility, in accordance with the Resource Conservation and Recovery Act. The Permit requires the cleanup of the DTSC invites you to review and contamination, as well as continued environmental monitoring. Production of solid propellant ceased in August 2003. All DTSC has not scheduled a public other manufacturing operations ended in December 2004. • Surface Impoundment 0706 stored liquid wastes resulting from solvents and ammonium perchlorate used for container washing. Operations ceased in 1985. Surface impoundments 0250, 0635, and 0706 operated under a hazardous waste facility permit issued September 26, 1983 and expired on September 26, 1988. DTSC acknowledged these former surface impoundments as closed with hazardous waste left in place on November 25, 1991. • The former Hydrolysis Treatment Facility Station (HTF) The HTF began operation in September 1997 under a RCRA Permit for the purpose of treating excess propellant and propellant-related wastes. The permit expired in 2007. UTC notified DTSC of their intent to close on December 14, 2004. Full demolition and removal of the HTF was completed in July 2008. DTSC acknowledged the HTF as closed with hazardous waste left in place on May 14, 2015. • The former Open Burning Facility (OBF) The former OBF comprises approximately 18 acres and consisted of 10 former open burn units constructed in 1984. Propellant waste was transported to the OBF and ignited. The residual waste was shipped to a permitted Class I disposal facility. The OBF operated under interim status. The final burn was on October 18, 1996. DTSC acknowledged the OBF as closed with hazardous waste left in place on March 12, 2015. Permitting History UTC first applied for a Post Closure permit on February 27, 2004 for Former Surface Impoundments 0250, 0635, and 0706. The Post Closure Permit specified the groundwater monitoring requirements and cleanup goals for the surface impoundments. The Post Closure Permit was approved on December 4, 2006 and expired on December 2, 2016. On December 18, 2014, UTC applied for a Class 3 permit modification to change the boundary lines of the property. The western buffer area was sampled and no contamination was found. DTSC approved the Class 3 permit modification on May 4, 2015 which transferred the western portion of the property, which historically served as the buffer zone, to the Santa Clara Open Space Authority for use as a natural preserve area. Federal and state law allows facilities with expired permits to continue to operate if the facility has submitted an application for renewal that is accepted by DTSC in advance of the permit expiration date. UTC submitted the required Application to renew and add the OBF and HTF to the Post-Closure Permit in June 2015. Compliance History DTSC inspects UTC on a regular basis to ensure compliance with California laws, regulations, and the permit conditions. For the past 4 years, there have been no violations found at the site. Post-Closure Permit Renewal Process The Facility must submit an application for renewal to DTSC. After reviewing the application, DTSC proposes a permit determination by either preparing a draft permit or proposing a permit denial. UTC submitted an application for renewal and DTSC required additional information until the application was complete. DTSC prepared a draft Permit which is available for public review. California Environmental Quality Act (CEQA) Under the California Environmental Quality Act (CEQA), DTSC must evaluate whether the Permit may have any significant impacts on human health and the environment. As part of this evaluation, DTSC has proposed a Notice of Exemption (NOE) which concludes that approval of the draft Permit would not result in any impact to human health and the environment. Next Steps DTSC encourages public participation in our decision-making process and invites the public to review and comment on the draft Permit. Before making a final determination on the draft Permit, DTSC will review and respond in writing to all public comments. A Response to Comments document will be sent to all those who submitted comments and to those who request a copy. A copy of the Response to Comments will also be placed in the information repositories listed below.
