The Eviction Crisis Understanding the Magnitude of the Crisis, Who it Affects, and What HUD Can Do August 10, 2021
Today’s Eviction Crisis Predates the Pandemic • The main cause of eviction is lack of affordable housing, a longstanding and persistent problem. • In 2017, according to the American Housing Survey: o More than 10 million households spent more than 50% of their income on housing o Only 59 affordable housing units were available for every 100 very low-income households. o About 2.8 million households were unable to pay all or part of their rent (6.3% of renters). • In 2016, about 3.6 million eviction cases were filed in court (Eviction Lab).
The Pandemic Has Worsened Housing Needs • 6.6 million renter households are behind on rent.* • 5 million households are “not at all confident” in their ability to make the next rent or mortgage payment.* • 3.25 million renter households are “very likely” or “somewhat likely” to be evicted in next two months, and numbers are rising.* • Without the federal, state, and local moratoriums, we would expect 10+ million households to be facing eviction. *As of Aug 2, 2021, from Census Household Pulse Survey.

Interagency Efforts to Prevent Eviction • Federal, state, and local eviction moratoria. • $46b for Emergency Rental Assistance Program (ERAP) to prevent eviction. o Administered by Department of Treasury; funding provided as block grants to states and localities. • $100m ARPA funding for NeighborWorks America to address housing instability. • New Congressional funding for Legal Services Corporation to analyze eviction laws and areas with high rates of eviction. • Congressional funding to HUD for eviction legal services and request for feasibility study of national eviction database. • White House convenings on eviction prevention and diversion programs. • Many agencies publishing eviction resource web pages.
HUD Actions to Prevent Eviction • Extended eviction moratorium for families in FHA-insured housing (and other housing with HUD loan guarantees) through Sept. 30. • Produced resources/guidance for HUD grantees and stakeholders on: • The availability of ERAP and other funding streams to prevent evictions and homelessness. • Streamlined recertification processes for HUD-assisted households that experience a drop in income. • Innovative practices in eviction prevention and requirements for landlords to provide 30 days’ notice before issuing notice to vacate. • Protecting against selective evictions of protected classes in violation of the Fair Housing Act. • Preparing report to Congress on creating a national eviction database. • Reviewing additional legal authorities that HUD could use to stop evictions.
New Eviction Legal Services Grant Program • Provides $20 million in grants for eviction protection and diversion services for low-income tenants at risk of or subject to eviction. • Eligible grantees are non-profit or governmental entities with experience in legal services. • Eligible activities include outreach to tenants on their legal and fair housing rights, assistance in understanding eviction procedures and completing forms, and services to help lessen the negative consequences of eviction – i.e., not just legal representation! • Applications due September 8, 2021. • NOFO can be found at: https://www.hud.gov/sites/dfiles/SPM/documents/EvictionProtectio nGrantProgramFR-6500-N-79.pdf
