CROMWELL HIGH SCHOOL PROJECT GRADUATION 2021 We are excited to announce that PROJECT GRADUATION 2021 will be held on June 9, 2021 from 9:30 p.m. to 4:30 a.m. at Quassy Amusement Park. Bussing will be provided to and from Cromwell High School on the evening of the event. Students who would like to attend, and their parent/guardian(s), must read, sign and return all required documents in order to participate. NOTICE OF RISK, INFORMED CONSENT, AND WAIVER REGARDING PROJECT GRADUATION 2021 This Notice of Risks, Informed Consent, and Waiver (“Notice”) relates to students’ optional and voluntary participation in Project Graduation 2021. The parents or legal guardians (“Parents”) of participating students (“Student” or “Students”) and the Student must sign this Notice and return it to the Cromwell High School (“CHS”) Main Office by May 21, 2021. NOTICE OF RISK Project Graduation 2021 (the “Event”) is an all-night, substance-free party for CHS Seniors. The Cromwell Public Schools and the Cromwell Board of Education (together, the “District”) has worked throughout the year with dedicated parent volunteers to offer this celebration for students as they graduate from CHS. Participation in the Event is optional and voluntary and is not an educational or graduation requirement of the District. The Event is scheduled to be held from June 9, 2021 at 9:30 p.m. until June 10, 2021 at 4:30 a.m. at Quassy Amusement Park in Middlebury, CT. Students attending the Event will be transported from CHS to Quassy Amusement Park at the beginning of the Event and from Quassy Amusement Park to CHS at the end of the Event. Project Graduation will provide transportation to and from CHS through DATTCO Bus Company. Chaperones will include one or two certified staff members from the District as well as parent volunteers working under their direction. Event activities include various rides, activities, etc. More information about Quassy Amusement Park is available at https://www.quassy.com/things-to-do/amusement-park-rides. Given the current pandemic health emergency related to the highly contagious novel coronavirus (“COVID-19”), Students are invited to attend the Event under certain conditions and consistent with all applicable rules, regulations, federal and state orders and guidance, and guidance from public health officials related to COVID-19. Further details about the Event, and relevant rules and regulations, are attached to this Notice as Appendix A. Further information about COVID-19 is attached to this Notice as Appendix B. Parents are encouraged to drop off and pick up their Students at CHS at the appointed times. However, Students may choose to park their cars overnight at CHS. If students choose to park their cars on District property, the Parents and the Student understand that there is a risk of damage or theft to their vehicles and any property stored therein. The District will not provide security on the premises and is not responsible for any damage or theft of property on such premises. If students do choose to park their cars in the CHS parking lot, they are encouraged to lock their vehicles and not store valuable items in their vehicles overnight. 9459367v2
Transportation to and the activities associated with the Event present risks to the Student personally and to his/her property, some of which may result in serious personal injury or death, and these risks can be a consequence of not only the Student’s actions or negligence but also the actions or negligence of others, or travel conditions or equipment. The District is not responsible for any injury, loss, or damage to the Student’s person or property, whether resulting from acts or omissions of third parties, or other persons not under the control of the District, from the operation or condition of facilities or premises, from acts of war or terrorism, or from acts of God or nature, including from pandemic, except to the extent that the injury, loss, or damage is caused by the sole negligence or reckless, wanton or intentional misconduct of the District, its board members, officers, employees, agents, contractors, representatives, or assigns. INFORMED CONSENT AND WAIVER We, [Parent Names] and [Student Name], understand that the Student has the opportunity to participate in Project Graduation 2021. As a condition of the Student being able to participate, we understand that we are required to read the information in this Notice, Appendix A, Appendix B, and the websites cited in these documents to ensure that we are informed of and understand the risks associated with participating in the Event during the COVID-19 pandemic. In signing below, the Parents attest that we are the parent(s)/guardian(s) of the above- named Student, and the Parents and Student attest that we have read the Notice, Appendix A, and Appendix B. We agree to abide by all rules and regulations described therein, and expressly understand the risks related to participating in the Event. In consideration for the Student being allowed to participate in the Event, we fully ASSUME ALL RISKS, inherent and otherwise, whether or not described above, in connection with the Student’s participation in the Event, and WAIVE the right to initiate and/or pursue in any manner any and all lawsuits and any other claims in any forum against the District, its board members, officers, employees, agents, contractors, representatives, volunteers and/or assigns (the “Released Parties”) for any injury or harm connected to the Student’s participation in the Event. These agreements of assumption of risks and waiver do NOT apply if (1) the liability, damage, loss or injury is caused solely by the negligence of the Released Parties and does not include the negligence or any other act or omission by any other person or entity (such as the Student, the Parents, other third parties or independent vendors/contractors); or (2) the liability, damage, loss or injury is caused by the reckless, wanton or intentional misconduct of a Released Party. These agreements of assumption of risks and waiver will be construed in accordance with Connecticut law. MEDICAL AUTHORIZATION We, [Parent Names] are the parents or legal guardians of (the “Student”). We represent that the Student is fully capable of participating in Project Graduation 2021, with or without reasonable accommodations, without causing harm to himself, herself or others. We understand that, in the event of a medical emergency threatening the Student’s life or limb, no informed consent is required for the Student’s treatment and that emergency medical care will be obtained and rendered to the Student. We further understand that if the Student’s medical condition is urgent but not life threatening, informed consent is required for treatment. If the Student needs urgent or emergent medical care for which informed consent or permission may be requested or required, and if reasonable attempts to reach us for consultation and informed consent are unsuccessful, we hereby delegate to the chaperones of Project Graduation the authority to make on our behalf all medical decisions regarding the care and treatment of the Student, including decisions on surgery, transfusions, and the administration of anesthetic, and to give informed consent to such treatment. APPENDIX A 2021 Cromwell High School Project Graduation The following rules, regulations, and expectations apply to all students attending the Event. Only Cromwell High School (CHS) students receiving diplomas and approved by the CHS administration are eligible to attend. The event will take place at Quassy Amusement. All students must arrive at CHS by 9:30 p.m. on June 9, 2021 to board the bus. Buses will leave promptly at 9:45 p.m. to transport students from CHS to Quassy Amusement Park. Students must take the bus to participate in this event. Buses will also transport students from Quassy to CHS at the end of the evening. Students must stay for the entire event. If a student needs to leave early, a parent/guardian must pick the student up at Quassy Amusement Park and sign the student out. The student cannot return to the event. Students are invited to participate in many activities offered at Quassy Amusement Park, including various rides and pavilion activities. More information about Quassy Amusement Park is available at https://www.quassy.com/things-to-do/amusement-park-rides. This is an alcohol, drug, nicotine, and vape free event. Students are reminded that they must abide by all school rules, including the Cromwell Public Schools policy prohibiting alcohol, drug, nicotine and vapor products, during this event. Any student determined or suspected to be under the influence of alcohol, drugs, nicotine or a vaping product will be asked to remain with a teacher or chaperone while the student’s parent/guardian(s) are contacted. The parent/guardian(s) will be required to pick up their child from the event. If necessary or advisable, the teacher or chaperone will seek medical attention for the student. Misconduct will not be tolerated. If a student engages in misconduct, violates these rules or any protocols established by Quassy Amusement Park, or otherwise violates Cromwell Public Schools rules and regulations, including any COVID-19 health and safety protocols, the student’s parent/guardian(s) may be contacted and required to pick the student up from the event. The District is not responsible for any personal articles that may be lost during the event. Students are advised not to bring any bags, jewelry, watches, money or other valuables. No food or drinks may be brought on the bus or to Quassy Amusement Park. The chaperones reserve the right to inspect any bags or other containers brought by students to the event. Students are encouraged not to drive and parents are encouraged not to let their children drive to the parking lot in order to board the bus for the event to avoid potential accidents due to lack of sleep. STUDENTS WILL ONLY BE ALLOWED TO BRING THEIR CELL PHONE AND A SWEATSHIRT OR JACKET. 4 9459367v2
APPENDIX B Notice of Risks Related to COVID-19 COVID-19 is an illness caused by a virus that can spread from person to person, primarily through respiratory droplets. Data suggest that there can be transmission of COVID-19 through respiratory droplets of those with mild (or no) symptoms or those who do not feel ill. COVID-19 symptoms can range from mild (or no) symptoms to severe illness. Symptoms of COVID-19 may include, among other symptoms, fever or chills, cough, shortness of breath or difficulty breathing, fatigue, headache, congestion or runny nose, muscle or body aches, sore throat, new loss of smell or taste, nausea or vomiting, and diarrhea. The estimated incubation period is between 2 and 14 days. It is important to note that some people become infected and do not develop any symptoms or feel unwell. COVID-19 is a new disease and there are limited data and information about the impact of many underlying medical conditions on the risk for severe illness from COVID-19. Severe illness from COVID-19 is defined as hospitalization, admission to the intensive care unit (ICU), intubation or mechanical ventilation, or death. Among adults, the risk for severe illness from COVID-19 increases with age, with older adults at highest risk. Additionally, adults of any age with the following conditions are at increased risk of severe illness from the virus that causes COVID-19: cancer; chronic kidney disease; COPD (chronic obstructive pulmonary disease); Down Syndrome; heart conditions, such as heart failure, coronary artery disease, or cardiomyopathies; immunocompromised state (weakened immune system) from solid organ transplant; obesity (body mass index [BMI] of 30 kg/m2 or higher but < 40 kg/m2); severe obesity (BMI ≥ 40 kg/m2); pregnancy; sickle cell disease; smoking; and type 2 diabetes mellitus. Adults of any age with other medical conditions not listed here might be at increased risk for severe illness from the virus that causes COVID-19. As more data become available, additional risk factors for severe COVID-19 may be identified. While fewer children have been sick with COVID-19 compared to adults, children can be infected with the virus that causes COVID-19, can get sick from COVID-19, and can spread the virus that causes COVID-19 to others. Children, like adults, who have COVID-19 but have no symptoms can still spread the virus to others. Most children with COVID-19 have mild symptoms or have no symptoms at all. However, some children can get severely ill from COVID-19 and might require hospitalization, intensive care, or a ventilator to help them breathe. In rare cases, they might die. Babies under one year old and children with certain underlying medical conditions might be at increased risk for severe illness from COVID-19. Children with the following conditions, among others not listed here, might be at increased risk for severe illness: asthma or chronic lung disease; diabetes; genetic, neurologic, or metabolic conditions; sickle cell disease; heart disease since birth; immunosuppression (weakened immune system due to certain medical conditions or being on medications that weaken the immune system); medical complexity (children with multiple chronic conditions that affect many parts of the body, or are dependent on technology and other significant supports for daily life); and obesity. The Centers for Disease Control and Prevention (CDC) and partners are investigating a rare but serious medical condition associated with COVID-19 in children called Multisystem Inflammatory Syndrome in Children (MIS-C). It is not yet known what causes MIS-C and who is at increased risk for developing it. Importantly, there are now authorized and recommended vaccines to prevent COVID-19 in the United States, and the CDC recommends getting an authorized COVID-19 vaccine when it is available. However, many people will not have been vaccinated by the date of Project Graduation. In addition, multiple variants of the virus that causes COVID-19 have been documented in the United States and globally during this pandemic. Finally, although COVID-19 vaccines are effective at preventing illness, scientists are still learning how well vaccines prevent people from spreading the virus that causes 5 9459367v2
COVID-19 to others. After exposure, people can be infected with or “carry” the virus that causes COVID-19 but not feel sick or have any symptoms. For this reason, even after vaccination, the CDC recommends that individuals continue taking precautionary measures to help prevent getting sick as we learn more about how COVID-19 vaccines work in real-world conditions. The CDC advises, among other precautionary measures, that everyone two years and older should wear masks in public; stay at least six feet away from others who do not live with them; avoid crowds; avoid indoor spaces that do not offer fresh air from the outdoors as much as possible, and if indoors, bring in fresh air by opening windows and doors, if possible; wash their hands often with soap and water for at least 20 seconds or use a hand sanitizer that contains at least 60% alcohol if soap and water are not readily available; cover coughs and sneezes; clean and disinfect frequently touched surfaces daily; monitor their health daily; and stay home and isolate from others when sick. Additional information regarding COVID-19 is available on the following websites or upon request from the District: CDC website at https://www.cdc.gov/coronavirus/2019-nCoV/index.html DPH website at https://portal.ct.gov/Coronavirus Although the District has implemented certain preventative measures consistent with applicable rules, regulations, federal and state orders and guidance, and guidance from public health officials related to COVID-19, the District cannot ensure that Students participating in Project Graduation and/or their Parents or others in the Student’s household will not become infected with COVID-19. Moreover, the District cannot protect against exposure to or infection by COVID-19 that occurs due to the actions, omissions, and/or negligence of students or others, including District staff members, other Project Graduation participants, and other individuals located at the Event. 6 9459367v2
