Reporting Requirements Section 514 of the VTL • The Vehicle and Traffic Law (VTL) requires the court to report to the Commissioner of Motor Vehicles within 15 days any judgment of conviction or any bail forfeiture. • If a conviction results in a mandatory suspension or revocation, it must be reported to DMV within 96 hours of the imposition of sentence. • Convictions for non-resident CDL drivers must be reported within 96 hours.
CDL/CMV Convictions • Any traffic conviction for an offense committed by an out-of-state CDL/CLP holder in any motor vehicle, or an out-of-state non-CDL/CLP holder in a CMV must be reported to NYS DMV within 96 hours as required by VTL 514(d). • The vehicle type on the ticket will indicate CDL VEH, BUS or HAZMAT. • NYS DMV is required to report these convictions to the licensing state within 10 days. • Failure to meet this requirement jeopardizes approximately $40 million in yearly federal highway funding.
Order of Suspension Pending Prosecution MV-1193 • Use the following codes for “Suspension Type” entry: – H = Hard suspension (box 1 on form MV-1193). • Hardship cannot be granted. – P = Prompt suspension (box 2 on form MV-1193). • Use the following codes for “Hardship Indicator”: – Y = Yes hardship granted. – N = No hardship. – S = Sean’s Law (box 3 on form MV-1193). • Motorist must have DJ or MJ (J = Junior) license on date of violation. • Motorist must be under 21 on date of violation.

Section 1804 of the Vehicle and Traffic Law • Prohibits a municipality from collecting a fine, penalty, fee, surcharge or forfeiture when the charge of a violation of the Vehicle and Traffic Law is dismissed.
Reporting Dispositions When Money Is Still Owed (Fine Not Collected) If a motorist is convicted or has pled guilty, but has not paid the fine or surcharge, it is improper to withhold reporting the disposition until payment is received. • If you transmit electronically, send a disposition transaction with a disposition code of PG/FNC or CONV/FNC. • Complete the disposition/sentence section of the UTT as PG/FNC (dispo code 23) or CONV/FNC (dispo code 24). • When paid in full, update the record by submitting a PG or CONV disposition.
Suspension vs. Revocation • Suspension – license privileges taken away for a period of time. Privileges returned after the suspension period. • Revocation – license privileges taken away. Motorist must reapply to DMV for privileges to be reinstated after the revocation period.
Alcohol & Drug Related Order of Suspension or Revocation (MV-1192) • Transmit electronically or submit an MV-1192 (do not submit both). • If the license has been confiscated by court staff, it can be mailed to TSLED without any correspondence. • A 20-day stay may be granted by the court; if a stay is not entered, the suspension/revocation becomes effective as of the sentence date.
Ignition Interlock • The law requires the court to sentence the motorist to ignition interlock when the defendant is convicted of VTL 1192(2); (2-a) or (3). • DMV sends the court notification if the court fails to sentence the defendant to the IID requirement as required by statute.
Reporting Ignition Interlock • IID Restriction can be reported: • Electronically through your courtroom software program with IID noted in the probation or secondary sentence fields. No additional paperwork required. OR • By submitting an MV-1192 with ‘Yes’ checked for ‘Has the motorist been ordered to install an ignition interlock device’ and with a disposition showing IID in the in disposition/sentence field. • Removal of IID restriction is reported on Court/Probation letterhead and sent directly to the Driver Improvement Unit.
Duplicate Disposition/Amendment Record UT-20 used for the following: • Defendant is convicted after bail forfeiture has been filed with DMV. • Clerical error on original certificate. • Original certificate is lost or misplaced and duplicate is required. • An error is found in the TSLED System reports. • Conviction is withdrawn after appeal or successful motion to vacate judgment. Must be accompanied by signed Order to Vacate Judgment (Coram Nobis). • Defendant is resentenced. • Corporate substitution. • No ticket issued (enter docket number as ticket number). • Duplicate ticket number issued. • Disposition submitted to TSLED by mistake and ticket needs to be reopened. User Password Security Policy • One password, one user Each user must be assigned a unique user ID (no shared or generic user IDs are permitted). • Passwords must be kept confidential at all times, and changed regularly. • Passwords must not be shared. Provisioned users must not allow unauthorized users to access DMV information resources. • If a user suspects that a password has been compromised, they should notify TSLED to obtain a new password.

Monthly Reports • CM01 – Report of Pending Cases (monthly) • Includes currently scofflawed cases and scofflaw date, entry, and corrections of arrest records. • Does not get returned to TSLED. • CM02 – Report of Cases Pending 60 Days (NYS drivers) • When entering a subsequent date, the court must wait 60 days from the new court date to scofflaw the motorist again. • Parking, Stopping, or Standing violations cannot be scofflawed and do not appear on report. • Enter scofflaw suspension through VPASS or your courtroom software.
Monthly Reports continued • CM02.1 – Report of Cases Pending 60 Days (Out-of-State drivers) • Home state is required to suspend their motorist if NY scofflaws them within 6 months of violation date. • Suspension in the home state is optional if notified after 6 months of violation date. • CM03-Report of Transferred Cases • Identifies cases transferred to your court. • CM04-Report of Disposed Cases • Identifies cases closed by dispositions.

Law Types That May Be Scoffable The authority to suspend someone’s license/privilege for failure to answer a summons or pay a fine is set forth in VTL section 510(4-a).
Suspension Notices • The Department of Motor Vehicles sends out an MV-1160.3 to NY motorists or an MV- 1161A to out of state motorists. • Suspension effective date is 37 days. 30 day notice as required per section 510(4a) of the VTL plus 7 days to allow for mailing time.
Clear Scofflaw
Confirmation Notice • Print the confirmation notice, sign and give to defendant. • This will generally reflect on the license file within 1-2 days. • DO NOT FAX OR MAIL NOTICE TO TSLED.
TSLED Ticket Search • TSLED Ticket Search – Allows courts to search TSLED records for their tickets. – If the ticket is returnable to your court, all arrest, scofflaw and disposition information will display for the ticket. – If the ticket is not returnable to your court, a message will display, ‘Ticket returnable to XYZ Court’. – Searching by name will result in an error message if the ticket is not answerable to your court.

Real ID • Due to the Federal REAL ID Act, starting October 1, 2020, every domestic air traveler will need a REAL ID-compliant license, permit, or identification card to get through security at U.S. airports. • REAL IDs are available at all DMV offices. • The cost is the same as getting a standard license or non-driver ID, which are now marked Not for Federal Purposes. • Visit the REAL ID page on our website at dmv.ny.gov/REALID
