Communication ‘A European strategy for data’
 adopted by the European Commission on 19 February 2020

• Creating a single market where data can flow within the EU and across sectors

• Making more data available while keeping those who generate the data in control

• Setting fair, practical and clear rules for access and use of data and make them fully
 respected (in particular data protection, competition law, IPR)

• Investing in next generation standards, tools and infrastructures to store and process
 data
The European Data Strategy is based on 4 pillars

1) Data governance  setting up a cross-sectoral governance framework for data
   access and use

2) Enablers  investing in data and strengthening Europe’s capabilities and
   infrastructures for hosting, processing and using data

3) People  empowering individuals, investing in skills and in SMEs

4) Data ecosystems  launching common European data spaces in strategic sectors
   and domains of public interest
The European Data Strategy is delivered through 3 main
 instruments (1/3)

1) Data Governance Act Proposal for a Regulation (25 November 2020)

2) Implementing Regulation on High-Value Datasets (HVD) (in progress)

3) Data Act proposal (in progress)
The European Data Strategy is delivered through 3 main
 instruments (2/3)

• Implementing Regulation on High-Value Datasets (HVD)
  • Data with a high commercial potential and that can speed up the emergence of value-added EU-
    wide information products (Open Data Directive of 2019)
  • High-value datasets must be available free-of-charge, machine readable, provided via APIs and
    provided as a bulk download
  • Implementing regulation will include a list of high value datasets in the field of statistics as
    prepared by Eurostat in cooperation with the national statistical institutes.
• State of play with respect to the process of the legislative act
  • Impact assessment – Successfully passed through the Regulatory Scrutiny Board – Dec -2020
  • Currently in Commission inter-service consultation (ISC)
  • Next step: Online public consultation will follow the ISC
  • Proposal of the list of HVD to be submitted to the Open Data Committee in Q2/Q3 2021
  • The Open Data Directive (EU) 2019/1024 to be transposed by 17 July 2021
  independently of the Implementing Regulation on HVD.
The European Data Strategy is delivered through 3 main
 instruments (3/3)

• Data Act proposal
   • Main objective to set the right conditions for better control and conditions for data sharing for
     citizens and businesses
   • Will address B2B, B2G data-sharing, co-generated (IoT) data, review of database directive
   • Ongoing work on impact assessment/inception impact assessment to be published soon
   • Building on the B2G data-sharing Expert Group Report
   • PG Task Force on access to privately held data
• State of play with respect to the process of the legislative act
   • Inception impact assessment published on 28 May 2021 – The Roadmap was open for feedback
     until 25 June 2021
   • Impact assessment - in progress
   • Online public consultation – (Q2/Q3 2021)
   Next steps: Regulatory Scrutiny Board, Inter-service consultation (Draft act), Commission adoption
   planned for Q4 2021

Objectives of the expert group

A report with recommendations, in view of preparing a legislative and non-
legislative framework of conditions that would ensure effective and sustainable
access to data collected and held in the private sector for producing official
statistics.

     • Assets (what is already there): How the statistical system is organized
       today, statistics legislation, ESS Governance structure, Code of Practice.
     • Gaps and open issues (what is missing) – specific for B2G4S!

3.    The vision for the future
     • Describe where we want to get to, what is desirable from the perspective
       of the whole society (composition of different stakeholders’ interests.)
