“emoji” – Call for art & entry form Frisco Art Gallery at the Frisco Discovery Center 8004 N. Dallas Pkwy, Frisco, TX 75034 Eligibility: “emoji” is an exhibit held in the Frisco Art Gallery of two and three-dimensional artwork from artists ages 15 and up. The show will exhibit two and three-dimensional works in any medium (e.g. painting, drawing, printmaking, sculpture, mixed media, etc.) with an emphasis on pieces created with expressive subject matter or materials. Work must have been completed by the participating artist(s) only. The exhibit will run from Feb 3-27, 2015. Entries: Artists may submit up to 5 entries for the show. If it is a drawing, painting, print, or hangable relief sculpture, maximum size is 60” in any direction and the piece must be completely compatible for secure installation with the Arakawa Cable & Rail Hanging System. Art must be ready to hang with wire installed approximately 1/3 of the way from top of frame on the back (NO saw-tooth hangers). Pieces may be free-standing or ready for mounting on a pedestal or shelf. Frisco Arts has a limited number of pedestals available on a first-come, first-served basis. Include placard on back or bottom of work including name, date, title, medium, size, and price. Entry Procedures: Please submit an entry form electronically to pprater@friscoarts.org by January 28, 2015. If accepted, artist must remit entry fee and release form at the drop-off. Hand delivery of accepted entries will be Monday, February 2 between 12-2PM. NO LATE ENTRIES ACCEPTED. IF ENTRIES are NOT ready-to-hang or display, they may be dismissed from the show. Frisco Arts reserves the right to defer entries deemed inappropriate for a public audience. Fees: non-refundable $30 entry fee per artist; student rate is $20 Reception: All artists and any friends are welcome to attend the FREE reception on Wednesday, February 11, from 7-9PM. Jury Panel: TBD Sales: Frisco Arts will forward any prospective buyer to the artist. Frisco Arts retains a 20% commission on any sale to help defray costs of maintaining the Frisco Art Gallery.
Use of Images: All entrants must agree that any image or artwork submitted to the “emoji” show may be used for marketing or promotional purposes directly related to the show. This includes publication in printed materials, electronic media, internet, catalog, gallery shows, and on friscoarts.org or friscodiscoverycenter.com. Any images used will be credited to the artist. Artist retains copyright and all other rights. Pick Up: Please pick up artwork on Monday, February 28, between 12PM-2PM. You will need to sign out at the office before retrieving your artwork. Any artwork not picked up will accrue a $5 per day, per piece storage fee, for up to 30 days. After that point, artwork becomes property of Frisco Arts.

“emoji” – Frisco Art Gallery Individual Artist Agreement & Release – 2.3-2.27 This Art Exhibit Agreement (“Agreement”) is made and entered into this _____ day of__________________, by and between Frisco Arts, a 501 c-3 nonprofit organization, and __________________________________ (“Artist/Guardian”) on the terms and conditions set forth below. WHEREAS, the Exhibit is anticipated to be held from February 2, 2015, through February 28, 2015, and any additional dates agreed to in writing; and WHEREAS, the Exhibit will be located at Frisco Discovery Center, 8004 N. Dallas Pkwy., Frisco, Texas 75034; and WHEREAS, in exchange for the promotion of the arts, Artist agrees to lend his/her Artwork (hereinafter defined) for display at the Exhibit as set forth below; and NOW, THEREFORE, for and in consideration of the premises and the mutual promises, covenants, and agreements hereinafter set forth and per the separate contract, Artist and Frisco Arts agree as follows: 1. Artwork and Agency. Artist agrees to lend his/her Artwork, as more particularly described and/or depicted on the “emoji” Call for Art & Entry Form, attached hereto and incorporated herein for all purposes, for display by Frisco Arts at the Exhibit (“emoji”). The parties acknowledge and agree that the Exhibit is the sole and exclusive event of Frisco Arts in its promotion of public art. 2. Acceptance of Guidelines. By execution of this document, Artist acknowledges that he/she has been given and has read and accepts the “emoji” Call for Art, including but not limited to those guidelines regarding hanging and installing, sales commission, and storage fees. 3. Photographic Rights. Artist hereby grants permission to Frisco Arts to photograph and/or videotape and/or to authorize others to photograph and/or videotape the Artwork and Exhibit for any non-commercial use, including but not limited to, installation documentation, publicity of the Artwork and/or Exhibit, record keeping and additional non-commercial purposes such as, among others, educational, public relations and promotion of the arts. 4. Conflicting Events and Exhibit Hours. Frisco Arts will coordinate the scheduling of the Exhibit so as not to conflict with any other event and Artist understands that Frisco Discovery Center is a multi-use facility and Artist further agrees that he/she will cooperate with and respect the rights of other users of the facility. Artist further understands that this artwork will be on display and open to the public during normal business hours for Frisco Discovery Center and at other such times as determined by Frisco Arts. Furthermore, no agreement has
been made between Artist and Frisco Arts for any other open exhibit times/hours unless expressly stated in writing by Frisco Arts. 5. No Security/Waiver of Damages/Liability. Artist acknowledges and agrees that Frisco Arts will not provide any security for the Exhibit, including, without limitation, set up, operation, viewing by the public and/or removal of the Artwork at the conclusion of the Exhibit, and Frisco Arts shall not be liable for any lost, stolen and/or damaged property, materials, equipment and/or the Artwork and any other items associated And/or used in conjunction with the Exhibit and/or Artwork. ARTIST HEREBY RELEASES FRISCO ARTS, CITY OF FRISCO, FRISCO COMMUNITY DEVELOPMENT CORPORATION, ITS COUNCIL MEMBERS, OFFICERS, AGENTS, REPRESENTATIVES AND EMPLOYEES, FROM, AND WAIVES ANY AND ALL RIGHTS TO ANY AND ALL CLAIMS FOR DAMAGES, OR OTHERWISE, IT MAY HAVE WITH REGARD TO LOST, STOLEN AND/OR DAMAGED PROPERTY, MATERIALS, EQUIPMENT AND/OR THE ARTWORK AND ANY OTHER ITEMS ASSOCIATED AND/OR USED IN CONJUNCTION WITH THE EXHIBIT AND/OR ARTWORK. PARAGRAPH: ARTIST HEREBY RELEASES FRISCO ARTS, CITY OF FRISCO, FRISCO COMMUNITY DEVELOPMENT CORPORATION, ITS COUNCIL MEMBERS, OFFICERS, AGENTS, REPRESENTATIVES AND EMPLOYEES, FROM, AND WAIVES ANY AND ALL RIGHTS TO ANY AND ALL CLAIMS FOR DAMAGES, OR OTHERWISE, HE/SHE MAY HAVE WITH REGARD TO, FRISCO ARTS’ REMOVAL OF THE ARTWORK AND/OR RELATED MATERIALS, EQUIPMENT AND/OR ANY OTHER ITEMS ASSOCIATED AND/OR USED IN CONJUNCTION WITH THE EXHIBIT AS PROVIDED IN THIS PARAGRAPH. 6. Indemnification. ARTIST SHALL DEFEND, INDEMNIFY, SAVE HARMLESS, AND EXEMPT FRISCO ARTS, CITY OF FRISCO, FRISCO COMMUNITY DEVELOPMENT CORPORATION,, ITS COUNCIL MEMBERS, OFFICERS, AGENTS, REPRESENTATIVES, SERVANTS AND EMPLOYEES FROM AND AGAINST ALL LAWSUITS, ACTIONS, LEGAL PROCEEDINGS, CLAIMS, DEMANDS, DAMAGES, COSTS, EXPENSES, AND ATTORNEYS’ FEES INCIDENT TO THE PERFORMANCE OF THIS AGREEMENT AND/OR THE SETUP, OPERATION, VIEWING BY THE PUBLIC AND/OR REMOVAL OF THE ARTWORK AND ARISING OUT OF A WILLFUL AND/OR NEGLIGENT ACT AND/OR OMISSION OF FRISCO ARTS AND/OR ARTIST, THEIR RESPECTIVE OWNERS, OFFICERS, PARTNERS, AGENTS, SERVANTS, REPRESENTATIVES, CONTRACTORS, SUBCONTRACTORS, VOLUNTEERS AND/OR EMPLOYEES. This Paragraph shall survive the termination of this Agreement. 7. Entirety of Agreement, Governing Jurisdiction and Mediation. This Agreement constitutes the entire Agreement between the parties. No modification will be enforceable except in writing and signed by both parties. This Agreement is governed by the laws of the State of Texas. In the event that any dispute arising under this Agreement results in litigation or mediation, such action or proceeding will be brought exclusively with the state court of Collin County, Texas. a. Entire Agreement. This Agreement contains the entire agreement of the parties with respect to the matters contained herein and may not be modified or terminated except upon the mutual written agreement of the parties hereto. b. Authority to Execute. The individuals executing this Agreement on behalf of the respective parties below represent to each other and to others that all appropriate and necessary action has been taken to authorize the individual who is executing this Agreement to do so for and on behalf of the party for which his or her signature appears, that there are no other parties or entities required to execute this Agreement in order for the same to be an authorized and binding agreement on the party for whom the individual is signing this Agreement and that each individual affixing his or her signature hereto is authorized to do so, and such authorization is valid and effective on the date hereof.
c. Savings/Severability.
