This was the biggest field we have had with 84 ladies playing and trust me the competition was of the highest quality. Day one with all the ladies in great spirit, all in their own team uniform and teams doing their team talks and getting ready to do battle and have fun. It was awesome to see how serious the ladies were and the scores did show on day one with the leaders on 86 and 7 teams right behind them within 3 points. The Monday night was a bit of a party with Dan Vee performing and getting all the ladies on their feet and dancing. Tuesday morning was an early start with all the ladies taking it to the next level of seriousness wanting the trophy. It was the team of Riana Karemaker, Rona Erasmus, Queenie Steyn and Ane Worst with a big second day score of 93 that clinched this year’s Belle of the Bush honours on a total of 176 point. KEEPING UP WITH THE JONES’ July has been a very busy month. Dylan Frittell won the John Deere Classic and Ashley Buhai kept us all in suspense when she very nearly lifted the ladies Open for South Africa. Well done guys. Tee and Sandwedges was involved in its very first women’s Pro Am which was played at Blair Atholl Golf Estate on 4 July. Our huge thanks to Investec Wealth and Management and Pam and Neil Senior for making it happen. Our ladies event at Champagne Sports Resort in November is going exceptionally well. Get your 4 ball booked soon and join the fun. We have a new promotion in October to KZN where we are going to be playing a few of the old favourite courses – Royal Durban Golf Club, Beachwood Golf Course and Mount Edgecombe – The Woods. Read about it in this issue. Lynn and I spent a wonderful 3 days at Elements Golf Estate with friends. The golf course was wonderful to play and we really enjoyed ourselves. Many thanks to Ian Leach and his team for our enjoyable stay. Lots of exciting news to come from Elements Golf Estate in the future. Lynn and I were at Zebula for the Belle of the Bushveld. STREICHER RULES ROOST AT SA HIGH SCHOOL CHAMPS BY: LALI STANDER Megan Streicher from Somerset College made golfing history in Women’s Month when she became the first female winner in the ninth SA High School Championship at Koro Creek Bushveld Golf Estate recently. Streicher hit the golfing radar with a top six finish in the SA Women’s Stroke Play Championship in April. She reached the semi-finals of the SA Women’s Amateur and a month later, the GolfRSA B-Squad member tied for third in her international debut at the ATI Ciputra Golfpreneur Junior World 2019 in Indonesia. PRAISE FOR SIXTH NATIONAL GOLF FESTIVAL The 6th edition of the National Golf Festival was described as a big success by players from across the country and as far afield as Dubai. Manicured courses and perfect winter weather conditions allowed for some great golf over the three days of the tournament, with camaraderie and social events rounding off the festival on the fourth day. “We aim to promote George and the Garden Route as the best golf destination on the African continent. The National Golf Festival is the only event of its kind on the African continent and allows golfers to select from a menu of local courses, including Kingswood, Oubaai, George, Fancourt Montagu, Fancourt Outeniqua, Pezula, Pinnacle Point, Simola and Goose Valley. Six of these courses are in the Top 25 and all in the Top 100 courses in SA. George is also home to the Links Course at Fancourt Hotel and Country Club which is the top-rated course in South Africa. Golf tourism is a strong economic driver in the region, and we aim to build on this” said NGF founder and director Charl Marais. The festival kicked off with the expo, registration and welcome function on Wednesday the 3rd of July at the Wilderness Hotel. At the expo visitors could view some of the courses, meet players and enjoy interesting local products. Unique international golf memorabilia was also on display. From Thursday the 4th to Saturday the 6th players took part in the NGF Tournament over three categories on nine courses across the Garden Route. These included Pinnacle Point, Fancourt Montagu, Kingswood, Oubaai, Fancourt Outeniqua, George Golf Club, Pezula, Simola and Goose Valley. The prize- giving function concluded on Saturday night at Augusta Grill with great entertainment by Michael Lindt. The festival’s unique scoring system levels the playing field and everyone had a fair chance to win, no matter their handicap. This system also takes into account different conditions at different courses. HIP TO UNLIMITED BE SQUARE BY: JOHN DICKSON GOLF CARTS We often have heard the expression “the hips don’t lie” well the hips play a huge part in the golf swing. The golf swing is made up of many different moving parts and the sequence of the movement play a huge roll in the execution of a golf swing. Even when we look at other sports the hips play a big part in the movement of athletes and the transferring of weight. Lots of athletes when they get older have hip replacements and I think this has a lot to do with poor movement when they were playing the sports they were active in. In Golf the hips are where we bend from and they connect the upper body to the lower body. The golf swing relies on this connection to help synchronise the movement from the loaded backswing down to impact and through to a balanced finish. The golf swing coils in the right hip on the backswing (for a right handed golfer) and then the transfer onto the left side to facilitate the body being able to rotate to the desired finish. If the hips do not work on the way down then the shot will either be hooked or pulled. If the hips are over active this can lead to the ball going right. The desired hip movement should be a definite movement onto the left side so that the right side can rotate through the hitting area to the balanced finish. One of the big requirements is to make sure the shoulders remains reasonably square to the intended path you want the ball to start on. If the hips work to fast or to early they can lead to the shoulders opening up to early resulting in a pull or pull slice. Hence the expression Hip to be square really asks the question of us to use the hips correctly but not at the expense of the shoulders. WHEN MAKING A WILL... We tend not to give a thought to making a will unless we are diagnosed with a life-threatening disease or have reached an age where our friends are dying off at an alarming rate. But death can come unexpectedly, like a thief in the night (to quote the Bible). Every day we read news reports and hear anecdotes about people who have died in motor, industrial or hunting accidents (or even bizarre Darwin-award style accidents) or of heart attacks, aneurysms, strokes or other unexpected and sudden medical conditions. Without being morbid, we owe it to those close to us to leave our affairs tidy, and this means that we must be prepared for the unexpected. Here are a couple of things to bear in mind when you contemplate your mortality and your worldly goods. You need to appoint an executor. This is the person who wraps up your estate, collects your cash and assets, pays your bills and taxes and distributes the balance to your beneficiaries. This is a technical and legal process, so you must make sure you appoint someone who is suitably qualified and experienced. It is also a task that has a tendency to be pushed to the bottom of the pile of a busy person who does not focus on and is not passionate about this kind of work, so you must also make sure that your executor also ticks these boxes. You do not have to specify who must receive every single item and account that you have in your will. If you don’t mention a specific item, it forms part of the residue of your estate, which goes to your heirs. They will then have to decide among themselves who gets what and what will be converted to cash to be divided among them. But if you want specific people to receive specific things or specific cash amounts from your estate, these are bequests that must be made in your will. Bear in mind that it might save those who you leave behind anguish and conflict if you have made your wishes known. You may bequeath an asset to a beneficiary subject to the condition that when he or she dies it must be left to someone else. This condition is called a fideicommissum. This is quite common with land such as farms or holiday homes, where a father leaves the property to his son subject to the condition that it is left to his son, and so on. Before 1965, property could be kept in a family eternally in this way. But in 1965 a law was passed that limited a fideicommissum to two consecutive beneficiaries. So even if you leave your property with the condition that it must pass down from father to son indefinitely, you’re your grandson inherits it he can do with it as he pleases. You may also leave property to one person subject to limited rights in favour of another. A common example is a usufruct, where a house or farm is left to, say, your child, subject to the life (or limited period) usufruct in favour of your spouse. Your child becomes the owner of the property immediately upon your death, but your spouse has the right to live in the property, rent it out and enjoy any income that it generates. Everything that is left in your estate after your bills and taxes have been paid and your bequests distributed is divided among the heirs that you nominate in your will. You are free to leave this to anyone and in whatever proportions you like. Some legal systems provide for what they call a “legitimate portion”, a minimum percentage of your spouse and/or descendants. This does not form part of South African law – spouses and children have no legal right to inherit from you if you choose to leave them out of your will. Of course, if you do disinherit them and they are partly or wholly financially dependent on you, they will have a claim for maintenance against your estate. In this case, an actuary determines a lump sum that will satisfy the maintenance claim, which is then a liability of your estate like any other debt that you owe when you die, and will reduce the value of the residue that the heirs will receive. People often want to leave the bulk of their wealth to their children, out of fear that their spouse will meet a new partner and leave everything to him or her. While I can understand the motivation, I don’t really agree with this. It may make sense if both spouses have significant wealth independently of each other. But most married couples’ lifestyles are fueled by their combined means. Take one’s share of the loot away and the other may struggle to get by. So, while the children will get a welcome injection of capital, your spouse may be left decidedly poor. One way of dealing with this particular dilemma is to create a residual fideicommissum in your will. This is similar to the fideicommissum described earlier, but covers everything that your spouse inherits from you generally, not a specific asset. The spouse may use up what he or she has inherited, so he or she may make the lifestyle changes that we need as transit from one phase of our lives to the next, but whatever is left must be left to your children. If you have children under 18, they will need a guardian if both their parents have died. This is something that can cause a great deal of pain and conflict if there are different family members who each feel that if they should be the guardians or if there are family members who feel obliged to take on the role, but are not really in a position to do so. If you nominate guardians in your will, you will not only avoid this pain and conflict but will also have the peace of knowing that your children are left with someone you know and trust. If you leave children under 18 and have not made provision for a trust in your will, their inheritance must be converted to cash and paid into the Guardian’s Fund, which is administered by the department of justice. When the children turn 18, they will then receive their entire inheritance, plus interest. Before that, their guardians may claim maintenance from the guardian’s fund, which is paid out of the children’s inheritance. But having the maintenance paid is a slow process, and your children may be left wanting. If you want to avoid this and also delay your children receiving their inheritance until they reach an age at which you believe they will responsibly manage their money, you must set up a trust for them in your will. To do this, you must nominate trustees. These must be people whom you trust to not only preserve and grow your children’s inheritance, but also to release money to your children and their Guardians when they need it. Under South African law we have complete freedom of testation; as long as it is not illegal or contrary to public policy or morals, effect must be given to any instructions or restrictions that you may state in your will. However, you should guard against trying to rule from the grave. We cannot predict the future; although they may be made with the best intentions, conditions and stipulations that seem sensible and necessary when you make your will may cause your loved ones tremendous heartache and even harm many years later. I have seen this at first hand. It is advisable to keep things simple and to let the future take care of itself. 19
PLAY FAIR... “Play the course as you find it; play the ball as it lies. If you can’t do either then play fair. In order to play fair, you need to know the rules of golf.” Many of us, watch hours of golf on TV, be it the USPGA, the European Tour, the LPGA and the like. We see certain rulings made and then as- sume we can take those onto the golf course ourselves. Please be careful as you may end up being penalised. Every tour has what they call a “Hard card” (a set of rules for that tour) as well as local rules (which will vary per tournament) that are applied. Just because you see them being implemented on TV doesn’t mean they become implementable at your club. By comparison, your club may introduce “preferred lies” for a period and then remove that local rule after a while. As your club has a Committee, the respective tours have Committees who determine the implementation of their local rules. A recent example was in the Irish Open where Model Local Rule F-5 was in effect i.e. where relief was allowed for Immovable obstructions close to the putting green. The long form of the local rule reads: Relief from interference by an immovable obstruction may be taken under Rule 16.1. The player also has these extra options to take relief when such immovable obstructions are close to the putting green and on the line of play: The player may take relief under Rule 16.1b if an immovable obstruction is: Ball in General Area. On the line of play, and is: • Within two club-lengths of the putting green, and • Within two club-lengths of the ball. DR. RULZ Exception - No Relief If Line of Play Clearly Unreasonable. There is no relief under this Local Rule if the player chooses a line of play that is clearly unreasonable. Please be sure to read your local rules board and know which local rules are in play when you go out and play. It may save you a few shots. In terms of sustainable golf, one of the quick tests for sustainability is to ask whether a golf course has policies, procedures and plans to deal with the three Ps of sustainability namely, people, planet and profit. From a different perspective the Environmental Management Act defines sustainable development as the integration of social, economic and environmental factors into planning, implementation and decision-making so as to ensure that development serves present and future generations”. As we have reiterated many times in this column, compliance of environmental factors, i.e. the planet, and good governance of social and economic factors, i.e. people and profit, are part of the foundation the underpins licence to operate. Furthermore, the collation of relevant data from the course and then sharing this information is crucial. King IV Principle 12 of 17 supports this by stating that the entity i.e. the golf club, should govern technology and information in a way that supports the organisation setting and achieving its strategic objectives. In this regard one of the strategic objectives for every golf club in South Africa should be to operate sustainably. The Lost City Many golf clubs in South Africa, for a several reasons are tightening their golf course maintenance budgets which is impacting upon, for example bunkers. The question is whether the management decisions impacting upon bunkers have been made with the appropriate information. In this regard Club Managers and Course Superintendents will be receiving a questionnaire regarding bunkers. We hope that there will be overwhelming support to participate in the South African bunker survey.
