Senior Contracts Advisor Job Description What’s the job? The Group’s work is guided by the public transport provisions of the Regional Land Transport Plan and the Regional Public Transport Plan. Every day we have thousands of people travelling with Metlink (across rail, bus, harbour ferry and Total Mobility) and every one of those journeys matters to us. Our role is to plan, develop, promote and deliver public transport services and supporting infrastructure in the Wellington region. Our goal is to be more than just a public transport service, we want to be a symbol of pride for the Wellington region, an integral part of what makes living in our region great. The Senior Contracts Advisor will lead the development and creation of timely, cost-effective and high-quality contracts. You will assist the Manager Commercial Partnerships to minimise Metlink’s exposure to commercial and/or contractual risks professionally and ethically, by drafting commercially sound contracts and mitigating any risks that are identified during the management of the contracts. You will be the group subject matter expert and you will provide financial and contract advice to assist procurement, commercial disputes and business case development within the Group. Alongside the GW legal and procurement team, you will contribute to the development of strategies for the procurement of Metlink’s needs to assist cost reduction targets and value creation. You will also support procurement activities to ensure they are carried out in an efficient and fully auditable manner. 01/2020 Senior Contracts Advisor Page 1
What you’ll do 1. Provide contract management and procurement thought leadership by: Researching and advising on partnering contract obligations for GW and rail, ferry and bus operators, and developing and implementing new/improved processes to support this Managing contract schedule reporting activities, by implementing processes to ensure compliance, price management (indexation and scope changes) and contract administration Actively monitoring legal, financial, regulatory, and business risk in contract and subcontract terms and conditions, and escalating these to the Commercial Partnerships Manager, and working through resolutions for these Leading the development of contract policies and practices and process improvement initiatives; ensure contract practices, transactions and documentation comply with policies and procedures, contract requirements, and Government regulations Overseeing the management of documents for all Public Transport contracts, ensuring all files and related commercial documents are accessible Monitoring and interpreting NZTA standard procurement regulations and clauses for updates with a focus on active contracts and future bidding impacts, and ensuring the Groups processes and practices are compliant with these Overseeing, developing and producing a wide range of complex contract documentation in response to customer inquiries, to address PT contractual issues, and as otherwise required for the compliant and complete administration of contracts Developing summary materials to support training of GW staff on contract matters Presenting and reporting on aspects of Pubic Transport contracts to internal and external parties as required 2. Provide contract management advice for the Group by: Participating in every element of Metlink acquisition, including requests for proposal, financial and contractual analysis, programme management and subcontracting Assisting with procurement of new contracts, including advice to support negotiations and implementation activities Researching and advising on internal process requirements to implement new functions, grow existing functions or to inform new contracts or contract variations Managing contracts including review/approval process for entering into new contracts, contract negotiation, implementation, reporting, invoicing, closeout and compliance Acting as an escalation point within the Group for consistent interpretation and application of contracts and variations and for issues of an unusual nature Reviewing, evaluating, drafting and negotiating various types of contract related documents (i.e. Contracts, Subcontracts, Consultant Agreements, Vendor Agreements, Purchase Orders, RFQs, RFPs etc.) for compliance with policies and procedures Reviewing and processing variation documents to include changes in scope, period of performance, funding levels and general updates in collaboration with the Manager Commercial Partnerships, Strategy and Investments, Operations, and Finance 01/2020 Senior Contracts Advisor Page 2
Managing medium to high complexity interactions involving suppliers, customers and the overall needs of Metlink Working with the Strategy and Investments team, and the Principal Account Managers supporting the performance and financial management of public transport contracts, including contributing to financial modelling for ongoing contract management and performance monitoring Providing financial and contract advice to assist with the contract commercial disputes, as required 3. Provide Relationship Management by: Representing Metlink and GW credibly and professionally, internally and externally Developing and maintaining effective long-term, collaborative relationships with key partners and stakeholders 4. Consider sustainable resource management by: Promoting sustainable resource management including making effective and efficient use of resources available to the Group Carrying out such other duties relating to resource management (air, land, water) as may be assigned from time to time 5.
