Ordinary Council Meeting Minutes 13 April 2021 9 MATTERS OF PUBLIC IMPORTANCE / LORD MAYORAL MINUTE 9.1 Lord Mayor Minute - Prince Philip Message of Condolence MOTION 1. THAT Council endorses that I submit the message of condolence to the Governor-General of Australia’s online condolence book as outlined below. 2. THAT Council endorses that I forward a letter to Her Majesty the Queen and the Royal Family for the recent passing of His Royal Highness Prince Philip, The Duke of Edinburgh. “On behalf of City of Darwin Aldermen, Council Staff and the people of Darwin, I express our deepest condolences to Her Majesty Queen Elizabeth II and the entire Royal Family on the passing of His Royal Highness The Prince Philip, Duke of Edinburgh. We have been honoured to have had Prince Philip visit Darwin on many occasions since 1956 including to open the Darwin Community College in March 1974 and in 1982 when he visited Garden’s Oval and Smith Street Mall. With strong ties to both England and Greece, Prince Philip has a special place in the hearts of the people of Darwin. Rest in Peace. The Hon. Lord Mayor Kon Vatskalis” CARRIED 10/0 9.2 Timor-Leste Natural Disaster MOTION THAT the City of Darwin Sister City Committee liaise with the Consul General of Timor-Leste in ascertaining the immediate need for assistance as a result of the recent Natural Disaster to affect Dili and the entire country of Timor-Leste. Furthermore that a report be provided to the next Ordinary meeting of Council advising of the support options that the City of Darwin can provide. Ordinary Council Meeting Minutes 13 April 2021 13 NOTICES OF MOTION 13.1 NOTICE OF MOTION - REFUGEES IN DARWIN DETENTION FACILITY I, Alderman Justine Glover, give notice that at the next Ordinary Council Meeting on 13 April 2021, I will move the following motion:- RESOLUTION ORD168/21 Moved: Alderman Justine Glover Seconded: Lord Mayor Kon Vatskalis 1. THAT Council voice it's strong opposition to the indefinite detention of nine declared refugees currently held in a Darwin detention facility. 2. THAT Council call on the Department of Home Affairs and Federal Government to end the indefinite detention of the nine declared refugees. 3. THAT Lord Mayor write to Senator Sam McMahon seeking her assistance in facilitating the release of the nine refugees in Darwin. CARRIED 10/0 13.2 NOTICE OF MOTION - CITY OF DARWIN CLICK AND FIX APP TO INCLUDE HEALTH AND WELL-BEING INFORMATION I, Alderman Jimmy Bouhoris, give notice that at the next Ordinary Council Meeting on 13 April 2021, I will move the following motion:- RESOLUTION ORD169/21 Moved: Alderman Jimmy Bouhoris Seconded: Alderman George Lambrinidis THAT the Chief Executive Officer provide advice to Council in modifying the City of Darwin Click and Fix app to include health and well-being information that is currently held on the City of Darwin website. Ordinary Council Meeting Minutes 13 April 2021 LORD MAYOR KON VATSKALIS DEPARTED THE MEETING AT 6:17 PM AND ALDERMAN PETER PANGQUEE TOOK OVER THE ROLE OF CHAIR. 14 ACTION REPORTS 14.1 REVIEW OF POLICY 069 - RISK MANAGEMENT POLICY RESOLUTION ORD170/21 Moved: Alderman Jimmy Bouhoris Seconded: Alderman Rebecca Want de Rowe 1. THAT the report entitled Review of Policy 069 – Risk Management Policy be received and noted. 2. THAT Council notes the recommendation of the Risk Management and Audit Committee that the revised Policy 2305.100.E.R - Risk Management Policy be adopted. 3. THAT Council adopts the revised Policy 2305.100.E.R - Risk Management Policy. THAT the report entitled Review of Policy 013 - Tourism Promotion be received and noted. 2. THAT Council adopts the revised Policy 013 – Tourism Promotion. Ordinary Council Meeting Minutes 13 April 2021 14.4 SOCIAL BUDGET INITIATIVES RESOLUTION ORD173/21 Moved: Alderman Rebecca Want de Rowe Seconded: Alderman Robin Knox 1. THAT the report entitled Social Budget Initiatives be received and noted. 2. THAT Council refer an increase to the Community Grants Program of $100,000 to the 2021/22 annual budget process and that the budget to be allocated as follows: (a) $50,000 for quick response grants for Youth Programs in the Northern Suburbs (b) $40,000 for an Arts and Cultural Development grant program (c) $10,000 for the delivery of Busk a Move program. CARRIED 10/0 14.5 WULAGI AND KARAMA WALKWAYS - COMMUNITY CONSULTATION OUTCOME RESOLUTION ORD174/21 Moved: Alderman Justine Glover Seconded: Alderman Gary Haslett 1. THAT the report entitled Wulagi and Karama Walkways - Community Consultation Outcome be received and noted. 2. THAT Council undertakes a night-time closure of Walkway 209, Moreton Place to McMillans Road, Karama. 3. THAT the residents who provided feedback through the consultation process be informed of Council’s decision. CARRIED 10/0 14.6 NORTHERN TERRITORY PLANNING COMMISSION - DESIGNING BETTER STAGE TWO CONSULTATION RESOLUTION ORD175/21 Moved: Alderman Gary Haslett Seconded: Alderman Jimmy Bouhoris 1. THAT the report entitled Northern Territory Planning Commission - Designing Better Stage Two Consultation, be received and noted. 2. THAT the report entitled Elected Member Allowances 2021/22 be received and noted. 2. Ordinary Council Meeting Minutes 13 April 2021 16 REPORTS OF REPRESENTATIVES 16.1 LOCAL GOVERNMENT ASSOCIATION OF THE NORTHERN TERRITORY (LGANT) DEVELOPMENT OF RECONCILIATION ACTION PLAN RESOLUTION ORD178/21 Moved: Alderman George Lambrinidis Seconded: Alderman Peter Pangquee Alderman Peter Pangquee advised Elected Members that LGANT is: - developing its first Reconciliation Action Plan and that Alderman Pangquee has been appointed by LGANT to a working group to develop the plan; and - reviewing the LGANT Constitution in response to the new Local Government Act 2019. CARRIED 10/0 16.2 AUSTRALIAN CHINESE FRIENDSHIP SOCIETY COMMUNITY CENTRE RESOLUTION ORD179/21 Moved: Alderman George Lambrinidis Seconded: Alderman Peter Pangquee Alderman Jimmy Bouhoris reported that he attended the Australian Chinese Friendship Society event over the weekend and advised that the organisation had obtained land in Leanyer for a new community centre. CARRIED 10/0 16.3 LAND FOR WILDLIFE FEEDBACK RESOLUTION ORD180/21 Moved: Alderman George Lambrinidis Seconded: Alderman Peter Pangquee Alderman Robin Knox reported on positive feedback and support from the community after attending a Land for Wildlife function. Alderman Robin Knox thanked and acknowledged the efforts of staff with the promotion of the Gardens for Wildlife Program. CARRIED 10/0 Page 12
Ordinary Council Meeting Minutes 13 April 2021 16.4 AUSTRALIAN LOCAL GOVERNMENT ASSOCIATION MEETING RESOLUTION ORD181/21 Moved: Alderman George Lambrinidis Seconded: Alderman Peter Pangquee Lord Mayor reported to Council on attendance at the Australian Local Government Association (ALGA) meeting held in Canberra as follows: - Lord Mayor, Chief Executive Officer Scott Waters and Local Government Association of the Northern Territory (LGANT) Chief Executive Officer Sean Holden attended the meeting - City of Sydney Councillor, Linda Scott was elected as President of ALGA - ALGA are currently recruiting for a new Chief Executive Officer. - A full report via the Chief Executive Officer will be provided to the next Council briefing session. CARRIED 10/0 17 QUESTIONS BY MEMBERS 17.1 WORKS OCCURING ON PROGRESS DRIVE, NIGHTCLIFF RESOLUTION ORD182/21 Moved: Alderman George Lambrinidis Seconded: Alderman Peter Pangquee Alderman Peter Pangquee raised that he had received a letter advising of works and vegetation removal occurring on Progress Drive Nightcliff two days after the works had commenced. Alderman Peter Pangquee noted the worked are being carried out on behalf of Department of Infrastructure, Planning and Logistics but queried whether Council has any input into the community engagement process for works occurring on Council owned land, carried out by the Northern Territory Government. Chief Executive Officer recommended that Alderman Peter Pangquee discuss the matter with the Member for Nightcliff and that he will provide that feedback directly to the Northern Territory Government Department of Infrastructure, Planning and Logistics Chief Executive Officer. Chief Executive Officer advised that he will invite the Project Manager from Department of Infrastructure, Planning and Logistics to the next Council briefing session to provide an update on the John Stokes Square Redevelopment project. Ordinary Council Meeting Minutes 13 April 2021 17.2 SAND QUALITY AT LAKE ALEXANDER RESOLUTION ORD183/21 Moved: Alderman George Lambrinidis Seconded: Alderman Peter Pangquee Alderman Jimmy Bouhoris raised that the sand at Lake Alexander, East Point is looking un- maintained. Chief Executive Officer took the matter on notice. Alderman George Lambrinidis advised he had received the same enquiries regarding the sand quality from members of the public but also advised he had received comments that the water quality had improved. The Chief Executive Officer reminded Elected Members of the newly established City of Darwin East Point Reserve Advisory Committee as a suitable forum to raise matters of this nature also. CARRIED 10/0 17.3 BRADSHAW TERRACE GREENING WORKS RESOLUTION ORD184/21 Moved: Alderman Robin Knox Seconded: Alderman Peter Pangquee Alderman George Lambrinidis discussed current greening works occurring on Bradshaw Terrace and raised that he noted the root balls of the trees that were removed and queried if they had been planted correctly. Further, he queried whether Council would be investigating the health of the remaining trees along the Bradshaw Terrace median strip as a result. Chief Executive Officer took the matter on notice. CARRIED 10/0 18 GENERAL BUSINESS Nil 19 DATE, TIME AND PLACE OF NEXT ORDINARY COUNCIL MEETING THAT the next Ordinary Meeting of Council be held on Tuesday, 27 April 2021, at 5:30PM (Open Section followed by the Confidential Section), Council Chambers, Level 1, Civic Centre, Harry Chan Avenue, Darwin. 20 CLOSURE OF MEETING TO THE PUBLIC THAT pursuant to Section 65 (2) of the Local Government Act and Regulation 8 of the Local Government (Administration) Regulations the meeting be closed to the public to consider the Confidential Items of the Agenda. Ordinary Council Meeting Minutes 13 April 2021 RESOLUTION ORD185/21 Moved: Alderman Rebecca Want de Rowe Seconded: Alderman Andrew Arthur That Council considers the confidential report(s) listed below in a meeting closed to the public in accordance with Section 65(2) of the Local Government Act: 26.1 City Safe Security Patrols - February 2021 This matter is considered to be confidential under Section 65(2) - 8(e) of the Local Government Act, and the Council is satisfied that discussion of this matter in an open meeting would, on balance, be contrary to the public interest as it deals with information provided to the council on condition that it be kept confidential. 26.2 Rent Relief Requests This matter is considered to be confidential under Section 65(2) - 8(b) and 8(c)(iv) of the Local Government Act, and the Council is satisfied that discussion of this matter in an open meeting would, on balance, be contrary to the public interest as it deals with information about the personal circumstances of a resident or ratepayer and information that would, if publicly disclosed, be likely to prejudice the interests of council or some other person. 26.3 Movement Strategy Update This matter is considered to be confidential under Section 65(2) - 8(c)(iv) of the Local Government Act, and the Council is satisfied that discussion of this matter in an open meeting would, on balance, be contrary to the public interest as it deals with information that would, if publicly disclosed, be likely to prejudice the interests of council or some other person.
