T H E aft MIASF UPDATE ET by Patience Cohn, Marine Industries Association of South Florida K e rMAR CHANGE IS IN THE WIND The year 2021 started with a flurry of legislative Florida State Capitol activity including some that could have an impact on marine businesses. As always, when there is a change in administration, it results in a change in some policies. We were grateful the expanded international travel ban still provides an exemption for yacht crew joining their boat in the U.S. On the federal level, a bill called the Pro Act 2021 may be the most problematic action happening. The bill was first introduced in 2020 and passed the House. It is expected to pass with ease again this year. The Senate can utilize the filibuster to stop its movement, but it is very possible portions of the bill could make their way into law and that warrants being watched closely. Pro Act is sweeping labor reform; while many of the changes relate to union rules, several items hit close to home. Florida is a right-to- work state; however, the Pro Act would invalidate all states’ right-to work laws. The act would codify California’s ABC test for employee vs contract labor. Here are the basics of the ABC contract labor test: A. The worker is free from the control and direction of the hiring entity in connection with the performance of the work, both under the contract for the performance of the work and in fact; B. The worker performs work that is outside the usual course of the hiring entity’s business; and C. The worker is customarily engaged in an independently established trade, occupation, or business of the same nature as that involved in the work performed. Item B may be of the most concern when you think of how many people in our industry prefer the freedom of freelancing and offering their services on an as-needed basis.
