GM “Last Minute of Play Giveaway” Contest General Motors of Canada Limited OFFICIAL RULES AND REGULATIONS This contest is held by General Motors of Canada Limited (“GMCL”). It runs from October 30, 2007 at 10:00 a.m. (PT) to March 17, 2008 immediately prior to the start of the second (2nd) period (the “Contest Period”). Contest Rules & Regulations Eligibility 1. Residents of British Columbia who have reached the age of majority in British Columbia and who possess a valid B.C. driver’s license at the time of entry may enter this Contest. Employees of, immediate family members of, or those residing with an employee of GMCL, General Motors Place, Vancouver Canucks hockey club/team, Orca Bay Sports & Entertainment, their agents and representatives, their parents, affiliates, subsidiaries and dealers, advertising and promotional agencies, sponsors, suppliers of prizes, materials or services related to this Contest, including the independent judging organization are not eligible to enter this Contest. “Immediate family” is defined as parents, siblings, children, partner or spouse. In order to participate in the Grand Prize Event (as such terms are described below), each of the Finalists who will be shooting a puck must additionally be willing and physically able to participate in such event and cannot be a current or former professional, semi-professional or Canadian Major Junior hockey player, or collegiate hockey player at any level (freshman, junior varsity, or varsity for men or women) in the past (5) year period immediately preceding March 1, 2008. To Enter 2. No purchase necessary to enter. Limit of one (1) entry per person during the Contest Period, regardless of the mode of entry. There are two (2) ways of entering this contest: (a) Online. By logging on to www.canucks.com/chevylastminute where you will complete all the required fields on the “Last Minute of Play Giveaway” entry form and click on “submit” and you will automatically be entered into the Contest. Online entries must be received by 10:00 a.m. (PT) on the day of a Vancouver Canucks’ home game in order to be eligible for that day’s home game draw and all subsequent draws. (b) By ballot. To enter, complete the paper entry form which can be found at the two (2) GMCL vehicle displays inside General Motors Place on the Concourse Level, 800 Griffiths Way, Vancouver, BC V6B 6G1 and deposit it at any of the ballot boxes there during each Vancouver Canucks Team (“Team”) home game during entry period. An “Entry Period” will begin one (1) hour prior to the start of each Team home game and will close upon the start of the second period of each Team home game during the Contest Period.
3 Prizes Finalist Prizes: There are up to sixty (60) Finalist Prizes available to be won. Each Finalist Prize consists of two (2) tickets to the Team game at General Motors Place on April 5, 2008 at 7:00 p.m. PT. Approximate retail value of each Finalist Prize is $500 CDN. All incremental costs in using or claiming a Finalist Prize not outlined in this prize description are the sole responsibility of the Finalist Prize winner and their guest including but not limited to: transportation, parking, gasoline, meals, beverages, gratuities, entertainment, excursions, merchandise, souvenirs, local and long distance telephone calls, and all personal expenses of any kind or nature. All prizes must be accepted as awarded; no cash substitutes. Finalists must agree to attend the Team game on April 5, 2008 and participate in the Grand Prize Event shoot-out game at centre ice in order to be eligible for the Grand Prize. Grand Prize: There is one Grand Prize available to be won, consisting of a 2008 Chevrolet Equinox LS 1SB model; approximate retail value/MSRP: $27,595. The Grand Prize includes destination/freight charges. Colour, accessories, and other specifics of the prize will be at GMCL’s sole discretion. Manufacturer’s warranty applies to the Grand Prize. Upon notification, winner will personally take delivery of the vehicle from a GMCL dealership within B.C. reasonably close to the winner's home as designated by GMCL, within three (3) months of being declared the winner. Winner must present adequate personal identification to claim the Grand Prize. The Grand Prize vehicle will not be released unless winner first shows proof of having a valid B.C. driver’s license and satisfactory insurance. Winner is solely responsible for all taxes and expenses which are not included in the prize description above, including but not limited to: registration and license fees, insurance, additional accessories and all other costs incurred in claiming, registering or using the vehicle. Winner is responsible for all costs associated with any upgrade or option packages winner may request and which GMCL, in its sole discretion, is willing to provide or has provided respecting any vehicle. GMCL, at its discretion, may substitute a model year 2009 vehicle of the same or like model and style in the event of lack of vehicle availability due to limited production or any other reason. All taxes on prizes other than taxes specifically referred to in these rules are the responsibility of the winner. Prize Draws: 4. QUALIFIERS During the Contest Period, and as described below, the contest administrator will select two (2) Qualifiers, during each Vancouver Canucks home game. Each Qualifier selected, will represent the game during which their names have been drawn. The contest administrator will make two (2) random draws during each Team home game to declare Qualifiers as follows: (a) Online Qualifier Draws. At 10:00 a.m. [PT] on the day of each Canucks Team home, one (1) name will be drawn from all online entries that have been received up to that point. The online entrant chosen will become one of the Qualifiers for that day’s home
Team game. Odds of being declared an Online Qualifier are dependant on total number of online entries. (b) On-site (Ballot entry) Qualifier Draw. The Ballot entry period for each Canucks Team home game will begin one (1) hour prior to that game and will close immediately prior to the start of the second (2nd) period of that game. Immediately after the start of the second (2nd) period of that game, one (1) ballot will be drawn. The entrant named on the ballot will be declared the second Qualifier for that game. Odds of being declared an on-site Qualifier are dependant on the total number of on-site ballot entries. If a goal is scored by the Team against the opposing team during the last minute of play in the second period, both Qualifiers will be declared Finalists and will be eligible to participate in the Grand Prize Event. A Qualifier may only receive one (1) Finalist entry regardless of how many goals are scored in the last minute of play by the Team. The last minute of play begins at the last 00:59 seconds in the period down until and including zero. The time a goal was scored will be determined by the final call of the National Hockey League (NHL) referee for the game. If there is no goal scored in the last minute of play, there is no prize awarded to either Qualifier. The odds of being declared a Finalist depends on the number of goals scored during the last minute of play in each period of each home game during the Contest Period. ON-SITE FINALIST: On April 5, 2008 there will be one (1) random draw to select one On-Site Finalist as follows: On-Site Finalist Draw. One Finalist will be declared by one (1) random draw on April 5, 2008 from all on-site ballots received during the period that begins one hour prior to the April 5, 2008 game start up and ends with the closing of the second period of that game. The odds of being selected as a On-Site Finalist during the April 5, 2008 game and to be eligible to participate in the Grand Prize shoot-out event at centre ice during that game, depends on the total number of On-site ballot entries received that day during the entry period (1 hour before the game up to the closing of the second period). The On-Site Finalist designation has no retail value. Grand Prize Event. Each Finalist and the On-site Finalist will randomly be assigned, by the Contest Administrator, to a position on the goal line on the ice and will be required to shoot a hockey puck marked with their name, with a hockey stick, from their designated spot, to the centre line without going past it. The Finalist whose puck stops closest in measurement to the designated centre line without any portion of the puck passing the furthest edge of the line, will win the Grand Prize. Measurement will take place after each puck has stopped. Measurement will be based on the final stop of the puck, regardless if the puck: touched the board(s), bounced off the board(s), hit another competitor’s puck(s) or was hit by another competitor’s puck. Pucks will not be touched or cleared away until the game is finished. Determination of measurement is at the sole and final discretion of the independent judging organization. No practice, warm up, qualifying or trial shots will be permitted at General Motors Place on the day of the Grand Prize Event. The shoot-out game at centre ice will not be considered practice, warm up, qualifying or trial shots. The hockey pucks will be approved regulation pucks provided by the Vancouver Canucks Hockey Club. Finalists must wear ice cleats and a helmet (provided by Contest Administrator) and use a regulation hockey stick (as provided by Contest Administrator) to participate and must attempt the shot with no third party assistance, equipment or machinery of any kind, other than as provided by the Contest
Administrator. In the event that there is only one Finalist declared during the Contest Period, there will be no shoot-out game and the Finalist will be declared the Grand Prize winner. General Conditions 5. To be declared a Finalist and/or a Grand Prize winner and claim a Finalist and/or a Grand Prize the potential winner must: a) Be reachable by the independent judging organization at the phone number listed on the entrant’s entry form within 48 hours of the Team Home Game or the random draw. b) Correctly answer, a time-limited, mathematical skill-testing question that will be asked by the independent judging organization over the telephone without help of any nature. c) Be eligible according to the contest rules and sign a Declaration and Release form that will be sent by mail, fax or e-mail and return it, duly completed to the contest organizers within seven (7) days of its receipt (before the shoot-out event on centre ice for the April 5th Finalist). The Declaration and Release requires potential Finalists and the Grand Prize winner to confirm, except where prohibited by law, acceptance of the prize as awarded, eligibility to participate in this contest and compliance with these rules and to release: (i) GMCL, its parent, affiliates, subsidiaries, divisions, dealers, its advertising and promotional agencies, sponsors, suppliers of prizes, materials or services related to this contest, and the independent contest organization, and all of their respective employees, directors, officers, shareholders, agents successors and assigns; and (ii) Orca Bay Sports & Entertainment, the National Hockey League (“NHL”), the NHL Member Clubs, NHL Enterprises, L.P., NHL Enterprises Canada, L.P., the NHLPA and current and former players, and each of their respective affiliates, parents, and related entities, as well as the owners, governors, officers, directors, partners, partnerships, principals, employees, agents, representatives, volunteers, sponsors, promoters, and advertisers of all the foregoing; from any liability and damages which could arise out of or are in any way related to the contest and/or from the awarding, receipt, possession and/or use or misuse of any prize and any travel related thereto. In the event that a Finalist should win the Grand Prize, an additional Grand Prize Declaration & Release form will need to be signed. 6. Failure to comply with any of the above conditions or otherwise with the rules, will result in the disqualification of the selected Finalist. If, as a result of an error relating to the entry process, drawing or any other aspect of the contest, there are more potential winners of prizes than contemplated in the contest rules, the Contest Administrators will perform a random draw amongst all eligible prize claimants after the contest closing date to award the prize 7. Upon receipt of the Declaration and Release form, the contest organizers will notify the prize winners of the manner in which he/she will have to take possession of the prize. GMCL reserves the right to determine how the presentation of the Finalist and Grand Prizes will occur and this may be either a media event, by mail, or in person. 8. By entering this contest, the Finalists and the Grand Prize winner authorize the contest organizers and their representatives to use in any related publicity, if required, his/her name, photograph, image, television appearance, any statements he/she may make regarding the prize, place of residence
and/or voice for advertising purposes worldwide in perpetuity and in any form of media including television broadcast of the shoot-out game and the Internet, without any form of compensation or further notice. 9. All entries become the property of GMCL and will not be returned to entrants at any time. No communication or correspondence will be exchanged with entrants, except with the entrants selected to win the Finalist and Grand prizes. 10. In the event that, for reasons beyond their control and not related to the winner, the contest organizers were unable to award a prize as described in these rules, they will substitute a prize of similar nature and equal or greater value or, at their sole discretion, the cash value of the prize. 11. The contest is void where prohibited by law and is subject to all Federal, Provincial and Municipal laws and regulations. Any dispute arising hereunder shall be adjudicated in the applicable court in Toronto, Ontario. 12. Entries are subject to verification by the contest organizers. GMCL, its advertising and promotional agencies, their employees, agents and representatives may not be held liable for, (i) late, lost, delayed, not received, damaged, misdirected, incomplete, stolen, fraudulent, postage due or illegible entries (all of which entries shall be automatically void and not eligible for a prize); (ii) failure to receive entries due to transmission failures, busy signals, traffic congestion on the internet or at any website or technical failures of any kind, including, without limitation, malfunctioning of any network, servers, access providers, hardware or software, whether originating with sender or recipient, or (iii) any injury or damage to entrant’s or any other person’s computer related to or resulting from participation or downloading any materials in this contest and breaches of privacy due to interference by third party computer “hackers”. GMCL (or the independent contest judging organization) reserves the right to void any entry and/or cancel or modify the contest in whole or in part (without notice to entrants individually) if, in its sole discretion, it determines that for any reason (such as tampering or infection by computer virus or any other cause beyond its control) the contest is not capable of running as originally planned, fraud, technical failures, human, printing or distribution errors, or any other causes or occurrences have compromised the administration, safety, fairness or integrity of the contest. Any person entering this contest or trying to do so by any means which go against the intention of these Rules and which would be unfair to the other participants (example: computer hacking, fraudulent use of one or several access codes or obtaining such access codes through fraudulent means, etc.) will be automatically disqualified and GMCL reserves the right to seek remedies and damages to the fullest extent permitted by law - including criminal prosecution. 13. By entering this contest, entrants accept and agree to be bound by these rules and the decisions of the contest sponsor, GMCL and the independent judging organization, which are final, binding and conclusive on all matters relative to this contest.
