Not present GENERAL SESSION The meeting was called to order by Ms. Wood, at 8:34am. Mr. Strickland gave the Invocation. Mr. Cawthon led the Pledge of Allegiance. EXECUTIVE DIRECTOR’S REPORT- Daniel Biggins Mr. Biggins requested the Board excuse absences for the following board members: • Mr. Boyette • Mr. Cathey • Mr. Lawson • Mr. Maphis (partial) Mr. Biggins informed the Board of proposed legislative changes for the upcoming legislative session. Mr. Biggins also informed the Board that a federal judge had granted an injunction against Senate Bill 76, and while that injunction is in place, the Department will not cite contractors for violations related to that Senate Bill. With nothing further to report the Board voted unanimously to approve this report. CHAIRMAN’S REPORT- Ms. Wood Ms. Wood thanked the Ad Hoc Committee for their discussion regarding the creation of a new specialty contractor’s license. With nothing further to report the Board voted unanimously to approve this report. PROSECUTING ATTORNEY’S REPORT- Ian Brown Mr. Brown provided an update on the case load of his team, and updated the Board on personnel changes within his unit. With nothing further to report the Board voted unanimously to approve this report. HEARING AND PETITIONS ALBRIGHT, GREGORY – INFORMAL HEARING Mr. Albright was present. Mr. Milne presented this case stating Mr. Albright’s application for a Certified Solar Contractor’s license was denied at the December 2020 meeting of the Board for the applicant being under investigation or prosecution in another jurisdiction for an action that would constitute a violation Department of Business & Professional Regulation Construction Industry Licensing Board Meeting Minutes July 2021 Page 11 of 18
of Chapter 489, Florida Statutes, contrary to section 455.213 (4), Florida Statutes. The Notice of Intent to Deny was filed in February of 2021. Mr. Albright timely requested an informal hearing. After discussion, the Board voted to vacate the previous denial and to approve the application. ARIAS, GREGORY – MOTION TO RECONSIDER Mr. Arias was present. Mr. Milne presented this case stating Mr. Arias’ application for a Certified Plumbing Contractor’s license was denied at the June 2020 meeting of the Board for failure to demonstrate the required experience, pursuant to section 489.111, Florida Statutes, and Rule 61G4-15.001, Florida Administrative Code. The Notice of Intent to Deny was filed in September of 2020. Mr. Arias timely requested a formal hearing but, with the permission of board counsel, requested that the file be reconsidered by the Board to obviate the need for formal administrative proceedings. After discussion, the Board voted to vacate the previous denial and to approve the application. BEST, GUY – INFORMAL HEARING Mr. Best was not present. Mr. Mile presented this case stating Mr. Lewis’s application to qualify Inline Cable Corp. as an additional business was approved at the April 2021 meeting, contingent on the applicant providing proof of 20% ownership in GN Systems, Inc., and Inline Cable Corp.,, within 30 days of the filing of the order. The Notice of Intent to Deny was filed in May of 2021. Mr. Best timely requested an informal hearing for the purpose of allowing him to withdraw the application as he no longer wish to pursue qualification of Inline Cable Corp. After discussion, the Board voted to uphold the previous contingency, resulting in a denial of the application since the application had not complied with the timeframe within which to provide proof of ownership. CRUZ SALAZAR, REINILDER – INFORMAL HEARING Mr. Cruz Salazar was not present. Mr. Milne presented this case stating Mr. Cruz Salazar’s application for a Certified Plumbing Contractor’s license was denied at the May 2021 meeting of the Board for failure to demonstrate the required experience, pursuant to section 489.111, Florida Statutes, and Rule 61G4-15.001, Florida Administrative Code. The Notice of Intent to Deny was filed in June of 2021. Mr. Cruz Salazar timely requested an informal hearing. After discussion, the Board voted to uphold the previous denial. DAMM, JOSHUA – INFORMAL HEARING Mr. Damm was present and was represented by counsel. Mr. Milne presented this case stating Mr. Damm’s application for a Certified Plumbing Contractor’s license was denied at the April 2021 meeting of the Board for failure to demonstrate the required experience, pursuant to section 489.111, Florida Statutes, and Rule 61G4-15.001, Florida Administrative Code. The Notice of Intent to Deny was filed in May of 2021. Mr. Damm timely requested an informal hearing. After discussion, the Board voted to vacate the previous denial and to approve the application. DAVIS, PATRICK – INFORMAL HEARING Mr. Davis was not present. Mr. Milne presented this case stating Mr. Davis’ application for a Certified General Contractor’s license was denied at the March 2021 meeting of the Board for failure to demonstrate the required experience, pursuant to section 489.111, Florida Statutes, and Rule 61G4-15.001, Florida Administrative Code. The Notice of Intent to Deny was filed in April of 2021. Mr. Davis timely requested an informal hearing for the purpose of allowing him to withdraw the application. After discussion, the Board voted to vacate the previous denial and to allow the applicant to withdraw the application. DUNBAR, LIONEL – INFORMAL HEARING Mr. Dunbar was present. Mr. Milne presented this case stating Mr. Dunbar’s application to qualify Excel Building & Development Corp. as an additional business entity was denied at the April 2021 meeting of the Board for failure to appear as required by Rule 61G4-15.0021, Florida Administrative Code, and for failure to demonstrate the qualifying agent would have the ability to supervise the construction work and business activities of the organization, as required by section 489.119, Florida Statutes. The Notice of Intent to Deny was filed in May of 2021. Mr. Dunbar timely requested an informal hearing. After discussion, the Board voted to vacate the previous denial and to approve the application as a change of status to move the license qualifying National Maintenance & Contracting, Inc., to the proposed business. Mr. Evans was present. Mr. Milne presented this case stating Mr. Evans’ application for a Certified Pollutant Storage Contractor’s license was denied at the April 2021 meeting of the Board for failure to demonstrate the required experience, pursuant to section 489.111, Florida Statutes, and Rule 61G4-15.001, Florida Administrative Code. The Notice of Intent to Deny was filed in May of 2021. Mr. Evans timely requested an informal hearing. After discussion, the Board voted to uphold the previous denial. LONG, KYLE – INFORMAL HEARING Mr. Long was present. Mr. Milne presented this case stating Mr. Long’s application for a Certified General Contractor’s license was denied at the February 2021 meeting of the Board for failure to demonstrate the required experience, pursuant to section 489.111, Florida Statutes, and Rule 61G4-15.001, Florida Administrative Code. The Notice of Intent to Deny was filed in March of 2021. Mr. Evans timely requested an informal hearing. After discussion, the Board voted to vacate the previous denial and to approve the application. MANNING, WILLIAM – PETITION TO MODIFY FINAL ORDER Mr. Manning was present with counsel. Mr. Milne presented this case stating that as a result of a disciplinary case, both of the petitioners licenses (CBC1252962 & CCC1325922) were revoked in June of 2018, with fines and costs being imposed. The petitioner, through counsel, filed a motion to reconsider the case in September of 2018. The petition was heard at the November 2018 meeting of the Board, resulted in the Board passing a motion to reinstate both of the petitioner’s licenses with the condition that the petitioner serves probation for a period of ten years. The petitioner, through counsel, then filed a petition for termination or modification of probation in June of 2020. The petition was heard at the September 2020 meeting of the Board, resulting in the Board passing a motion to reduce the amount of probation to be served from ten years to four years. In March of 2021 Mr. Manning, through counsel, filed a second petition for termination or modification of probation. After discussion, the Board voted to grant the petition, terminating the probation for the petitioner. MONTANA, JUAN – INFORMAL HEARING Mr. Montana was present with counsel. Mr. Milne presented this case stating that Montana’s application to qualify Zankey Development Corp. was denied at the April 2021 meeting of the Board for failure to demonstrate the qualifying agent would have the ability to supervise the construction work and business activities of the organization, as required by section 489.119, Florida Statutes. The Notice of Intent to Deny was filed in May of 2021. Mr. Montana timely requested an informal hearing. After discussion, the Board voted to vacate the previous denial and to approve the application. PIEDRA, ORESTES – PETITION FOR DECLARATORY STATEMENT Mr. Piedra was present and was represented by counsel. Mr. Milne presented this case stating Orestes Piedra filed a petition for a declaratory statement on April 21, 2021. The petition was noticed in the Florida Administrative Register on April 29, 2021. Mr. Milne noted the petitioner is seeking a determination relating to the phrase “demolish” as used in subsection 489.105 (3)(c), Florida Statutes, and whether or not he, as a licensed contractor, can subcontract demolition work to an unlicensed contractor. After discussion the Board voted unanimously that the petitioner had standing. After further discussion, the petitioner withdrew his petition. PRINCE, VINCENT – INFORMAL HEARING Mr. Prince was present. Mr. Milne presented this case stating Mr. Prince’s application for a Certified General Contractor was approved at the May 2020 meeting of the Board, with the condition that the applicant provide written proof that all pending IRS liens against LandAmerica Holdings & Investments Group, LLC be satisfied within 180 days from the date of the filing order. The Notice of Intent to Approve with Conditions was filed in June of 2020. Mr. Prince timely requested an informal hearing, which was heard by the Board at the June 2021 meeting of the Board. At that hearing, the Board voted unanimously to approve the application with the same conditions and to give the applicant an additional 180 days to provide the requested documentation. Mr. Prince then requested a hearing to appear before the Board at the July 2021 meeting to review the previously provided documentation to determine if that was sufficient for compliance. After reviewing the documentation, the Board voted unanimously to remove the previously imposed conditions and to approve the application RODRIGUEZ, AXI – PETITION FOR VARIANCE AND WAIVER Ms. Rodriguez was present. Mr. Milne presented this case stating Ms. Rodriguez filed a petition for variance and waiver on May 24, 2021. The petition was noticed in the Florida Administrative Register on June 3rd, 2021. Mr. Milne noted the petitioner is seeking a variance or waiver of Rule 61G4-16.005, Florida Administrative Code, that states for the purpose of certification a passing grade on the examination shall be valid only for a period of four (4) years from the date of the most recently passed portion of the exam. After discussion, the Board voted to grant the petition for the duration of time it would take to process the existing application. SANDERS, WALTER – INFORMAL HEARING Continued 30 days. TELLEZ, LEXTER – INFORMAL HEARING Mr. Tellez was present. Mr. Milne presented this case stating Mr. Tellez’ application for a change of status of his Certified Plumbing Contractor’s license was denied at the March 2021 meeting of the Board for failure to report convictions and pleas of criminal offenses to the Board, pursuant to section 455.227 (1)(t), Florida Statutes. The Notice of Intent to Deny was filed in June of 2021. Mr. Tellez timely requested an informal hearing. After discussion the Board voted to vacate the previous denial and to approve the application. • Effective 05/11/2021 Mr. Milne informed the Board that he would be submitting the Annual Regulatory Plan in the coming months, and requested that the Board allow him to include the anticipated rule regarding the exterior finishes specialty license rule in the report. After discussion, the Board unanimously passed a motion to give Mr. Milne the authority to include the anticipated rule in the Annual Regulatory Plan. Mr. Cawthon indicated that the Ad Hoc Committee would continue to convene in the coming months to further define the scope of work of the license and to further determine the exam and experience requirements. OLD BUSINESS Removal of Board materials from laptops. NEW BUSINESS Mr. Cawthon discussed his concerns with the lack of appointments to the Board. Mr. Biggins indicated that the Department would continue to do everything it could to make sure that appointments to the Board would be considered.
