Krakora, Public Defender Jennifer Sellitti, Director of Training 2018 TRAINING EVENTS GUIDE January-June The training team is pleased to announce our Training Events Guide for January to June, 2018. The Guide is offered to let attorneys know what trainings are coming so you can manage your calendars to reserve time for events that are most important or interesting to you. For managers, the Guide is a tool that you can use to direct attorneys to specific trainings, incorporate training recommendations into PAR evaluations, or designate attorneys to attend trainings and bring the information back to share with others. Programs in the boxes are featured trainings that involve special guest speakers or events that we expect will be in high demand. We have made every attempt to offer a mix of trial advocacy, forensic and substantive legal training. The Guide notes in bold when attendance is mandatory for certain attorneys. Unless otherwise noted, the program will last the entire day. Exact times will be published when the announcement goes out. You may not register until there is a formal announcement. Please note that while we have endeavored to create a calendar that represents everything that will be offered from now through June, programs will be added and revised as needed. The Guide is by no means exhaustive. All programs are subject to change. The calendar through December will be published in the Spring.
Welcome to Management! Hughes Justice Complex, OPD Library January 10-11, 2018 10:00-4:00 This two-day program is designed to help new managers navigate common issues. We will cover human resources, working with courts and prosecutors’ offices as well as working to ensure that the agency’s goals are being fulfilled at the regional level. This is a small program limited to those who manage other employees. Registration is limited. Client-Centered Ethics Hughes Justice Complex, OPD Library January 23, 2018 10:00-4:00 In this program, we will focus on the ethics of client-centered representation. We will discuss client interviewing, ethical challenges arising information gained in client interviews, and recurring scenarios in our practice. We will also review the RPCs that govern our communication and relationships with clients. Immigration Update Hughes Justice Complex, 4th Floor January 31, 2018 10:00-12:30 Join us for a review of immigration law and its impact on our cases and clients. We will explore immigration consequences of plea bargains, how immigration has changed in the past year, and the impact of criminal justice reform. Immigration Workgroup Meeting Hughes Justice Complex, 4th Floor January 31, 2018 1:30-3:30 The afternoon is reserved for the first meeting of the Immigration Workgroup. Forensic Science Workgroup Meeting Hughes Justice Complex, OPD Library February 1, 2018 10:00 – 4:00 This meeting of the FSW will feature work group updates, discussion of next steps as well as a program of guest speakers. Our featured speaker will be Professor Jules Epstein, Visiting Professor of Law and Director of Advocacy Programs and Clinical Legal Education at Temple University’s Beasly School of Law. Professor Epstein served as the Commissioner of the National Commission on Forensic Sciences until the Commission was disbanded by Attorney General Jeff Sessions. He has served on forensic science committees for the American Bar Association, the National Institute of Standards in Technology, and the National Institute of Justice, to name a few. This program is open only to members of the Forensic Science Workgroup. 1
Cross-Examination for Mental Health Lawyers Hughes Justice Complex, OPD Library February 2 & 9, 2018 10:00 – 4:00 This two-day program provides mental health lawyers with an in-depth exploration of cross-examination. Using hypothetical cases, participants will learn about storytelling through cross, chaptering, impeachment, and crossing experts. We will focus on telling the client’s story through the state’s witnesses and experts. The program will consist of two days spaced one week apart. Open to mental health attorneys only. Miller (Zuber and Comer) Time Hughes Justice Complex, 4th Floor February 22, 2018 10:00-4:00 This program is geared towards those attorneys who are representing clients at Miller resentencing hearings. We will explore the science of adolescent brain development and the Miller case law as well as how to create more persuasive written and oral sentencing motions. Although this event is aimed at attorneys who have Miller cases, it is for any lawyer who wants to improve their sentencing advocacy or better understand young adult clients. Open to all attorneys. Black History Month Celebration Hughes Justice Complex, OPD Library February 28, 2018 12:00 – 2:00 Join us for our annual celebration of the contributions African Americans have made to our clients, our community, and our country. Special guest speaker to be announced. Advanced Cross for Pool Attorneys, Part 1 Hughes Justice Complex, OPD Library March 1, 2018 9:30 – 4:30 (Part 2-March 15, 2018) This program is the first in a series of training programs geared specifically for pool attorneys. Adapted from our in-house Advanced Cross program, which is typically two days in a row, this training is divided into two parts that will be held within weeks to offer more flexibility for pool lawyers who wish to attend. Attorneys must commit to both days of the training to be admitted. Part 1 will focus on the chapter method and storytelling through cross, and part 2 will focus on impeachment and crossing expert witnesses. Management Training for Support Staff Hughes Justice Complex, OPD Library March 8-9, 2018 This two-day program is designed to help managers who supervise support staff navigate common issues. We will cover human resources, working with attorneys, investigators and the public as well as working to ensure that the agency’s goals are being fulfilled at the regional level. This is a small program limited to those who manage support staff teams. Registration is limited. 2
Drug Court Training Hughes Justice Complex, OPD Library March 14, 2018 This training will bring together drug court attorneys to discuss best practices. We will review utilization of experts, expungements, case law, the AOC timeline for processing applications and appeals. This program is mandatory for all drug court attorneys. Advanced Cross for Pool Attorneys, Part 2 Hughes Justice Complex, OPD Library March 15, 2018 9:30 – 4:30 (Part 1 March 1, 2018) Day 2 of the Advanced Cross for Pool Attorneys will focus on impeachment and expert witnesses. Office of Law Guardian (OLG) – Representing the Non-Verbal Child, Part 1 Hughes Justice Complex, 4th Floor March 21, 2018 This program is for Law Guardian attorneys. Psychologist to train Law Guardian attorneys on areas of interest in our field relating to our clients: developmental milestones and red flags, attachment and bonding, social and emotional development, trauma, abuse and neglect. OLG – Representing the Non-Verbal Child, Part 2 Hughes Justice Complex, 4th Floor March 23, 2018 A step-by-step guide to developing a position on behalf of the non-verbal client at every stage of the proceedings. This training will include a discussion of the new Law Guardian guiding principles, the tools needed to make decisions on behalf of our clients. This program is designed to follow the Day 1 psychologist training. 3
Race and the Justice System Forensic Science Center, Hamilton, NJ March 27-29, 2018 This three-day program is designed to allow thoughtful consideration of the role that race plays in the justice system. On March 27th (from left) Jeff Robinson, Deputy Legal Director and the Director of the ACLU Trone Center for Justice and Equality, will return to New Jersey to repeat his powerful presentation on Race in America. March 28 will be devoted to a full day discussion on the criminal justice system featuring guest speakers Rashaan Hall, Director of the ACLU of Massachusetts’ Racial Justice Program (center) and Marc Mauer, Executive Director of the Sentencing Project (right), and more. March 29 will be devoted to the role race plays in child welfare law with speakers to be announced. This program is designed to expand upon last year’s event and to address how we challenge systemic racial bias while representing one client at a time. March 27 will be open to those attorneys who did not have the opportunity to attend last year before being opened to the rest of the agency. March 28 and 29 will be open to criminal and child welfare attorneys respectively on a first come first served basis. Train the Trainers Hughes Justice Complex, OPD Library April 3, 2018 This program is for lawyers who are or would like to be a part of our training program. It is designed to give trainers the skills they need to run small group sessions and offer critiques to participants. The program is mandatory for those trainers who will participate in the Spring Training Program but additional spots will be made available for those interested future trainings. Law Guardian Train the Trainers Hughes Justice Complex, OPD Library April 5, 2018 This program is for law guardian attorneys who are interested in developing their skills as trainers, with an emphasis on training in small groups. This by-invitation program is mandatory for those trainers who will participate in OLG’s BYOC trainings. 4
Spring Training Trial Skills Program Hughes Justice Complex, 4th Floor April 9-13, 2018 Join us for New Jersey’s first large-scale, week-long trial advocacy program. This program will bring together more than 70 lawyers for a hands-on, small group based trial advocacy training. It features nationally-renown speakers on trial advocacy including (from left): Aisha McWeay, Mary Moriarty, Sam Dennis, Deja Vishny and more who will lecture and lead small group breakout exercises. Attendance is mandatory for our new lawyer class of 2017 (those who started on or after September of 2017.) Additional spots will be offered as available. Office of Parental Representation (OPR) Appellate Training Hughes Justice Complex, 4th Floor April 18, 2018 This program will focus on appellate advocacy for OPR clients, including but not limited to written and oral advocacy. We will discuss rule changes and protocols for designated counsel. Training will cover how to effectively advance legal theories with a workshop on persuasive writing. A case law update will also be presented. This program is mandatory for all active OPR-Appellate pool and staff attorneys. OLG Essential Skills Days 3&4 Hughes Justice Complex, OPD Library April 18-19, 2018 10:00 – 4:00 This training program reviews the essential skills involved in advocating for child-clients. The updated program is MANDATORY for attorneys who have been practicing for less than five years with the agency. Any attorney working in OLG who has not attended this valuable training is also encouraged to attend. Megan’s Law Update North April 25, 2018 – 2:00-4:00 Essex Training Center, Newark Join Special Hearings Unit Deputy Fletcher Duddy for a lunchtime recap of case law, developments and ongoing legal issues in Megan’s Law. Open to all attorneys working in our northern regions. 5
Forensics Hughes Justice Complex, 4th Floor May 1, 2018 Our May 1 date is reserved for emerging issues in forensic science. Join us as outside speakers as well as members of our Forensic Science Workgroup present on the most pressing forensic issues in our cases. Megan’s Law Update Central May 8, 2018, 2:00 – 4:00 Hughes Justice Complex, OPD Library Join Fletcher Duddy for a lunchtime recap of case law, developments and ongoing legal issues in Megan’s Law. Open to all attorneys working in our central regions. OLG BYOC Hughes Justice Complex, Library May 9-10, 2018 This BYOC program can help is designed for pool attorneys who want help, ideas, or just some dedicated time to work on a case that is going to trial. Participants will bring their own cases and work in small groups to develop a theme and theory and advocacy plan. The format is some lecture but mostly work in breakout groups. Megan’s Law Update South May 15, 2018, 2:00 – 4:00 Mental Health Conference Room, Gibbsboro Join Fletcher Duddy for a lunchtime recap of case law, developments and ongoing legal issues in Megan’s Law. Open to all attorneys working in our southern regions. Investigative Training Hughes Justice Complex, 4th Floor May 16, 2018 Join us for a comprehensive training on issues facing our investigators at the office and in the field. Speakers and agenda to be announced. Civil Rights in Mental Health Law Hughes Justice Complex, OPD Library May 18, 2018 10:00 – 4:00 Join us for a discussion on bringing civil rights challenges on behalf of our mental health clients. This program will feature special guest speakers who will discuss the civil rights of mental health clients and how our office can be more proactive in filing them. Open to mental health attorneys only. 6
OLG Motion Hearings Gibbsboro, NJ 10:30 – 4:00 May 21, 2018 Please join us for this informative training on the "Nuts & Bolts of Motion Practice.” Training will focus on motions applicable to Law Guardian practice and attorneys will leave with a sample packet of motions to utilize in their practice. Bring Your Own Case (BYOC) for Pool Attorneys Hughes Justice Complex, OPD Library May 22-23, 2018 Have a case that keeps you up at night? This BYOC program can help. This training is designed for pool attorneys who want help, ideas, or just some dedicated time to work on a case that is going to trial. Participants will bring their own cases and work in small groups to develop a theme and theory, opening statement, and cross-examination of a main witness. The format is some lecture but mostly work in breakout groups. Pool attorneys will be allowed to bill for the time spent working on their case during the training. Billing details to follow at registration. Bring us your worst case, your most complicated case, or just your next case to go to trial! Intern Orientation Hughes Justice Complex, OPD Library May 31, 2018 At this training we will welcome our summer interns. Together we will review roles and responsibilities in the agency, ethics, and expectations for their time with us. Professionalism Training Hughes Justice Complex, OPD Library June 6, 2018 Join us for an exploration of ethics issues in the legal profession. The program will combine lecture and breakout groups where we review and discuss ethics rules, case law, and real-world scenarios. Open to all attorneys. Direct Examination for Mental Health Lawyers Hughes Justice Complex, OPD Library June 15, 2018 10:00 – 4:00 Telling our client’s story is a challenge particularly when doing so by using expert witnesses and appearing before the same judge time and time again. Join us for a program focused on direct examination for mental health lawyers. We will discuss discovering the client’s story, bringing it out on direct through the client and telling it through the expert’s testimony. Open to mental health lawyers only. BYOC Class of 2016 Hughes Justice Complex, OPD Library June 19-21, 2018 In this program for those attorneys who joined the office between September of 2016 and September of 2017, participants will bring their own cases and work in small groups to develop a theme and theory, opening statement, and cross-examination of a main witness for a case that this currently scheduled for trial. The format is some lecture but mostly work in breakout groups. This BYOC is MANDATORY for criminal attorneys in the class of 2016. Remaining spots will be assigned by invitation only.
