Best, Jim April 29, 2020: COVID-19 Municipal Update Pelosi Calls for $500 Billion in State Funding; McConnell Open to Deal Negotiations are continuing this week on Capitol Hill for a “CARES 2.0” coronavirus stimulus package. Throughout negotiations, funding for state and local governments has emerged as a key point of contention between Republicans and Democrats. 1
House Speaker Nancy Pelosi (D‐CA), on a Tuesday conference call with reporters, said House Democrats were looking to include at least $500 billion in funding for states, plus additional money for county and municipal governments in the next relief package. Late last week, Pelosi made it clear funding for state and local governments was at the top of her priority list, telling reporters, “There will not be a bill without state and local,” and the final number would be, “probably a number equivalent to what we have done for small businesses.” Such an amount would be closer to $700 billion. The $500 billion number floated by Pelosi for states is also identical to a bipartisan bill introduced by Sen. Bill Cassidy (R‐ LA) last week to provide aid to states, counties, and local governments. Senate Majority Leader Mitch McConnell (R‐KY), who indicated last week that he had no plans to provide additional funding to states and local governments, has changed course and signaled this week he is open to a deal. In return for state and local government funding, McConnell wants a provision included in any package that limits the liabilities of health care workers, business owners and employees from lawsuits as they reopen in the coming weeks and months. The Facility, which was announced on April 9 as part of an initiative to provide up to $2.3 trillion in loans to support U.S. households, businesses, and communities, will offer up to $500 billion in lending to states and municipalities to help manage cash flow stresses caused by the coronavirus pandemic. National Association of Counties Call with Treasury Department On Tuesday, April 28th, the National Association of Counties held a call with the Treasury Department to answer questions related the Coronavirus Relief Fund, the portion of the CARES Act that allocated money to state governments and municipal governments with populations above 500,000. The following is a condensed readout of the call. Coronavirus Relief Fund Guidance Goal: To provide counties with a framework for thinking about whether an expenditure is an appropriate use of funds. Wanted guidance to be general rather than specific and aimed to make sure money can be used on eligible first and second order expenses due to pandemic. o An example of second order use includes providing incentives or economic support to businesses that may have needed to close because of orders issued by local government. Treasury anticipates issuing additional FAQs to address issues and questions that arise over coming weeks, so keep an eye out. Question and Answer Summary o How does CARES Act funding interact with other federal funding, say under FEMA/Stafford Act? Can CARES Act money cover FEMA cost share? Treasury has intentionally remained silent on whether FEMA cost share is covered. CRF money may be more flexible than some other programs, but keep in mind it also has a requirement that funds need to be expended by the end of the calendar year, so for a long term project, non‐ CARES money may be a better fit. o Is there additional guidance on how local governments can subgrant money to small businesses? Guidance allows for second order effects to be included and one thing they were thinking was if state/county wanted to provide something akin to PPP/wage support for private employers and perhaps non‐profits. You would need to draw a direct line from beneficiary to COVID‐19 outbreak for expense to be eligible. o Can CARES money be used to pay public workers? 2
Not necessarily. Intent was not to provide wage replacement for public sector, as that would essentially be a revenue replacement. However, may be able to justify such use if the employee(s) is doing a job significantly different than what was budgeted for, ex: a parks worker being reassigned to a public safety role due to COVID. Training and education for furloughed public workers is also likely allowable in right circumstances. o Would interest on a tax anticipation note be an eligible expense? Treasury has not opined on that, but you could argue it’s an unanticipated expense and not revenue loss. It is something that should be addressed more formally in FAQ. o Can counties share with municipal governments within jurisdiction that don’t have a population above 500,000? Non‐profit organizations? Treasury is still discussing. The entity that receives the money directly from Treasury is responsible for appropriate use of funds by other entities. o Do funds need to be spent before December 2020? Can an entity obligate funds for a contract before that date but pay a vendor later? No. Statute indicates funds must be expended by end of year. Cash must be out the door by end of year. o Would programs supporting late/missed rent, mortgage, or utility bills be allowed? Possibly, but have to be careful that utility relief isn’t used as a way to reimburse lost revenue to publicly controlled utility entities. Other types of support may be easier, but as stated before, you need to make sure there is a direct connection to COVID and not just a generalized economic slowdown. o Can CRF payments be used for capital improvement costs? Depends on circumstances; some capital expenditures that are necessary in order to promote /preserve health would be, but if it looks like a county is just taking care of deferred maintenance, that might be questioned on audit. o What date do counties need to submit list of projects to Treasury? Counties do not have to submit a list to Treasury for approval. Keep your receipts but don’t need to ask permission. Best, Jim April 27, 2020: COVID-19 Municipal Update Outlook on Potential Fifth Coronavirus Stimulus Package Congress and the Administration have already passed four coronavirus stimulus packages to combat COVID‐19 and to prop up the economy. Now attention shifts to a potential fifth stimulus package to address concerns that were not included, or not enough funding was included, in the previous four. While Democrats believe a fifth stimulus is needed, Republicans, along with Senate Majority Leader Mitch McConnell (R‐KY) have indicated they want to take a pause on more stimulus packages and deficit spending. While Congress begins discussions, here are several topics that could be included: Several provisions have been circulated around that could be potentially included in the next stimulus. Of these provisions first is additional funding to state and local governments. In previous stimulus packages, local governments around the county with a population below 500,000 were excluded from direct funding. Democrats, as a result, are 1
adamant that securing state and local money is one of their top priorities for the next bill. However, Senate Majority Leader McConnell previously indicated that he would support allowing states to declare bankruptcy as they face huge budget holes sparked by the economic impact of the coronavirus. Second, Members of Congress have indicated their needs to changes to small business aid. While the Treasury Department has specified the nearly $660 billion already provided for the Paycheck Protection Program (PPP) will be the last tranche of money, lawmakers have proposed including new strings for additional funding that would tighten who can get help after reports that large chain restaurants were able to qualify for tens of millions of dollars in loans. Another provision that has been mentioned in the same breath as a fifth stimulus is voting in upcoming elections. Democrats are pushing to include funding in the future stimulus that would ensure states have enough funding to carry out elections by mail. Republicans so far have resisted, arguing it would be vulnerable to fraud. Furthermore, Democrats also want to include a boost in food assistance. Specifically, in the interim coronavirus stimulus (the one most recently passed), Democrats wanted a 15 percent increase in Supplemental Nutrition Assistance Program (SNAP) benefits – Republicans, however, objected. Now, Senate Democrats have introduced their own proposal to increase the baseline for SNAP benefits by 30 percent and expand benefits to individuals living in U.S. territories. Lastly, infrastructure. President Trump, along with Treasury Secretary Mnuchin have been vocal in their want for infrastructure to be included in a coronavirus stimulus. Additionally, there is bipartisan support for such a package, as Speaker of the House Nancy Pelosi agreed on the need for infrastructure. However, with questions as how an infrastructure package could be paid for, discussions have stalled. Currently, the Senate and House are both on recess. The Senate is slated to return on May 4. The House has not indicated when it will return, though House Democrats indicated it will not be before May 4. Read More: The Hill Paycheck Protection Program Restarted Today In a joint statement from the Small Business Administration (SBA) and Treasury Department the Paycheck Protection Program (PPP), which was replenished with an additional $320 billion from Congress over the weekend, resumed accepting applications this morning at 10:30 a.m. EST. Many small business owners were shut out from financial aid after the initial program, launched April 3 with an initial $349 billion, was exhausted by April 16. Congress passed a relief bill that President Donald Trump signed Friday with more funding for the program and a separate disaster loan and grant initiative whose funding also expired last week. Read More: CBS News Federal Reserve Board Announces Expansion of the Municipal Liquidity Facility The Federal Reserve Board announced today of an expansion of the scope and duration of the Municipal Liquidity Facility (MLF). The facility, which was announced on April 9 as part of an initiative to provide up to $2.3 trillion in loans to support U.S. households, businesses, and communities, will offer up to $500 billion in lending to states and municipalities to help manage cash flow stresses caused by the coronavirus pandemic. “The facility, as revised, will purchase up to $500 billion of short‐term notes issued by U.S. states (including the District of Columbia), U.S. counties with a population of at least 500,000 residents, and U.S. cities with a population of at least 250,000 residents. The new population thresholds allow substantially more entities to borrow directly from the MLF than the initial plan announced on April 9. The facility continues to provide for states, cities, and counties to use the proceeds of notes purchased by the MLF to purchase similar notes issued by, or otherwise to assist, other political subdivisions and governmental entities. The expansion announced today also allows participation in the facility by certain multistate entities.” 2

FROM: ANTHONY, JASON AND PAUL GONSALVES SUBJECT: COVID-19 UPDATE: POSSIBLE RETURN OF THE LEGISLATURE DATE: MONDAY, APRIL 27, 2020 Last week, Governor Newsom announced the opening of new testing facilities and the receipt of new testing supplies. The Governor has a goal of eventually being able to test 80,000 Californians per day. As of this week, they are hoping to hit the 25,000 test per day mark by the end of April. The Governor continues to give no indicator of when the stay at home order will be lifted and insists that the decision has to be based on science and data. As you know, the Legislature has been in recess for nearly six weeks. Usually by this time of year the Legislature is dominating political headlines by conducting multiple hearings a day for thousands of bills and at the same time working through adoption of the state budget. For the past six weeks, however, all eyes have been on the Governor. With tens of thousands of people tuning in to watch his press conferences live every day, and more catching him in other media outlets later, Governor Newsom has had a constant presence in the public eye. At the same time, the Governor’s nearly unlimited power under the California Emergency Services Act has left the Governor no need to consult with the Legislature during the crisis. The Act allows the Governor to suspend virtually any law or regulation he chooses during a state of emergency. Facing a statewide crisis, the Governor has wielded this power to shutter businesses, alter court proceedings, suspend evictions, make it easier to qualify for social safety net programs, alter employment law, and make many other changes. He has, for
example, used his authority to bend scope of practice rules which stipulate the types of care medical professionals can provide based on their licensing and education. Usually, even minor proposed changes to scope of practice go nowhere in the Legislature and result in years of fighting. While Governor Newsom continues to get high marks from experts and the public, legislators are beginning to bristle at having to live in his shadow. Some legislators have complained that the Governor and his staff are not responsive to questions about resource deliveries and state services in their districts. Others have noted that they receive virtually no warning from the Governor about new Executive Orders, only learning about them minutes before they are released to the public. By far the most serious complaints of legislators revolve around the Governor’s choice to execute a contract for $1.4 billion worth of personal protective equipment. This enormous contract has been negotiated without consultation with the Legislature. It also includes an agreement to purchase supplies from BYD, a Chinese owned company with a record of providing faulty equipment. The same week that the Governor announced this deal on national television, the Assembly and Senate scheduled budget oversight hearings on the Administration’s efforts to combat COVID-19. While legislators were careful to compliment the Governor on his handling of the crisis, there was also bipartisan criticism on issues related to distribution of supplies and resources, and on his contract for PPE. The growing tension may also be driving the desire of the Legislature to get back into the fray. Members in both the Assembly and Senate have amended several bills to address aspects of the COVID-19 crisis. In some cases, these bills address issues already resolved in Executive Orders, indicating that some legislators may want to revisit the Governor’s work. Originally scheduled to return on April 13, the Legislature opted to delay until May 4 for public health reasons. Based on what we have heard, the Assembly intends to return sooner rather than later and have directed their staff to prepare for their return on May 4. The Senate seems more reluctant to get ahead of state and county shelter in place orders. It is possible that the two houses will compromise and return later than May 4, but still ahead of June. Regardless of their return date, we expect an expedited and, frankly, rushed process for vetting bills that allows limited opportunity for public input. The Legislature’s track record on laws enacted with limited review and limited public input is questionable at best. It is possible each house will give itself as little as a month to hear bills in policy committee, fiscal committee, and on their respective floors before turning them over to the other house for consideration. Given that none of this has been announced publicly, the details are likely to change in the coming days and weeks. Before making this decision, legislative
leadership must carefully weigh public reaction to their return, frustration with a limited public process, and the moral and possibly legal liability associated with calling their staff and stakeholders back into the Capitol despite public orders to socially distance and shelter in place. At this time, we are told the Legislature plans to convene their floor sessions and hearings at the Memorial Auditorium in Sacramento in order to provide for appropriate distancing. In addition, they are working on a plan(s) for the public to be able to provide remote audio and/or video testimony, but again those details are yet to be finalized as many Members have expressed their concerns about returning too early (for example 40 Assemblymembers signed onto a letter to the Speaker urging him to allow for remote voting). We will keep you apprised of further developments.

As Sustainability Division Manager for the City, I oversee our waste, recycling and organics programs and share your concerns over contamination of recycling containers and environmental pollution caused by waste. There are several actions that we are taking to address these issues. The City will be issuing a Request For Proposals (RFP) for waste services in the City this summer. When the new contract takes e ect on January 1, 2022, many of the changes that you are looking for will be implemented. For example, we will have standardized bin colors (blue for recycling, black/grey for trash and green/yellow for organics). There will also be standardized labelling showing what goes in which bin. In addition, the hauler will be required to monitor bin contamination and issue notices to customers. The City has already standardized its own bin labelling for public containers, and will be deploying additional recycling containers with labelling at all bus stops. You mention use of a particular label, produced by Recycle Across America. We have reviewed and evaluated many di erent labels for each of our 3 types of bin. One of the challenges is that the recycling centers (or MRFs) and composting operations have unique processing abilities depending on their operations and equipment. This means that what’s recyclable at one facility may not be at another. Thus we work directly with our haulers to develop signage that is appropriate for the facilities where our community’s materials are taken. This has been a County-wide e ort, and hopefully we can standardize that signage at least within our region. I very much appreciate your desire to improve recycling. However, what you might not know is that 94% of American voters support recycling, and 74% believe it should be a national priority (PIRG 2019). Also, voters are extremely concerned about the 48,000,000 pounds of waste going into oceans each day. Recent reports state that the amount of waste going into oceans has increased by 27% since the onset of the global recycling collapse (Reuters Oct 2019). I am one of those voters. THE ASK: Please begin displaying the standardized labels on the recycling bins in your jurisdiction. Please support legislation which includes the society-wide standardized label solution for recycling bins to help everyone be able to recycle properly. Let’s follow the example of earlier leaders who voted to standardize road signs, nutritional labels, etc. – simple solutions that eliminate public confusion and allow all of us to act on our good intentions. HERE’S THE PROBLEM: The economics and demand for recyclable materials suffer due to the millions of tons of garbage being thrown in recycling bins. It is
solely because of that contamination that China and other countries banned the purchase of U.S. recyclables. This costly contamination stems directly from the hundreds of thousands of inconsistent labels displayed on recycling bins throughout the U.S., which cause public confusion, apathy, and skepticism about recycling. HERE’S THE PROVEN SOLUTION: To fix this, the nonprofit organization Recycle Across America, created the first and only society-wide standardized labels for recycling bins in 2010 to help people be able to recycle properly wherever they are. There are now more than nine million standardized labels displayed on recycling bins throughout the country, including on bins in thousands of federal, state, and municipal locations, businesses, schools, airports, sports stadiums, industrial facilities, and households. The standardized labels for recycling bins consistently prove to increase recycling levels 50-400% and reduce contamination significantly; in many cases, entirely. The more the labels are seen on bins throughout society, the more the efficacy and economics of recycling will thrive for municipalities, taxpayers, recycling markets and processors, and manufacturers who need these materials to reuse.
