Landlords aware - Top 8 changes coming in 2021 INTRODUCTION Over the course of recent years landlords have had to cope with ever increasing legislation and the challenge to remain compliant becomes ever more demanding. In the current climate now more than ever it is important to be aware of all the rapidly changing legislation. The Coronavirus Act 2020 introduced many restraints on landlords with one of the most significant being that a tenant was entitled to six months notice rather than two if the landlord was looking to seek possession of their property. The report should be given to your tenant within 28 days of completion for existing tenants and prior to all new tenancies from 1st April. It lasts for five years. Be aware that if you have an existing EICR that recommended the next inspection to take place after 10 years this will not be valid. This has been amended to every five years. Local authorities have the power to impose fines of £30,000 for non-adherence. 5
Landlords aware - Top 8 changes coming in 2021 MAY 2021 The Debt Respite Scheme (Breathing Space Moratorium and Mental Health Crisis Moratorium) (England & Wales) Regulation 2020 comes in to force from 4th May. This will give those in debt such as tenants with rent arrears temporary respite from being chased for payment. The impact on landlords is that if they are notified of a Moratorium Debt through a regulated debt advisor it will not be possible to seek possession of the property by issuing a Section 21 or Section 8 notice on the grounds of rental arrears. All charges, fees and interest must be frozen for the duration of the Moratorium which is 60 days. 6
