SALE OF PROPERTY BY PUBLIC TENDER INTRODUCTION A tax sale is the sale of one or more properties by a municipality to recover unpaid property taxes on those properties. The sale is conducted in accordance with the Municipal Act, 2001 and the Municipal Tax Sales Act https://www.ontario.ca/laws/statute/90m60 When you buy a property at a tax sale, you take it “AS IS”. There are no warranties of any kind. SALE OF PROPERTY BY PUBLIC TENDER GENERAL GUIDELINES As per the Municipal Tax Sales Act: • The municipality makes no representation regarding the title or any other matter relating to the property to be sold. Responsibility for ascertaining these matters rests solely with the potential purchaser. • You do not have a right to enter onto a property that is being sold at tax sale. The person who owns the property is not obligated to allow people to inspect the house or the property. • This sale is governed by the Municipal Act, 2001 and the Municipal Tax Sales Rules made under the Act. The successful purchaser will be required to pay the amount tendered plus any further accumulated taxes and the relevant land transfer tax . • The municipality has no obligation to provide vacant possession to the successful purchaser. FAQ’S – PROPERTY SPECIFIC In an effort to assist potential buyers in determining their level of interest, property specific information is provided herein based on frequently asked questions from previous tax sale properties. TENDER SUBMISSION REQUIREMENTS Tenders shall be: Submitted on Form 7 (seven) “Tender to Purchase” as provided in tender package; Typewritten or legibly handwritten in ink; any changes initialed Accompanied by a deposit of at least twenty percent (20%) of the tender amount, by way of money order or by way of bank draft or certified cheque by a bank or authorized foreign bank within the meaning of section 2 of the Bank Act (Canada), a trust corporation registered under the Loan and Trust Corporations Act or a credit union within the meaning of the Credit Unions and Caisses Populaires Act, 1994. Submitted in a sealed envelope that indicates on it that it is a tax sale and provides a short description or municipal address of the land sufficient to permit the treasurer or his/her designate to identify the parcel of land to which the tender relates (A label is provided in this tender package. Please tape or glue or otherwise affix to the outside of your return envelope for clear identification of contents to reduce risk of misdirection)
SALE OF PROPERTY BY PUBLIC TENDER PROCEDURE FOR SUBMITTING A TENDER All tenders must be submitted to the attention of Janet Powers, Mgr. of Purchasing & Risk Services/Deputy Clerk on or before May 6, 2021 at 3:00:00 p.m. local time and received at: City of Quinte West Municipal Office PO Box 490 7 Creswell Drive Trenton, ON K8V 5R6 PLEASE BE AWARE OF AND ALLOW EXTRA TIME IN CONSIDERATION OF COVID RESTRICTIONS AS THEY RELATE TO ACCESS TO THE MUNICIPAL OFFICE AND POSSIBLE LINE UPS. • Physical distancing and masks are required inside and outside of the building. • At this time, a maximum of three (3) members of the public are permitted inside city hall at any given time, there may be line ups. • Upon arrival, phone 613-392-2841 to announce your arrival and when available, a Customer Service Representative (CSR) will meet you at the door to receive your envelope. The city “received” stamp will be applied, the time noted, and the initial of the CSR receiving your envelope applied. • For your records and to provide proof of delivery if required, please take a photograph of the face of your envelope that captures your name, the Roll # of the property being sold, Description of Property and markings of the CSR as to time and date of delivery. If you have no phone camera, please ask for a photo copy.
SALE OF PROPERTY BY PUBLIC TENDER • In the event of a dispute over delivery details, the city records will prevail unless the bidder can provide evidence to the contrary in the manner as described above. • The City assumes no responsibility or liability for any cost incurred by the respondent in the preparation or submission of tenders. • The City shall not be responsible for any liabilities, costs, expenses, loss or damage incurred, sustained or suffered by any respondent prior or subsequent to or by reason of the acceptance or the non-acceptance by the City of Quinte West of any tender or by reason of any delay in the acceptance of a tender . • Each Form 7 (seven) submitted shall relate to only one parcel of land and shall be contained in a separate envelope along with the appropriate bid deposit. • Faxed or other electronically transmitted bids will not be accepted. INQUIRIES AND CLARIFICATIONS It is the sole responsibility of any party submitting a bid to investigate all conditions, restrictions, liens etc. associated with any property offered for tax sale. City staff are not able to provide information regarding title searches, liens, environmental conditions etc. Questions regarding interpretation of any item pertaining to the tendering process may be submitted by email purchasing@quintewest.ca Bidders are responsible for obtaining their own legal advice. SALE OF PROPERTY BY PUBLIC TENDER FREEDOM OF INFORMATION Release of information contained within a respondent’s document will be subject to the Freedom of Information Act. Extracts of documents submitted may be used as part of a public document for reporting purposes. Requests for information other than standard public information (i.e., names of those submitting tender, total amount of bid) must be dated and submitted in writing to the Mgr. of Purchasing & Risk/Deputy Clerk, after which time the municipality has thirty days to respond. WITHDRAWAL PROCEDURE A tender is withdrawn if the tenderer’s written request to have the tender withdrawn is received by the treasurer or their designate before 3 p.m. local time on the last date for receiving tenders. The envelope containing a withdrawn tender shall be opened at the time of the opening of the sealed envelopes in accordance with the Municipal Tax Sales Act. TENDER OPENING A virtual public tender opening shall be conducted and shall take place at approx. 3:10 p.m. following closing. The names of respondents submitting bids and total bid amounts will be announced. Details of the virtual opening may be found at www.quintewest.ca under the Bids and Tenders button. PRELIMINARY CHECKING Initially all tenders shall be checked to ensure that; The tender form 7 is signed as necessary; The amount tendered is equal to or greater than the minimum tender amount as shown in the advertisement and tender document;
SALE OF PROPERTY BY PUBLIC TENDER The tender complies with regulations as stated in the Municipal Act; Each tender envelope is time and date stamped prior to the contract closing time; Tenders must be legible, written in ink or typewritten. Submissions written in pencil will be rejected. The authorized officer signing the tender must initial erasures, corrections or strikeouts. Each bid is accompanied by a deposit of at least twenty percent (20%) of the tender amount, by way of money order or by way of bank draft or certified cheque by a bank or trust corporation payable to The City of Quinte West; (round your cents up to nearest cent) In the event that a bid does not contain or comply with a mandatory item, it must be rejected. TENDER AWARD As per the Municipal Tax Sales Act: • All qualified bids will be identified and all but the two highest will be rejected. • Where two or more tenders are equal, the tender that was received earlier shall be deemed to be the higher. • Each rejected tender will be returned to the tenderer together with the tenderer’s deposit without interest within five (5) days, and a statement of the reason for rejection. • The highest tenderer will be notified immediately by ordinary mail sent to the address shown in the tender, that the tenderer will be declared to be the successful purchaser if, within 14 (fourteen) days of the mailing of the notice, the balance of the amount tendered, and any taxes that may be applicable, such as land transfer tax are
SALE OF PROPERTY BY PUBLIC TENDER paid, in cash, bank draft, or certified cheque to the City of Quinte West. • Provided the highest tenderer makes the payment as set out above, the treasurer or his/her designate shall declare the tenderer to be the successful purchaser. • If the highest tenderer does not make the payment as set out above, the tenderer’s deposit shall be immediately forfeited to the municipality and the treasurer or his/her designate shall offer the parcel of land to the lower tenderer in accordance with section 12 (twelve) of the Municipal Act. • If the Treasurer or his/her designate is required to offer the parcel of land to the lower tenderer, the treasurer or his/her designate shall immediately notify the tenderer by ordinary mail sent to the address shown in the tender, that the tenderer will be declared to be the successful purchaser if, within 14 (fourteen) days of the mailing of the notice, the balance of the amount tendered, and any taxes that may be applicable, such as land transfer tax are paid, in cash, bank draft or certified cheque to the treasurer or his/her designate. • If the tenderer makes the payment as set out above, the treasurer or his/her designate shall declare the tenderer to be the successful purchaser. • If the tenderer does not make the payment as set out above, the treasurer or his/her designate shall declare that there is no successful purchaser and may register a notice of vesting in the name of the municipality; and
