Auction Date The agent is authorised to submit the goods to public auction on ____ /____ /________ Commission The agent shall be entitled to a fee of 10% plus GST on items under $5,000 or 5% plus GST for item $5,001 or over on top of the hammer price. Auction Items Items will be displayed on Ray White Rural Temora website. Photos need to be supplied by vendor for this service. Photos can be emailed or delivered to the office. Photos displayed on website will be at agents discretion
Reserves Onus on the vendor to supply in writing any reserves prior to sale commencement otherwise items will be sold at auctioneers discretion. Delivery Delivery of items to auction yard is responsibility of vendor. Items can be collected, contact office for a quote. Unsold Items Items not sold must be collected by vendor on the day of auction or by arrangement. For all items not sold during the agreement period the vendor will be charged a listing fee of $10 per item to cover administration and advertising. Promotional Activities Goods are to be advertised and promoted with information, supplied by the vendor as agent sees fit in both internet and print media. Occupational Health & Safety - Vendor accepts that agent has no control over any of goods offered for sale and agent accepts no responsi- bility for any harm, loss, or damage what so ever arising from the goods or their transportation or use. - The agent shall take all reasonable care and skill when handling any of the goods and shall not be liable for any damage or loss to such goods as a result of such handling. Insurance Agent is not required to acquire insurance for goods. Payment to vendor Agent is required to account for the proceeds of the sale of the vendor within ten (10) working days after completion of sale, Subject to payment having been made by the purchasers, and receival of vendors banking details. Auction Items & Conditions of sale The vendor authorises the agent to conduct the sale of the goods pursuant to the Terms and Conditions of the sale, a copy of which has been inspected and read by vendor prior to signing this agreement. Privacy Policy The agent uses personal information collected from the vendor only to act as the agent and perform their ob- ligations under this agreement. Vendor Authority & Warranties The vendor guarantees all goods are free from encumbrances’ and they are the lawful owner of the goods and have the authority to enter into this agreement. ALSO NOTE – We will NO longer be accepting any televisions that are not digital (e.g. analogue etc), set top boxes, older computer monitors/hard drives or NON saleable items. Terms and Conditions 1. The highest bidder shall be the purchaser but in the event of any dispute arising between two or more bidders the ultimate purchaser may be determined by the Auc- tioneer, whose decision shall be final or he may put up the lot or lots again. 2. The Vendors shall have the right to bid either by the Auctioneers or their Agents for any lots offered. 3. The Auctioneer may, without giving a reason, refuse to accept the bid of any per- son or persons, and may decline the offer for any lot or lots at any time. 4. Immediately after the fall of the hammer the buyer shall, if requested by the Auc- tioneers, pay a deposit of not less than 10 per cent of the purchase price of the lot and any further deposits when requested. 5. The whole of the lots having been available for inspection, no allowance or re- funds will be made, nor will any buyer be permitted to reject any lot on the ground that is not correctly described, the said lots are to be taken with all faults (if any) and will be at the buyers risk on fall of the hammer and thereafter the Vendor will be free of all responsibility for safe-guarding the goods and will not be liable for any loss of or damage to the goods whether such loss or damage is caused or contributed to by any act, neglect or default of the Vendor, its servants, employees or agents. 6. Any deficiency in the quantity described shall not vitiate the sale but neither the Vendor nor the Auctioneers shall be accountable for the deficiency, damage or loss which may arise thereafter. 7. In the event of non-compliance with any of the above Terms & Conditions, all monies paid by the Purchaser shall be absolutely forfeited and the goods purchased may be sold, either by Public Auction or Private Contract, without notification at the risk and expense of the former Purchaser who shall be liable for any deficiency which may arise together with all costs and charges, but shall not be entitled to any profit which may accrue from such resale. Furthermore all items sold remain the property of the Vendor until such time as lots are fully paid for and any payment by cheque, cleared. 8. The Auctioneers are selling as agents for the respective Vendors of all lots. A com- mission is charged to the Vendor. The Auctioneers do not warrant the title to any lot and shall not be responsible for deficiency in any such title. 9. All lots are at risk of the Purchaser immediately upon the fall of the hammer. 10. Purchaser shall be responsible for cartage and storage costs incurred should they fail to pick up goods by the nominated time. 11. A Buyers Premium of 10% + GST for items less than $5,000 or 5% + GST for items $5,001 or higher is payable by the purchaser on top of the hammer price on all lots sold. Our Terms: Strictly cash, Visa, MasterCard, Bankcard and EFTPOS prior to collection unless otherwise arranged with the management.
