Contingency Staffing Strategies • If having staff isolate or quarantine would result in closing classroom, programs may consider contingency staffing strategies • Determine in consultation with LPHA, and in consideration of any unique risks • Start with shortening quarantine Consistent with OAR 333-019-0014, worksite, childcare, and school restrictions can be removed by statement of the local public health administrator that the disease is no longer communicable to others or that adequate precautions have been taken to minimize the risk of transmission. 14

Testing Kit Distribution • OHA was able to order approximately 6 million COVID-19 testing kits at the end of the year • For the first time, they were able to set aside a limited amount for early learning • Because there were not enough testing kits to make available to all child care and early learning providers, only the following will be receiving kits at this time: • Oregon Prenatal to Kindergarten programs • Preschool Promise providers • Relief Nursery programs • ELD continues to work closely with OHA to determine if additional testing kits are available to be distributed to all child care providers

Agency and Program Updates
Agency Updates: Sprinkler Rule Update: • In April 2021, the Department of Consumer and Business Services (DCBS) adopted rules requiring new RF and CF providers to install an automatic sprinkler system in their facility or alternative fire safety tools based on local building officials. • On January 26th, the ELD and DCBS engaged in joint temporary rulemaking to provide an alternative option to sprinklers. • ELD's fire safety ruleset is temporary language that will be effective 120 days (January 26, 2022 through May 26, 2022). The ELD will engage in a public rulemaking process, including partner engagement and a Rulemaking Advisory Committee (RAC), before the Early Learning Council adopts a permanent rule in spring 2022. • The Office of Child Care is using a technical assistance/coaching approach to enforcement. Providers will have an opportunity to come into compliance during the temporary ruleset period. Note: We are required to address complaints.
