OFFICIAL COMMUNITY MEETING REPORT Petitioner: 1511 Central, LLC Rezoning Petition No. 2021-004 This Community Meeting Report is being filed with the Office of the City Clerk and the Charlotte- Mecklenburg Planning, Design and Development Staff pursuant to the provisions of the City of Charlotte Zoning Ordinance. PERSONS AND ORGANIZATIONS CONTACTED WITH DATE AND EXPLANATION OF HOW CONTACTED: A representative of the Petitioner mailed written notice of the date, time and virtual format for the Community Meeting to the individuals and organizations set out on Exhibit A attached hereto by depositing such notice in the U.S. mail on February 24, 2021. A copy of the written notice is attached hereto as Exhibit B. DATE, TIME AND FORMAT OF MEETING: The Community Meeting was held on Thursday, March 11, 2020 at 5:30 p.m. via the Zoom platform. Recipients of the notice letter were directed to RSVP for a link to the virtual meeting via email or phone to a member of the Petitioner’s team. Members of the community who were unable to access the virtual meeting were directed to email or call a member of the Petitioner’s team and could be provided with a copy (including a mailed paper copy, if necessary) of the meeting presentation. MEETING PARTICIPATION: The Virtual Community Meeting had thirteen (13) attendees, including the Petitioner’s team, as listed in Exhibit C. The Petitioner was represented at the Community Meeting by Vlado Novakovic and John Hadley, as well as by Petitioner’s agents, Collin Brown and Brittany Lins with Alexander Ricks PLLC. SUMMARY OF PRESENTATION/DISCUSSION: Mr. Collin Brown welcomed the attendees and introduced the Petitioner’s team, using a PowerPoint presentation, attached hereto as Exhibit D. Mr. Brown clarified that the Petitioner is the current property owner and former owner of Nova’s bakery. The Petitioner no longer wished to continue the bakery operations and was not forced out by redevelopment. Mr. Brown showed aerials and a street view of the approximately 0.9-acre property located on the north side of Central Avenue, east of Pecan Avenue, and west of The Plaza. Mr. Brown gave a general overview of the rezoning process and development considerations that a developer must take into account, including ordinance requirements, environmental constraints, and access and transportation requirements. Mr. Brown explained that the site currently zoned B-2 with a PED (pedestrian) overlay and the Petitioner is seeking to add an optional request to the existing zoning district. Mr. Brown showed the land us plan recommendation from the Plaza-Central Pedscape Plan, which recommends a mix of uses for the site, including multi-family, office, and retail uses. Mr. Brown explained that the Petitioner is seeking an optional provision to the site’s existing B-2 PED zoning district while committing to keeping the existing building. He stated that preserving the character of the main strip of the Plaza Midwood area is a priority for many community members in the area. The building formerly home to Nova’s bakery is currently considered legal non-conforming since it was likely built before many of today’s ordinance standards were adopted. This means that the existing uses in the building can continue to operate but when a change of use occurs, the building must come into compliance with current-day zoning ordinance standards and must meeting current parking standards. The Petitioner would like the ability to 02266‐001/00287748‐1
remove the existing parking lot on the site to accommodate future expansion while keeping the existing building character. The Petitioner’s team believes that keeping the existing building and removing some of the parking is preferred as opposed to tearing down the existing building to provide a new development with a self-contained parking deck to meeting ordinance standards for parking. Mr. Brown referenced several similar rezoning requests within the same block, including two on the opposite side of Central Avenue and Workman’s Friend on the opposite corner of the block where the buildings were preserved, and parking standards were reduced or eliminated. He also showed several examples of by-right developments under similar zoning districts in the PD overlay, where new buildings were constructed with parking decks, as an alternative to the rezoning proposal that could be built by-right (i.e., without requiring City Council approval). Mr. Brown stated that the rezoning timeline could result in a public hearing as early as April 19th and a City Council decision on May 17th. The virtual meeting was then opened for discussion via either chat or the “raise hand” function on Zoom to allow participants to ask individual questions or provide comments. In response to an attendee question, Mr. Brown stated that the Petitioner’s team does not know the full scope of the expansion yet and any expansion would likely not be imminent but would most likely eventually be located within the existing parking lot. An attendee asked whether the alleyway between the two parcels would remain open and the Petitioner’s team responded that the Petitioner is currently not seeking an alley abandonment so the alleys would remain at this time. Several attendees commented that parking is their biggest concern. An attendee recognized that the nearby single-family homes are located within the historic district which makes it very difficult to add a driveway to their existing homes, thereby requiring that most residents park along the neighborhood streets. The current parking situation along these neighborhood streets have become increasingly difficult as the retail and other Plaza Midwood entertainment destinations grow in popularity. An attendee commented that she is unable to park near her house on the weekends. These attendees inquired into the feasibility of parking permits for residents-only along these streets. The Petitioner’s team stated that any parking permits would be handled outside of the scope of this rezoning but the Petitioner’s team would be willing to discuss with CDOT and council members to understand their positions on the issue and a potential path forward. A few attendees also commented about noise concerns and would like to see the intensity of the redevelopment step down as it got closer to the neighborhood with sensitivity to the noise that accompanies outdoor dining. An attendee stated that she was comfortable with outdoor dining closer to Central Avenue and in the former Nova’s parking area, but not closer to the single-family homes further down Pecan Avenue. An attendee specifically requested that the existing parking area behind the newly constructed building and abutting single-family homes remain a parking area or contain commitments that restrict its future use. [NB: The Petitioner subsequently submitted a revised plan that restricts this area to parking, as suggested by the attendee.] An attendee also requested a commitment on height. The Petitioner’s team acknowledged that unlimited height did not seem reasonable and that they would submit a revised plan addressing a height restriction. [NB: The Petitioner subsequently submitted a revised plan with a 40’ height restriction for new buildings.] The formal meeting concluded at approximately 6:15 p.m. An attendee later provided written comments, attached as Exhibit E. We did not pose any questions or comments at the meeting, but I would like to follow up with my thoughts and concerns as a homeowner adjacent to the rezoning property and possible changes to our neighborhood. (1) Size of New Construction: The most recent construction that currently abuts our property provides an example of what happens when an oversized building is placed in such close proximity to a private home. Even though this new structure is considered a two-story building, the high ceilings interior design gives the impression of a three-story building. I think anyone can see that aesthetically our new commercial neighbor overwhelms our home. See attached photos. With this in mind, I am concerned about the height and bulk of any new construction. I believe I heard at the meeting that if this rezoning is approved, new construction would be confined to the height and relative size of the single-story portion of the original Nova’s Bakery facing Central Avenue. (not the two- story addition that was attached to the back of the original building several years ago). Our business neighbors across the street from us are Urban Nail Bar and Bohemian Wine Bar. From my perspective these
two buildings are a much more appropriate fit with our street landscape. (see photo in attachment) (2) Parking Issues: We are fortunate that we have a driveway that accommodates our parking needs, however, there are many times on weekends that our driveway is blocked by an illegally parked car. We put up a “Please do not block driveway. Thank you” sign, and that has helped. I add that as “buffer house” owners, we experience frequent cleanup jobs of picking up discarded cups, bottles, sales slips, cigarette butts and most recently Covid masks. (3) Noise Issues: Our business neighbors next door (so far) are Stroke Putt (miniature golf bar) on the bottom floor and Fitness Together on the top floor of the new building. Noise has not been an issue at this point, however it is hard to judge due to the COVID regulations over the past twelve months. I have attached some photos to illustrate how an oversized building can alter the landscape aesthetics of our Pecan Avenue neighborhood.
