Forced Marriage Forced marriage takes place when the bride, groom or both do not want to get married but are forced to by others, usually their families. People forced into marriage may be tricked into going abroad, physically threatened, isolated from others and/ or emotionally blackmailed to do so. Forced marriage is very different to an arranged mar- riage, which takes place with the full and free consent of both the prospective bride and groom. Forced marriage is wrong and cannot be justified on any religious or cultural basis. In Austria forced marri- age is illegal. It is not only a violation of human rights but also a serious criminal offence. In Austria any person who forces another person to marry against their will is prosecutable and guilty of an offence. Austrian Criminal Code §§105, 106 grievous duress Perpetrators who force a person to marry against their will are punishable with imprisonment bet- ween 6 month and 5 years.
BEWARE, if… • You are not allowed to attend school anymore • You are not allowed to stay in education, or if you should quit your job • Your parents start to talk about marriage all the time • Your relatives suddenly start to visit frequently and talk about marriage a lot • There has been forced marriage in your family before • Your family suddenly decides to visit your home country without a specific reason These events can, but don’t have to be alerting signs. In any case, get advice!
What you can do! If you are forced to go abroad and you are worried that you will be married against your will : • Get help and contact one of the listed agencies! They can support you and help you to live indepen- dently. • Involve a person you trust to support and help you. • Make sure you have the address of the Austrian embassy in your home country, as well as contact details of at least one of the listed agencies. • Make sure to be able to access all your personal documents (Passport, or if you are not an Austrian citizen a copy of your Residence permit/legal status etc.). Keep the documents in a secure place! (Have a copy of all documents on your email account and give a copy to your confidant) • Make sure you have a mobile phone that works abroad.
• Make sure you have access to money, when you are abroad. • Write a statement declaring that you don’t want to leave Austria for good and deposit it with your confidant. • Tell the person at boarder control that you are being kidnapped and forced to leave the country. They have to help. • Remember that the Austrian embassy is going to support you, if you are already abroad. This is also important if you have already been forced to marry someone!
Try to consider the following! If you don’t have Austrian citizen- ship: • consider carefully if there is any way to prevent leaving Austria. • make sure you check the validity of your right of residence before your departure • contact the relevant immigration authorities (Aliens Police Authority)
How can I support affected people? • Take it serious if the affected person is scared. • Take time for the affected person, but don’t make rushed decisions. • Accompany the affected person to one of the listed counselling centres. • Don’t hesitate to find help on the person’s behalf. • Treat all information that has been entrusted to you as a “secret”. • You are an invaluable help if you can support a friend/relative/school-or work colleague! Guidance for employers, instructors or teachers: Give the affected person the opportunity to get in touch with a counselling centre. Allow them time off for counselling sessions during their work/school hours.
