Oceans Protection Plan
• $1.5 billion national investment that improves marine safety and
  responsible shipping, protects Canada’s marine environment, and
  offers new possibilities for Indigenous and coastal communities
• Five year plan for long-needed coastal protections
    • Action plan to deliver results for the coming decade
• Will engage communities, first responders, and governing
  authorities to work together effectively to respond to emergencies
    • Safer navigation in Canada’s waters through better information in the
      hands of mariners
    • Strengthened marine communications and traffic services centres
    • Modern hydrography for charting in priority areas
    • Enhanced marine weather forecasting
    • Tougher requirements for industry response to spills
    • Greater leadership internationally
    • Increased Canadian Coast Guard towing capacity
    • Preservation and restoration of marine ecosystems

North Atlantic Right Whales

• After the deaths of 11 North Atlantic Right whales in Canadian waters (and
  3 found in the US), the GoC announced a temporary mandatory slowdown
  in the Gulf of St. Lawrence in order to protect the marine mammals on
  August 11, 2017
• The slowdown area is quite large and has impacted marine transits by
  large vessels (over 20 metres) in the area – cargo, cruise, ferry and fishing
  vessels
• Transport Canada continues to work with partners (DFO, CCG, US) to
  monitor the location and movement of the whales
• Migration is expected in the fall, but an exact timeframe is unknown - the
  slowdown will remain in effect until the whales have migrated or other
  information becomes available

Ballast Water
• The Ballast Water Convention came into force September 8, 2017
• Canadian vessels on international voyages are required to have an
  International Ballast Water Management Certificate
• Vessels coming to Canada are subject to the Port State Control
  procedures
• Vessels should have on board an International Ballast Water Certificate,
  Ballast Water Log book and a valid Ballast Water Management Plan
• The management of ballast water on board of vessels will continue to
  include exchange, alternate method (ballast water management
  system), retention on board or discharge into a port reception facility.

Regulatory Update

Marine Personnel Regulations
                                CONTEXT
Three conventions, to which Canada is a signatory, are driving this
regulatory amendment project:

1. International Convention on Standards of Training, Certification and
   Watchkeeping for Seafarers (STCW) including the 2010 Manila Amendments

2. The International Convention of Standards of Training, Certification and
   Watchkeeping for Fishing Vessel Personnel (STCW-F), which was ratified on
   September 29th, 2011 (came into force on September 29th, 2012)

3. Amendments to the Maritime Labour Convention, 2006 (including the 2014 &
   2016 amendments)

Marine Personnel Regulations
   HIGHLIGHTS OF PROPOSED AMENDMENTS

• Introduction of a Small Vessel Operator Certificate of Competency
• Updating the validity of current Domestic Fishing Certificates
• Introduction of new Domestic Waters Limits; which will impact seafarers’
  certification, MED refresher requirements and Hours of Rest
• Mandatory refresher training in MED for seafarers onboard ships operating in
  NC1 Waters or unlimited waters
• Mandatory Leadership training for all deck and engine officers at operational or
  management level
• Update of the Passenger Safety Management and Specialized Passenger
  Safety Management training
• Addition of basic and advanced training for personnel onboard ships using
  gases or low flashpoint fuels
• Addition of basic and advanced training for personnel onboard ships operating
  in polar waters

Marine Personnel Regulations
   PROPOSED AMENDEMENTS FOR CABLE FERRIES

• September 2016, workshop with cable ferry operators and unions to address issues on
  safe manning and proposed amendments to the MPR
• Resulted in two proposed amendments to the Marine Personnel Regulations:
    • Manning requirements, mandatory training for cable ferry operators and crew
      members
    • Training and familiarization plan appropriate to the specific of the cable ferry and its
      route
• Collaboration with the CFA and other stakeholders continues to look for ways to better
  adapt the evaluation tools for minimum safe manning levels with the unique
  characteristics of cable ferries
• Study on international best practices for ferries on safe manning underway
• Part 1, which pertains to certification for deck and engine - nearly complete
• Regulatory drafting has begun on Part 2 (Crewing) and Part 3 (Maritime Labour
  Standards)
• Publication in Canada Gazette, Part I, is anticipated for late 2018

Regulations Amending the Administrative
      Monetary Penalties and Notices
          (CSA 2001) Regulations

• As new Regulations are made, or existing Regulations
  amended, they must be designated as violations within the
  Administrative Monetary Penalties and Notices (CSA 2001)
  Regulations (AMPNRs) to make them legally enforceable,
  under the AMP scheme
• Target: Amending regulations to be published in Canada
  Gazette Part I in October 2017

      Monetary Penalties and Notices
           (CSA 2001) Regulations
• This proposal seeks to make amendment to the Administrative Monetary
  Penalties and Notices (CSA 2001) Regulations to designate new
  violations pursuant to the following Regulations:

   •   Small Vessel Regulations
   •   Ballast Water Control and Management Regulations
   •   Safety Management Regulations
   •   Collision Regulations
   •   Vessel Pollution and Dangerous Chemicals Regulations
   •   Fire and Boat Drills Regulations

Proposed Environmental Response
             Regulations – Phase I
                                   UPDATE
• These regulations will repeal and replace the existing response
  organizations and oil handling facilities regulations made under the
  former Canada Shipping Act (now replaced by the Canada Shipping Act,
  2001)

• Phase I: new oil handling facilities must declare their operations to the
  Minister
    • New regulations will address the prescribed requirements in the Oil Pollution
      Prevention plans (OPPP) – that do not currently exist in the 1995 regulations
      – and new requirements for the Oil Prevention Emergency plans (OPEP)
    • Estimated date for Canada Gazette Part I – winter 2018

• Phase II will repeal Part I of the existing
   • Response Organizations & Oil Handling Facilities Regulations; and
   • Environmental Response Arrangement Regulations

Vessel Pollution and Dangerous Chemicals
                 Regulations
                                 UPDATE

• Proposed amendments to the Regulations will include new or revised IMO
  standards that emerged since the NA Emission Control area was
  implemented in 2013 and to address some regulatory concerns raised by
  stakeholders
• Revisions will include the implementation of a “data collection system for
  fuel consumption of ships”, recently adopted by the IMO
• Anticipate these proposed regulatory amendments to be implemented by
  Fall 2018

Canadian Marine Advisory Council (CMAC)

• National CMAC Meeting
    • December 5, 6 and 7, 2017
    • Ottawa - Shaw Centre
    • New this year: opening plenary will be an all day event and will feature salient
      information on marine matters in a panel discussion

• Regional CMAC Meetings:
    • Ontario Region: October 4, 2017 – Hamilton, Ontario
    • Prairie and Northern Region: November 15-16, 2017 – Iqaluit, Nunavut
    • Québec Region: To be announced. (Normally held in March)
