July 8, 2021 Dear LSBA Members, Over the past seven years, the Louisiana State Bar Association’s Lawyer in Libraries program has assisted thousands of individuals with their legal needs because of volunteer attorneys like you. I would like to thank you for your continued support of Lawyers in Libraries and again ask for your help to provide much-needed legal assistance, particularly in areas without a physical legal aid office. Last year, despite the pause of in-person services, Lawyers AND Libraries was able, with your dedication, to continue to provide legal assistance through the innovative use of various virtual tools. This year, lawyers will return to the libraries to provide in-person assistance, as well as broadcast live webinars during our week of service to be held in conjunction with National Celebrate Pro Bono Week October 25th-30th. With the second highest poverty rate in the United States, Louisiana citizens are vulnerable and experience increased need for legal representation and assistance. The effects of COVID-19 and the devastation left behind by this past year’s hurricanes and major flooding has only exacerbated the dire situations of many Louisianans. The issues arising from such situations often have uncomplicated legal remedies if individuals have access to an attorney, legal services, or resources. Your assistance with brief advice and legal education can help resolve an individual’s problem and make a significant difference in their lives. I encourage LSBA members to volunteer for Lawyers in Libraries by signing up at http://www.LouisianaLawyersinLibraries.org. Participation in this program does not require a large time commitment—two hours of individual 10-15-minute consultations or a classroom-style presentation on a specific legal topic. As always, the LSBA and local libraries will support your efforts and also help coordinate logistical details for volunteer attorneys to provide their services effectively. Serving the Profession.” For the public, this ideal confirms our commitment to providing access to the legal system for all individuals, regardless of financial circumstance. For attorneys, the Bar aims to better connect the public with counsel and enable a more efficient and just legal system. Legal aid staff attorneys are outnumbered by Louisianans eligible for their service by 22,500 to 1. Though we are slowly recovering as the state reopens, there remains overwhelming legal needs following the pandemic and the natural disasters our State has faced this past year. Pro bono volunteers are essential to meeting the legal needs of those who are unable to afford the cost of an attorney. The LSBA is dedicated to serving the public in this need and works to develop helpful resources and cultivate community partnerships to support pro bono work and make Louisiana attorneys more available to the public. Select the date(s) & time(s) to volunteer. You can select more than 1 time slot & more than 1 location. Choose the event type you would like to offer: Ask-A-Lawyer sessions or Presentation. Attorneys are also encouraged to sign up for LA.FreeLegalAnswers.org to answer questions virtually. Once registered, the LSBA will confirm your event(s) & e-mail introduce you to the contact for the library branch(s) you chose. Volunteer attorneys are not allowed to directly solicit clients at the event, but they can inform their partner library if they would like their name or firm included in promotional materials. The LSBA promotes all events via LSBA publications & partner organizations. Libraries will also promote these events to their patrons. See Sample Media Documents in this Guide. Attorneys are encouraged to promote the program to colleagues & encourage other attorneys to volunteer. You can share any of the materials in this Guide. Review the "Important Event Information" and "Trainings & Resources for Volunteer Attorneys" materials included in this Guide. For presentations, inquire with your partner library ASAP as to the availability of a tv, projector, &/or any other desired visual aid. If you would like to provide printouts, please print copies & bring them to the library yourself. For Ask-A-Lawyer sessions, please confirm with the library that they can print copies of the Intake Waiver Form & the “Resources & Referrals” list. Reconnect with your partner library the week prior to events to confirm logistics-- including if they can print Sign-In Sheets. 4
2021, Guide for Attorneys CHECKLIST FOR ATTORNEYS Show up at least 15 minutes early. For Ask-A-Lawyer sessions, all patrons must sign an Intake Waiver Form. A copy is provided in these materials. (Return completed waivers to the library.) Participants are likely to have legal issues that may be outside your practice area. You may respond as far as you feel comfortable. The “Resources & Referrals” of this Guide has been designed to provide you with the necessary tools to be able to assist or refer patrons who need additional help. Should a patron have a question that you are unable to answer, that person can be directed to another volunteer, if available, or provided with an explanation that this event has a limited scope. You can also provide them with a copy of the “Resources & Referrals” list for further assistance. Please return completed Intake Waivers to the library. Please send the LSBA any pictures taken during the event &/or with library staff including the names of persons in the pictures for use Bar Journal articles. For confidentiality reasons, please do not include patrons in the pictures. You may fill out and submit the CLE credit form included in the materials. Submit forms to stephanie.beaugh@lsba.org. At the conclusion of the week, all volunteers will receive a follow-up survey via email. Your feedback is greatly appreciated and helps us improve the event for future years. 2021, Guide for Attorneys LAWYERS IN LIBRARIES IMPORTANT INFORMATION Ask-a-Lawyer sessions allow patrons to ask questions about their ASK-A-LAWYER individual legal issues during a 15-20-minute attorneys are requested to provide as much information and direction as consultation. Volunteer SESSIONS they feel comfortable communicating, & then supply each patron with a “Resources & Referrals” list which includes statewide lawyer referral information, contact information for legal aid & pro bono organizations, & additional resources. Legal Presentations, in contrast, feature a classroom setting & cover LEGAL predetermined topics. Please notify the LSBA & partner library as soon as possible of a determined topic. Though ideally there will be time for PRESENTATIONS questions at the end, legal workshops should provide an overview of the law & not elicit details of individual patrons’ cases. In other words, volunteer attorneys should provide legal information about the law but not legal advice about an individual’s specific issue. Attorneys & library staff can coordinate event details according to their preference. All patrons participating in an Ask-A-Lawyer session are required to sign INTAKE WAIVER an intake waiver which explicitly acknowledges that enrollment of counsel is neither expressed nor implied. LOCAL MEDIA Libraries & attorneys are encouraged to contact local media outlets to promote their upcoming event. Attorneys should advise the participating OUTLETS library whether they want their name & firm acknowledged. Included in this Guide are a sample Press Release & sample flyers libraries may use to promote events. Attorneys can obtain CLE credit for the pro bono work they do. Attorneys can apply to receive 1 hour of CLE credit for each 5 hours of pro bono PRO BONO CREDIT representation, up to a maximum of 3 CLE credits per year. Attorneys can complete the 5 hours at different organizations, meaning if an attorney provides 2 hours of pro bono assistance with ‘Lawyers in Libraries,’ they can apply for 2/5 of 1 CLE credit and complete a further 3 hours of pro bono assistance at a different organization. To apply for CLE credit, attorneys must complete the attached form at IV(d) & email it to stephanie.beaugh@lsba.org. The lawyer who performed the representation must complete Part I of this form, and then provide the original to the assigning court, program, entity, or law school. 2. TRAININGS & RESOURCES FOR VOLUNTEER ATTORNEYS These materials are to help prepare attorneys for volunteering. 1) Pro Bono Desk Manual The Louisiana Legal Services & Pro Bono Desk Manual is a concise resource designed to help legal aid attorneys respond to questions about frequent issues from low income communities. The following topics are included in the Desk Manual: bankruptcy, consumer law, employment law, family law, federally subsidized housing, foreclosure, landlord-tenant, Medicaid, social security/disability, and successions. Please note that the Manual has not been updated since 2013. 2) Free Legal Answers Volunteer Training LA.FreeLegalAnswers.org is an online pro bono program that allows people to ask civil legal questions online that are answered by attorney volunteers. This training shows you how to sign up and navigate the website. Attorneys, particularly those interested in volunteering for virtual events, are encouraged to register in advance. 3) Emergency/Disaster Training Manual for Volunteer Attorneys This manual contains information for attorney volunteers on common legal issues that arise after a disaster. This page includes information on: lawyer referral programs, legal aid organizations, online resources, forms, self-represented litigant resources, and other organizations that provide legal information. 2) Free Legal Answers: https://LA.FreeLegalAnswers.org LA.FreeLegalAnswers.org is an online pro bono program that allows people to ask civil legal questions that are answered by attorney volunteers. Financial Eligibility Requirements apply. 3) Louisiana Law Help: https://louisianalawhelp.org Louisiana Law Help was written primarily for self-represented litigants. The website provides brief descriptions of numerous areas of law as well as some forms. Some descriptions are in video, some are written. 4) Modest Means Directory: www.LSBA.org/public/FindLegalHelp/ModestMeans.aspx The Modest Means Online Directory provides a list of attorneys who charge reduced fees to people who earn equal to or less than 400% of the Federal Poverty Line. 5) Louisiana's Legal Service Providers Legal service organizations are non-profit legal aid programs that provide civil legal help to those who meet certain income qualifications. 2021, Guide for Attorneys CUSTOMIZING FLYERS To change the electronic versions of the Ask-A-Lawyer flyer and the Legal Workshop flyer, please follow these steps. 1. Download the Powerpoint file with both flyers from "For Librarians" page on www.LouisianaLawyersinLibraries.org. 2. Double-click on the underlined question marks in order to edit the text and change the text to the information specific to your event. 3. After it is correct, to export as a .jpeg (for website applications), click on the File menu. Choose “Save As” and in the drop-down menu on the right, click on "JPEG". 23
