Kentucky Ginseng Dealer Guide American ginseng, particularly roots with wild character, are highly demanded in the market. The commercial value and demand places heavy harvest pressure on ginseng populations. Your cooperation and legal trade of this resource is vital to the health of this industry. Inside this guide, you will find all the details and form samples for legally conducting ginseng business in Kentucky. Please take the time to review thoroughly. Following these recommendations help keep our program in compliance and its continued success. It also helps provide efficiency in your time and our staff’s time throughout the season. Dealer Responsibility As a Kentucky licensed dealer, it is your responsibility to review and understand how to complete the required paperwork for recording ginseng transactions. The Kentucky Department of Agriculture (KDA) uses information documented by a licensed dealer to complete export certificates and to record and report annual harvest data to the United States Fish and Wildlife Service (USFWS). This information is required in order to continue to have a ginseng program in our state. Legal Authorization for Program The Kentucky ginseng program is authorized under KRS 246.650, KRS 246.655, KRS 246.660, KRS 246.990, and 302 KAR 45:010. Kentucky is one of 19 states and 1 tribe with an approved wild ginseng export program and is one of the largest producers of wild ginseng. Your cooperation, stewardship, and following our state’s ginseng laws help keep this industry going for the next generation. Guide Basics Buying Kentucky Ginseng - As a licensed ginseng dealer you are legally able to buy uncertified Kentucky ginseng from harvesters or other Kentucky dealers. This section will cover buying basics of Kentucky ginseng, including how to complete your Purchase Forms, how to order more purchase forms, and legal for trade scales. Selling Kentucky Ginseng - As a licensed ginseng dealer you are legally able to sell uncertified Kentucky ginseng to other Kentucky dealers or certify Kentucky ginseng to take it out of state. Buying Ginseng Ginseng roots vary greatly in size and characteristics. Seasonal and cyclical weather patterns, harvest month, and age of root may affect the quality of the root. Post-harvest handling and drying techniques affect the market value of the ginseng root. Roots dried too fast and with too high of heat damages the coloring throughout the ginseng root and the desired chemicals inside the ginseng root. Ginseng dried too slowly encourages fungal grow and discoloration on the root. As a dealer, you may choose to buy fresh roots to control the drying process or sell fresh roots. Dealer Definition Review Who can buy ginseng for resale or export? Only a licensed dealer. Anyone purchasing ginseng for the purposes of resale or export should hold have a ginseng dealer’s license in Kentucky. What constitutes as ginseng buying? If you advertise on social media or in newspapers as buying ginseng, you should be a licensed dealer. Do you post signs on the roadside as buying ginseng? You should apply for a dealer’s license. Does a family member, spouse or employee help handle paperwork, money, or roots? It is recommended that they become a licensed dealer. If you are in doubt, our recommendation is always to obtain whatever licensing or paperwork. After obtaining your license, two main considerations are properly weighing your ginseng and record keeping. Legal for Trade Scale Dealers purchase American ginseng and other forest-harvested herbs by weight. It is important when conducting sales to have the correct weight. It is a good business practice to obtain accurate weights. Additionally, you must record the weights for each ginseng transaction on a provided Purchase Form. A certified legal for trade scale is the lawful way to measure weights of your products. Is my scale legal for trade? All scales put into service in Kentucky after July 1, 2003 must have a National Type Evaluation Program (NTEP) certificate of conformance. Hanging scales are allowed as long as they meet all of the legal for trade criteria. Vendors selling scales should be able to inform the purchaser that a scale is Handbook 44 compliant. There are some hanging scales that do not meet these criteria, so it is important to get the assurance from the vendor in writing. What makes my scale certified? It is the responsibility as the scale owner to have the device inspected and to maintain the accuracy of the scale. Scales should be inspected annually. Inspections may occur any time of the year, not just at the start of ginseng season. Inspectors with the Kentucky Department of Agriculture (KDA) conduct these inspections. The inspector will place a sticker when scale that passes inspection and provide you a print out. Your scale is certified for twelve months. How to get my scale inspected? Inventory – Record Keeping As a dealer, you should document all ginseng transactions. This is from the time you purchase the ginseng from a harvester/digger/collector or another dealer to when you sell it. You must be able to account for all ginseng poundage, which is in your possession or has been in your possession and how it stopped being in your possession. This includes the following: How and when and who the ginseng was sold Stolen (we recommend reporting to law enforcement authorities, too.) Destroyed (fire, flood, damaged, etc – document with photographs and other supporting materials) What is certified or not certified If you are a buyer of multiple states, ginseng that originates from outside of Kentucky should be clearly labeled and not comingled along with proper certificates from the state of origin. How you choose to keep track of the ginseng is up to you. The only requirements is that your inventory system must be self-explanatory to an outsider and available upon request. Provided Forms The Kentucky Department of Agriculture provides Purchase Forms and a Purchase Form Log to record transactions. Record all ginseng purchases only on original, triplicate Ginseng Purchase Forms provided to you. To request additional purchase forms, document the activity on your forms on the Purchase Form Log. The purchase form log is available as a template to fill out on your computer by email request. Sales tracking root inventory documentation, and other ginseng activity is important to keep track. How you do so is up to your own business practices. However, the system must be self-explanatory to someone not familiar with your business. Other Buying Considerations Ginseng regulations cover the minimum requirements for legal trade. Often, the market demands a higher quality and older root than what may be harvested and sold to you. When purchasing ginseng, you should develop an inspection process to review the condition and character of the roots you are buying. Ginseng roots are required to have at least four (4) neck scars for legal export. With each year of growth the stem leaves a scar when it dies back for the year. There should be four of these scars on a root, at the very minimum. If you are buying fresh ginseng, you should establish if you wish for harvesters to wash the ginseng and storage until the root is sold. Fungal growth and mold is a large concern. If you buy fresh ginseng to wash and dry yourself, there are specific concerns in recording on your purchase forms, described under the section to help you complete your Image 1. Ginseng Purchase Form Purpose of Ginseng Purchase Form The Ginseng Purchase Form is for recording all purchases of ginseng from harvesters by licensed dealers. Dealers complete these forms in the presence of the harvester at the time of purchasing roots. On this form you will capture the growing method and condition of the ginseng at the time of purchase, harvest year, the harvester’s name and contact information, when and where they harvested the ginseng, and the weight of ginseng roots on your certified scale. Do not transfer purchase forms among dealers. The serial numbers of the purchase forms are issued to your specific dealer number. Upon first approval of your ginseng dealer's license, you will be issued a series of purchase forms. These come in bundles of 25 forms. To order additional purchase forms, you submit a log of your purchase forms. The Ginseng Purchase Form Log is in the next form section. Harvesters and Growers If you are a harvester or grower selling your own ginseng, you can use this form to document your ginseng to sell to other dealers or to present for certification. As a dealer, you must see that this form is filled out completely prior to presenting for certification or selling the ginseng to another dealer. How to fill out the Ginseng Purchase Form Signature statement at middle Each harvester signing the form agrees to the statement at the top of (Rev 20190 or top of page (Rev the page, 2014) “The undersigned parties certify that they have complied with all state and federal laws pertaining to the recording, harvest, purchase, sale, and transfer of ginseng.” Form Number This is a five digit serial number. This number is recorded and each form is issued by dealer number. Purchase Forms are non- transferable. More are available by submitting a Purchase Form Log. Wild Ginseng Growing Method – Legal Kentucky Definitions Wild Simulated The legal definitions of Kentucky attempt to capture the growing Woodsgrown practices to help you honestly market ginseng base on production Cultivated practices and root character. These are defined under 302 KAR 45:010. • Wild ginseng is ginseng grown with minimal interference by humans, and under natural canopy in forest or woodlands. Mature ginseng plants resulting from berries of wild ginseng planted as required under harvest laws are also wild. • Wild Simulated ginseng is grown from seed not planted under harvest regulations with minimal interference by humans and under natural canopy. • Artificially propagated ginseng is grown from seeds or rootlets that are either exempt from the provisions of the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES) or have been derived from cultivated parental stock. Refer to CITES Resolution Conf. 11.11 (Rev. CoP15) for more information on regarding the definition of “artificially propagated”. Woodsgrown and cultivated ginseng may be artificially propagated. • Woodsgrown ginseng is grown under natural canopy and has been purposefully managed. • Cultivated ginseng is grown under artificial shade and in tilled soil. Printed Name of the Harvester As a dealer, it is your responsibility for this to be legible. Write in the full first and last name of the person you are purchasing ginseng from. Address Write in the complete street or box number of the harvester’s address. City, State Zip Write in the city, state, and postal zip code for the harvester’s address. Signature of Harvester The harvester needs to sign or make their mark. This is to assist you as a ginseng dealer to fully document and obtain true information on transactions and covers all ginseng New for 2020-21 transactions. Confirm and document identity on all ginseng • Ask to examine the harvesters' photo identification transactions • Very important to verify and document harvester's identity • Verify their information is correct that you've recorded on the Ginseng Purchase Form • Record their drivers' license number on an extra transaction line on the purchase form. • Obtain a copy of their photo identification. • Consider paying by check or cashier's check; just not cash Recording Harvester Information For the 2020-21, newly printed forms have a space to capture this extra information. On the older forms, you can simply use two lines per single transaction to provide plenty of space. Examples are below. Image 2. County Harvested In Kentucky has 120 counties. As a dealer, you will receive a list of them, as well as their cities. A large part of the ginseng program is an accurate recording of the harvest weight by county our state. County weights are totaled and reported to the USFWS as part of Kentucky participating and having a wild ginseng program. If a harvester says the ginseng came from more than one county, have him or her tell you a guess of how much came from each. Place one county on each line. You can put the same harvester transaction across multiple lines. Harvest was in more than one county Ginseng may be harvested in more than one county. When they have two or three counties worth of ginseng in their lot, have them estimate what percentage is from each county. These must be split on different transaction lines. This is an example of how to fill out Purchase Form when a harvester presents ginseng from more than one county. They should be broken up on several lines, instead of being put on the same line. Unacceptable Acceptable. List counties on separate transaction lines. Weight (Pounds) Place the weight of the ginseng on this line. All weights should be in pounds and measured on a certified scale. Green to Dry Conversion Forms As a dealer, you have the opportunity to buy ginseng fresh as green ginseng. Sometimes market conditions warrant for you to dry this ginseng you purchased green. You may simply want to control the washing and drying process yourself. In short, KDA staff must clearly be able to understand any written notations clearly without requesting clarification. We must be able to clearly understand any explanations and mark outs. Clearly mark the reasoning for any corrections. You may use additional, full sheets of paper, if you need more room to explain. Purchase Form Completion Correctly filling out your Ginseng Purchase Form will help our office process your paperwork faster. Do not use stapes on ginseng forms or documents, paper clips work great!. Copy Routing of Ginseng Purchase Form Each Purchase Form comes with three non-carbon copies. The use of each color and copy is described below. Use a clipboard or other hard surface with an extra sheet of paper or notebook under the form to fill out each form. Writing will transfer onto stacked forms; be sure you are only marking on one set of forms at a time. White Copy - KDA The white copy is the original. This is the copy that our office needs to process your paperwork for an export certificate. If you certify your ginseng, you will present the white copy to receive your Export Certificate. If you sell your ginseng to another licensed Kentucky dealer, you will give that dealer the white copy, plus the ginseng sold. The buying dealer is responsible for certifying prior to export. As the selling dealer, you would record this activity on your Ginseng Purchase Form Log. If you purchase ginseng in a dealer to dealer to dealer (or more) transaction, you are responsible for making your own copies of Purchase Forms for your files. The white copy always follows the ginseng until certification. If you do not wish for another dealer to see your Purchase Forms and list of diggers, we recommend certifying the ginseng for export yourself. Yellow Copy – Dealer Files The yellow copy stays in your files, if you certify your own ginseng. If you sell your ginseng to another dealer in a dealer to dealer transaction, you will release the white copy and yellow copy of the Purchase Form to the dealer purchasing your ginseng, as well as the ginseng. Pink Copy – Dealer Files The pink copy is an extra version of the form. This is used in dealer to dealer transactions. If you sell your ginseng to another dealer, keep this for your files. Image 6. Ginseng Purchase Form Log As a licensed dealer, you are issued a series of Purchase Forms. These purchase forms come in a bundled back of 25 forms. Each has its own serial number and are tracked to your dealer number. The purpose of this log is to account for all purchase forms. Do not transfer purchase forms. The serial numbers of the purchase forms are issued to your specific dealer number. The purpose of this form is to keep track of that status of the purchase forms issued to you. In the status column provide details such as, " Certified on __________ (date)", "Sold Dealer to dealer on ________ (date) to Dealer Number ______", or "Other, explained _________: " Submit to KDA once completed. DEALERS should make a copy of this form for your records. Each month, from September to April, you should submit a log sheet. If no buying activing, simply say, “no buying activity”. Selling Ginseng Dealers may sell ginseng to other dealers. This could occur before or after certification. If you as a dealer sell to another dealer, you must complete a Dealer-to-Dealer Transaction Form and keep your corresponding original, white Ginseng Purchase Forms to the Kentucky dealer you sell the ginseng. Dealer to Dealer Transaction Form As a dealer, you may not want to certify your ginseng for export, but sell it to another dealer instead. This form records such transactions. The white copy of the Purchase Form follows a Dealer to Dealer form until the ginseng is certified for export from Kentucky. This form is for ginseng sold from dealer to dealer that is uncertified. After a dealer-to-dealer transaction, it is then up to the buying dealer to certify the ginseng before export from Kentucky. As the selling dealer, you would also document your Dealer-to-Dealer sales on your Ginseng Purchase Form Log In case of dealer-to-dealer-to-dealer (or more) transactions, simply fill out a new form for each transaction. The white copy of the Purchase Form and white copy of all Dealer/Dealer forms must follow the ginseng until paperwork is presented for certification. Green Check to note whether the ginseng conditions is dry or green Dry at the time of the dealer-to-dealer transaction. Harvest Year Write in the ginseng harvest year. Weight (Pounds) Total weight listed on the Purchase Form in pounds. Total Weight Add up the weights of all Purchase Forms listed to obtain the total weight. Transaction Date Indicate the date when this transaction occurs. Seller Printed Name of Registered Dealer Print the name of the buyer legibly. Seller Signature of Registered Dealer Have seller sign their name Seller Dealer Number List the seller's dealer number Buyer Printed Name of Registered Dealer Print your name legibly. Copy Routing of Dealer-to-Dealer Transaction Form: The Dealer-to-Dealer Transaction forms are available in triplicate. The use of each color and copy is described below. Use a clipboard or other hard surface to fill out each form. Writing will transfer onto stacked forms; be sure you are only marking on one set of forms at a time. White Copy – KDA The white copy is the original of this form. The buyer on this form should submit the white copy of the Dealer to Dealer Transaction form, along with the white copy of the related Purchase Forms to the Kentucky Department of Agriculture to obtain an Export Certificate. In case of dealer-to-dealer-to-dealer (or more) transactions, simply fill a new form for each transaction. The white copy of the Purchase Form and white copy of the Dealer-to-Dealer Transaction Form of every transaction must follow the ginseng until paperwork is presented for certification. In dealer-to-dealer-to-dealer (or more) transactions, you are responsible for making your own copies of Purchase Forms for your files. The white copy always follows the ginseng until certification. Yellow Copy – Buyer The ginseng dealer buying ginseng from another dealer should keep the yellow copy on file. Pink Copy – Seller The ginseng dealer selling ginseng to another dealer should keep the pink copy on file. Other Notations: Keep all forms available on file for inspection. An Export Certificate will be issued from the Dealer-to-Dealer Transaction Forms and corresponding Ginseng Purchase Forms and root inspection. On the left are 16 underage roots. On the right is one legal root. Notice that 16 little roots barely weigh more than a single legal root. Not only is harvest of underage illegal, it is worthless. American Ginseng Export Certificate Exporting Ginseng out of Kentucky Before ginseng harvested in Kentucky can leave the borders of Kentucky, a Kentucky ginseng dealer must certify it for export out of Kentucky. This is true whether you are a harvester that lives in or out of state or a Kentucky ginseng grower planning to transport ship ginseng or dealer running a buying route. Export under the Kentucky Ginseng Regulations means “to transport, ship, carry, haul, take, or otherwise move ginseng collected in Kentucky outside of Kentucky.” Ginseng must also be certified at the state of origin before coming in Kentucky. Additionally, to export ginseng out of the United States, getting it out of the harvested state is the first step in that process. Once Kentucky ginseng is certified for export, it may be sold at any time to anyone, under Kentucky regulations. You will need to check with the importing state, especially in regards to hold over ginseng, for that state’s laws and regulations regarding ginseng. Certifying Kentucky Ginseng In order to certify Kentucky ginseng, you must first become a licensed Kentucky dealer. How to complete the American Ginseng Export Certificate KDA staff complete most of the Export Certificate. You are responsible for verifying your lot amounts are correct and submitted to us as part of your certification request. As a dealer, you will print your name, dealer number, signature, signature date, and dealer shipment number. Year Write in the year ginseng is harvested. Total Numerical Weight Write the weight in pounds, decimal format. Example, 12.21 (correct), not 12 pounds 3 ¼ ounces (incorrect). Total Written Weight Write out the weight with words, like you would on a check. For example, 12.21 would be twelve and 21/100 pounds. Printed Name of Registered Dealer Print your name legibly. To capture this information, fill in the five digit Purchase Form Number on the top right hand corner of the document. Do this for each Purchase Form which is included on this Export Certificate. For example, purchases indicated on Ginseng Purchase Forms 00001, 00011, 00021, and 00031 will be part of a shipment with Export Certificate Number 9999. Line Number(s) Write which lines (ranging from 1 to 10) from each Purchase Form are included on this Export Certificate. Total Pounds Write in the total poundage for the ginseng represented on the export certificate. Signature of State Agent A Kentucky Department of Agriculture staff member trained in the ginseng program will review your Purchase Forms and sign their name. Title of Agent Kentucky Department of Agriculture staff member's title Date of Certificate Date in which Kentucky Department of Agriculture staff member completes certification for this export certificate. Ginseng Certification Inspection We are making some changes to our ginseng certification procedures to expedite and minimize your time on KDA campus. Your cooperation and planning is critical for this year’s success and each other’s safety. In order to accommodate and provide the essential services from our office for your business, it is important for you to plan and anticipate your business needs. Our offices have reduced staffing to minimize potential exposure to COVID-19 and meet Healthy at Work Guidelines. Visitors are allowed on campus by appointment only. You must conduct a self-administered health assessment the day of your appointment and wear a mask. Ginseng Inspection Appointments 1. Ginseng inspections are by appointment. 2. To help make this process most efficient, an active email account is necessary. Please note that we often cannot send or receive emails from address hosted at the yahoo.com domain. Further, an email account from google, a gmail account, is required to use the self-scheduling 3. You may schedule an appointment using a google/gmail.com account. You will need to submit your Purchase Transaction Forms, Dealer to Dealer Transcation Form, and certification lot preferences before your appointment. We will review and record these documents before your scheduled appointment. 5. This is not an option if you need timely export certificates. We do not recommend mailing the original documents. Drop off the originals at our office. We have a drop box in our lobby you can leave an envelope with your documents. This is simply a drop off box; there will not be any staff available to assist you. 6. Submission deadline See the attached inspection calendar. Most inspection days fall on a Thursday or Wednesday; this changes from week to week. If the inspection day is Thursday, the submission deadline is Tuesday, except for holidays then the deadline is Monday. If the inspection day is Wednesday, the submission deadline is Monday. 7. We will confirm the recorded poundage and fees by email the day before your scheduled appointment. Please remember your check or money order to pay the certification fee on the day of your inspection. Inspection Day 1) Arrive at your appointment on time. 2) Complete your Visitors Health Assessment, including temperature check. 3) Bring the ginseng you are certifying for an inspection on the day of your appointment. The ginseng will be visually examined, weighed, and have a sample pulled for a root and age count. 4) Bring your original documents. 5) Bring your fee payment. Certification fee is $2.00 per pound and is payable by check or money order. Where to come on the day of your appointment: 1) You will come to the back of our building to our warehouse area/courtyard. a. To reach our warehouse, you will continue to the stop sign on Corporate Drive, rather than turning left up into our building lot as you typically do to come into the office. b. The warehouse for Markets is at the far end of the courtyard; there is a carport to the left as you come around in between the buildings and another by the markets building. We will have tables set up and tape to mark the requested social distancing for our and your safety. 2) If there is no one at the warehouse door, please call or text (502) 330- 5810. You should see a staff member at the table. Parking 3) Gather your original forms, fee payment via check or money order, ginseng, health assessment, and mask and bring them to the inspection area in the warehouse. 4) Provide your self-administered health assessment and have your temperature checked. You must wear a mask while you are out of your vehicle during your ginseng appointment. 5) Place your original forms and fee on the clipboard and ginseng for inspection on the table. 6) We will then step up to gather your documents to review and ginseng to conduct the root inspection. 7) Next, we will leave export certificates on the table for your signature. 8) You will sign the export certificates and leave the pink copies on the table in the clipboard. Your certification fee payment receipt will be on the clipboard for you to collect. 9) You will not have access to our facility for restroom or other needs, so please plan accordingly. We anticipate your inspection and certification to go very quickly compared to appointments in the past. 10) Each time you are scheduled we will confirm that you have receive and understand these instructions. If you have any other questions or concerns, do not hesitate to reach out. We will not allow walk-ins on inspection days. If you are delayed for your appointment time, you may be asked to reschedule for the next inspection day. Weight Receipt The ginseng buying and selling season for root harvested in the annual harvest season ends each calendar year on March 31. All ginseng harvested should be documented at this time either through the certification process or a weight receipt. There is no fee for a weight receipt. The Buying Season Ends Kentucky Department of Agriculture is the only agency at this time that can issue a MAR weight receipt. This is done by appointment at our office. 31 Harvesters and growers may obtain a weight receipt at the end of the season by appointment with no fee. Harvesters and grower may obtain weight receipts at the end of the season. These are available by appointment in our Frankfort office. For good stewardship, it is best to leave ginseng in the ground to continue growing for another season if you choose not to market it. Licensed Kentucky ginseng dealers have the choice between issuance of a weight receipt issued or export certification. There is a fee for the export certificate, but that allows a dealer to be able to legally export and sale their certified ginseng. Ginseng weight a weight receipt may not be certified until September 15 in the fall after successfully applying to be a licensed dealer. Our policy is to encourage an export certificate over a weight receipt for a licensed dealer. All holdover root from Kentucky licensed dealers must have a Copy Routing of American Ginseng Weight Receipt weight receipt of certification.
