AMERICAS BRAZIL Banco Central do Brasil delayed1 the entry into force of the regulations on internal policies, procedures and controls to be adopted by the regulated institutions in preventing the use of the financial system for the practice of crimes of "laundering" or concealment of assets, rights and values and financing of terrorism (PLDFT). Banco Central do Brasil also adjusted2 the regulation of the Special Temporary Liquidity Line backed by Guaranteed Financial Bills (LTEL-LFG), the maximum limit on loans taken by cooperative banks will become 100% of the Adjusted Shareholders' Equity calculated based on the Combined Balance Sheets of the Cooperative Systems. This seeks to give the same treatment to cooperative banks as that accorded to prudential banking conglomerates. The period for disclosing the “Pillar 3 Report”, referring to the base dates of March 31, 2020 and June 30, 2020, was increased3 from 60 to 90 days. UNITED STATES (FEDERAL) The White House released the Guidelines4 for Opening up America Again, offering guidance to state and local officials on a three-phase approach to reopening their economies. The Senate adjourned a pro-forma session yesterday without agreeing on an emergency bill5 to replenish the Paycheck Protection Plan. The Trump administration and Congressional Democrats will continue discussions to hammer out a deal through the weekend. Further session postponements: CT, RI, SC New tax deadline extensions announced: AK, IA, MD, MA, MI, MN, MO, WI New revenue projections or insight into potential revenue shortfalls: DE, IN, MD, PA Budget cuts being considered: AR, HI Colorado: Spending cuts initiated for current fiscal year Kentucky: Legislature overrode governor's line-item vetoes to budget and revenue bills Louisiana: Considering a special session Rhode Island: State financial planning meetings to occur in April and May Virginia: Governor has issued line-item amendments to the FY 2021-22 budget, including spending freezes Wisconsin: Special session held April 14-15 District of Columbia: DC will not seek to establish nexus for business tax purposes for employees temporarily teleworking in the District due to the coronavirus As of April 16, 2020, at least 23 legislatures (Alabama, Alaska, Arizona, California, Colorado, Connecticut, Delaware, Georgia, Guam, Hawaii, Illinois, Iowa, Kansas, Louisiana, Minnesota, Mississippi, Nebraska, New Hampshire, New York, Rhode Island, South Carolina, Tennessee and Virgin Island) have postponed their legislative session. EMEA AUSTRIA 2020/04/15 FMA extends ban on short selling of certain financial instruments listed on Vienna Stock Exchange, while also modifying it7 Extended the ban on short sales in certain financial instruments listed on the Vienna Stock Exchange. This is an extension of a measure enacted on March 18, 2020. The ban was extended through May 18, 2020. The ban now applies to all net short positions, and will take effect on April 16, 2020. BELGIUM 2020/04/15 Renewal of the Prohibition of Short Selling8 FSMA announces a renewal of the prohibition of short selling and similar transactions on the regulated market of Euronext Brussels, pursuant to Article 20 of the Regulation (EU) no. 236/2012 of the European Parliament (SSR). The prohibition will apply from April 17, 2020 through May 18, 2020. EU 2020/04/16 ESMA agrees to five short selling bans on national competent authorities due to coronavirus (COVID-19)9 The European Securities and Markets Authority (ESMA) has issued an official opinion agreeing to the renewal of the emergency restrictions on five short selling and similar transactions by the Finanzmarktaufsicht (FMA) of Austria, the Financial Securities and Markets Authority (FSMA) of Belgium, the Autorité des Marchés Financiers (AMF) of France, the Hellenic Capital Market Commission (HCMC) of Greece and the Comisión Nacional del Mercado de Valores (CNMV) of Spain. All five national competent authorities (NCA) imposed restrictions in March 2020 due to the coronavirus (COVID- 19) pandemic, which were due to expire in April 2020. The NCAs decided to renew the restrictions until 18 May with the possibility of further extension, as approved by ESMA. 2020/04/16 EIB Group establishes EUR 25 billion guarantee fund to deploy new investments in response to COVID-19 crisis11 Following a recommendation by the Eurogroup on 9 April, the Board of Directors of the European Investment Bank (EIB) today backed the creation of a €25 billion European COVID-19 guarantee fund. The fund will enable the EIB Group to scale up its support for European companies up to an additional €200 billion – with a focus on SMEs. GREECE 2020/04/15 Hellenic Capital Market Commission renews ban on short sales (Greek)12 The HCMC has renewed the ban on short sales and net short positions on the Athens Exchange. The ban applies to sales of shares covered by subsequent intraday purchases, and all related instruments relevant to the calculation of the net short position. It will go into force on April 25, 2020, and end at midnight on May 18, 2020. OMAN 2020/04/16 CMA issues virtual meeting guidelines13 Oman's Capital Market Authority (CMA) has issued new virtual general meeting guidelines. The guidelines apply to meetings of Public Joint Stock Companies and Investment Funds. In addition to Oman Capital Market Authority Decision No. E/25/2020, the Authority has issued Oman Capital Market Authority Decision No. E/8/202014 which explains the procedures to be followed in organizing these general meeting. QATAR 2020/04/16 Qatar's Commerce and Industry Ministry has issued Qatar Ministerial Decision No. 4/2020 on e-voting in the general assembly meetings of public and private companies (Lexis Middle East)15 Under the Decision, these companies can hold general assembly meetings remotely. SAUDI ARABIA 2020/04/15 King issues new package to mitigate economic impact of coronavirus16 Saudi Arabia's King has announced a new financial support package that has been approved. The 50 billion Riyal package includes financial support, exemptions, relief measures and accelerating payment of private sector dues. It is the second financial support package to be announced by the Saudi authorities. The King has also extended a discount of 30% for electricity bills for consumers in the commercial, industrial and agricultural sectors for two months. SPAIN 2020/04/15 Comisión Nacional del Mercado de Valores extends ban on net short positions by one month (Spanish)17 The ban applies to positions taken on Spanish trading venues (Stock Exchanges, the Alternative Stock Market, and MAB). The ban takes effect from April 18, 2020, and will remain in force through May 18, 2020. UK 2020/04/16 Further Details of Coronavirus Large Business Interruption Loans Scheme Announced Ahead of Launch18 Further details of the Coronavirus Large Business Interruption Loans Scheme (CLBILS) have been announced ahead of its launch on Monday, 20 April 2020. The restriction of the scheme to businesses with turnovers of no more than £500 million has been removed. All firms with a turnover of more than £45 million will now be able to apply for up to £25 million of finance, and up to £50 million for firms with a turnover of more than £250 million. 2020/04/15 FCA expectations regarding funds in light of coronavirus (COVID-19)19 The FCA has updated its expectations regarding funds during the COVID-19 outbreak. The update concerns paper-based and manual processes, unitholders dealing in units in authorized funds by post, fax or other physical means and what alternative fund managers should do if dealing by those means becomes impossible. 2020/04/16 Companies House support for businesses hit by COVID-1920 Changes announced today will help businesses avoid being struck off the Companies House register as they deal with the impact of the coronavirus outbreak. ASIA AUSTRALIA 2020/04/16 APRA announces new commencement dates for prudential and reporting standards21 The Australian Prudential Regulation Authority (APRA) has announced new commencement dates for six prudential and reporting standards that have been finalized but are yet to fully come into effect. It follows last month’s announcement that APRA was suspending the majority of its planned policy and supervision initiatives22 in response to COVID-19. At the time, APRA foreshadowed it would also consider adjusting implementation dates for policy initiatives that had been finalized but not yet commenced. KOREA 2020/04/16 FSC approves revised rules on misconduct in financial services23 The FSC has adopted revised rules and regulations for the examination and sanctions on financial institutions particularly regarding rules on exemption from sanctions and requests for regulatory interpretation and no-action letters. NEW ZEALAND 2020/04/16 Coronavirus (COVID-19) New Zealand—‘Safe harbor’ for company directors and business debt hibernation—what do these proposed changes mean for you and your business? (LexisPSL)24 Restructuring & Insolvency analysis: Last month, Dentons Kensington Swan predicted that the New Zealand government would relax reckless trading rules and introduce a safe harbor for directors in light of the coronavirus (COVID-19) pandemic. The government’s recent announcement of a temporary safe harbor for directors and the business debt hibernation scheme is a positive step to help struggling businesses and company directors under pressure. We examine these changes in more detail. PHILIPPINES 2020/04/16 Monetary Board Cuts Policy Rate by 50 Basis Points, Approves Package of Measures to Support MSMEs25 In its meeting on 16 April 2020, the Monetary Board assessed the impact of the COVID-19 pandemic on the Philippine economy. During the meeting, the Monetary Board decided to cut the interest rate on the BSP’s overnight reverse repurchase (RRP) facility by 50 basis points (bps) to 2.75 percent, effective Friday, 17 April 2020.
