AMERICAS UNITED STATES (FEDERAL) Senators Kamala Harris, Bernie Sanders and Ed Markey presented1 a bill today to give most Americans $2,000 a month during the COVID-19 pandemic. The plan would be retroactive to March. The legislation would provide a direct payment to individuals who make up to $120,000 throughout the pandemic and for three months thereafter. Married couples filing jointly would receive $4,000 and parents would get $2,000 per child for up to three children. Several GOP senators have voiced2 opposition to the latest Democratic proposed stimulus bill. Lawmakers are requesting3 that the Treasury Department reassess guidance the IRS issued last week stating that expenses associated with forgiveness of small-business loans under the Paycheck Protection Program (PPP) are not tax deductible. Yesterday, the Treasury Department said it would revise one of the pieces of tax guidance implementing provisions relating to the $2.2 trillion COVID-19 relief package. UNITED STATES (STATE SPECIFIC) As of 8am EST on May 8, 2020, there are 700 pending COVID-19 Legislations throughout 25 states. A total of 1,249 COVID-19 related bills have been enacted and proposed in the U.S. The high level summaries are included below. Over 300 executive actions have been issued in 50 states, Puerto Rico, the District of Columbia, Guam, and the Virgin Islands. Over 1,120 executive actions have been issued in total Over 145 bills have been introduced in 42 state legislatures, Puerto Rico, the District of Columbia, the Virgin Islands and Guam related to paid sick leave and worker protections as well as appropriations requests Over 30 states and the District of Columbia have issued emergency regulations on a number of issues including but not limited to insurance carriers, labor and wage, and medical licensure As of May 8, 2020, at least 18 legislatures (Alaska, Arizona, Colorado, Delaware, Georgia, Guam, Hawaii, Illinois, Iowa, Kansas, Nebraska, New Hampshire, New York, Northern Mariana Islands, Rhode Island, South Carolina, Tennessee and Virgin Islands) have postponed their legislative session. UAE 2020/05/08 Individuals, SMEs and private corporate customers seeing values of TESS5 The Central Bank of the UAE, CBUAE, has announced that to date, 75 percent was already draw-down from the AED50 billion liquidity facility, equivalent to AED37.2 billion total consumption of allocated funds. During the past two weeks, additional banks have joined the scheme, increasing the total number of banks participating in TESS to 24. UK 2020/05/08 Coronavirus and customers in temporary financial difficulty: draft guidance for insurance and premium finance firms (Financial Conduct Authority)6 The FCA has updated its guidance on its expectations for firms when dealing with customers of general insurance and pure protection contracts who may be experiencing temporary financial difficulty as a result of the coronavirus pandemic (COVID-19). It is not intended to have any relevance in other circumstances (for example customers in financial difficulty which pre-dates coronavirus, where existing forbearance rules apply). 2020/05/08 Hessen: Fourth Regulation to combat the coronavirus7 The Hessen State Government has updated 10th Corona-Virus Regulation Ordinance on the limitation of social contacts and the operation of businesses and offers based on the Coronavirus pandemic (Corona contact and operating restrictions regulation). California CA A 2496 Allows a credit against income taxes to a taxpayer that is a business with a physical location in the state in an Pending amount equal to the costs paid or incurred by the qualified taxpayer during the taxable year for the purchase of cleaning and sanitizing supplies used at business locations in the state to prevent the transmission of the novel coronavirus. California CA A 3123 Prohibits an employer from discriminating or retaliating against an employee for complying with an isolation or Pending quarantine order issued by a public health official due to a public health emergency. Requires an employer to grant paid sick leave to an employee, if the employer's place of business is closed by order a public health official, or if the employee is providing care or assistance to their child whose school or daycare provider is closed due to a public health emergency. California CA A 3208 Excludes from gross income, for state income tax purposes, any covered loan amount forgiven pursuant to the Pending federal Coronavirus Aid, Relief, and Economic Security Act. California CA A 3216 Makes it an unlawful employment practice for an employer to refuse to grant a request by an eligible employee Pending to take family and medical leave due to the coronavirus. Permits employees taking leave due to COVID 19 to continue participation in employee health plans, including life insurance or short or long term disability or accident insurance, pension and retirement plans, and supplemental unemployment benefit plans. California CA A 3329 Provides that following the termination of the Federal Pandemic Unemployment Compensation amount Pending provided pursuant to the CARES Act, or any other federal supplemental unemployment compensation payments for unemployment due to the coronavirus pandemic, that an individual's weekly benefit amount be increased by a specified amount for the remainder of the duration of time the individual is entitled to receive benefits. California CA S 117 Provides that due to the coronavirus, the instructional days and minutes requirements will be deemed to have Enacted been met during the period of time the school is closed. Extends the deadline to conduct the English learner assessment, unless otherwise determined by the Superintendent. California CA S 915 Prohibits the management of a mobile home park from terminating or attempting to terminate the tenancy of a Pending resident who is impacted by the coronavirus pandemic. Prohibits the management from imposing rent increases or other charges on top of what is included in a resident's base rent during the time the resident is making payments of overdue rent. California CA S 932 Requires the State Department of Public Health and each local health officer to collect data relating to the sexual Pending orientation and gender identity of individuals who are diagnosed with coronavirus. California CA S 939 Prohibits the eviction of tenants of commercial real property, including businesses and non-profit organizations, Pending during the pendency of the state of emergency related to coronavirus. Makes it a misdemeanor, an act of unfair competition, and an unfair business practice to violate the foregoing prohibition. California CA S 943 Authorizes wage replacement benefits to specified workers who take time off work to care for a minor child Pending whose school has been closed due to the coronavirus outbreak or to care for a special needs child or adult, or both, due to the outbreak. California CA S 1159 Amends existing law relating to the workers' compensation system. Defines injury for a critical worker to include Pending illness or death that results from exposure to coronavirus disease. Creates a disputable presumption that an injury that develops or manifests itself while a critical worker is employed arose out of and in the course of the employment. California CA S 1163 Authorizes existing law regarding a vote by mail voter who is unable to return their ballot to designate any other Pending person to return the ballot during a duly proclaimed state of emergency or local emergency due to an epidemic or other contagious disease, including Coronavirus disease; declares to take effect immediately as an urgency statute. California CA S 1196 Makes it a crime for a person, contractor, business, or other entity to sell or offer to sell goods or services for a Pending price at a certain percentage greater than the price charged by that person immediately prior to a date set by a proclamation or declaration of emergency. Makes it a crime for a person, contractor, business, or other entity who did not charge a price immediately prior to an emergency proclamation or declaration to charge a price more than fifty percent. 9
California CA S 1322 Relates to Remote Online Notarization Act. Authorizes a notary public to apply for registration with the Pending Secretary of State to be a remote online notary public. Provides that the act shall remain in effect only while there is a declaration of a state of emergency by the Governor related to the coronavirus in effect. California CA S 1410 Establishes the Coronavirus Disease Emergency Rental Assistance Program, to be administered by the Director of Pending Housing and Community Development; prohibits an owner who participates in the program from increasing the gross rental rate for the dwelling unit between the specified dates by the owner; creates the Coronavirus Disease Emergency Rental Assistance Fund in the State Treasury, and upon appropriation by the Legislature. California CA S 1431 Relates to existing law which requires a physician and surgeon and a dentist to refund any amount paid by a Pending patient for services rendered that constitutes a duplicate payment within 30 days after the patient's request for a refund if the duplicate payment has been received. Reduces the 30-day timeframe to 21 days. California CA S 1435 Requires the Governor's Office of Business and Economic Development, in cooperation with the Office of Pending Planning and Research, to track specified information regarding state opportunity zone investments and to post some of that information on the Office's internet website. Requires public agencies that are required to compile the development project lists to include specified information about projects funded by an opportunity zone fund. District Of DC B 718 (Enacted) Provides, on an emergency basis, authority to the Executive and to address critical needs of District Enacted Colombia residents and businesses during the current public health emergency including wage replacement, business relief, and additional authorities and exemptions regarding health, public safety, and consumer protection.
