FCC Update Relocation Payments Clearinghouse Updates ▪ On May 14, Intelsat submitted comments on the Relocation Payment Clearinghouse’s April 30 draft handbook of policies and procedures for the submission and processing of costs associated with the transition. Generally, Intelsat’s comments were geared toward streamlining the cost reimbursement review process by, for instance, minimizing the amount of evidentiary documentation required to be filed with each request, and reducing the amount of granular, impractical, or irrelevant detail needed to accompany reimbursement requests. ▪ Intelsat also advocated for the protection of commercially sensitive information, for the Clearinghouse to avoid unnecessarily second-guessing cost decisions made in good faith when reviewing reimbursements, and for the reimbursement of large costs to be possible on a milestone basis. ▪ In addition to its comments, Intelsat met with FCC staff regarding the issues above in a series of meetings described in a May 28 ex parte notice. ▪ The draft handbook can be found at: https://cbandrpc.com/guidance/Resources/RPC_C- band_Handbook_DRAFT_4-30-2021.pdf © Intelsat 2020 | Confidential & Proprietary 5
FCC Update, cont’d. Updates, cont’d. • Discussions with the Clearinghouse on a commercial agreement to govern its relationship with the satellite operators are ongoing. However, the satellite operators have provided an initial tranche of funding to the Clearinghouse to fund initial Clearinghouse operations • The FCC has yet to issue the 5G flexible use licenses won by the winning bidders in Auction 107, despite the fact that the pleading cycle for the FCC to receive challenges to the winning bidders’ license application forms ended in April. One pending issue is DISH’s protest of the auction wins by T-Mobile and Verizon, in which they claimed the winning bids by T-Mobile and Verizon would cause unacceptable spectrum consolidation in certain markets. Before the overlay licensees can fund Clearinghouse operations (including reimbursements), they must actually be awarded their licenses. • The satellite operators’ 2nd Quarterly Report for 2021 to provide updates on their progress with the C-band transition are due to be filed with the FCC by early July. © Intelsat 2020 | Confidential & Proprietary 6
