BOROUGH OF NORTH HALEDON ZONING BOARD OF ADJUSTMENT MINUTES January 7, 2021 Chairman Van Dyk called the Regular Meeting to Order and read the Open Public Meetings Act Statement Due to the current state of emergency, this meeting is being conducted electronically via Zoom and the directions on how to join the meeting for the public have been posted on the NH website WWW.NORTHHALEDON.COM STATEMENT: This meeting is called pursuant to the provisions of the Open public Meetings Law. This meeting of January 7, 2021, was included in a list of meetings notice advertised in the NORTH JERSEY HERALD NEWS & NORTH JERSEY RECORD on December 17, 2020 was posted on the door of the Municipal Building on the same date and remains continuously posted as the required notices under the Statute. In addition, a copy of this notice is and has been available to the public and is on file in the Office of the Municipal Clerk. Proper notice having been given, this regular January 2021 meeting of the North Haledon Board of Adjustments is called to order virtually and the Secretary is directed to include this statement in the minutes of this meeting. New Business Application # 1037 Applicant: Brian Link & Donna Cornelius RE: 7’frnt defic. 88 Edson Place rear yard variance North Haledon, New Jersey 07508 Block: 66.07 Lot: 17 A member from the public Mr. Abassi has joined the meeting. The Application is now complete. Both Applicants are sworn in. The Applicants state their case for a front yard variance on Bensam where 40’ is required – reduce to 33’ incorporate a staircase so a 7’ variance is required. The current rear yardage is 50’ required and it is currently at 22’ which will be maintained, it will be extended 6’ but not encroaching more. It is a variance of 28’. It is partly a safety matter. If we were on the deck, there is no way to exit, also, it is a little smaller than they would like. It will include the staircase. The railings will be 3’ high as per code. There will be plants for screening and shade. The rear deck will be replaced in the same footprint. It cannot be any larger because it will interfere with the driveway. Lattice will be under the deck to store lawn furniture and garbage pails. The lights that are existing will be the only lights. The Applicant has a letter from his attorney excusing the town from any responsibilities. The Attorney states that the Board can only grant them variances as to the requirements Borough ordinances, we cannot grant you any variances with respect to any setback on the the file map. In the future, if someone says that you don’t have good title because you violated the setback map, it is not at the liability of the Board. Mr. Vaccaro asked if the Applicant has looked for any other place to minimize the variance. The Applicant has and it would have to be a spiral staircase. Chairman Van Dyk asks if anyone from the public would like to speak. Mr. Waleed Abassi, 100 Mulberry Street. Suite 1301, Newark NJ 07102 is representing Tareef and Olla Abassi who reside at 57 Bensam Place. His clients would strongly object to any further encroachment to their yard. He would like clarification on how it is not encroaching further into his yard. Mr. Link testifies how it will not encroach further but the house is already nonconforming so a second variance is required. Public portion is closed.
A motion is made by Ron Tattersall to approve Application #103 with a front variance of 7’ and a rear yard variance of 28’ with natural screening. Seconded by: William De Block Roll call to approve: Ron Tattersall, William De Block, Anthony Vaccaro, Ralph Vuoncino,Rick Scrofani, Domenico Fusco, Chairman George Van Dyk. Attorney Faasse tells the Applicants the legal information APPROVAL OF PRIOR MINUTES: December 3, 2020 A motion was made by: Anthony Vaccaro to accept minutes with 4 changes per Ralph Faasse . Seconded by: Ron Tattersall. DISCUSSION Ron Tattersall gave Attorney Ralph Faasse commendation on all of his efforts and expertise with the Board. Happy New Year!
