Commitee REASONABLE ACCOMMODATION FOR FINANCIAL DISABILITY? WHAT? Mark Kelly President (Manufacturer Division) A recent Florida case decision by the Federal 11th Circuit Court of Appeals in Atlanta Nicole Weis has muddied the water on whether there is a “reasonable accommodation” on income Vice President (Filled guidelines for residency. The issue was whether a disabled individual could be granted a Communities Division) reasonable accommodation of counting his food stamp payments and a stipend from his father to achieve the income requirements to purchase a Habitat for Humanity home. Dwight Selby Treasurer (Retailer Division) Schaw v. Habitat for Humanity of Citrus County, Inc. involved an appeal from a Florida Middle Matthew Steiner District Court decision granting a motion for summary judgment which determined that Secretary (Filled Communities a reasonable accommodation did not have to be made to accommodate the effect of a Division) disability, that is the economic impact on the individual. Mr. Schaw is a quadriplegic who applied to purchase a Habitat for Humanity home. Habitat has income guidelines which Cyndi King Mr. Schaw did not meet with his social security income payments. (Supply & Service Division) The trial court, the Federal Middle District Court in Tampa, agreed with Habitat and ruled Alice Funk that Mr. Schaw was not requesting a reasonable accommodation based upon his handicap, (Finance & Insurance Division) but rather based upon his income. Matt Gentile (Finance & Insurance Division) The 11th Circuit Court of Appeals reversed and said that upon making a reasonable accommodation request, the burden goes to the owner of the real estate to determine Jim Hoekstra whether it can accommodate that request. The court said that the consideration of food (Filled Communities Division) stamp payments and the father’s stipend was reasonable because the income and inability John Overmier to work was an effect of his disability. The court engaged in a very detailed analysis, much (Supply & Service Division) of which is unimportant for the property manager, but did rule that a community owner or Gena Paugh manager needs to evaluate the impact of granting the accommodation. If it is a reasonable (Developer Division) accommodation that does not cause an “undue burden” on the property owner, the accommodation should be granted. In this case the appellate court said the trial court did not. Now the matter will likely go to trial on whether the denial was unreasonable, an expensive and time-consuming effort that will likely be avoided by a settlement. Where does this decision leave community owners and managers? When a reasonable accommodation is requested, it is important to determine how difficult it will be to grant the accommodation. If the accommodation does not inflict an undue burden on the property owner, the reasonable accommodation should be granted. Each request, however, must be evaluated on the specific facts and circumstances related to the person making the request. FMHA | 10
FMHA News September 1, 2019 REMINDER: Renew Your Dealer License Before Sept. 30, 2019 The Department of Highway Safety and Motor Vehicles has sent out reminders for you to renew your dealer license prior to their license expiration on September 30, 2019. On July 16, 2019, the Department emailed renewal notices and applications to 1173 licensed mobile home dealers and mobile home brokers and 341 licensed New and Used Recreational Vehicle Dealers. A renewal package was mailed to dealers without an email address on file. A completed renewal application form (HSMV 86720, “Renewal Application Motor Vehicle, Mobile Home, or Recreational Vehicle Dealers”), fee and required documents must be submitted to the local Regional Office responsible for your dealership. To ensure proper processing of renewal applications, dealers are advised to submit their completed renewal application, required documents and fee to the regional office. They are further advised not to submit their application to Tallahassee. All checks must be made payable to DHSMV. For assistance in locating one of the Regional Offices, please visit https://www.flhsmv.gov/pdf/dealerservices/ms_regional_offices.pdf. Local Regional Offices will be available to assist dealers from 8 a.m. - 5 p.m., Monday through Friday.
