NOTICE TO BIDDERS NOTICE IS HEREBY GIVEN that the County of Wyoming will receive sealed bids for insect spraying and extermination services at various County owned and/or occupied buildings . Bidding may include individual buildings or collectively. Such sealed bids must be received in the Wyoming County Department of Buildings and Grounds, 143 North Main Street, Warsaw, NY 14569, Monday through Friday, between the hours of 8:00 am and 3:30 pm, PRIOR TO 11:00 am on Tuesday, December ,15th, 2020 at which time said bids will be opened at the Wyoming County Buildings and Grounds office. Bid forms and detailed specifications may be obtained at the Wyoming County Department of Buildings and Grounds, at the above mentioned address, Monday through Friday, between the hours of 8:00 am and 3:30 pm. Or on line at www.wyomingco.net. Vendors may call to arrange for document pick up. No documents will be mailed. Any vendor submitting a bid based on incomplete or inaccurate information resulting from documentation received from any third party, shall not have cause for relief from award or completion of a contract in accordance with the official documents on file with the Wyoming County Department of Buildings and Grounds. It is highly suggested that all vendors interested in participating in this bid, contact the Wyoming County Department of Buildings and Grounds directly at the above address or telephone number to assure that they have received the most accurate and up to date material concerning this contract. The County does not offer nor supply anyone the list of people that have obtained a copy of these bid specifications or cost estimates for cleaning services at various County owned and/or occupied buildings. INSTRUCTIONS TO BIDDERS 1. Read all documents contained in the bid specifications. 2. Vendors are responsible for submitting their bids to the exact location indicated on the “Notice to Bidders” prior to the time indicated in the “Notice to Bidders”. No bids will be accepted after the designated time indicated in the “Notice to Bidders”. NOTE: This includes any changes listed on the latest addendum issued by the Wyoming County Department of Buildings and Grounds, if any. Delay in mail delivery is not an exception to the deadline for receipt of bids. 3. Bidders are responsible for reporting, in writing, any errors found in the bid specifications to the Wyoming County Department of Buildings and Grounds, 143 North Main Street, Warsaw, NY 14569. 4. Questions about or clarifications to the technical specifications must be made in writing to the Wyoming County Department of Buildings and Grounds prior to the bid opening. Such questions must be in the possession of the Wyoming County Department of Buildings and Grounds three working days prior to the bid opening unless otherwise indicated. Verbal questions may not be entertained. Questions may be emailed to Madamczak@wyomingco.net , Attention: Michael Adamczak. Include bid name. Faxed bids are not legitimate. All bids must be an original that is received from the Wyoming County Department of Buildings and Grounds. 5. Bidders shall indicate on the outside of their sealed bid the following information: 1. Title of Bid 2. Date and Time of Bid Opening 3. Company Name Vendors submitting “Alternate” pricing, products or services, must do so as a separate bid package to be considered for award. Each bid must be submitted under separate cover and will be considered on its own merits. 6. Each bid shall contain the following information: 1. County Bid Proposal Form, filled out completely. 2. Non-Collusion Bidding Certification and Iranian Energy Divestment form signed and dated. 3. Insurance Certificates per “Appendix A”. 4. Hold Harmless Form. 5. Offer to Contract Form. 6. Identification and background of the personnel involved in the project. 7. Letters of reference from recent clients for whom similar services were provided. 8. Any other information as noted in the bid document. 7. Failure to submit any of the above data may result in the rejection of the bid as non-responsive. Furthermore, the County reserves the right to require the vendor to supply any additional information it deems necessary to determine the successful responsive/responsible vendor and further to wave any minor informalities it deems in its best interest 3
Scope of work: Contractor will be responsible for pests/insects (spraying/removal) and/or rodent management at various County facilities that include but are not limited to the following: Pests/Insects: Spiders Cockroaches Beetles Crickets Ants (all species) Fleas Centipedes/Millipedes Moths Gnats Bees/Wasps/Hornets (any/all stinging insects) Biting insects Any/all other common insects Rodents: Mice Rats Moles Chipmunks Squirrels (all types) Other small Rodents Pests/Insects are to be sprayed. Rodents are to be baited (in bait boxes) or trapped. Exterior treatments: Each listed building upper and lower perimeter is to be treated/sprayed twice per year: - First treatment is to be performed no sooner than 4/15/2021 but no later than 4/30/2021 - Second treatment is to be performed no sooner than 9/1/2021 but no later than 9/15/2021 - Bait stations/traps to be maintained monthly, no later than 40 days between treatments. Interior treatments: - Public Safety (Jail side only), to be inspected for pests/insects and treated monthly (12 times annually), no later than 40 days between inspections/treatments. These areas include but are not limited to: Hallways, cells, blocks, restrooms, breakrooms, kitchens, offices, common rooms, any other room within the facility. All pest control services shall be performed in accordance with Federal, State, and Local rules and regulations. All chemicals used during the service must be approved for its intended use and applied in a manner consistent with all laws and regulations set forth by New York State. Contractor is to supply bait traps in areas required. Contractor is responsible for inspecting bait traps and maintaining bait traps on facility grounds. Contractor must be able to demonstrate that they have appropriate license and certifications for applicator that will be on site. Contractor will be responsible for any reporting to any State agencies in regards to chemical applications Contractor is to conduct inspection during routine services. Contractor is to provide a copy of inspection report within one week of service in an effort for the county to address any issues found. Contractor shall supply all labor, materials, tools and equipment necessary to safely preform the tasks outlined in this contract. Employees of the contractor must be identifiable as employees of the contracted. All work shall be performed in accordance to New York State Department of Labor law Article 8, PRC # 2020-901171 Contractor must supply service reports for areas that are treated to include what chemical was applied, the amount of chemical applied, where chemical was applied and what insects were treated. Report must provide license number and name of technician that conducted services. Employees of the contracted agency entering any secured areas such as the Wyoming County Jail to conduct interior treatments must submit to a background check. Wyoming County reserves the right to deny access to facilities based on outcome of background check. Contractor shall perform treatments after normal business hours, Monday through Friday or weekends if permitted. Schedules must be coordinated with the Wyoming County Facilities Director Invoices shall be submitted to County on or before the 15th of every month. All payments will be made with in thirty (30) days after an invoice has been approved. 5

METHOD OF AWARD Insect spraying and general pest maintenance will be awarded on a price per location. The Wyoming County Board of Supervisors reserves the right to reject any and all bids, to accept either in whole or in part a minimum of one (1) location per bidder, as may be provided in the specifications, or to waive any informality. Past performance and references will be considered to qualify bidders. Contracts are to be awarded for a term of three years starting January 1st, 2021 through December 31st 2023. WYOMING COUNTY DEPARTMENT OF BUILDINGS & GROUNDS BID FORM PROPOSAL FORM FOR BID to be publicly opened at the date and time indicated on the Notice to Bidders for Extermination and general pest control at various County owned and/or occupied buildings. Bids must be submitted in a sealed envelope marked “ PEST CONTROL” or box plainly marked as to its contents. Proposals must contain a statement of non-collusion as required by Section 103-d of the General Municipal Law. The County reserves the right to reject any or all bids. The Agency reserves the right to award the bid to the lowest responsible bidder whose bid best fits the needs of the Agency, to reject any or all bids, or to waive any informalities. APPENDIX B HOLD HARMLESS Purchaser , Public Services-Transportation The hereby agrees that it will indemnify (Name of Contractor) and save harmless the County of Wyoming from and against all losses from claims, demands, payments, suits, actions, recoveries and judgments of every nature and description brought or recovered against it by reason of any omission or act of the purchaser, its agents, employees, or subcontractors in the performance of this contract, to the extent permissible by law. This indemnification shall include all costs and disbursements incurred by the County of Wyoming in defending any suit, including attorneys’ fees. Furthermore, at the option of the County of Wyoming, the Contractor shall provide defense for and defend all claims, demands and causes of action referred to above, and bear all other costs and expenses related thereto. Iranian Energy Sector Divestment Contractor/Proposer hereby represents that said Contractor/Proposer is in compliance with New York State General Municipal Law Section 103-g entitled “Iranian Energy Sector Divestment”, in that said Contractor/Proposer has not: a) Provided goods or services of $20 Million or more in the energy sector of Iran including but not limited to the provision of oil or liquefied natural gas tankers or products used to construct or maintain pipelines used to transport oil or liquefied natural gas for the energy sector of Iran; or b) Acted as a financial institution and extended $20 Million or more in credit to another person for forty-five days or more, if that person’s intent was to use the credit to provide goods or services in the energy sector in Iran. Any Contractor/Proposer who has undertaken any of the above and is identified on a list created pursuant to Section 165-a (3)(b) of the New York State Finance Law as a person engaging in investment activities in Iran, shall not be deemed a responsible bidder pursuant to Section 103 of the New York State General Municipal Law. The County reserves its rights, in accordance with General Municipal Law Section 103-g to award the Bid/Proposal to any Bidder/Proposer who cannot make the certification, on a case-by-case basis under the following circumstances: 1. The investment activities in Iran were made before April 12, 2012, the investment activities in Iran have not been expanded or renewed after April 12, 2012, and the Bidder/Proposer has adopted, publicized and is implementing a formal plan to cease the investment activities in Iran and to refrain from engaging in any new investments in Iran; or 2. The County has made a determination that the goods or services are necessary for the County to perform its functions and that, absent such an exemption, the County would be unable to obtain the goods or services for which the Bid/Proposal is offered.
