CRAIGELLACHIE VILLAGE HALL WILL BE OPEN FOR VIEWING OF AUCTION LOTS FROM NOON UNTIL 2pm ON DAY OF AUCTION. AUCTION WILL COMMENCE AT 2pm. Enquiries prior to auction on 1 May 2019 should be sent to Craigellachie Village Council at: whiskyauctionCVC@gmail.com SCIO Craigellachie Village Council SCO 18399, Spirit of Speyside Whisky Festival Whisky Auction 1st May 2022 Terms and conditions Definitions • ‘Hammer price’ – the £ price at which a lot is knocked down [sold] by the auctioneer to the Buyer at the fall of the hammer. • ‘Lot’ – any item or items consigned with a view to sale at the auction. • ‘Organisers’ – Craigellachie Village Council [CVC] and their appointed auctioneers. • ‘Seller’ – the person who offers the lot for sale • 'Buyer' – the person who makes the final bid as determined by the auctioneer or the auctioneer’s clerk. Conditions: 1. All items sold as seen and are not subject to return. 2. The seller is responsible for the lot description and authenticity. The Organisers reserve the right to challenge and/or change obvious errors or omissions. 3. The Seller warrants that they are the true owner of the lots or that they are duly authorised by the true owner to place the lots for sale. 4. The Seller and the Buyer confirm that they are over 18 years of age. We reserve the right to challange & verify the age of anyone attempting to register to purchase whisky who appears to be under 25. 5. Sellers are limited to a maximum of 6 lots unless otherwise agreed by the organisers. 6. The Seller gives the Organisers absolute right to photograph and illustrate the Lots and to use these photographs and illustrations as the Organisers see fit, for the purpose of the auction. 7. The Seller shall indemnify ,defend and hold harnless both the Organisers and the Buyer separately, against all payments, costs, expenses, demands, or any loss or damage whatsoever and wheresoever incurred by either of them in respect of any breach of these Conditions by the Seller. 8. The Seller may stipulate a reserve price in pounds sterling. The auctioneer will action this reserve with a 10% discretion if necessary. If no reserve is agreed at the time of consignment all items will be sold, without reserve, at best on the day. All items will be sold at a price which complies with The Alcohol (Minimum Price per Unit) (Scotland) Order 2018. 9. The Seller authorises the Organisers to deduct from the hammer price a commission at the stated rate of 10% of each lot. The Buyer will also be charged 10% of the hammer price. 10. Sellers will be notified of any unsold lots within 21 days of the auction. An admin fee of £3 per lot will be payable when picking up unsold items. Arrangements for collections should be made by emailing whiskyauctionCVC@gmail.com 11. Seller Registration forms must be completed and returned to ‘J Tweedie, Cuil Sith, Brickfield Court, Craigellachie as soon as possible & no later than 9pm on 15th April in order to be catalogued. 12. The Lots are to be deposited at the Craigellachie Village Hall on 16th April, between 10am & 1pm. The Organisers shall arrange secure storage for the bottles from drop off until the auction date. The Organisers will use reasonable care when both storing and transporting the Lots. It is recommended that the Sellar procures adequate insurance for their Lots until the sale date. 13. Buyer registration forms will be available from members of CVC before the auction or on the day of the auction at the Village Hall. Bids can be registered before the auction via these channels or by emailing whiskyauctionCVC@gmail.com 14. Payment by cash [£ sterling], credit or debit card on the day of the auction. Any postal / packing costs will be at the cost of the buyer. Transfer of right of ownership from Buyer to Seller shall be upon payment being made to the Organisers. The risk of ownership, including but not limited to loss of or damage to the Lot shall transfer upon payment being made. 15. Any item that remains uncollected by 30th June 2022 will become the property of CVC. 16. The Organisers shall use reasonable endeavours to make payment to Sellers before 5th June 2022 17. We will only use your data to contact you about our whisky auction events if you have granted your consent for us to do so. If at any time you decide you no longer wish to be contacted, please advise us accordingly and we will delete your details from our records.
