Are you ready for transfer students with IEPs? • Timelines begin upon the Student’s enrollment [IDAPA 08.02.03.109.04(F)] • Written request for current IEP within two school days! • IEP Team determines whether new/additional assessments are necessary within five schools days of receiving the IEP. • IEP Team Meeting is necessary to create interim IEP with parent agreement or implement the current IEP. And… • If there is no agreement, the student is placed in General Education. • This means that the education provided the student is still appropriate. • Or in other words do not use the threat of a general education placement to force an agreed upon interim IEP with the parents. Implement the former district’s IEP • The current IEP from the Idaho school district shall be implemented if a new IEP cannot be developed within five (5) school days of the student’s enrollment or if a reevaluation will be taking place. • 60 calendar days [excluding periods when regular school is not in session of five or more consecutive days] from date of written consent to determine eligibility • Implement IEP within 30 days of eligibility determination unless parents agree to an extension. Go through Transfer Process Transfer Process (Formerly Known as Sufficiency Review) • IEP teams use the transfer process to review the special education records of incoming students and determine what next steps are needed to ensure that the student has uninterrupted access to FAPE. Important Reminder to LEA Charter Schools Charter Schools MUST adopt the Idaho Special Education Manual ANNUALLY CHAPTER 8: CHARTER SCHOOLS Federal law requires that students with disabilities be offered educational choices comparable to those offered to students without disabilities. One of these choices is the opportunity to attend a public charter school. Each public charter school, whether a charter school within a district or a charter school LEA (Local Education Agency), shares in the obligation to accept and appropriately serve students with disabilities under the IDEA in the same manner as any other public school. The LEA charter school board of directors/trustees is required to adopt and ensure that the LEA implements this Manual. Welcome Back for SY 21-22 – August 11, 2021 | 38

American Rescue Plan Act (ARPA) IDEA Supplement not Supplant Reminders • ARPA IDEA Part B funds do contain a supplement not supplant requirement. This is different from ESSERIII. • Supplement not Supplant defined: Prohibits states from replacing state funding (MOE) for a particular program with federal dollars. • You cannot move existing local funded (MOE) Special Education staffing positions to ESSER III funds. Meeting Maintenance of Effort • To ensure an LEA continues to meet the IDEA’s MOE requirements, the use of ESSER funds should not supplant or replace the use of local or state and local funds previously used to provide these services. • Remember that federal IDEA Part B funds are only utilized when you have first met Maintenance of Effort. Fiscal Accounting Software Survey • The SDE is interested in learning what type of accounting software is used by Idaho LEAs so that we may collaborate with LEAs to create training resources. • Our goal is to address common questions and processes required under IDEA Part B, as reviewed by the Special Education Fiscal Monitoring program. • Surveys launching August 16th, 2021. Fiscal Monitoring • If your District or Charter were monitored recently, we will be reaching out for final wrap ups on any corrective action that needs to bring you to compliancy. • You will then be issued a final letter to certify your IDEA Part B audit.
