A World Class Regulatory Program 11 A Top Priority of Army Civil Works and and USACE: • 1,168 members of the Regulatory Community of Practice • 55,000 authorizations annually * • 26,000 jurisdictional determinations (JDs) annually* *Stats as of Sept 30, 2020 Recent Program Changes: Nationwide Permits (NWPs) efficiently authorize minimal impact activities across the country • 2021 Final Rule (effective date March 15, 2021): Reissued 12 existing NWPs with modifications to increase program efficiency, Issued 4 new NWPs • 40 existing NWPs remain in effect under 2017 final rule, anticipate reissuing those 40 NWPs later this year in a separate final rule Navigable Waters Protection Rule (NWPR) (June 22, 2020) • Redefined definition of which waters are regulated under Clean Water Act • 4 Categories of Regulated Waters • 12 Categories of Exclusions • Defines terms used in regulations not previously defined Mission: Issue fair, timely, and balanced permit decisions that protect aquatic resources and navigation while authorizing needed development.
