BACKGROUND The Shire in its 2021/22 Annual Budget has allocated funds amounting to $4,605,474 for the acquisition of capital assets and undertaking infrastructure works. COMMENT The Capital Works Program for 2021/22 financial year are detailed below and details the progress made on each project. STATUTORY ENVIRONMENT NIL POLICY/FINANCIAL IMPLCATIONS To deliver the Capital Works Program within budgeted allocations. COMMENT Road Construction and Capital Yalgoo-Ninghan Road – NIL Yalgoo-Morawa Road – NIL Road Maintenance Maintenance Grade: Yalgoo-Ninghan Road, Badja Wool Shed Road, Muralgarra to Wagga Wagga Road, Jokers Tunnel Road, Badja Road, Wagga Wagga Road & Edah Station Air Strip. COMMENT The Local Government Act 1995 and the Local Government (Financial Management) Regulations 1996 requires the Chief Executive Officer to present a list of accounts paid and/or payable to Council and to record those accounts in the minutes of the meeting. STATUTORY ENVIRONMENT Local Government Act 1995 6.10 Financial Management regulations Regulations may provide for – a. The security and banking of money received by a local government’ and b. The keeping of financial records by a local government; and c. The management by a local government of its assets, liabilities and revenue; and d. The general management of, and the authorisation of payments out of – I. The municipal fund; and II. The trust fund, of a local government. Local Government (Financial Management) Regulations 1996 13. Payments from municipal fund or trust fund by CEO, CEO’s duties as to etc. 1. If the local government has delegated to the CEO the exercise of its power to make payments from the municipal fund or the trust fund, a list of accounts paid by the CEO is to be prepared each month showing for each account paid since the last such list was prepared – I. The payee’s name; and II. The amount of the payment; and III. The date of the payment; and IV. Sufficient information to identify the transaction. 15

Presented to the council at the next ordinary meeting of the council after the list is prepared; and b. Recorded in the minutes of that meeting. COMMENT Council was unsuccessful last financial year in receiving responses for the single dwelling, shed conversion, proposed by Architect Roly Brando. It is proposed that Council seek options from modular suppliers within specific parameters. The expected cost of this project sits close to the tender threshold and as such a tender is suggested. Administration will utilise an online portal as well as receive hardcopy applications. As there are currently no preferred suppliers in this supply category it is considered prudent to conduct the operation as a Tender. It is forceable that the whole project will exceed the threshold and even with the Shire providing some works themselves septic’s or other services could be considered avoidance if supplied by different parties. A document is provided detailing the timeline and scope of the tender. This will be placed online and also advertised in a Statewide Newspaper. Tender responses will be provided back to Council to consider inline with the current budget. Minutes – Ordinary Council Meeting – Friday 29th October 2021 14.3 Temporary Site Office – Paynes Find Roadhouse Applicant: Shire of Yalgoo Date: 23/10/2021 Reporting Officer: Chief Executive Officer Ian Holland Disclosure of Interest: NIL Attachments: Request for Extension SUMMARY That Council considers an extension to the temporary approval granted for the placement of site offices and sea containers on Lot 4315 Plan 190649 a Crown Land Lease held by Outback Enterprises (WA) PTY LTD. COMMENT At the Ordinary April 2021 Council Meeting held in Paynes Find Council resolved to grant structures associated with a road project a temporary exemption from the Shires Local Planning Scheme. After Administration investigated the site and determined that the project was not yet completed a request for extension was received from Ertech. As can be seen in the attached letter that the project has suffered a number of delays and a retrospective extension has been requested until November. The original exemption was provide from the 7th May 2021 and Council can not provide the exemption for a period greater than 12 months. The Shires Environmental Health Officer has attended the site to ensure that plans are in place to manage the extra capacity on site for the remainder of the project. Current Permitted Special Uses for Lot 4315 are listed as Road House, Short-term accommodation and Caravan Park. Under the Planning and Development (Local Planning Schemes) Regulations 2015 which is reflected in the Local Planning Scheme, Schedule 2, Part 7 Clause 61 states that development approval is not required for works if – under item 17 of the applicable table – the Works are “Temporary Works” and they follow the condition that “The works are in existence for less than 48 hours, or a longer period agreed by the local government, in any 12-month period. It should be noted that further checks such as building permits are not required as per the following extract from the Building Act 2011. 70. Buildings incidental to infrastructure (1) A permit is not required for a building or an incidental structure that is, or is proposed to be, used in the construction, operation or maintenance of road, rail, port, harbour, airport, water, sewerage, electricity, oil or gas supply infrastructure. (2) However, the permit requirement provisions apply to a building or an incidental structure of a kind mentioned in subsection (1) — (a) that is, or is proposed to be, a residential facility or a recreational facility; or (b) that members of the public normally use; or (c) to which members of the public are permitted access. 28

Minutes – Ordinary Council Meeting – Friday 29th October 2021 14.4 Capital Roadworks 2021/22 Applicant: Shire of Yalgoo Date: 23/10/2021 Reporting Officer: Chief Executive Officer Ian Holland Disclosure of Interest: NIL Attachments: NIL SUMMARY That Council determines the method by which Capital Road expenditure will be conducted in the 2021/22 Financial Year. COMMENT Last year the Shires works crew successfully prepared over 8km of Yalgoo-Ninghan Road for sealing and completed the project amid one of the wettest periods in over 50 years. Apart from a short stretch on the northernmost section, that was affected by heavy vehicle traffic, this work was completed to a high standard and the Shire Crew should be proud of their accomplishment. While we are now aware that this work can be accomplished by the internal crew some lessons have also been learnt with respect to our capacity. Conducting this work required significant grader hours and a large cost is born for travel when no camping or accommodation is considered closer to site. Utilising even one grader for construction removes our capacity to cover the rest of the network. Alongside Disaster Recovery Work there are a number of projects that are currently more beneficial for the crew to conduct such as culvert replacement and clearing, patching work, resheeting and construction jobs closer to the Yalgoo townsite. It is suggested that Administration approach WALGA preferred suppliers for quotes on the Shires Capital works on Yalgoo-Ninghan Road and Yalgoo-Morawa Road. COMMENT Council has recently secured funding for the renovation of the Yalgoo Community Hall from Lotterywest being $300,000. Now that this budget is known administration can prepare a Tender for the renovation of the facility. The opportunity exists to separate the process into two sections or one lump project, being Design then Construct or Design and Construct. Their also exists a secondary discussion on the level of renovation and the outcomes and length of life that would result from different options. Once all of the cladding is removed there may be historical instances of water damage to supports and internal beams. If the position of the building is not changed or improved drainage is not installed then water damage could see the building in a detrimental state in a short timeframe. Options also exist to maintain some parts of the building and replace others. As an example the kitchen and body of the hall could be reconstructed/repaired around the hall flooring and a new foyer with antechamber and ablutions installed at the front of the building. A new structure over the top of the Main Body of the building could be built to match the existing form or visual. This could be as simple as a prefabricated shed that is designed and coated to match the existing layout. Any form of building will be difficult off the back of Cyclone Seroja and a housing construction boom. It should also be noted that a drawn out design period may result in some funding such as stimulus funding being ineligible for the project. The resolution is informed by previous Council decisions relating to the Yalgoo Community Hall. COMMENT Under the Shires Governance Policy 1.5 it describes the circumstances in which a gift is provided to a Councillor in recognition of their service. As per the policy and section 34AC of the Local Government (Administration) Regulations 1996 the CEO is to arrange a suitable gift for departing Councillors. The Local Government Act 1995 and regulations require the gift to be set between specific thresholds as follows, when a 4 year term has been met. 5.100A. Gifts to council members A local government cannot give a gift to a council member unless — (a) the gift is given in prescribed circumstances; and (b) the value of the gift is less than a prescribed amount. [Section 5.100A inserted: No. 17 of 2009 s. 34.] 34AC. Gifts to council members, when permitted etc. (Act s. 5.100A) (1) The retirement of a council member who has served at least one full 4 year term of office is prescribed under section 5.100A(a) as circumstances in which a gift can be given to the council member. (2) The amount of $100 for each year served as a council member to a maximum of $1 000 is prescribed under section 5.100A(b) in respect of a gift given to a council member in the circumstances set out in subregulation (1). COMMENT Incidents of dogs at large increased across the school holidays but have since decreased. Last week a veterinary clinic was held at the Yalgoo Hall resulting in numerous spaying surgeries for both cats and dogs as well as vaccinations and registrations across 2 days. The next edition of the bulldust will remind residents of the importance of keeping dogs on a lease in a public place. Fines upwards of $200 can be issued for dogs that are loose in town. Responsible pet ownership will be advertised around town and it will be requested that the School help to promote this message as well. It is the intention of Administration to now capture any dogs that are left at large in or around the Yalgoo townsite. This will be performed from the existing budget which may have to be evaluated as part of the midyear budget review. COMMENT It is common practice throughout regional local government in WA to close Shire offices over the Christmas and New Year period. On days other than the public or Union Agreement holidays, employees will utilise annual leave entitlements, etc. for the normal work days affected. As per previous years it is proposed the closure take place from the 20 th December 2021 to the 31st of December inclusive. After the New Years Public Holiday Staff would return to the office on Tuesday the 4th of January. It is necessary that the office closure be advertised to inform the public in the Mid West Times newspaper, Yalgoo Facebook page and a notice on the Shire Office notice board. The Works Crew will also shut down across this period with arrangements made for the gardens, waterpark and some limited road maintenance. Minutes – Ordinary Council Meeting – Friday 29th October 2021 14.10 Proposed Land Swap Applicant: Shire of Yalgoo Date: 27/10/2021 Reporting Officer: Ian Holland Chief Executive Officer Disclosure of Interest: NIL Attachments: Mapping Reserve 3227 SUMMARY That Council consider a land swap proposed by the Department of Planning Lands and Heritage due to a Road Encroachment over Reserve 3227 which has been allocated for inclusion in the Yamatji Land Estate. COMMENT The following is provided by the Department of Planning, Lands and Heritage: The Yamatji Nation Indigenous Land Use Agreement (Yamatji Nation Agreement) was conclusively registered on 26 October 2020. A key commitment under the Yamatji Nation Agreement is the delivery of the Yamatji Land Estate. In accordance with best practice Crown land administration, the Department of Planning, Lands and Heritage (Department) requests your comment on a proposed land swap detailed below. Reserve 3227 in Yalgoo townsite is an unmanaged reserve with the purpose of “Public Utility” covering an area of 0.44 hectares. This parcel of land comprises Lot 95 (PIN 1011949) on Deposited Plan 223239 and is the whole of the land described in Qualified Certificate of Crown Land Title Volume 3012 Folio 750. Reserve 3227 is land allocated for inclusion in the Yamatji Land Estate. The constructed road, Campbell Street, encroaches on this land parcel as shown in the attached map. The Department is seeking comments as to whether the Shire of Yalgoo would support a proposed land swap for an area of land, equivalent to the area of the road encroachment, from the adjoining Campbell Street Road Isolation. Administration comment: This section of Campbell Street has existed for some time in its current form and was likely deviated so that access was easier to the MRWA Depot site on King St. Administration has no objection to an equal section of the northernmost road reserve being included in the reserve to preserve the currently existing road and maintenance zone. A lane access currently sits in between the existing properties and Horizon Power infrastructure sits across the lower part of the road reserve. COMMENT After initial in principal support at the Ordinary May meeting Council further resolved the following at a Special Meeting held on the 14th of June 2021. OFFICER RECOMMENDATION/COUNCIL DECISION Request for Road Use Agreement between the Shire of Yalgoo and Mount Gibson Mining Limited That Council: 1. Accept in principle the Shine Iron Ore Project - Proposal for Road Access put forward by Mount Gibson Mining and will provide comment on any sections discussed or where a differing view is held by Council; 2. Approve Mount Gibson Mining Limited’s CA07 application for a 3 month term in line with the payment arrangements in the proposal until a Road Use Agreement can be returned to Council for consideration (the Shires template Road Use Agreement as attached will be provided as a starting point); 3. The 3 month term of road owners permission (CA07 Letter) will start upon execution of the Pre-Work Agreement in point (4) with adequate traffic management to the satisfaction of the Shire. 4. Delegate to the CEO the negotiation and acceptance of a Pre-Work Agreement between Mount Gibson Mining Limited and the Shire of Yalgoo inclusive of Insurance, Bank Guarantee, Traffic Management and Pre-Work on Yalgoo-Ninghan Road; 5. Authorise the signing and sealing of the Agreement described in point (3) by the Shire President and Chief Executive Officer. Administration is following up on the position of a light tower and the condition of the intersection with the mines “freedom road” access. Unfortunately we have also been informed that the whole project has started winding down and the mine will be placed into care and maintenance. A request has been received to continue shipments until the end of the year for ore already extracted. It is expected that Mt Gibson will wish to continue working on a road use agreement for when the site will become operational again. This 42
