NOTICE TO BIDDERS Sealed bids will be accepted for Dover, Lower Windsor, Manchester, Newberry, Springettsbury and Windsor Townships, York County, Pennsylvania until 9:00 am, on March 1, 2021, at the Dover Township office, 2480 West Canal Road, Dover, Pennsylvania at which time and place they will be opened and publicly read for the following: Traffic Line Painting and Pavement Marking Specifications for the above item may be obtained at the Dover Township Office between 8:00 a.m. and 4:00 p.m. Monday through Friday. All bids must be sealed and clearly marked "Bids for Line Painting". The municipalities reserve the right to reject any or all bids and to waive any defects or irregularities in the best interest of the Townships. DOVER TOWNSHIP Laurel A. Oswalt, Manager
INSTRUCTIONS TO BIDDERS 1. The contractor acknowledges that although the contractor is bidding on a unit price for the total quantities on the Bid Proposal Form, each municipality has its own separate project and the successful bidder will be required to enter into separate contracts with each municipality. 2. As part of the bid, the contractor is required to complete the Bid Proposal Form attached hereto, based on the items and quantities specified by each municipality. The form may not be changed, modified, deleted or added ot in any manner whatsoever, nor shall any written or printed communication be added thereto no submitted therewith. 3. The contractor acknowledges that each municipality shall pay directly to the contractor the cost of materials and services furnished to the municipality by the successful bidder. Each municipality shall issue its own notice to proceed. 4. The contractor acknowledges that the contract signed by the successful bidder and the municipality shall consist of: A. Notice to Bidders B. Instructions to Bidders C. Bid Proposal Form All of which are attached hereto. 5. The public work specified in the bid documents constitutes maintenance work under the Prevailing Wage Act and, therefore, prevailing wage does not apply. 6. All bids shall be submitted in the place, time and manner set forth in the advertisement for bids. 7. The prices in this bid are neither directly nor indirectly the result of any agreement with any other bidder. 8. All blank spaces in the proposal shall be filled in clearly where indicated, either typed or written in ink. Altering and/or changing any part of this proposal will be sufficient reason for rejection. 9. The contractor hereby agrees to save harmless and fully indemnify Manchester, Dover, Lower Windsor, Windsor, Newberry and Springettsbury Townships and all its officers or agents from all damages, costs or expense that may be at any time imposed or claimed for infringement of any patent right of any persons, association or corporation as a result of the use by Manchester, Dover, Lower Windsor, Windsor, Newberry and Springettsbury Townships or any of their officers, agents,
Instructions to Bidders 2 Line Painting 2021-2022 or employees of the article(s) supplied under this contract and of which the contractor is not the patentee, assignee or licensee. 10. No contract may be assigned, sublet or transferred without written consent of the Boards of Supervisors of Manchester, Dover, Lower Windsor, Windsor, Newberry and Springettsbury Townships 11. The contract shall be awarded to the lowest responsible bidder or bidders, provided, however, that Manchester, Dover, Lower Windsor, Windsor, Newberry and Springettsbury Townships reserves the absolute right in its discretion to determine whether any bid is the equivalent of the specifications listed. 12. Manchester, Dover, Lower Windsor, Windsor, Newberry and Springettsbury Townships reserve the right to reject any and all bids, as well as to waive or assert any irregularity, informality or variation in any bids, as it may appear to be in the best interests of the Township. 13. No award will be made to any bidder who, in the opinion of the Boards of Supervisors, is in default on any bid proposal, or purchase order, or contract with the Township prior to date of the bid proposal under consideration. 14. The amount of the contract or contracts shall in all cases, whether of straight sale price, conditional sale, bailment lease or otherwise, be the entire amount which the Township shall be required to pay to the successful bidder or his assigns in order to obtain the services and/or property advertised for, and shall not be construed to mean only the amount which it pays to acquire title or to receive any other particular benefit of the whole bargain. 15. Manchester, Dover, Lower Windsor, Windsor, Newberry and Springettsbury Townships are EXEMPT from all excise taxes, as well as State Sales Tax and Gasoline Taxes. No tax shall be included in the Bid Price. Successful bidders will be required to furnish tax exemption forms with their invoices. 16. The successful bidder or bidders shall, within twenty (20) days of notification of award of the contract, shall furnish a bond with corporate surety satisfactory to the Township, in the amount of fifty percent (50%) of the amount of the contract, conditioned for his performance of the contract. 17. The Boards of Supervisors will reject all bids not meeting specifications. If a contractor furnishes articles not meeting specifications, and does not replace such articles, or if there is a failure to deliver within the specified time, the Township may contract for the same in the open market, deduct the expense, including any excess in price over that called for in the contract from the amount due the contractor from Manchester Dover, Lower Windsor, Windsor, Newberry and Springettsbury Townships,. If the amount due the contractor is not sufficient to
Instructions to Bidders 3 Line Painting 2021-2022 meet such expenses in excess price paid for, the Township may proceed against the contractor or his sureties under the bond or surety, by proper action through the Township Solicitor. 18. Any article that is defective or fails in any way to meet the terms of the contract or purchase order will be rejected. In the event a dispute regarding the quality or acceptability of the product, bidder shall furnish all equipment and personnel to conduct applicable quality testing, including but not limited to reflectivity, and furnish test results to municipalities. The decision of the Boards of Supervisors shall be final and the rejected material will be replaced by and at the expense of the contractor. 19. It is to be understood that any reference to a particular manufacturer's product, either by trade name or by limited description, has been made solely for the purpose of more clearly indicating the minimum standard of quality desired. The term "or approved equal" is defined as meaning any other make equal in material, workmanship and service, and as efficient and economical in operation. An article meeting these conditions may be accepted. 20. Be certain that adequate postage to cover mailing is attached in order to ensure prompt delivery of proposals. Manchester Township, York County, Pennsylvania, will not be responsible nor will it accept proposals delivered late or with postage due. 21. Bids may not be withdrawn for a period of thirty (30) days after the bid opening. 22. Bidder warrants that it is in compliance with the Americans with Disabilities Act (Public Law 101-336) and that it will, in carrying out the requirements of any contract awarded by the municipalities, comply in all respects with the provisions of the act and its implementing regulations. 23. Bidder shall furnish all materials, equipment, and personnel to complete the specified work. 24. The paint shall be Type II as per the Pennsylvania Department of Transportation (PennDOT) Traffic paint specifications dated August, 1979 (or most recent edition). 25. Successful bidder shall apply reflectorized glass spheres to both center and edge line stripes at the rate of six (6) pounds of glass spheres per pound of paint in accordance with the PennDOT specifications dated September 8, 1975 (or most recent edition). 26. Traffic line paint striping shall be applied in accordance with the PennDOT Publication #68, dated May, 1981 (or most recent edition) at a wet film thickness of 15 mils (+/- 1 mil). All work conducted must meet these specifications and pass inspections conducted by the municipality or, in the event of a dispute, the bidder.
Instructions to Bidders 4 Line Painting 2021-2022 27. Traffic line paint striping shall be applied to specific roads as identified upon the "Notice to Proceed". Successful bidder shall commence painting operation within thirty (30) days of the receipt of the "Notice to Proceed". Municipality (collectively or individually) may issue more than one "Notice to Proceed" during the contract year. 28. Traffic line paint striping shall be applied with a self-propelled, non-walk behind paint distribution machine which must be capable of simultaneously applying two (2) four inch (4") wide line stripes. Walk behind paint distribution machines shall be used to apply paint for crosswalks, stop bars and directional arrows. 29. Successful bidder shall implement the necessary traffic control techniques as identified in the Penn DOT Publication 213, dated September, 1983, (or most recent edition) for the purpose of controlling traffic and providing adequate drying time to prevent vehicular tracking. 30. Contract period shall be one (1) year from date of contract award. 31. Approximate quantities are listed on the attached bid proposal form for each municipality. Quantities of double yellow center line refers to linear feet of road. One road foot of double yellow centerline is listed as one LF not two LF. 32. Municipality (collectively or individually) will pay the successful bidder only for actual quantities of material applied. 33. Bids will be accepted until March 1, 2021 at 9:00 a.m. at the Dover Township Office, 2480 West Canal Road, Dover, Pennsylvania 17315, at which time they will be opened and publicly read. All bids shall be marked on the outside of the bid as follows: BID FOR LINE PAINTING - March 1, 2021.
