THE COURIER Foxfield Asphalt and Street Servicing The time has finally arrived to perform the repairs to several streets in Foxfield. These repairs will take place in multiple phases on each street and residents will need to move their vehicles from the following areas based on the schedule below. Part 1 – Underdrains and Concrete Curb Services The first portion of work will involve the excavation and installation of under-street drainage pipes and the replacement of various sections of concrete curb and gutter. The areas of service for the under-street drainage pipes on each of the streets listed below will be marked with white paint and arrows on the pavement and can also be viewed on an overhead map on Page 7. All vehicles must be removed from the indicated areas by 7 AM each day, weather permitting, and may return to park overnight after 5PM each day. The areas where curb and gutter replacements will occur are noted with yellow “X” marks on each section of curb to be replaced and will also be noted with an “X” on each parking space that needs to be emptied, again between 7 AM to 5 PM on each scheduled day of service. These services will take place as follows: Monday 8/24 and Tuesday, 8/25 – Devon, Fairmont and Gannon Way Tuesday 8/25 and Wednesday, 8/26 - Bickel and Dorrell Courts Wednesday 8/26 and Thursday, 8/27 – Southall and Asbury Way It will be necessary to ask that vehicles be removed from the street by 7:00 AM each day of the scheduled dates of the repairs. Any vehicle not moved by 7:00 AM will be relocated by the Proprietary towing service to make room for the repairs (A $55 fee will be assessed to the property if towed). Part 2 – Pavement Milling, Replacement and Striping The second portion of work will involve the milling, replacement and restriping of the entire asphalt surface of the affected areas of each street and can be viewed on an overhead map on Page 8. During these services, it will be necessary for each section to remain closed overnight through noon the following day to allow the new asphalt adequate time to cure before reopening to traffic. All vehicles must be removed from the indicated areas by 7 AM on the scheduled date and may not return until after noon on the following day. Each one of these phase section areas will be marked with paint and arrows to note the break points and dates for service. These services will take place as follows (Phase colors as noted on the map on Page 8.) A motion “to open two pools as soon as is practicable” was defeated by a vote of 2 “Yes” and 4 “No” votes This was not an easy decision to make and there were strong differences of opinion on both sides of the issue on the Facilities Committee, which could not reach a unanimous decision, and the Board of Directors. But as Jefferson said, “every difference of opinion is not a difference in principle.” The health and safety of CountrySide residents was the primary concern to all the volunteers involved and many factors were considered in making this decision. Phase 3 guidelines say that “swimming pools may be open at up to 75% occupancy, if applicable, provided ten feet of physical distance may be maintained between patrons not of the same household”. Applying the “10 feet of distancing” requirement, given the square footage of our pools, CountrySide would have had to operate at about 25% of normal capacities. With scheduled down times every two hours for the required cleaning, we would have been able to accommodate less than 5% of the estimated CountrySide population at the pools on any given day. We extensively researched the operating procedures that would be required under Phase 3 of the Forward Virginia plan. The costs of compliance was estimated at approximately $13,000-$14,000 per month per pool, which included the purchase of hand sanitizer dispensers, employing a professional cleaning service to perform enhanced cleaning procedures, the hiring of a security firm to monitor the mandated social distancing and to conduct the necessary screening, the purchase of signage to instruct and inform pool patrons on the State of Virginia guidelines, and the ongoing replenishment of supplies. The cost of compliance, which could have been covered in the existing pool management budget from the more than $30,000 in savings from not opening the pools prior to this time, to serve such a limited number of residents was raised as a concern by a member of the Board. We consulted our legal counsel and insurance agents on the question of liability risk, both of whom advised extreme caution. While many residents suggested the use of liability waivers to protect the Proprietary, our attorney informed us that in Virginia, one cannot waive personal injury in advance. Likewise, our insurance was unlikely to provide all the necessary coverage against claims resulting from a pandemic. We know this is disappointing, but please understand that the decision was not made lightly. The Board, the FAC, and the PMP staff devoted hundreds of hours exploring the requirements and our options to try to make it possible to open the pools safely. Although the decision was not unanimous, a majority of the Board ultimately decided that while Virginia has made strides in its attempts to contain the spread of the virus, the resurgence of the virus in communities both local and in other states is of ongoing concern. Even if we took all precautions advised by the CDC and the Virginia Department of Health, there is no way we could guarantee the protection of our residents against this insidious disease. The pools will be maintained as necessary to protect these valuable assets for future use, and while this is still a current ongoing expense, there will be some savings realized from the pool closures. The Board is evaluating the best way to refund these savings to property owners. Stay Safe. The CountrySide Board of Directors PAG E 10
THE COURIER Virginia DMV Extends Vehicle Registration The Proprietary has received several calls regarding automobiles with expired plates. Due to COVID-19, the DMV has made extensions for renewal of expired plates. From the DMV website: “Vehicle registrations expiring March-July are extended for up to 180 days, not to exceed October 31, 2020. All renewal fees (driver’s license, identification card and vehicle registration) will remain the same and no late fees will be assessed for customers who renew during the extension period. The month in which your new credential expires will also not change from the original date of expiration. For example, a customer with a vehicle registration originally expiring in April 2020 will have until October 2020 to renew, and the new credential will be valid until April 2021. Virginians eligible to renew their licenses, identification cards, or vehicle registration online are encouraged to take advantage of those services. Mail-in options are also available for a number of transactions, such as original title transactions, and, if mailed a notice, vehicle registration and driver’s license renewals.” Please check out https://www.dmv.virginia.gov/general/#covid19.asp for information regarding Vehicle Registrations. Loudoun County Schools Approve Virtual Start to Year Article by Ken Duffy, WTOP News, July 21, 2020 Early Wednesday morning, after hours of discussion, the Loudoun County School Board voted to enforce a full- time distance learning model for the start of the school year. Schools Superintendent Dr. Eric Williams made a presentation at the board meeting that started Tuesday night, but didn’t conclude until about 1 a.m. Wednesday. Loudoun County is the state’s third-largest school district. The motion to start the year exclusively online passed 7 to 2 after being introduced after midnight. The two votes against came from Jeff Morse and John Beatty. Williams said an all-virtual start will allow more time to deal with physical distancing challenges with any in- person learning that would be phased in if COVID-19 metrics allow. “Scaling up in stages with constant monitoring of implementation and data is more prudent,” Williams said. The initial plan was to go with a hybrid model of two days of in-person instruction for students per week. Earlier in the evening, the board provided a statement to WTOP in response to an inquiry about the likely change, which was then read by Williams at the meeting. “Based on the latest information we have, LCPS believes the school year should start with 100% percent distance learning, with very limited or no exceptions, and proceed with implementing the planned hybrid model in stages.” Before this, Loudoun County schools gave parents the option of choosing an education model. The survey of parents concluded about a week ago, and almost 40% wanted their child to go to class in person and mix in some online instruction. Loudoun County Health Department Director David Goodfriend also appeared at the meeting to take questions about COVID-19 concerns, but ultimately told the Board “it’s your decision” about how to start the next school year. Goodfriend also said the level of COVID-19 transmission is not the main concern. “The key challenge is maintain the 6-foot distancing,” which Goodfriend said is “critical.” The Loudoun Times-Mirror also reported that recent delays in processing virus tests played into the decision to endorse the exclusively online model. Subject to the provisions of Article 2 of 55-509, a person selling a lot shall disclose in the contract that (i) the lot is located within a development which is subject to the Virginia Property Owner’s Association Act; (ii) the Act requires the seller to obtain from the property owners’ association an association disclosure packet and provide it to the purchaser….. When the Proprietary receives an order for a POA packet it initiates a physical inspection of the entire property. The inspection of exterior maintenance items includes peeling paint, algae on siding, broken window seals, wood rot, fences in need of repair, etc. In addition, exterior modifications/enhancements are noted and checked for approval. If you haven’t done so already, please ensure that you have submitted an application for those exterior modifications. An application with a violation disclosed upon a POA inspection may request a “non-standard rush review” (less than 15 days). There will be a fee of $25.00 for this out-of-cycle, expedited review. This fee is not a commitment for approval. Selling a home can be stressful enough so ensuring the exterior of your home is in tip top shape and you have applied for and been approved for any exterior modifications before you list will make the selling process much smoother.
