         Draft Minutes of a Regular Meeting of Council
          held on Monday, September 21st, 2020 at 4:00 p.m.
             in the Township of Seguin Council Chambers
                      and Electronic Participation

The following Members were present:
                   Mayor Ann MacDiarmid (Council Chambers)
                   Councillor Art Coles (videoconference)

Approval of Agenda.
After the meeting was called to order Mayor MacDiarmid asked for approval
of the agenda. Council approved the agenda with the following
additions/changes. Addition of item 09.5 Business and item a) Vianet Inc.
Report to Seguin Council re: Status and Considerations Relating to Tower
Site, Otter Lake. Addition to 13. Correspondence of item y) AGCO - Public
Notice Cannabis Application. Addition to 14. Closed Session item b) Fill By-
law Exemption Request 58 Broken Trail of an email from the applicant, Mr.
Exler. Addition to 14. Closed Session item d) An update via email from the
consultant on the recruitment for the position of Chief Administrative Officer
(CAO) and a draft letter of offer of employment. Addition to 14. Closed
Session of item e) Update re: Local Planning Appeal Tribunal – Appeal to
Zoning By-law Amendment Application No. R-2019-0017-H Hiebert.

Disclosure of Pecuniary Interest.
Mayor MacDiarmid requested that any disclosures of conflict of
interest/pecuniary interest be declared for the record. Councillor Fellner
declared a possible conflict of interest/pecuniary interest related to agenda
item 05. b) Accounts “B”, payment to Wayne Hall Construction as the Party
is Councillor Fellner’s employer. Councillor Fellner did not participate in the
consideration of this matter.

Council considered Staff Report No. CS-FC-2020-009, 2020 Benthic
Monitoring Report. Katarina Krievins of the Georgian Bay Biosphere Reserve
was present via videoconference to answer any questions Council had
related to the program.

George Stivrins and Michael Reeves representing 1636411 Ontario Inc.
addressed Council via videoconference to discuss improvement of access to
their property (Property Roll No. 4903-030-009-01500). Council directed
staff to meet with Mr. Stivrins and Mr. Reeves to review their proposal for
upgrading of an entrance to the property from either Oastler Park Drive or
Parry Sound Road and to report back to Council on the discussion and
options.

Council considered Staff Report No. CS-FC-2020-010, 2019 Water Quality
Monitoring Report. Kris Hadley of Hutchinson Environmental was present via
teleconference to answer any questions Council had related to the program.

“THAT as per the recommendation of Staff Report No. DPS-PL-2020-101,
Enhancements to the Shoreline By-laws Council does hereby direct staff to
undertake revisions to the following By-laws and report back to Council with
Draft By-laws for Council consideration:

       By-law No. 2008-103, Being a By-law to regulate the protection,
        preservation and removal of Trees within the Township of Seguin.
       By-law No. 2008-104, Being a By-law to prohibit or regulate
        blasting in areas of the Township of Seguin.
       By-law No. 2008-105, Being a By-law to prohibit or regulate the

placing or dumping or removal of fill in areas of the Township of
        Seguin.”.

“THAT the Council of The Corporation of the Township of Seguin does
hereby grant an exemption for 9 Yoho Island, Property Roll No. 4903-010-
005-11572-0000, (Watson) pursuant to Section 5.1 of By-law No. 2008-105,
Being a By-law to prohibit or regulate the placing or dumping or removal of
fill in areas of the Township of Seguin, subject to the conditions as
recommended in Staff Report No. DPS-PL-2020-102, copy attached as
Schedule “A” to this resolution.”.

“THAT as per the recommendation of Staff Report No. PW-RD-2020-019 the
Council of The Corporation of the Township of Seguin does hereby declare
the following equipment as surplus and authorizes staff to dispose of the
equipment:

   4 Yard Meyer Sander Unit.
   Utility trailer.”.

The Mayor advised Council would now consider the following shore road
allowance application:

   Shore Road Allowance Application No. RAS-2019-0010-H (Waldman).
    Whitefish Lake. By-law No. 2020-087.

The Mayor asked if any written objections had been received.

The Clerk advised no written objections had been received.

“THAT By-law No. 2020-087, being a By-law to close, stop up and sell a
portion of original Shore Road Allowance, Application No. RAS-2019-0010-H

Resolution No. 2020-400

“THAT By-law No. 2020-090, Being a By-law to stop up temporarily part of
the highway municipally known as Victoria Street East in the Village of

           Council Minutes of September 21st, 2020, Page 4 of 7
Rosseau, now the Township of Seguin, District of Parry Sound, is hereby
deemed to have been read a first, second and third time and passed by
Council.”.

                                                                     CARRIED

Council considered a Report from Vianet Inc. on the status and
considerations relating to the proposed telecommunication tower site near
Otter Lake. Council directed staff to advise Vianet Inc. that Council would
like Vianet to review other potential broadband telecommunication tower
locations in place of the proposed 125 Rankin Lake Road location.

Council also directed staff to send Councillors Osborne and Moffatt the
Vianet Inc. contract.

Council directed staff to review the letters of interest for appointment to the
Committee of Adjustment which had previously been received and report to
Council on an appointment to fill the vacancy on the Committee.

Council directed staff to add discussion regarding rumble strips on municipal
roads to the October 5th, 2020 Council Meeting Agenda.

Council directed staff to obtain an update from the Ministry of Transportation
Ontario regarding alleged illegal signs on the Highway #141 corridor at
Sandy Plains Road, the Seasons of Muskoka sign and signs in the Village of
Rosseau.

           Fill By-law Exemption Request – 58 Broken Trail, Exler.
           Local Planning Appeal Tribunal – Appeal to Zoning By-law

District of Parry Sound more particularly described as Part 1 Plan 42R-
21164, is hereby deemed to have been read a first, second and third time
and passed by Council.”.

“THAT the Council of The Corporation of the Township of Seguin does
hereby grant an exemption for 58 Broken Trail, Property Roll No. 4903-030-
001-02900-0000, (Exler) pursuant to Section 5.1 of By-law No. 2008-105,
Being a By-law to prohibit or regulate the placing or dumping or removal of
fill in areas of the Township of Seguin, subject to the following conditions as
outlined in Staff Report No. DPS-PL-2020-100:

   1. That the property is subject to site plan control as per Section 4-
      1.a)(iv.) of the Site Plan Control By-law 2011-083;
   2. That the beach area east of the main staircase and stairs into Otter
      Lake west of the main staircase are removed and the associated
      shoreline areas be rehabilitated by a professional ecologist by June 1st,
      2021 to the satisfaction of the Township of Seguin; and,
   3. That any further shoreline development be in compliance with the
      regulations of Zoning By-law 2006-125 in effect at the time of the
      granting of the relief to Fill By-law 2008-105.”.
