The Corporation of the Township of Seguin Draft Minutes of a Regular Meeting of Council held on Tuesday, April 6th, 2021 at 4:30 p.m. in the Township of Seguin Council Chambers and Electronic Participation The following Members were present: Mayor Ann MacDiarmid (Council Chambers) Councillor Art Coles (videoconference) Councillor Ted Collins (teleconference) Councillor Terry Fellner (videoconference) Councillor Gail Finnson (videoconference) Councillor Daryle Moffatt (videoconference) Councillor Rod Osborne (videoconference) Approval of Agenda. After the meeting was called to order Mayor MacDiarmid asked for approval of the agenda. Council approved the agenda with the following additions/changes. Addition to item 06. Shore/Concession Road Allowances item a) Application No. RAC‐2019‐0015‐F (Smith) of correspondence from Klaus & Elisabeth Tomantschger, Jeff & Deb Smith and, Jaimes & Jennifer Blunt. Disclosure of Pecuniary Interest. Mayor MacDiarmid requested that any disclosures of conflict of interest/pecuniary interest be declared for the record. None were declared. The following resolutions were considered. CARRIED Resolution No. 2021‐072 Moved by: Councillor Rod Osborne Seconded by: Councillor Terry Fellner “THAT the Council of The Corporation of the Township of Seguin does hereby adjourn the Regular Meeting to hold a Public Meeting for the following matters: Council Minutes of April 6th, 2021 Page 1 of 15
Consent Application No. B‐2021‐0002‐H (Russell/Newton). Consent Application No. B‐2021‐0004‐H (Nullmeyer). Consent Application No. B‐2021‐0003‐H & Zoning By‐law Amendment No. R‐2021‐0002‐H (Jacklin).”. CARRIED The Mayor advised Council would now hold public meetings for proposed Consent and Zoning By‐law Amendment Applications. The Mayor advised in accordance with the Planning Act, Council would consider all matters placed before it prior to granting a Consent or passing a Zoning By‐law. The Mayor advised if a person or public body who files an appeal of a decision of the Council of The Corporation of the Township of Seguin in respect of a proposed Consent does not make written submissions to the Council before it provides or refuses to provide a provisional Consent, the Local Planning Appeal Tribunal may dismiss the appeal. The Mayor advised anyone who wished to receive Notice of the passing of a Zoning By‐law Amendment not owning land within 120 metres of the area to which it applies and who has not submitted such a request in writing should provide their full name and address to the Clerk. The Mayor advised if a person or public body does not make oral submissions at a public meeting or make written submissions to the Council of The Corporation of the Township of Seguin, the person or public body is not entitled to appeal the decision of Council to the Local Planning Appeal Tribunal and the person or public body may not be added as a party to the hearing of an appeal before the Local Planning Appeal Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to do so. The Mayor advised the purpose of Consent Application No. B‐2021‐0002‐H (Russell/Newton) is to sever an existing 0.64 hectare waterfront parcel at 31 High Hill Road, mutually owned by the Russell’s and Newton’s. As a Condition of Consent, the subsequent parcels would be added to the neighbouring properties, resulting in one less waterfront parcel. A lot area of 0.32 hectares from the existing lot would be added to the benefitting lands at 36 High Hill Road (the Russell’s). The remaining 0.32 hectares would be added to the benefitting lands at 27 High Hill Road (the Newton’s). The Mayor asked the Clerk to state the method by which Notice of the meeting was provided and the dates on which that Notice was provided. The Clerk advised Notice of the public meeting was provided by posting the Council Minutes of April 6th, 2021 Page 2 of 15
property and by regular mail on March 23rd, 2021. Notice was therefore considered to be provided in accordance with the requirements of the Planning Act. The Mayor asked if anyone had registered to speak in favour of or in opposition to this application. The Clerk advised David Falkanger of Falkanger Designs, Agent for the Applicant, had registered to speak to this application. David Falkanger spoke to explain the reasons for the application and to answer any questions Council may have of him related to the application. The Mayor asked if the Township had received any correspondence with respect to this application. The Clerk advised no correspondence had been received. The Mayor advised the purpose of Consent Application No. B‐2021‐0004‐H (Nullmeyer) is to permit a boundary adjustment. The granting lands (98B Maile Run) would convey a parcel having an area of 163 sq. m and frontage on Lake Joseph to the benefitting lands at 31 High Point Road. As a result of the adjustment, the benefitting lands would be increased to 2.92 hectares, while maintaining the existing lot frontage. The retained lands would have a lot area of 11.78 hectares, while maintaining the existing lot frontage on Lake Joseph. The Mayor asked the Clerk to state the method by which Notice of the meeting was provided and the dates on which that Notice was provided. The Clerk advised Notice of the public meeting was provided by posting the property and by regular mail on March 23rd, 2021. Notice was therefore considered to be provided in accordance with the requirements of the Planning Act. The Mayor asked if anyone had registered to speak in favour of or in opposition to this application. The Clerk advised Chloe Spear and Jamie Robinson of MHBC Planning Urban Design & Landscape Architecture, Agents for the Applicant, had registered to speak to this application. Chloe Spear and Jamie Robinson provided a brief presentation to explain the reasons for the application and to answer any questions Council may have of them related to the application. The Mayor asked if the Township had received any correspondence with respect to this application. The Clerk advised no correspondence had been received. The Mayor advised the purpose of Consent Application No. B‐2021‐0003‐H (Jacklin) is to create one new 2 hectare rural lot with 100 metres of frontage on McCauley Road. The Retained Lands would have a resulting lot area of 38 hectares with 300 metres of frontage on McCauley Road. The Mayor advised the purpose of Zoning By‐law Amendment Application No. R‐ 2021‐0002‐H (Jacklin) is to rezone the proposed severed lot from the Rural (RU) Zone to the Rural‐Exception Thirty‐Nine (RU‐39) Zone to recognize the deficient lot area and frontage. The Mayor asked the Clerk to state the method by which Notice of the meeting was provided and the dates on which that Notice was provided. The Clerk advised Notice of the public meeting was provided by posting the property and by regular mail on March 17th, 2021. Notice was therefore considered to be provided in accordance with the requirements of the Planning Act. The Mayor asked if anyone had registered to speak in favour of or in opposition to these applications. The Clerk advised no one had registered to speak to these applications. The Mayor asked if the Township had received any correspondence with respect to these applications. The Clerk advised no correspondence had been received. The Mayor advised Council would now close the public meeting and reconvene the regular meeting. CARRIED The Mayor advised Council would now consider the following road allowance application: Concession & Shore Road Allowance Application No. RAC‐2019‐0015‐F (Smith). By‐law No. 2021‐018. The Mayor asked if any correspondence been received related to this application. The Clerk advised correspondence stating objections had been received from Council Minutes of April 6th, 2021 Page 5 of 15
Klaus & Elisabeth Tomantschger and Jaimes & Jennifer Blunt. Correspondence had been received from Jeff & Deb Smith, the Applicants with additional information on the application. Further correspondence had been received from Klaus Tomantschger advising he had spoken with Township staff and now had a better understanding of the application and his concerns were addressed. The Mayor asked if anyone had registered to speak to the application. The Clerk advised Jeff & Deb Smith, the Applicants had registered to speak to the application. Jeff & Deb Smith spoke to provide further information on the reasons for the application and to answer any questions of Council related to the application. CARRIED Resolution No. 2021‐079 Moved by: Councillor Terry Fellner Seconded by: Councillor Ted Collins “THAT By‐law No. 2021‐019, Being a By‐law to deem Lot 5 and Lake Avenue on Plan 217 pursuant to Section 50(4) of The Planning Act not to be on a plan of subdivision (Property Owner: Deborah and Jeff Smith, Property Roll No. 4903‐030‐ 004‐05504, File No. D‐2020‐0004‐F), is hereby deemed to have been read a first, second and third time and passed by Council.”. CARRIED Christy Cafovski, Executive Director and Gail Burrows President of the Parry Sound Area Chamber of Commerce addressed Council to provide an update on activates and initiates undertaken by the Chamber. Council thanked Ms. Cafovski and Ms. Burrows for their presentation. Greg Mason representing the Georgian Bay Mnidoo Gamii Biosphere Community Nominated Priority Place addressed Council to provide a presentation and update on the Community Nominated Priority Place Project for Species at Risk including attention to regional learning and planning opportunities; habitat mapping, roads ecology and Better Management Practice tools as well as land use planning and management assessment. CARRIED Resolution No. 2021‐087 Moved by: Councillor Daryle Moffatt Seconded by: Councillor Art Coles “WHEREAS on December 7, 2020 the West Parry Sound District Museum (the Museum) representatives completed a deputation to The Corporation of the Township of Seguin (Seguin) and submitted an application for funding for 2021 in the amount of $17,500.00 (the 2021 Funding); AND WHEREAS the 2021 Funding was included in the Seguin preliminary 2021 Council Minutes of April 6th, 2021 Page 8 of 15
Budget as discussed on February 1, 2021; AND WHEREAS the 2021 Funding was held until May or June 2021 because the Museum was currently closed to the public and had sufficient cash flow to pay its outstanding expenses; AND WHEREAS at the March 1, 2021 Council meeting, Council was informed that Councillor Moffatt has resigned from the Museum’s Board of Directors due to Board governance matters; AND WHEREAS by separate resolution, Seguin Council will appoint a new representative for the Museum’s Board of Directors who will report back on the Board governance matters; AND WHEREAS Councillor Moffatt had requested that a review of the 2021 Funding be completed before contributing to the Museum; AND WHEREAS the Seguin 2021 Budget was approved at the April 6, 2021 Council meeting, which included the 2021 Funding. THEREFORE BE IT RESOLVED THAT Seguin hold the 2021 Funding until such time as the Board governance matters have been resolved and the Museum is open to the public on a regular basis. At such time, Seguin Council will review the 2021 Funding request to determine the appropriate amount to contribute to the Museum.”. CARRIED Council considered correspondence from James Chirico, Medical Officer of Health/Executive Officer of the North Bay Parry Sound District Health Unit in response to Council Resolution No. 2021‐066 requesting COVID‐19 Statistics for the West Parry Sound Area. The correspondence was received as information. Resolution No. 2021‐090 Moved by: Councillor Art Coles Seconded by: Councillor Gail Finnson “WHEREAS, the Township of Seguin is within the district of the North Bay Parry Sound District Health Unit (Health Unit); and WHEREAS, the Health Unit received its first allocation of vaccine more than a month and a half later than Southern Ontario and Ottawa health regions; and WHEREAS, vaccine allocation for the Health Unit has not increased over time to compensate for the delay in provision of the first vaccine allocation; and WHEREAS, COVID‐19 transmission rates in Northern Ontario, as evidenced by the effective reproduction numbers R(t), are among the highest in the province; and WHEREAS, due to the vaccine allocation, the Health Unit is still in phase 1 of the rollout while public health unit regions in Southern Ontario and Ottawa are in phase 2; and WHEREAS, 26.5% of the population in the Parry Sound District and 22.4% of the population in the Nipissing District are aged 65 years or older, compared to 16.7% for all of Ontario (2016 Census); and WHEREAS, the delay in the Health Unit vaccine allocation and smaller vaccine quantities are causing increasing inequities in the booking of COVID‐19 Council Minutes of April 6th, 2021 Page 10 of 15
vaccination clinics; and WHEREAS, due to the vaccine allocation, our front line medical personnel and first responders and Indigenous populations have not received their required allocation. NOW THEREFORE BE IT RESOLVED THAT the Council of The Corporation of the Township of Seguin requests that the vaccine allocation be prioritized to public health unit regions that are still in phase 1 to enable them to catch up to those regions in Southern Ontario; and FURTHERMORE BE IT RESOLVED THAT this motion be forwarded to the Honourable Doug Ford, Premier of Ontario, the Honourable Christine Elliot, Minister of Health, the Honourable Steve Clark, Minister of Municipal Affairs and Housing, Sylvia Jones Solicitor General, Dr. David Williams, Chief Medical Officer of Health, Dr. Homer Tien Chair Vaccination Task Force, Vic Fedeli, MPP – Nipissing, Norm Miller, MPP – Parry Sound‐Muskoka, John Vanthof, MPP – Timiskaming‐Cochrane, Mayors/Reeves within the North Bay Parry Sound District Health Unit district, Ontario Boards of Health, and the Association of Local Public Health Agencies (alPHa).”. CARRIED Council considered attendance at the 2021 Annual Conference of the Association of Municipalities of Ontario. Mayor MacDiarmid was previously approved to attend the Conference. No additional Members of Council are attending the Conference. Council considered correspondence from the District of Parry Sound Municipal Association advising the Spring Meeting has been canceled and the Association has also waived the 2021 membership fees. The correspondence was received as information. Council considered correspondence from the Federation of Northern Ontario Municipalities regarding the 2021 Annual Conference. Any Member of Council wishing to attend the virtual conference is to register themselves for the Conference. Resolution No. 2021‐091 Moved by: Councillor Gail Finnson Seconded by: Councillor Daryle Moffatt “THAT Township of Seguin Council does hereby support the resolution from the City of St. Catharine’s (copy attached as Schedule ”A”), requesting an amendment to Schedule 6 of Bill 197 (Environmental Assessment Act), eliminating the adjacent municipality overreach powers. AND THAT a copy of this resolution be forwarded to Hon. Doug Ford Premier, Hon. Jeff Yurek Minister of Environment, Conservation and Parks, Hon. Steve Clark Minister of Municipal Affairs and Housing, Norman Miller MPP Parry Sound‐ Muskoka, the Association of Ontario Municipalities (AMO) and the City of St. Catharines.”. CARRIED Resolution No. 2021‐092 Moved by: Councillor Terry Fellner Seconded by: Councillor Art Coles “WHEREAS, Safe Quiet Lakes has established the national Decibel Coalition of like‐minded stakeholders called the “Decibel Coalition”; AND WHEREAS, the objective of the Decibel Coalition is to have the Small Vessel Regulation SOR‐2010‐91 enhanced by the Federal Government/Transport Canada to include decibel limits on the amount of noise from boat motors and provisions for effective and easy enforcement procedures; AND WHEREAS, excessive noise from boat motor noise on our waterways has been a pervasive, persistent and growing problem for many years in the Township of Seguin; AND WHEREAS, jurisdiction of Canadian waterways is with the Federal Government and as such municipalities cannot make by‐laws for our lakes and rivers; AND WHEREAS, the current legislation requires boat motors to have a working muffler but has no performance requirements for sound emissions measured in decibel limits; AND WHEREAS, police are reluctant to lay charges with regards to the muffler law; AND WHEREAS, Transport Canada has recently opened the opportunity to discuss and receive comments on possible options for changes to the Small Vessels Regulation with regards to boat mufflers and sound emissions; AND WHEREAS, the Township of Seguin would welcome enactment of these improved regulations in the interests of our community. NOW THEREFORE BE IT RESOLVED THAT the Council of The Corporation of the Township of Seguin officially and publically joins as a member and supports the Decibel Coalition and allows the Decibel Coalition to use the Township’s name and logo and reference our membership in their communications with other Council Minutes of April 6th, 2021 Page 12 of 15
governments, government agencies and committees, other Decibel Coalition Members and promotion of the Decibel Coalition’s objectives in social media and the press and; FURTHERMORE BE IT RESOLVED THAT the Council of The Corporation of the Township of Seguin communicates about the Decibel Coalition to our community and encourages their support of the Decibel Coalition and encourages other municipalities to join the Decibel Coalition.”. CARRIED Resolution No. 2021‐093 Moved by: Councillor Rod Osborne Seconded by: Councillor Daryle Moffatt “WHEREAS the Township of Seguin has successfully completed speed control measures using 2 mobile units and there have been requests for permanent pole mounted units in certain areas; AND WHEREAS Sandy Plains Road and the Village of Rosseau have been deemed trouble spots. THEREFORE BE IT RESOLVED THAT Council does hereby authorize and direct staff to purchase 2 additional permanent solar powered speed monitoring units and that the 2 existing units be retrofitted for solar power.”. WITHDRAWN Council directed staff to provide a report to Council on the data collected to date with the Speed Spies. Council also directed staff to continue gathering data throughout the year and report to Council on a traffic calming strategy. Resolution No. 2021‐094 Moved by: Councillor Daryle Moffatt Seconded by: Councillor Art Coles “WHEREAS Pat Flowers has advised Council that Ms. Flowers is no longer a ratepayer or resident of the Township of Seguin; AND WHEREAS Ms. Flowers has been an active member of the Township of Seguin Foley Recreation Committee; AND WHERAES Ms. Flowers has advised she would like to remain a member of the Foley Recreation Committee; AND WHEREAS the members of the Foley Recreation Committee have provided consensus to Ms. Flowers remaining a member of the Committee. THEREFORE BE IT RESOLVED THAT the Council of The Corporation of the Township of Seguin does hereby reaffirm the appointment of Pat Flowers as a member of the Township of Seguin Foley Recreation Committee for the remainder of the Term of Council.”.
