These inspections were carried out in an effort to ensure that gas installations are compliant to the Gas Standards Act 1972 and the Subsidiary Regulations and are safe to use. The inspections raised several areas of concern, particularly those issues that were identified previous and have still not been rectified or are still occurring. Non-compliances identified during the 2017 and previous inspections include; LP Gas cylinders; unrestrained and/or not installed on an appropriate base or base material, located to close to sources of ignition to close to openings into buildings installed in a location with obstructed or restricted access inside buildings Flexible gas hose assemblies installed contrary to the regulations; hoses passing through walls and partitions hoses being joined to make a longer length The use of appliance not certified to Australian standards Building and Energy takes this opportunity to remind all residents and business owners that the Gas Standards Act 1972 requires that gas installations are to comply with the Gas Standards (Gasfitting and Consumer Gas Installations) Regulations 1999. On the 7th and 8th of November 2018, Building and Energy will be conducting random gas installation inspections. Inspector’s Orders may be issued to occupants for non-compliances found during these inspections, and the Inspector’s Order may prohibit the use of the gas installation until the non-compliances are rectified. If you feel that your gas installation does not comply with the requirements or is unsafe, Building and Energy recommends you have your gas installation checked by a licensed gas fitter prior to Building and Energy visiting and conducting inspections. Should you have any questions or concerns regarding this matter or any other gas related issues, please do not hesitate to contact Senior Gas Inspector Ian Allison on (08) 6251 1908. Dear Residents of Cocos, I have noticed some behaviours of residents in our beautiful small community. One of these issues are materials outside boundary such as boats & trailers, household timbers, roofing, vehicles, motorbikes and coconuts and coconut husks etc. are being permanently being stored outside their property boundaries. I would like to thank those residents who have done the right thing. I would also like to minimise the above behaviour from happening in the future. Please be aware and keep in mind that the Shire team members are doing their very best service to maintain our beautiful small community in a very tidy town and has spent a significant amount of labour and resources in various beautification programs. The Island cyclone season commence in November and concludes in April of each year however statistic have shown that the Islands experience cyclone events every month of the year. For this reason it is of high importance to make sure materials and equipment such as boats, trailers, timber, Household, building materials are stored within your allocated boundary area. The Shire is offering a one-month period for property owners to take quick action. We understand that for some people there are barriers to taking action so we would like to offer an opportunity to meet with people who are finding this difficult so that we can come up with a solution together. The generosity and kindness of our small community year-after-year is just unbelievable! Hari Minggu, 14hb Octoba adalah hari yang sangat mengagumkan sekali. Kebaikan dan kemurahan hati masyarakat ini setiap tahun sunggu tak tersangka! CIDHS P&C proudly announces that this year the total gross funds raised is about $53,000. This includes auction items, Showbags, all Food & Drinks stalls, Fun activities and Year 10 Silent Auction as well as cash donation prior to the Fete. HUGE THANK YOU to everyone! CIDHS P&C is aiming to become more accountable and transparent with the funds that we have raised. In 2017 and 2018, P&C contributed $23,000 to our school children and their families including subsidised uniforms, stationeries, Year 5/6 and Year 9/10 school camps, Workbooks etc. In 2018, apart from the standard contributions, the P&C purchased a B Grade Sea container in order to centralise all P&C assets. The P&C also asked Mr Jimmy Abdul Wahid, Contract Accountant of Shire of Cocos (Keeling) Islands to audit out books in June 2018. We were pleased to inform the Community that all our finance is well recorded. Based on Jimmy’s recommendations, the P&C invested in MOYB Basic (accounting software) to ensure better accounting management. Public Notices Notis-notis Umum Where someone driving a vehicle injures you due to bad driving II These are short articles about legal issues that may interest you. They are not legal advice. You should always get individual legal advice for your situation. This and the last article are about where a driver of a vehicle injures you due to their negligent driving (where they have made a mistake in their driving). You may be the driver of another vehicle, a passenger in the vehicle, a pedestrian, a motor cyclist or a bicyclist. What can you claim for when you make a claim in court for damages? You can claim for: Your non-pecuniary (nonmonetary) loss (also called “general damages”). This includes your pain and suffering, loss of amenities of life (which is loss of quality of life eg you were a ballet dancer but cannot dance anymore), loss of enjoyment of life, shortening of your lifespan and bodily and mental harm Past loss of earnings Loss of future earnings or earning ability Reimbursement for past medical, hospital, ambulance and pharmaceutical costs Home care services Future treatment, care and support needs, and where you are injured catastrophically, as well as the above, it includes the costs of rehabil- itation, attendant care services, aids and appliances, prostheses, education and vocational training, home and transport modification, and any other kinds of treatment, care, support or services that are approved by ICWA. There is a threshold before you can claim for non-pecuniary (non-monetary) losses The amount of the general damages for your injuries must be worth $21,500 or more (as at 1 July 2018) before you can claim for non- pecuniary losses. And up to $21,000 will be deducted from your overall damages claim, gradually reducing if your claim exceeds $62,500 and not deductible at all if your claim is worth $82,500 or over. These amounts are all indexed. Note that there is no threshold for pecuniary (monetary) losses and you can claim for these even if you cannot claim for general damages. Limits on amounts of damages There are caps on amounts for the various types of damages listed above. For claims for loss of earnings, you cannot claim more than 3 times adult full time average weekly earnings, even if you were earning more. There is an upper limit of non-pecuniary losses (general damages) of $418,000 (currently). Where you contributed to your injuries because you were negligent as well Your claim may be reduced if you were found to be negligent too and contributed to your injuries. This is called being contributory negligent. Some circumstances were you might be found to be contributory negligent are: If you were not wearing a seatbelt. You were not wearing a helmet on a bicycle or a motor bike. You were intoxicated (by alcohol or drugs or by any substance that affected your ability to exercise reasonable care and skill). You otherwise contributed to the accident – another example might be if you were speeding. If you are intoxicated, you are presumed to have contributed to the accident. You can displace (cancel) this presumption, by showing that your intoxication did not contribute to the accident. An example might be where as a pedestrian you are drunk, but you are walking properly and carefully along the footpath, and a car mounts the footpath and hits you from behind. Your contribution to your injuries can be assessed by the Court. So, for example, if you are found to be 25% responsible for your injuries, your damages claim will be reduced by 25%. Where you voluntarily assumed the risk (agreed to the risk) Sometimes, you know something prior to the accident and that thing caused or contributed to the accident. In this case you have voluntarily assumed the risk and you may get nothing. A typical example is where you get into a car with someone who you know is drunk. Another example is if you drive/are a passenger in a car that you know has a mechanical problem, such as very faulty brakes and the faulty brakes contribute to or cause the accident. Both injured parties making a claim because each was negligent You may be able to make a claim because the other driver was negligent and you suffered injuries. The other driver may also be able to make a claim because you were also negligent and they suffered injuries. An example might be where the other driver goes through a stop sign without stopping and you collide with her. You are injured and have a claim against her. However, your car has faulty brakes and if your brakes were not defective you would not have hit her with such force. She is injured more than she would have been because of your inability to brake more quickly. She has a claim against you. Kedua-dua pihak membuat klaim kerana kedua-duanya ceroboh Kamu boleh membuat klaim sebab pemandu pihak sebelah ceroboh dan kamu kecederaan. Pemandu pihak sebelah juga boleh buat klaim sebab kamu yang ceroboh dan menyebabka kecederaannya. Contohnya mungkin bilamana pemandu sebelah melanggar stop sign tampa berenti dan saling terajang dengannya. Kamu cedera dan membuat klaim terhadapnya. Tetapi, kereta kamu mempunyai brakes yang rusak dan kalau brake kamu tidak rusak kamu tak mungkin terajangnya dengan kuat. Dia cedera lebih daripada sekiranya brake kamu tidak rusak.
