2016 MUSTO Sail Fremantle Regatta 21 – 23 October 2016 SAILING INSTRUCTIONS Organising Authority: Fremantle Sailing Club Inc.
SAILING INSTRUCTIONS 1. RULES: 1.1. The regatta will be governed by the ‘rules’ as defined in the Racing Rules of Sailing (RRS). 1.2. The Yachting Australia Prescriptions and Special Regulations Part 2 shall apply. 1.3. Arbitration shall apply as detailed in SI18. 1.4. Silver Fleet Optimists only shall fly coloured streamers, as supplied by the Organising Authority, from the top of the sprit. 1.5. Discretionary Penalties will apply to those SI's marked with a “DP”. 1.6. Standard penalties will apply to those SI’s marked with a “SP”. 2. RACE COMMITTEE: The Race Committee will comprise of the Race Officers and an FSC Sailing Administrator. For the purposes of RRS 62.1(a) the Race Committee shall extend to include anyone performing a function of the Race Committee. 3. NOTICES TO COMPETITORS: Notices to competitors will be posted on the Official Notice Board, located inside the FSC Main Clubhouse. 4. CHANGES TO SAILING INSTRUCTIONS: 4.1. Any change to the Sailing Instructions will be posted not less than 90 minutes before the first race it will affect, except that any change to the Schedule of Races will be posted by 1800 on the day before it will take effect. 4.2. Changes to these Sailing Instructions ‘made on the water’ will be signalled by a Race Committee Boat. Flag ‘L’ will be displayed while the changes are being given. It shall be the responsibility of each boat to obtain the written or verbal instructions. 5. SIGNALS MADE ASHORE: 5.1. Each class will have signals made ashore at the flag pole adjacent to their launch area. Display of: Naval Numeral 1 will designate Racing Area Alpha. Naval Numeral 2 will designate Racing Area Bravo. Naval Numeral 3 will designate Racing Area Charlie. 5.2. When AP flag is displayed ashore, ‘1 minute’ is replaced with ‘not less than 30 minutes’ in the race signal AP. 6. SCHEDULE OF RACES: 6.1. Races are scheduled as follows: 2

It is intended to complete up to 8 races for Race Areas Alpha and Bravo. 6.3. It is intended to complete up to 12 races for Race Area Charlie. 6.4. There will be an alternative program for Optimist Bronze Fleet. 6.5. Subsequent races will be started as soon as practicable after completion of the previous race. 6.6. No warning signal will be made after 1530 on Sunday 23 October 2016. 7. SIGNING ON/OFF: SP 7.1 All helmspersons or crew shall sign on the sheets provided at the Dinghy Clubhouse prior to going afloat for racing. 7.2 All helmspersons or crew shall sign off within 60 minutes of completing racing for that session, or later at the discretion of the Race Committee. 7.3 Boats failing to comply with Clauses 7.1 and/or 7.2 shall receive, without a hearing, a 25% scoring penalty, but the score shall be no worse than a DSQ, in the race held closest to the offence. This changes RRS 35, 63.1, A4 & A5. 8. RACING AREA: 9.1. Alpha Course will be to the South of Success Harbour. 9.2. Bravo Course will be approximately 1.0nm to the West of Alpha Course. 9.3. Charlie Course will be approximately 0.5nm to the South of Bravo Course. 9.4. Optimist Silver Fleet races may be conducted in the harbour at the Race Committee’s discretion. To signal this change in course area while afloat the Race Committee Signal boat will display L flag over Optimist Silver Class Flag to indicate a change to the sailing instructions for the Optimist Silver Class. It shall be the responsibility of each boat to obtain the written or verbal instructions. 4
10. THE COURSE: 10.1. The diagrams in Attachment A show the courses, including the approximate angles between legs, the order in which marks are to be passed, and the side on which each mark is to be left. 10.2. No later than the Warning Signal, the Committee Boat will display (via a course board) the course to be sailed. 10.3. Three Race Areas will be used. Classes racing on each area are listed in SI 8. 11. MARKS: 11.1. The Alpha Course marks will be pink inflatable buoys. 11.2. The Bravo Course marks will be red inflatable buoys. 11.3. The Charlie Course marks will be yellow inflatable buoys. 12. THE START: 12.1. For Alpha and Bravo courses, races will be started using rule 26. 12.2. For Charlie course, races will be started in a 3 minute starting sequence as described below, this changes RRS rule 26 Minutes before starting signal. Visual signal. Sound signal. Means. 3. Class Flag. One. Warning 2. P,I,U,black flag. One. Preparatory 1. Prep removed. One long One minute 0. Class removed. One. Starting signal. 12.3. If flag U has been displayed as the preparatory signal, no part of a boat’s hull, crew or equipment shall be in the triangle formed by the ends of the starting line and the first mark during the last minute before her starting signal. If a boat breaks this rule and is identified, she shall be disqualified without a hearing but not if the race is restarted or resailed or postponed or abandoned. RRS 29.1 does not apply if Flag U is used as a preparatory signal. This changes RRS 26, 29.1 and 63.1. 12.4. The starting line will be between a staff displaying an orange flag on the Committee Signal Boat at the starboard end and a staff displaying an orange flag on the port end starting mark or boat. 12.5. The Committee Signal Boat will display an orange flag with one sound signal no less than five minutes before the first warning signal of a race or sequence of races to notify competitors that races will start soon. 12.6. Boats whose warning signal has not been made shall avoid the starting area during the starting sequence for other races. DP 12.7. A boat starting later than 4 minutes after her Starting Signal will be scored Did Not Start without a hearing. This changes RRS 63.1, A4 & A5. 12.8. There will not be a fixed starting sequence. Boats are required to monitor the class flags displayed in order to determine which class or classes are 5
being started. Once all boats of a class have finished, or retired, or the time limit for a race has expired, that class may restart at any time. 12.9. The Race Committee may start multiple fleets together. 13. CHANGING OF THE NEXT LEG OF THE COURSE: To change the next leg of the course the race committee will move the original mark or (finishing line) to a new position. 14. THE FINISH: 14.1. The finishing line will be between a staff displaying an orange flag on a Committee Signal Boat at one end and a staff displaying an orange flag on the other finishing mark. See course diagrams for details. 14.2. After her starting signal a boat shall not sail through the Start or Finish line in either direction while the Committee Boat is displaying an orange or blue flag unless she is starting, finishing, correcting an error in compliance with RRS 29.1, or taking a penalty at or near the finishing line in compliance with RRS 44.2. Boats failing to comply shall be scored DSQ without a hearing. This changes RRS 63.1 & A5 15. TIME LIMITS: Target time per race will be 45 minutes for the Alpha/Bravo courses and 35 minutes for the Charlie Course. Boats failing to finish within 20 minutes after the first boat in their fleet sails the course and finishes, will be scored Did Not Finish, without a hearing. This changes rules 35, A4 and A5. 16. RETIREMENT AND OUTSIDE ASSISTANCE: DP Any boat retiring from a race shall, where possible, notify an official Race Committee Boat prior to returning to shore. Should a boat be unable to notify a Race Committee boat they shall advise the Race Office immediately on returning ashore. 17. PROTESTS AND REQUESTS FOR REDRESS: 17.1. Protest forms are available at the Race Office, located inside the FSC Main Clubhouse foyer. Protests and requests for redress or reopening shall be delivered there within one hour of the finishing time of the last boat to finish on each course area in its last race of the day or the race committee signals no more racing today, whichever is the later. This changes rule 61.3. 17.2. Notices will be posted no later than 30 minutes after the Protest Time Limit to inform competitors of hearings in which they are parties or named as witnesses. Hearings will be held in the protest room (FSC Library) beginning at the time posted. 17.3. On the last scheduled day of racing a request for reopening a hearing shall be delivered: a) Within the protest time limit if the requesting party was informed of the decision on the previous day. b) No later than 30 minutes after the requesting party was informed of the decision on that day. 6
This changes rule 66. 17.4. On the last scheduled day of racing a request for redress based on a protest committee decision shall be delivered no later than 30 minutes after the decision was posted. This changes rule 62.2. 17.5. Breaches of SI’s marked “DP” will not be grounds for a protest by a boat. This changes rule 60.1(a). Penalties for these breaches may be less than disqualification if the Protest Committee so decides. This changes RRS 64.1. 18. ARBITRATION: 18.1 Rule 44.1 is changed to permit a boat that has broken a rule of Part 2, Part 4 or rule 31 to take a penalty after racing but prior to any protest hearing. Her penalty shall be a scoring penalty equal to a finishing place mid-way between the boat's actual finishing place and the score for a disqualification. Half points shall be disregarded and the points of other boats shall not be adjusted. Rule 63.1 is changed such that an arbitrator may allow a protest to be withdrawn. 18.2 An arbitration hearing will be conducted for all protests lodged in accordance with rule 61 which allege an infringement of a rule of Part 2, Part 4 or rule 31. Such hearings will be held subsequent to the protest being lodged and prior to the protest hearing. 18.3 The time and place of the arbitration hearing will be decided by the arbitrator and such advice may be given verbally. One representative of each boat will attend the arbitration hearing and no witnesses will be allowed. The arbitrator will decide the manner in which testimony is given. 18.4 After taking testimony, the arbitrator will make one of the following conclusions: (a) The protest does not comply with rule 61 and the protestor should withdraw the protest. (b) The matter shall proceed to a protest hearing. This may be because rules not suited to arbitration may be involved or because evidence is too complex or divergent or because injury, serious damage or a significant advantage may have occurred or because of the apparent severity of the alleged infringement or for any other reason decided by the arbitrator. (c) No rule was broken and the protestor should withdraw the protest. (d) A rule was broken by one or more of the boats involved, the infringing boat(s) may accept a scoring penalty as detailed above and if so accepted, the protestor should withdraw the protest. 18.5 An arbitration hearing shall not be re-opened. No conclusion of an arbitrator shall be subject to appeal or be grounds for redress. 18.6 Should the protest proceed to a protest hearing then the arbitrator may be a member of the Protest Committee. Any evidence given by an arbitrator 7
during a protest hearing shall be given only in the presence of the parties to the hearing. 19. SCORING: 19.1. 3 races are required to be completed to constitute a series. 19.2. When fewer than 5 races have been completed, a boat’s series score will be the total of her race scores 19.3. When from 5 to 7 races have been completed a boat’s series score will be the total of her race scores excluding her worst score. 19.4. When 8 or more races have been completed a boat’s series score will be the total of her race scores excluding her worst 2 scores. 19.5. Laser Masters event consists of the first 3 races Saturday and the first 3 races Sunday (A maximum of 6 races to be scored as per 19.1 to 19.3 above). The Laser Masters event consists of one division only for skippers over 35 (Laser Standard and Radial) and need to confirm this at registration. Laser Masters who sail the complete regatta will be included in the results for both the regatta and the Laser Masters. Laser skippers shall be eligible for one prize only. 20. SUPPORT BOATS: DP 20.1 All Support boats, coach boats and spectator boats must be Registered Online with the Organising Authority and display the appropriate blue/yellow identification flag handed out at Registration. Click Here to Register your support/coach boat for the 2016 Musto Sail Fremantle Regatta 20.2 Unless directed by the Race Committee, support boats, coach boats and spectator boats shall not enter the course area, starting area, finishing area or go closer than 100 metres to any boat racing from the time of the first Preparatory signal for the first class to start until all boats have finished or retired or the Race Committee signals a postponement or abandonment (unless requested to assist in a rescue). The penalty for failing to comply with this requirement may, after protest, be the disqualification of any boats associated with the infringing support personnel. 21. REPLACEMENT OF CREW OR EQUIPMENT: DP 21.1. Substitution of skippers will not be allowed. 21.2. Substitution of crew will not be allowed without prior written approval of the race committee 21.3. Substitution of damaged or lost equipment will not be allowed unless approved by the Race Committee. Request for substitution shall be made to the Race Committee at the first reasonable opportunity. 22. EQUIPMENT AND MEASUREMENT CHECKS: DP A boat or equipment may be inspected at any time for compliance with the class rules and sailing instructions. On the water, a boat can be instructed by 8
a race committee equipment inspector or measurer to proceed immediately to a designated area for inspection. 23. ADVERTISING: DP Boats shall display the event sponsor’s name(s) and logo(s) on the hull. These items will be supplied at registration by the Organising Authority and shall be affixed in accordance with the instruction template (Attachment B) for photographic and promotional purposes. 24. OFFICIAL BOATS Official boats will be identified via a white numbered flag. 25. RADIO COMMUNICATION: DP Except in an emergency, a boat shall neither make radio transmissions while racing nor receive radio communications not available to all boats. This restriction also applies to mobile telephones. 26. PRIZES: Prizes will be awarded to: o The first three boats in each fleet with 8 or more boats o The first two boats in each fleet with 5-7 boats o To the first boat in each fleet with 4 boats or less o The first female in fleets with over 4 females There will be a separate prize program for Optimist Bronze Fleet. Additional prizes may be awarded at the discretion of the Organising Committee. Fleets shall be organised and raced at the discretion of the Race Committee. Presentations will be held on the Sunset Deck at Fremantle Sailing Club at approx. 1630 on Sunday 23 October 2016 or as soon as possible following the racing. Prizes will be presented to prize winners or their nominated representative at the Presentation Ceremony only. 27. DISCLAIMER Competitors participate in the regatta entirely at their own risk. See rule 4, Decision to Race. The Organising Authority, their officers, members, volunteers, servants and agents will not accept any liability or responsibility for material damage, personal injury, death or inconvenience sustained in conjunction with or prior to, during, or after the regatta. 28. WARNING: Sailing and activities associated with it involve risks of personal injury, loss and damage and even death. The risks include but are not limited to, the risk of injury from collision, capsizing, falling overboard, being trapped under the 9
sail or boat after capsize and impact with equipment. Any of these events can also result in death. The risks involved in this activity are heightened by; Adverse weather conditions Inadequate training Fatigue Inexperience Failure to maintain the boat Failure to supply and use the recommended safety equipment Failure to observe the RRS and the FSC Sailing Instructions. This warning is given as a risk warning pursuant to Section 5I of the Civil Liability Act 2002 (as amended). Having given this risk warning, Fremantle Sailing Club will not be held liable for any personal injury or death, however it may occur. 29. INSURANCE: Each participating boat shall be insured with valid third party liability insurance with a minimum cover of $5 million ($10 million recommended) per incident or the equivalent. 30. MEDIA: In submitting the entry form, all competitors, parents, legal guardians, custodians provide their permission for all photographs, video, TV and sound recordings to be the property of the organisers and used for any purpose including public viewing and posting on FSC or Class Association websites, social media and publications. 10
