ALL BOAT SLIP OWNERS, THEIR LESSEES, INVITEES AND GUESTS SHALL COMPLY
WITH THE FOLLOWING REGULATIONS AND ANY OTHER REGULATIONS AS MAY BE,
FROM TIME TO TIME, PROMULGATED BY PIRATE'S BAY COMMUNITY ASSOCIATION,
INC

 1.   RULES OF THE ROAD. The rules of the road and the navigational laws of the United States
      shall apply to all vessels approaching or leaving boat slips and docks. When a vessel enters the
      boat slip and marina area, it shall come under the jurisdiction of Pirate's Bay Association and its
      agents. All vessels, and their Owners and Captains shall comply with all federal, state, county,
      and municipal laws, ordinances, and regulations, and shall strictly adhere to all United States
      Coast Guard and DEP Pollution standards.

 2.   RESTRICTIONS. Use of the marina area is restricted to vessels which have acceptable capable
      crew, able to appropriately secure the vessel by themselves. There will be no commercial operations
      conducted in the dock area and there will be no launching or haul-out facilities in the dock area.

 3.   PORTABILITY. The vessel shall move in 48 hours under its own power when requested by
      the Pirate's Bay Association Representative.

 4.   WET SLIP EVACUATION.

      The Marina is not a safe harbor and, as such, the Association wishes to make it clear to boat owners
      that their boats will have a better chance at survival if evacuated from the Marina. The Association
      will not be responsible for securing your boat or its accessories and all water and electricity may be
      turned off as a storm approaches. It is suggested that you have a plan of action ready in the event of
      an imminent severe storm. You may also want to have your boat hauled out and secured on land
      high enough to endure a storm surge. If you cannot have your boat hauled out of the water, you may
      want to locate a place safer than the Marina to move your boat to well in advance of a severe storm
      warning. If your boat remains in the Marina during a severe storm, the Association requires the
      following:

        a. Double all lines and rig crossing spring lines fore and aft of the boat.
        b. Attach lines high on piling to allow for tidal rise and surge.
        c. All storm lines should be at least one size larger than the lines regularly used to secure the
           boat.
        d. Make sure lines will not slip off pilings. Inspect pilings and choose those that seem strongest
           and tallest and are properly installed.
        e. Cover all lines at rough points to prevent chafing. Wrap with tape, rags, rubber hoses, etc.
        f. Install fenders to protect the boat from rubbing against the pier, pilings, and other boats.
        g. Assess the attachment of primary cleats, winches and chocks. These items should have
           substantial back plates and adequately sized stainless steel bolts.
        h. Batteries should be fully charged and checked to ensure their capability to run automatic bilge
           pumps for the duration of the storm.
        i. All lose items should be removed from the docks and boats.
5.   INSURANCE. Boat owners must provide proof of a liability/comprehensive boat
       insurance policy in the minimum amount of $300,000 for each vessel. The CAM
       will approve all exceptions to this requirement. The Association will not be
       responsible or liable for any loss or damage to boats (including tools, accessories,
       personal property, and equipment) by theft, fire, tornadoes, floods, hurricanes,
       windstorms, high or low water, or any other cause beyond the reasonable control
       of the Association.

6.   SINGLE VESSELS ONLY. Only one vessel is permitted in a slip within Pirate's Bay
       Community Association's DEP submerged land lease. A tender is permitted if on the
       mother ship or completely confined within the limits of the slip.

7.    PERMIT DECALS. Vessel permit decals will be issued to all boat slip owners, lessees, and
        transient guests. Permit decals shall be installed so that they may be seen easily from the
        common dock walkways. Any vessel without a sticker will be considered an unauthorized
        vessel and subject to removal. Slip owners are responsible for notifying the CAM when
        their lease is terminated

8.    LENGTH RESTRICTIONS. A vessel using the docks shall conform to the following table
       designated by the DEP approved drawings.

9 . MOORING LINES.          Mooring lines will be of proper size and in good condition to secure the
        size of the vessel as specified in the chart below:

     Mooring lines that are not stowed properly and are found on the common walkway or finger piers
     when the vessel is away from the dock will be removed by the Association Representative and will
     be discarded.
     When an Association Representative, discovers mooring lines that are not installed in a seamanship
     like manner and/or may cause damage or endanger to others, he/she will notify the owner as of that
     slip and request that the problem be corrected. If the problem is not corrected in 14 days, number 28
     below will apply. No mooring line shall be attached to a pedestal at any time or for any reason.
10.    HOSES. All potable water hoses shall be disconnected from the vessel and may be stored on the
       pedestal and removed from the dock and finger piers if the vessel will be unattended for more than
       three days. The hose when connected to the pedestal shall be kept in an orderly manner or it will be
       removed by the Association representative and discarded.
11.    POWER PEDESTALS. Power pedestals are the property of Pirate's Bay Association. No
       modifications shall be done to the pedestals. Electrical attachments are permitted after a dock
       modification is submitted to the Marina Committee and subject to Pirate's Bay Association approval.
       An approved electrical modification shall be installed by a licensed electrician. The Pirate's Bay
       Association's CAM shall be informed of the nature of the work and time frame of the work before
       starting.
12.   DETACHABLE CORDSETS. Cord sets for any use shall be marine grade exterior corrosion
      resistant material and all cords must be properly grounded. Extension cords other than for
      temporary tasks are strictly forbidden and will be immediately removed by the Association
      Representative and will be discarded.
 13. PUMP-OUT STATION. A pump-out station located at the end of “A” dock is available for use
       by slip owners, lessees, and condo renters. Use by the general public is forbidden.
 14. WASTE DISPOSAL. No boat slip owner, lessee, invitee, or guest shall illegally discharge any
       waste from any vessel's holding tanks, toilets, nor pump any bilge oil, flammable or inflammable
       liquids into the waters around the marina. Refuse and garbage shall not be thrown overboard.
       Boat slip owners, their lessees, invitees, and guests shall be responsible for disposal of their own
       refuse and garbage in a sanitary manner by placing in a plastic bag and depositing in waste
       containers provided by the Association.
 15. OIL AND CHEMICALS. Used oil or caustic chemicals will be removed to an off premise
       proper container by the boat slip owners, their lessees, invitees, and guests. DO NOT PUT IN
       CONTAINERS IN THE DOCK AREA PROVIDED BY THE ASSOICATION.
 16. FISHING and FISH CLEANING STATIONS. Pirates Bay Community Association welcomes
      authorized individuals to fish from the marina docks. If fish are to be cleaned at the marina, the fish
      cleaning station should be used. Any fish carcass or by-product resulting from processing your catch
      should be removed to a proper off-premise container. DO NOT PUT FISH CARCASS IN CONTAINERS
      PROVIDED BY THE ASSOCIATION IN THE MARINA AREA.
 17. CLEANLINESS. Each boat slip owner or his lessee shall be responsible for keeping his vessel
       and immediate dock area in such condition that it does not become cluttered, unsightly, or
       dangerous or reflect unfavorably on the appearance of the marina. Decks of all vessels and the
       immediate dock area shall be kept free and clear of debris, bottles, papers, trash, unattended
       fishing gear, any unsightly materials, and other inappropriate materials at all times.
 18. LODGING. No vessel may be utilized for permanent lodging. Boat owners, Lessees, or Guests
       may stay aboard their vessels as long as their length of stay does not constitute a “live-aboard”
       status as defined by the state of Florida. The State of Florida currently allows either 1) up to five
       consecutive days or 2) a maximum of ten out of thirty days of sleeping aboard a vessel within our
       submerged land lease.
 19. CHILDREN. Parents are responsible for the actions and safety of their children in the marina
       area. Children who behave improperly while in these areas or whose actions endanger
       themselves or others, may be excluded from these areas by the Association unless they are
       accompanied by a parent or responsible adult designated by the parent.
 20. PETS. All pets shall be kept under the owner's immediate control at all times. Pets shall be
       immediately removed from the dock area, at the request of the Association, if they disturb other
       users at the marina. There shall not be permitted any animal waste of any kind on any part of the
       marina.
 21. NOISE. Noise shall be kept at a minimum at all times. All users of the marina shall use discretion
       in operating engines, generators, radios, amplifiers and televisions so as not to create a nuisance
       or disturbance. NQ FIREWORKS ALLOWED.
22. FIRE. No charcoal barbecue or other cooking fires shall be allowed on the docks or finger piers.
     All boat barbecue grills must be secured while in use on the vessel.
23. REPAIRS. Major repairs or refitting vessels at the marina are permitted with written approval of
     the Marina Committee Board. Minor repairs, mechanical adjustments, electrical work, and touch-
     up painting are permitted. No repair work shall create a nuisance or adversely affect the property
     of others within the marina.
24. OUTSIDE WORKMEN. The boat slip owner and/or lessee upon whose vessel the repairmen are
     working, agrees to fully indemnify, defend and hold the Association, and its members, harmless
     against any loss caused by the work or workmen. The Association's CAM shall be informed
     before starting of the work to be done and the time frame of the job by the vessel owner or the
     workmen.
25. DOCK MODIFICATION. All modifications to the dock such as, lifts, Dock boxes shall be
     requested in writing, with a drawing and picture and submitted to the Marina Committee for
     review. The Marina Committee will submit the requested dock modification to the Association
     Board with recommendation to approve or recommendation of change to the request for approval.
     Any modifications will be subject to approval of the Association Board. It is further agreed that
     these modifications will comply with all local building restrictions and codes and will be installed
     and maintained at the slip owner's expense and liability. The Association will not be liable for any
     loss resulting from modifications made by the owner or lessee. The following conditions are
     applicable:
               A. DOCK BOXES. A drawing showing where the dock box will be placed and a
                   picture of the dock box shall be submitted to the Marina Committee and subject to
                   approval by the Association Board.
                        1.   One dock box per slip may be installed by the slip owner or lessee
                             provided they are securely attached to the dock immediately in front of
                             their own slip.
                        2.   The dock box shall not protrude into the walkway more than 24 inches, and
                             are of a commercially available marine type constructed of fiberglass with
                             a white gel coat finish.
                        3.   The maximum size is 96 inches in width 27 inches in height and 27 inches
                             in depth. Homemade dock boxes of any type will not be permitted.
               B. BOAT LIFTS. A written dock modification request with a drawing showing where
                   the boat lift will be placed in the slip and a picture of the boat lift shall be submitted
                   to the Marina Committee and subject to approval by the Association Board. The
                   following conditions are applicable:
                        1.   The total boat lift and boat lift pilings shall be in the confines of the boat
                             slip.
                        2.   The lift shall not rest on any of the Association common pilings.
                        3.   All electrical work shall be in conduit and hard wired to the pedestal and
                             connected after the meter in the pedestal by a licensed electrician.

                        4.   The Association's CAM shall be informed of the work to be done and the
                             time frame of the job before proceeding.
                        5.   No covered slips allowed
C. PAINTING OR CARPETING. No painting or carpeting of common property.

26.   MARINA MANAGEMENT AND SUBLEASING. Boat slip owners are required to provide
      updated information for the boat slip file with the Association CAM. The following conditions are
      applicable:

                       A. Slip owners shall submit and maintain current proof of liability
                          insurance coverage in the minimum amount of $300,000.00, current
                          Florida registration along with a current picture of the vessel that is in
                          the slip.
                       B. Slip owners who sublease their slip are required to provide the same as
                          (A) above for the vessel in the slip.
                       C. Out of state vessels shall comply with all Florida government regulations.
                       D. Lessees are not considered property owners or members of the Association
                          and therefore, are not entitled to use the private property of Pirate's Bay or
                          Brooks Landing. This includes, but is not limit to, the swimming pools, ice
                          machines, and laundry facilities, or parking and trailer storage area.
                       E. Lessees are requested to respect the private property of Pirates Bay and
                          Brooks Landing. At NO time should access to the marina disrupt the
                          privacy of an owner or guest at Pirate's Bay or Brooks Landing.
                       F. Lessees of slips and owners occupying a condo unit my access the dock
                          area by any gate and use any of the three walkout piers.
                        G. Owners and Lessees will not be guaranteed parking if they do not occupy a
                           condo unit. If parking is not available for marina lessees or guests, they may
                           be requested to park in an area as specified by the Association.

                        H. Brooks Landing slip owners will be responsible for parking arrangements
                           for their lessees. These lessees should not utilize any of the Pirates Bay
                           parking areas.

                         I. The Association reserves the right to nullify a lease agreement should the
                            lessee not abide by all rules and regulations of the dock area. The slip
                            owner shall be duly notified if such action should become necessary.
27. ADVERTISING. Signs advertising a "Boat for sale" are allowed if attached to the vessel. No other
    signs are allowed to be posted in the marina area including but not limited to signs of advertisement
    of condo units or slips either for sale or rent.
 28. DISCLAIMER. All slip owners, lessees, invitees, and guests agree and understand that in the event
    a condition should arise with their vessels, Which could, in the opinion of the Pirate's Bay Association
    or the Association's representative, cause damage to Association property or other personal property,
    or does not meet the requirements of above, the owner of the offending vessel shall be contacted. If
    contact is unsuccessful, all slip owners, lessees, invitees, and guests agree and authorize the
    Association and/or the Association's representative to take-the-necessary action to correct the
    condition. All owners, lessees, invitees, and guests further agree that in the event the condition is
    beyond the capabilities of the Association and/or the Association representative, a professional
    service may be called to correct the condition at the slip owners, lessees, invitees, and/or guest's
    expense. All slip owners, lessees, invitees, and guests agree to indemnify and hold harmless from
    liability, the Association and/or the Association's representative from any action taken to correct the
    condition. Or, the Pirate's Bay Association board can levy a fine against the slip owner for a violation
    up to $50.00 a day for 10 days but not to exceed $1,000.00 per violation.
I, the undersigned, have read all of the above Marina regulations 1 thru 28 and agree to the terms and
conditions thereof. I further agree to notify Pirate's Bay Association representative in writing if there
is a change in the information required to be in my file (insurance, registration, etc.)
