1. The Purpose of the Policy This policy document is intended to outline the principles and procedures to be adhered to when making use of drones, only as a hobby craft, in and around the Pecanwood Estate. Such should be incorporated into the current Conduct Rules and ratified at the Annual General Meeting in 2018. 2. The Objectives of the Policy Residents have raised concerns with respect to the use of Drones within the Estate, and with specific reference to the following: o Infringement of their privacy, o Photographic images that are being taken potentially of them or their families, and the purpose and publishing of such content. The purpose of this policy is to outline the use of drones within the Estate; and To further document the processes to be followed in the event that such is noted. 3. Responsibilities 3.1 The Board To approve the implementation of such policy. 3.2 The Pecanwood Estate Homeowners Association To ensure the implementation and effective management of such policy. 3.3 Security Committee To enforce such on a day to day basis, ensuring compliance to the policy at all times, and to document the actions taken for non-compliance by a resident, tenant, employee, guest and service provider. 4. Definitions "Remotely piloted aircraft" (RPAS): means an unmanned aircraft which is piloted from a remote pilot station, excluding model aircraft and toy aircraft. "Toy aircraft" means a product falling under the definition of aircraft which is designed or intended for use in play by children. "Model aircraft" means a non-human-carrying aircraft capable of sustained flight in the atmosphere and used exclusively for air display, recreational use, sport or competitions. General Principles of the Policy Those only interested in flying a hobby drone for private use (no commercial interest, outcome or gain), won’t be required to register the drone or obtain any licences, however the South African Civil Aviation Authority (SACAA) Remotely Piloted Aircraft System (RPAS) (Part 101) Regulations still apply. 6. Guidelines (in accordance with the South African Civil Aviation Authority) 6.1 Acceptable uses of RPAS For private use – (a) The RPAS may only be used for an individual's personal and private purposes where there is no commercial outcome, interest or gain; (b) The pilot must observe all statutory requirements relating to liability, privacy and any other laws enforceable by any other authorities. For all other use – (a) an RPA must be registered and may only be operated in terms of Part 101 of the South African Civil Aviation Regulations. 6.2 Dangers of negligent operation of an RPA Collision with other aircraft, with possible fatal results, Injury to the public, Damage to people's property, Legal liability for breaking laws such as privacy by-laws and other laws enforceable by other authorities. 6.3 Restrictions / Limitations of Drones DO NOT, through act or omission, endanger the safety of another aircraft or person therein or any person or property through negligent flying/operation of Remotely Piloted Aircraft, or toy aircraft. Do not fly/operate Remotely Piloted Aircraft, or toy aircraft 50 m or closer from: o Any person or group of persons (like sports field, road races, schools, social events, etc.) o Any roads and buildings, o Any property without explicit permission from the property owner. Unless approved by the SACAA, DO NOT fly/operate Remotely Piloted Aircraft or toy aircraft: o Near manned aircraft o 10 km or closer to an aerodrome (airport, helipad, airfield) o Weighing more than 7 kg o In controlled airspace o In restricted airspace o In prohibited airspace. o In No-Fly Zones (NFZ) in South Africa including: Prisons, Police stations, Crime scenes, Courts of law, Nuclear power plants, and National Key Points or Strategic installations like the Union Buildings Presidency in Pretoria. o Other prohibited air spaces including: Restricted (FAR), Danger (FAD) and Environmental (FAP) areas such as SAN Parks. Safari-goers may not operate their drones within 457 m above the ground in any of South Africa’s National Parks. This is because some sightseers use their drones to disturb or chase wild animals. Only drones used for wildlife conservation and research purposes are allowed, subject to special permission. Do not fly/operate Remotely Piloted Aircraft, or toy aircraft higher than 150 ft from the ground, unless approved by the Director of Civil Aviation of the SACAA. Apart from not being allowed to fly at night, be sure to keep an eye out for bad or inclement weather such as strong winds, rain or fog. 6.4 Permissible Use of Drones Fly/operate Remotely Piloted Aircraft, or toy aircraft in a safe manner, at all times. Remotely Piloted Aircraft or toy aircraft may fly in Restricted Visual Line of Sight (R-VLOS) only, which means that you must always maintain a direct line of sight with the drone. Max distance: The drone may fly up to 500 m away from the pilot whilst maintaining a direct line of sight. Max height: The drone may fly up to the height of the highest object in 300m of the drone, and not more than 192 m (400 ft) above the ground. Fly/operate RPA in daylight and clear weather conditions. Inspect your aircraft before each flight. you may fly on or above your property. 6.5 Conclusion Unfortunately, no drones can be flown on the Estate, without permission being granted from the PHOA. This is largely due to aviation legislation and privacy concerns; the aviation rules do not allow for it and the Pecanwood HOA must also comply to the same.
