Coming to Canada

• Temporary Resident Visa or Electronic Travel Authorization (eTA)
   • Allows you to travel to Canada but does not give you legal status in Canada

• At the Port of Entry, a Border Services Officer will decide on:
   1.   Your admission
   2.   Your legal status – temporary resident (visitor, student, worker) or permanent resident
   3.   The length of your stay in Canada as a temporary resident

Working on-campus while studying

• You can work on-campus without a work permit only if:
   •   You are a full-time student at an eligible educational institution
   •   Your study permit says you can work on- or off-campus
   •   You have already started studying
   •   You have a Social Insurance Number (SIN)

• You can work full time on campus without a work permit if you meet these
  conditions

Working off-campus while studying

• You can work off-campus without a work permit only if:
    •   Your are a full-time student at a designated learning institution (DLI)
    •   Your study program is minimum 6 months and leads to a degree, diploma or certificate
    •   Your study permit says you can work off-campus
    •   You have already started studying and you have a SIN

• During regular school terms/ semesters you can work off-campus for up to 20 hours per week.

• If you are on a scheduled break (i.e. winter or summer break) you can work full-time IF you are a
  full time student before and after the scheduled break

• Exception: in your final semester you can study part-time if you do not need a full course load to
  graduate                                                                                             10
Co-op or internship programs

• You can apply for a co-op work permit if:
   • You have a valid study permit
   • The co-op or internship placement is required to complete your study program
   • You have a letter from your school that confirms all students in your program need
     to complete work placements to graduate
   • The co-op or internship totals 50% or less of your study program

Extending your stay as a student and implied status

                                      Extend your Study Permit
                                      • Make sure your school is on the Designated
                                        Learning Institutions List
                                      • Gather all required documents
                                      • Apply online, ideally 3-4 months in advance

                                      Implied Status
                                      • If you apply for a new study permit before
                                        your old one expires, you can keep studying
                                        until a decision is made on your application
                                      • You must remain in Canada
 Important to always keep a legal
 status in Canada. Otherwise, you
  will have to leave the territory.

Restoration of status
If a temporary resident (visitor, worker or student) has lost their status, they may apply to restore
that status.

Applicant requirements:
    apply within 90 days of having lost their status
    meet the initial requirements for their stay
    remain in Canada until a decision is made
    have not failed to comply with any condition imposed (ex: work without authorization)
    have lost their status only because they have failed to comply with any of the following
       conditions :
        • The period authorized for their stay.
        • Non-compliance related to the type of work, employer or location of work

Note: there is currently a public policy that allows restoration after 90 days but there are
requirements to meet. More information available on IRCC website here

Foreign nationals applying for restoration have lost their status and may not continue to work or
attend school until their status has been restored and a new work or study permit has been issued.

Restoration fees (200 $) are not refundable.
How COVID-19 is affecting processing?

• Travel restrictions, service interruptions and country conditions abroad
  may not allow a person to submit full applications at this time.

• IRCC nonetheless continues to accept and process electronic
  applications for study permits, work permits, and extensions.

• No application in progress will be closed or refused due to a lack of
  documentation such as completing an immigration medical exam. An
  explanatory note must be submitted if the application is incomplete.

• A 90-day period will be granted for the applicant to comply with the
  requirements.

Biometric
International students outside Canada

•   Some biometric data collection sites are still closed.

•   If the collection site closest to you is closed, we will automatically extend the deadline for
    providing your biometric data, even if your letter of instructions says you have 30 or 90 days to
    submit it.

•   Your application will not be refused or closed if you cannot provide your biometrics due
    to the closure caused by COVID-19

International students inside Canada

•   Temporary residents are TEMPORARILY exempt from providing biometrics if they are already in
    Canada. This includes new requests or extensions.

IMPORTANT: this exemption does not apply if you are physically abroad.

Don’t go to the border
• Until further notice, travellers should NOT visit a Canada Border
  Services Agency office to apply for a work permit, study permit or
  permanent residence (known as flagpoling).

• Visitors, international students or temporary workers who are already
  in Canada can apply online to Immigration, Refugees and Citizenship
  Canada to extend your temporary resident status.

• For more information about how the Canada Border Services Agency
  facilitate the flow of legitimate travel and trade during the current
  global pandemic, please visit CBSA website.

Options after completing your study program
WITHIN 90 DAYS of receiving your completion letter OR final transcript:

Post-Graduation Work Permit (PGWP)

What is it?

      •   An open work permit
      •   Helps you gain Canadian work experience
      •   Helps support your PR application (if your experience is a NOC 0, A or B)
      •   You can only be issued one PGWP (not renewable, not extendable)

                                                                How long is it
                                                                   valid?

• Depends on length of study:
   • Less than 8 months = not eligible
   • 8 months - 2 years = same length as study program
   • 2 years and longer = 3 years

• A work permit cannot be issued for longer than the validity
  of your passport

Post-Graduation Work Permit (PGWP)

             • Successfully complete an eligible program Note: If because of
               COVID-19 you do not have a transcript available, you must submit
               an explanatory note.
             • Study full-time at an eligible Designated Learning Institution
             • Do not take unscheduled breaks or unauthorized leave
             • Do not exceed the allowable hours of off-campus work
             • Apply within 180 days of receiving letter of completion or final
               transcript from your school

How do I
qualify?

Post-Graduation Work Permit (PGWP)

• You can travel outside Canada and return with a valid visa or eTA while
  application in process ** Due to travel restrictions, you will have to wait until
  you get your work permit and have a valid job offer before traveling to
  Canada.

• If you apply when your study permit is still valid, you can work full-time until a
  decision is made

• If you wait over 90 days after program completion to apply, you cannot work
  while your application is in process

• You must stop working if your application is refused

Online Courses & Post-Graduate Work Permit
Eligibility for the PGWP will not be impacted for students whose courses have
been moved to an online format because of COVID-19.

In Canada:
• Students studying in Canada, who have graduated from a program eligible
   for a post-graduation work permit, but whose courses have been replaced by
   an online format due to the pandemic will remain eligible for the PGWP.

Abroad:
• Students who are currently unable to travel to Canada and who are
  attending their courses online due to the pandemic will be eligible for the
  PGWP. All time spent studying online from outside Canada between spring
  2020 and December 31, 2021 will be taken into account in determining the
  validity period of the PGWP.

Online Courses & Post-Graduate Work Permit
Short-term programs:

Students abroad who have undertaken an 8 to 12 month program between the Spring
and Fall 2020 semesters will be able to attend 100% of their program of study
remotely and still be eligible for a post-graduation work permit.

However, the time spent studying abroad after December 31, 2021 will be cut off from
the duration of the work permit.

In order to benefit from these above-mentioned facilitation measures, students must
have:
    A study permit
    An approval of a study permit

Open Work Permit for Former or Current Post-Graduation
              Work Permit Holders during the COVID-19 Pandemic
Who can apply?
• Your post-graduation work permit (PGWP)
    expired on or after January 30, 2020, or
    will expire within 4 months from the date you apply for this open work permit.
• You were in Canada as of January 27, 2021 and have stayed in Canada since then.
• You either:
    have a temporary resident status, or
    lost your temporary resident status, but you’ve already applied to restore it, or
    lost your temporary resident status, but you’ll apply to restore it at the same time as applying for
      this open work permit
• You have a valid passport.
What is the maximum duration of this work permit?
• 18 months or until the expiry of your passport
                          This public policy will be in effect until July 27, 2021.

Pathway to PR for resident of
          Quebec

                                27
Permanent Resident Programs in Quebec
Permanent Resident (PR) programs enable immigrants to settle permanently in
Canada. In Quebec, immigration is a shared jurisdiction.

      Governement of Quebec:
       Selects candidates who are destined for Quebec.
       Determines the conditions and selection criteria for candidates.
       Issues the Quebec Certificate of Selection (CSQ).

       Federal Governement:
        Grants the right of settlement (temporary and permanent) for all
         foreign nationals on the its territory, including Quebec.
        Checks the admissibility of immigrants (health, security & criminality).
        Delivers permanent residence and grants citizenship.

                       official language proficiency, level of education,

                     • Applicants with the highest scores are encouraged to
                       apply for permanent residence.
