As a reflection of our commitment to meaningful, sustainable change, in June 2020 Bryan Cave Leighton Paisner appointed Partners Jena Valdetero and Segun Osuntokun to co-lead the firm’s Inclusion & Diversity effort. Both bring determination, authenticity and a strong track record in driving change. As co-leader of BCLP Women, Jena introduced a number of policies and structural changes to address career barriers faced by women. As a founder of the firm’s UK Social Inclusion & Ethnicity network, Segun leads the award winning early talent program, Race for Change which has provided candid career insights to over 500 Black aspiring lawyers, making a transformative impact on the firm’s UK entry classes along the way. The timing of Jena and Segun’s appointment meant that they were able to lead our Firm’s robust response to this year’s events. Jena and Segun’s intention is to unleash and nurture the power of belonging, inclusion and diversity as a habit, not an initiative and to create an environment where all in the firm feel valued, respected, celebrated and able to reach their full potential. Steps are underway to strategically and systematically hard wire Inclusion & Diversity into the fabric of the firm. To ensure a one-firm approach is taken wherever possible our strategy and goals are supported by the firm’s Global Inclusion & Diversity Action Board, bringing together BCLP leaders and influencers from all four corners of the globe. This inaugural six-month Inclusion & Diversity Report intends to provide a candid, timely and informative insight into the challenges Bryan Cave Leighton Paisner is seeking to address, the steps we are currently taking and our future plans. We are incredibly proud to have been asked to lead as Co-Chairs of Bryan Cave Leighton Paisner’s Inclusion & Diversity effort. It is our goal to bring about meaningful and sustained change. We are determined to close the gap between the diversity in our Partnership and the diversity within our entry classes and associate ranks and to create an environment where each of our people, whether they are a fee-earning lawyer or business support colleague, feels able to bring their true selves to work, each and every day. We recognize that achieving this goal relies heavily on the engagement and commitment of all our people. While the first half of this year has brought with it exceptional challenge, we have seen a renewed willingness to listen and learn about the experiences of those in marginalized groups and a growing sense of responsibility, ownership, and accountability for inclusion and diversity. As stakeholders, the onus is on all of us to work toward creating a culture that welcomes, supports and advances diverse colleagues and talent through equitable opportunities, lasting connections and relationships, opportunities to learn from successes and failures alike, and overall, the chance to succeed. We are excited to share with our colleagues, clients and peers the Spring & Summer 2020 edition of BCLP’s Inclusion & Diversity Report. AN OPEN LETTER FROM SEGUN OSUNTOKUN BCLP London Office Managing Partner and Inclusion & Diversity Co-Chair Published in The Lawyer, July 2020 I hope that 2020 will be remembered as the year that uncomfortable but important conversations were propelled into the spotlight. Events of the last two months have forced leaders to look at what we can – and must – do better. As the managing partner of the largest office of a major international firm and as a Black man, I feel a responsibility to scrutinise the inclusivity of my own firm. I appreciate being in a painfully small minority in the City carries with it a duty to step forward as a vocal and visible role model. I am not naturally drawn to the limelight and the adage “if you can’t see it, you can’t be it” has weighed heavily in recent weeks. I recognise that the time has come to stand up and demand real, sustainable change. The focus on racism and racial injustice we have seen since the death of George Floyd is unprecedented and business leaders have a responsibility to make sure this is not just ‘a moment’. We have a responsibility to consider whether and how racism – implicit or explicit – pervades our firms. We have a responsibility to take a long hard look at our own organizations, to face uncomfortable realities and to ask difficult questions. Are we inclusive? Do we provide a level playing field for Black talent? Are we doing enough? I fear if we do not confront the uncomfortable now, we never will. In the spirit of real, sustainable change, I am proud to have played an active role in the genesis of the UK Race Fairness Commitment. The catalyst behind the commitment was a discussion on a study led by Rare Recruitment into the retention of Black, Asian and minority ethnic lawyers and their White counterparts. The results were sobering. Great strides have been made to broaden access to the legal profession, but more needs to be done to hold firms accountable for providing an inclusive environment and fair access to opportunities for Black professionals. The UK Race Fairness Commitment stands out from any other diversity initiative or charter I have seen. To be clear, this commitment extends to the entire workforce of participating firms – it is critical that business services professionals are not overlooked in this endeavour. The commitment it is not limited to the legal industry – I hope many employers across other industries will step up. In short, the UK Race Fairness Commitment aims to hold firms accountable for fair treatment of Black, minority ethnic and White applicants and staff. The firms that sign up to join the commitment intend to publish a far broader set of diversity data than they have in the past, opening themselves up to scrutiny. While many firms have a compelling story to tell when it comes to diversity, I believe this commitment will help to distinguish those who are prepared to walk the talk and also will also provide greater impetus for change. I have been encouraged to see many firms make pledges and commitments in recent weeks, but this must be a time for action as well as words. Here at BCLP I know we still have a great deal of work to do, but I am proud that we have one of the most ethnically diverse partnerships in the City, with over 14 per cent of our UK partners identifying as Black, Asian or Minority Ethnic. I am committed to working with my fellow partners to achieve real and lasting change. I call upon other business leaders across the UK and beyond to uphold these pledges and not allow the moment to pass. BCLP INCLUSION & DIVERSITY SEMIANNUAL REPORT 7 SPRING & SUMMER 2020
RESPONDING TO THE BLACK LIVES MATTER MOVEMENT In the days and weeks following George Floyd’s death, the global community expressed shock, sadness and anger. BCLP is steadfast in our resolve to continue to confront bias, racism and complicity, and to advocate for stronger accountability. We believe this cannot lead to a momentary sense of urgency, but rather a sustained and ongoing effort. BCLP has taken a number of actions to educate our people, and particularly our white colleagues, around issues such as systemic racism, power and privilege. These open and necessary conversations are only the beginning of the hard work we must do. THE LAW FIRM ANTI-RACISM THE UK RACE FAIRNESS ALLIANCE COMMITMENT BCLP is a proud member of the Law BCLP is a founding member of the Firm Antiracism Alliance (LFAA). STAND UP! SPEAK UP! CREATING A RACIALLY JUST WORKPLACE More than 500 BCLP colleagues joined Michelle Silverthorn, culture change expert and founder of Inclusion Nation, for Stand Up! Speak Up! – a high impact panel discussion focused on racism and the steps required to create a racially just workplace. Michelle was joined by BCLP Partner Angelia Duncan and Senior Information Services Manager Pierre Robinson for a candid panel discussion focused on racial injustice and the historical context of racism against Black people, as well as the contemporary anger and grief felt by many members of the Black community. BCLP/OFF SCRIPT In June 2020, BCLP launched BCLP/Off Script, a firmwide inclusion and diversity podcast featuring the honest conversations between colleagues across the firm discussing experiences, perspectives and stories. As the title implies, there is no script and the only Our People. Our Stories agenda is honesty. More than 1,000 BCLP colleagues have tuned into the weekly podcast series to hear deeply personal, powerful and professional conversations. The goal of BCLP/Off Script is to provide colleagues the opportunity to expand awareness and understanding of different experiences as well as promote continued conversations among colleagues, friends and family. All colleagues, regardless of location, seniority or role, are encouraged to share their stories. PERMANENT ADOPTION OF THE “PHILADELPHIA FLAG” Be You. To show solidarity and support, and to coincide with Pride month, our Global LGBTQ* community adopted the “Philadelphia flag,” which includes brown and black stripes to raise awareness of the issues people of color face specifically within the LGBTQ* community. FACING COVID-19 TOGETHER COVID-19 has caused disruption to every aspect of personal and professional lives. Our world and routines changed in a very short time. BCLP took a number of steps to support our people through this difficult time, ranging from relaxing our flexible working policies and providing mental health and well-being support to holding a number of family focused “experience sharing” sessions. SUPPORTING FAMILIES We learned early on in the pandemic the importance of bringing colleagues together to share the highs and lows of managing work life and home life during lockdown. BCLP’s series of family focused sessions included candid and human accounts of home- schooling, caring for older relatives and dealing with loneliness and isolation along with practical hints and tips. MENTAL WELL-BEING To mark Mental Health Awareness Week in the UK, BCLP held a virtual This is Me campaign, featuring personal insights into the mental health experiences of BCLP colleagues, including steps taken to cope and readjust during the pandemic. In June, BCLP held a global mindfulness taster session, led by Chartered Psychologist Susan Peacock of LiveWorkWell. The session discussed the neuroscience behind mindfulness and provided an opportunity to try out short guided meditations. ENGAGING WITH CLIENTS ON PSYCHOLOGICAL SAFETY AND VIRTUAL BELONGING London Partner Daisy Reeves, alongside our Inclusion & Diversity and Employment Law Teams, led a number of virtual master classes for BCLP clients focused on psychological safety, Speak Up & Listen Up cultures and the importance of inclusive leadership and virtual belonging in the context of COVID 19. LEADING WITH CONFIDENCE IN THE FACE OF UNCERTAINTY Abu Dhabi Partner and Inclusion & Diversity Board Member Hazel Shakur-Quinn moderated a panel of senior female leaders and influencers focused on leading virtual meetings. The session revealed key competencies that transform both communication and team leadership and that are necessary to use during uncertain times. UNDERSTANDING AND ADDRESSING THE ADVERSE IMPACT OF REMOTE WORKING ON DIVERSE TALENT To understand and address the impact of the extended period of remote working on diverse talent, BCLP introduced monthly reports tracking hours disparities for diverse lawyers by practice group and location. The reports are live across all U.S. offices and will be rolled out firmwide in the coming months. EARLY TALENT PROGRAMMING, CONTINUING IN EARNEST BCLP’s early talent programs are critical in attracting diverse talent to the firm. In the UK, the firm partnered with MyKindaFuture to launch BCLP Potential, a virtual early careers platform aimed at 16-to 18-year-old students from under-represented groups with an interest in law. The site provides dynamic outlines of routes into law, application tips and career advice more generally. In the U.S., our Summer Associate Program took place virtually. The firm’s Recruiting Team developed a robust curriculum that included practical skills trainings with follow-up exercises and projects, practice group presentations, attorney presentations on niche practices and matters, business services trainings encompassing all aspects of the business of law, and multiple inclusion and diversity sessions. STILL TO COME THIS YEAR IMPLICIT BIAS AND ANTI-RACISM TRAINING FOR ALL BCLP LEADERS AND PARTNERS Recognizing the need to educate those in a position of power and influence around the importance of anti-racism, combatting micro-behavior and stepping up as intentionally inclusive leaders, BCLP will roll out firmwide training for partners and leaders in the firm. SPONSORSHIP PROGRAM BCLP will kick-off the 4th year of its flagship U.S. Sponsorship Program in September. The year-long program brings together diverse U.S. associates who are within three years of eligibility for partnership consideration with partner sponsors, all of whom are senior leaders and rainmakers. 50% of those to participate in the first two cohorts of the program have since been promoted to partnership. This year, for the first time, the program will be expanded firmwide, incorporating sponsors and protégés from our offices in the UK and EMEA. STRUCTURED WORK ASSIGNMENT The firm is delighted to have instructed Mason & Cook to deliver a structured work assignment pilot program which will allow us to remove the risk of bias associated with work allocation and access to career-enhancing opportunity. Mason & Cook initially will work with our London Corporate & Finance Transactions Team, beginning September 2020. CONTINUING SUPPORT FOR PARENTS AND CAREGIVERS As the new school semester approaches, BCLP will continue to connect our people firmwide to explore and address the challenges facing working parents. Our approach will include expert-led sessions with topics such as “talking to your family when the world is a scary place” and “dealing with anxiety when preparing for the next stage of the pandemic.” EXPANSION OF BCLP/OFF SCRIPT We will build on the early success of BCLP/Off Script, expanding the series to feature more voices and topics. This holistic approach will allow our colleagues to honestly discuss their lived experiences and perspectives on race, ethnicity, ancestry, gender and gender expression, sexual orientation, religion and spiritual beliefs, physical health and disabilities, mental health and neurodiversity, veteran status, or any other range of human difference brought about by identity and experience. ASIA & MIDDLE EAST GENDER STRATEGY Partners Hazel Shakur-Quinn (UAE) and Marcus Dearle (Hong Kong) and Of Counsel Wanjing Goh (Singapore) are working to develop a gender strategy for the firm’s offices in Asia and the Middle East. The strategy will focus on supporting female talent at all levels, including emerging leaders, in addition to providing engagement and learning opportunities for partners and leaders. ACCESSIBILITY, A KEY FOCUS FOR OUR LONDON OFFICE MOVE BCLP placed accessibility at the heart of its London office move, which took place at the height of the pandemic. The firm’s approach included a two-stage accessibility audit to ensure that the completed fit-out met the highest levels of accessibility and usable design for all staff regardless of disability or long-term health condition. A neurodiversity audit also has been commissioned. The firm is proactively seeking feedback from its UK disability group as the process of emerging out of lockdown begins.
