Call to order. With a quorum present, the Regular Meeting of the Humble City Council was called to order by Mayor Aaron at 6:30 p.m. on Thursday, March 12, 2020 in the Council Chamber of the City of Humble City Hall, 114 West Higgins, Humble, Texas 77338. 2. Invocation and Pledge of Allegiance.
Mayor Pro-Tem Funderburk led the Invocation and Pledge of Allegiance. 3. Hear Visitors: During this time a citizen may address the City Council on any item which does not appear on the posted Agenda. Registration forms are available at the meeting and on our website. This form should be completed and returned to the City Secretary no later than ten (10) minutes prior to the beginning of the meeting. Upon stepping to the podium the speaker must state their name, and city of residence. Each speaker’s remarks are limited to three (3) minutes. The City Council will listen and receive the information presented by the speaker, Ask staff to look into the matter, or place the issue on a future agenda. Topics of operation concerns shall be directed to the City Manager. Comments should not personally attack other speakers, Council or Staff. No one wished to speak. 4. Consent Agenda: Ministerial or “housekeeping” items that can be voted on in one motion as allowed by law. Items may be removed from the Consent Agenda for individual consideration and discussed or acted upon by a majority vote of the Council. a. Minutes: February 27, 2020 Regular Meeting b. Correspondence Upon a motion made by Mayor Aaron, the City Council voted six (6) for and none (0) opposed to approve the Consent Agenda. The motion carried unanimously. 5. Presentation, possible action, and discussion on approval of Ordinance No. 20-864 encumbering funds budgeted in Fiscal Year 2019 for specific computer software applications and upgrades to be performed during Fiscal Year 2020. Upon a motion made by Mayor Pro-Tem Funderburk, the City Council voted six (6) for and none (0) opposed to approve Ordinance No. 20-864 encumbering funds budgeted in Fiscal Year 2019 for specific computer software applications and upgrades to be performed during Fiscal Year 2020. The motion carried unanimously. 6. Presentation, possible action, and discussion on approval of Ordinance No. 20-865 amending City of Humble Ordinance 19-852, passed and approved the 12th day of September 2019 and being an Ordinance adopting the City of Humble Budget for Fiscal Year 2019-2020, by adding to the budget adopted hereby an Addendum No. 3; providing for a certain amendment to such budget; making certain findings; and providing other matters related to the subject. Upon a motion made by Council Member Curry, the City Council voted six (6) for and none (0) opposed to approve Ordinance No. 20-865 amending City of Humble Ordinance 19-852, passed and approved the 12th day of September 2019 and being an Ordinance adopting the City of Humble Budget for Fiscal Year 2019-2020, by adding to the budget adopted hereby an Addendum No. 3; providing for a certain amendment to such budget; making certain findings; and providing other matters related to the subject. The motion carried unanimously.
7. Presentation, possible action, and discussion on approval of Resolution 20-820 amending Section 6.10 “To Receive Sick Leave Pay” of the City of Humble Personnel Policies. Upon a motion made by Mayor Pro-Tem Funderburk, the City Council voted six (6) for and none (0) opposed to approve Resolution 20-820 amending Section 6.10 “To Receive Sick Leave Pay” of the City of Humble Personnel Policies. The motion carried unanimously. 8. Presentation, possible action, and discussion on approval of street closure on Avenue A between Higgins and Main Street, for a street dance on April 11, 2020, from 10:00 a.m. to 7:00 p.m. at Lloyd’s Bar, 111 N. Avenue A. Upon a motion made by Council Member Pierce, the City Council voted six (6) for and none (0) opposed to approve a street closure on Avenue A between Higgins and Main Street, for a street dance on April 11, 2020, from 10:00 a.m. to 7:00 p.m. at Lloyd’s Bar, 111 N. Upon a motion made by Council Member Steagall, the City Council voted six (6) for and none (0) opposed to approve a Park Air 59 Replat, Partial Replat No. 1, for Archway Burdom Land Holdings, LTD., a subdivision of 9.670 acres / 421,209 sq. ft., being a Replat of Unrestricted Reserve “A”, Block 1, Park Air 59 Replat, F.C. No. 684300, H.C.M.R. situated in the W. B. Adams Survey, Abstract No. 95, located at 18780 Hwy 59, City of Humble, Harris County, Texas. The motion carried unanimously. 10. Adams Survey, Abstract No. 95, located at 18780 Hwy. 59, City of Humble, Harris County, Texas. City Manager Stuebe stated that there was a correction to this item. The Plat read Reserve A and it should be Reserve B. Upon a motion made by Mayor Pro-Tem Funderburk, the City Council voted six (6) for and none (0) opposed to approve a Development Plat of Air 59 Northern Tool, for Archway Burdom Land Holdings, LTD., a subdivision of 1.679 acres / 73,147 sq. ft. of land situated in the W. Adams Survey, Abstract No. 95, located at 18780 Hwy. 59, City of Humble, Harris County, Texas with the correction of Reserve B. The motion carried unanimously. 11. The motion carried unanimously. 13. Community announcements. City Manager Jason Stuebe stated in the best interest of the public: In following suit with other local entities and based on guidance from the Center for Disease Control, Harris County Health Department, and the State Department of Health, the following decisions have been made: - Good Oil Days Festival has been cancelled - All activities at the Bender Performing Arts Center have been cancelled through the end of March - All large public events at the Civic Center have been cancelled through April 4th - The Senior Activity Center will be closed effective Monday, March 16 through Tuesday, March 31st - Activities/Rentals at City Parks with more than 250 persons have been cancelled through the end of March - Music on Main will be cancelled The Humble Senior Bus will continue to run with increased cleaning and sanitation. Mayor Aaron added that the City will be proactive and reassess the situation at the end of March. 14. Adjourn With no further business to discuss, Council Member Pierce moved to adjourn. March 13, 2020 Number 11 More on COVID-19 The National League of Cities has provided additional information related to the coronavirus known as COVID-19, and the Texas Municipal League has prepared it own clearinghouse web page as well. For more information about COVID-19, please visit CDC’s website. Cybersecurity Training and Reporting Update As promised, the Texas Municipal League Intergovernmental Risk Pool (TML IRP) has released a free cybersecurity training program, including an online video. TML IRP did so in response to a new state law mandating that most city officials and employees complete cybersecurity training by June 14, 2020, and annually thereafter. The Texas Department of Information Resources (DIR) has also certified other programs, with more information available on the agency’s cybersecurity awareness training certification web page. DIR recently launched a self-reporting application called Texas by Texas (TxT), but cities must complete the following DIR survey by TODAY, March 13, to use it in the future. By using TxT, city employees can self-report their training compliance, and DIR will later send a detailed report from the TxT application to each city verifying their compliance. Whether your city uses TxT or not, the city will be responsible for tracking training compliance and submitting an acknowledgement form to DIR by June 15 through a web platform that will be available in April.
Cities will not submit individual employee certificates of completion to DIR. However, cities should retain certificates, or other proof of completion, with their training records. City officials with questions should contact DIR at TxTrainingCert@dir.texas.gov. TML member cities may use the material herein for any purpose. No other person or entity may reproduce, duplicate, or distribute any part of this document without the written authorization of the Texas Municipal League. 2
March 20, 2020 Number 12 Coronavirus (COVID-19) Updates The Texas Municipal League is open for business. The building is closed to all but essential personnel and most staff is working remotely, but the League remains open for business and is fully ready to serve. Cities are encouraged to call or email for legal assistance, help with ordinances, or for general advice or assistance. Let us know how we can assist you and your city. The League has prepared a coronavirus clearinghouse web page to keep cities updated. In addition, everyone who receives the Legislative Update should receive a daily email update each afternoon with information on new developments. The daily email updates will be our primary means of communication during the pandemic. Those emails are being archived as well.
Right-of-Way Lawsuit: Temporary Injunction Denied A judge has denied a temporary injunction in a lawsuit arguing that the Texas Legislature is giving away city rights-of-way for little or no compensation. The lawsuit began in 2017, when the City of McAllen and a coalition of around 40 cities sued the state to challenge the unconstitutionally low right-of-way rental fees in S.B. 1004 by Kelly Hancock (R – North Richland Hills). That bill, passed during the 2017 regular session, requires a city to allow access for cellular antennae and related equipment (“small cell nodes”) in city rights-of-way, and it also entitles cell companies and others to place equipment on city light poles, traffic poles, street signs, and other poles. The bill gives cities limited authority over placement, and it caps a city’s right-of-way rental fee at around $250 per small cell node. The artificially low price per node is a taxpayer subsidy to the cellular industry because it allows nearly free use of taxpayer-owned rights-of-way and facilities. The bill does precisely what the Texas Constitution prohibits: It is an action by the legislature forcing cities to give away their valuable assets to a private company. The lawsuit was recently amended to add a claim based on S.B. 1152, the “franchise fee elimination” bill passed in 2019. That bill (also authored by Senator Hancock) authorizes a cable or phone company to stop paying the lesser of its state cable franchise or telephone access line fees, whichever is less for the company statewide. Because it also requires an unconstitutional gift of use of cities’ rights of way, the pleadings in the small cell lawsuit were amended to include the bill. The lawsuit will still proceed, but companies won’t be enjoined from reducing their payments. TML member cities may use the material herein for any purpose. ORDINANCE NO. 20-866 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HUMBLE, TEXAS, POSTPONING THE GENERAL ELECTION PREVIOUSLY CALLED FOR SATURDAY, MAY 2, 2020 TO NOVEMBER 3, 2020 AS ALLOWED BY PROCLAMATION OF THE GOVERNOR, IN ORDER TO ELECT ONE COUNCILMEMBER FOR PLACE 4; AUTHORIZING EXECUTION OF JOINT ELECTION CONTRACT FOR THE NOVEMBER 3, 2020 ELECTION; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, in accordance with the general laws and Constitution of the State of Texas and the Charter of the City of Humble, Texas, and pursuant to Ordinance No. 20-861, a Municipal Officers’ election was ordered to held on May 2, 2020, for the purpose of electing Council Members for Places 3, 4, and 5; and WHEREAS, Places 3 and 5 were unopposed and declared elected on February 27, 2020 and will be sworn into office after May 2, 2020; and WHEREAS, the Governor of the State of Texas declared a state of disaster on March 13, 2020, in order to control the outbreak of the coronavirus disease (“COVID-19”); and WHEREAS, pursuant to Section 418.016 of the Texas Government Code, on March 18, 2020, the Governor of the State of Texas signed a proclamation suspending certain provisions of the Texas Election Code and the Texas Water Code to allow all local political subdivisions that are utilizing the May 2, 2020 uniform election date to postpone their elections to the November 3, 2020, uniform election date; and WHEREAS, pursuant to the Governor’s proclamation authorizing the City of Humble to postpone the May 2, 2020 election date, the City Council does by this Ordinance exercise its authority to postpone the General Election ordered for May 2, 2020, for the purpose of electing Council Member for Place 4 to November 3, 2020; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUMBLE, TEXAS: SECTION 1: That the Municipal Officers’ election previously ordered for May 2, 2020, for the City of Humble, Texas, for the purpose of electing members of the City Council to the office City Councilmember Place 4 is hereby postponed to November 3, 2020. SECTION 2: That the candidate filings for the Municipal election for May 2, 2020, for the City of Humble, Texas, for the purpose of electing members of the City Council for Council Member Place 4 shall remain valid for the election to be held on November 3, 2020, and that the filing period for candidates will not be re-opened for the election to be held on November 3, 2020. 1
SECTION 3: That all applications for ballot by mail (ABBMs) filed by voters due to being over the age of 65 or because of disability will still be valid for the November 3, 2020, election However, ABBMs for voters who submitted ABBMs based on expected absence from the county shall not be valid for the postponed November 3, 2020 election. SECTION 4: That the voter registration deadline for the November 3, 2020, election is October 5, 2020. All applications for ballot my mail for the November election must be submitted no later than October 23, 2020. Early voting will be conducted October 19, 2020, through October 30, 2020. SECTION 5. That the City Secretary is authorized to negotiate and execute an election contract with Harris County for the purposes of conducting the postponed election on November 3, 2020. Harris County will determine the Early Voting Clerk and contact information, main early voting location, early voting dates and hours, including weekend early voting, and branch early voting locations. SECTION 6. That should any word, sentence, paragraph, subdivision, clause, phrase or section of this ordinance be adjudged or held to be invalid, void or unconstitutional, the same shall not affect the validity of the remaining portions of said ordinance, which shall remain in full force and effect. SECTION 7. This Ordinance shall take effect immediately from and after its passage as the law and charter in such cases provide. PASSED, APPROVED AND ADOPTED this the 26th day of March, 2020. City of Humble Ordinance No. 20-867 AN ORDINANCE OF THE CITY OF HUMBLE DECLARING A PUBLIC HEALTH EMERGENCY, EXTENDING THE MAYOR’S DISASTER DECLARATION DUE TO PUBLIC HEALTH EMERGENCY; IMPOSING OTHER REQUIREMENTS DUE TO THESE EMERGENCIES; AND PROVIDING FOR A FINE IN AN AMOUNT NOT TO EXCEED $2,000 FOR EACH OFFENSE. WHEREAS, in December 2019, a novel respiratory disease named "SARS-CoV-2" that the causes a disease named "coronavirus disease 2019" ("COVID-19") was detected in Wuhan City, Hubei Province, China; and WHEREAS, symptoms of COVID-19 include fever, cough, and shortness of breath that may result in mild to severe illness, and in some cases death; and WHEREAS, on January 30, 2020, the World Health Organization Director General declared the outbreak of COVID-19 as a Public Health Emergency of International Concern and advised countries to prepare for the containment, including active surveillance, early detection, isolation and case management, contact tracing, and prevention of onward spread of the disease; and WHEREAS, on January 31, 2020, the U.S. Health and Human Services Secretary declared a public health emergency for the United States to aid the nation's healthcare community in responding to COVID-19; and WHEREAS, information issued by the Federal Center for Disease Control and the Texas Department of Health Services related to the Corona/COVID-19 virus have stressed undertaking steps to control the virus; and WHEREAS, those entities have urged that the failure to take steps to diminish the spread of the virus will result in the overwhelming of the health care system in this area; and WHEREAS, the present emphasis is the control of community spread of the virus by limiting the number of citizens who are present in a given area; and WHEREAS, the CDC also warns that workplaces and other places for mass gatherings may experience more absenteeism; public health and healthcare systems may become overloaded with elevated rates of hospitalizations and deaths; other critical infrastructure, such as law enforcement, emergency medical services, and transportation industry may also be affected; and health care providers and hospitals may be overwhelmed; and WHEREAS, to date, over 100 persons in the region have tested positive for the virus and it is anticipated that the number of persons diagnosed with the virus is likely to increase, as testing for the virus continues; and WHEREAS, the City of Houston, a major population center in close proximity to the City of Humble, declared a local disaster due to this same public health emergency on March 11, 2020; and
WHEREAS, Harris County has also declared a local disaster due to this same public health emergency; and WHEREAS, the Governor declared a statewide disaster due to public health emergency on March 13, 2020; and WHEREAS, the City, local health agencies, and political subdivisions within the region have been working diligently to implement CDC guidelines, but now require additional tools and resources to protect the public health given the current state of the epidemic and the need for a sustained response; and WHEREAS, it is necessary to the public health of the residents of the City of Humble and surrounding areas that those persons under investigation, persons under management, and quarantined persons remain within the confines of their homes or in safe, secure facilities during the quarantine period following their exposure to the virus; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF HUMBLE, TEXAS: Section 1. Public Health Emergency. Pursuant to §122.006 of the Texas Health and Safety Code, the City is authorized take any actions necessary to promote health and suppress disease, including quarantine, examining and regulating hospitals. The City of Humble hereby declares that those persons under investigation, persons under management, and quarantined persons remain within the confines of their homes or in safe, secure facilities during the quarantine period following their exposure to the virus. Section 2. Disaster Declaration Extended. Pursuant to Chapter 418 of the Texas Government Code, the Disaster Declaration due to Public Health Emergency issued by the Mayor on March 23, 2020 is hereby extended until cancelled by order of the Mayor or repeal of this Ordinance by Council. All actions included in the Mayor’s disaster declaration are hereby extended by this Ordinance. Section 3. Bar and Restaurant Dining Room Closures. It shall be unlawful for the operator of a bar or restaurant to be open to the public for the purposes of dine-in services; provided, however, this shall not preclude restaurants or bars from providing take out, delivery, or drive through window services in accordance with state law. In accordance with the Texas Disaster Act, this declaration shall take effect as applied to bars and restaurants at 8:00 A.M. on March 18, 2020 and shall terminate at 11:59 P.M. on April 3, 2020, unless extended by the Mayor, his successor, by act of the City Council, by act of the Governor, or the Commissioners’ Court of Harris County. Section 4. Prohibited Gatherings. Pursuant to §122.006 of the Texas Health and Safety Code and Chapter 418 of the Texas Government Code, the City is authorized take any actions necessary to promote health and suppress disease, including quarantine, examining and regulating hospitals. Pursuant to this statutory authority, the City of Humble hereby prohibits Community Gatherings within the City limits of Humble. For purposes of these regulations, a “Community Gathering” is any indoor or outdoor event or convening, subject to the exceptions and clarifications below, that brings together or is likely to bring together ten (10) or more persons at the same time in a single room or other single confined or enclosed space, such as an auditorium, theatre, stadium (indoor or outdoor), arena or event Page 2
center, meeting hall, conference center, large cafeteria, or any other confined indoor or confined outdoor space; provided, however: a. An outdoor “Community Gathering” under these regulations is limited to events in confined outdoor spaces, which means an outdoor space that (i) is enclosed by a fence, physical barrier, or other structure and (ii) where people are present and they are within arm’s length of one another for extended periods. b. These regulations do not prohibit gatherings of people in multiple, separate enclosed spaces in a single building such as a school or office tower, so long as 10 people are not present in any single space at the same time. These regulations also do not prohibit the use of enclosed spaces where 10 or more people may be present at different times during the day, so long as 10 or more people are not present in the space at the same time. c. For purposes of clarity, a “Community Gathering” does not include the following so long as visitors are generally not within arm’s length of one another for extended periods: (i) spaces where 10 or more persons may be in transit or waiting for transit such as airports, bus stations, or terminals; (ii) office space or residential buildings; (iii) grocery stores, shopping malls, or other retail establishments where large numbers of people are present, but it is unusual for them to be within arm’s length of one another for extended periods; and (iv) hospitals and medical facilities. Section 5. Severability. In the event any clause phrase, provision, sentence, or part of this Ordinance or the application of the same to any person or circumstances shall for any reason be adjudged invalid or held unconstitutional by a court of competent jurisdiction, it shall not affect, impair, or invalidate this Ordinance as a whole or any part or provision hereof other than the part declared to be invalid or unconstitutional; and the City Council of the City of Humble, Texas, declares that it would have passed each and every part of the same notwithstanding the omission of any such part thus declared to be invalid or unconstitutional, whether there be one or more parts. Section 6. Penalty. In accordance with Texas Government Code §418.173, a person who knowingly or intentionally violates this declaration commits an offense, punishable by a fine up to $1,000.00 or confinement in jail for a term that does not exceed 180 days. Further, any person who shall violate any provision of this Ordinance that is not covered by Texas Government Code §418.173 shall be deemed guilty of a misdemeanor and, upon conviction, shall be fined in an amount not to exceed $2,000. Each day of violation shall constitute a separate offense. This Ordinance shall be published as required by law as soon as practicable under emergency circumstances. Section 7. Effective Date. This Ordinance shall take effect immediately upon its approval; provided, however, Section 6 shall take effect follow notice and publication as required by law.
