GREYHOUND LINES, INC. PACKAGE EXPRESS TARIFF AND SALES MANUAL The Intercity Bus Directory, issued by National Bus Traffic Association, Inc., contains the industry rules and regulations which govern passenger travel and baggage and express service. The following general rules and regulations have been extracted from the Directory and included here. RATES, RULES, AND REGULATIONS The Rates and Charges in this document are shown in dollars and cents and are payable in lawful United States money or its equivalent. DETERMINATION OF APPLICABLE EXPRESS RATE ZONES: The applicable Express Rate Zones will be determined by using the United States Postal Zip Code Prefix (first three (3) digits of the Zip Code) of the Origin Station and Zip Code Prefix of the Destination Station. Select Origin State from the top of the column at the left. Click on Origin Zip Code Prefix. This will open a window showing all possible destination Zip Code Prefixes. Determine the applicable Rate Zone and click on the appropriate Table of Rates for the Rate Zone and type of Service. This will open a window showing the rates. Determine the rate by the weight of the shipment. PACKING, MARKING, LABELING, AND CONDITIONS OF ACCEPTANCE: All shipments must meet the following minimum requirements: • Unless otherwise specified, all shipments must be packed in containers made of material of durability and quality sufficient to withstand the handling, piling, and moving incident to transportation. This packaging must provide proper protection of shipment contents, and protection against damage to baggage or other shipments. • Unwrapped shipments, or shipments not packed in containers will be accepted if they will not cause damage to, or be damaged by other shipments or baggage. • Fragile items must be separated by corrugated partitions, individually wrapped in air-bubble plastic, styrofoam sheets or pellets, excelsior, molded plastic or specially designed creped wadding products. The interior must contain filler to prevent the fragile items from resting against or touching the exterior shell or another interior item. Clothing and bedding material, newspaper (crumpled or otherwise) are not adequate to protect fragile items in bus package express service. Fragile items include, but are not limited to, ceramics, plaster of paris objects, dishes, lamps, statues, pottery, glassware, stereo and electronic components. • All packages which contain fragile or perishable articles must be plainly marked "Fragile" or "Perishable." • The names and addresses of both consignee and consignor, plus shipping instructions must be plainly written, printed, typed, or otherwise legibly shown on all express shipments. • All lot shipments must be labeled as such. • Additional packing, marking, and conditions of acceptance may apply to specific articles, commodities, materials, and substances. These will be show in connection with each specific item. • The contents and/or nature of a shipment must be identified by the shipper prior to shipment and must be identified on the busbill, in sufficient detail to enable the carrier to ascertain, 1) that the shipment is acceptable in bus package express service, 2) that the shipment meets packing, marking, and labeling requirements, and 3) the amount of lawful rates and charges applicable. (Greyhound Package Express Agents may inspect a package at the time of shipment for the safety and security of our customers and employees. This inspection is not to verify proper packaging of the contents of the shipment. Proper packaging to protect the contents of a shipment is the sole responsibility of the shipper.) • The carrier reserves the right to open and inspect shipments when it has reason to believe that such inspection is necessary to insure proper packing of the contents or to determine that the contents are not damaged. If damage is found at point of origin, the carrier reserves the right to refuse the shipment. • The originating carrier reserves the right to refuse to accept shipments in an apparent damage condition. PACKAGE EXPRESS TARIFF AND SALES MANUAL DIMENSIONAL WEIGHT SURCHARGE: Any single package that measures in excess of 24 inches on any one side will be assessed an oversize surcharge. For lot shipments, the surcharge will be assessed, for each piece that exceeds 24 inches on any one side. The surcharge applies in addition to the shipping cost. Surcharges will be assessed on the longest dimension only as follows: Packages exceeding 24" but not longer than 36" will be assessed a $5.00 oversize surcharge. Packages exceeding 36" but not longer than 48" will be assessed a $9.00 oversize surcharge. Packages exceeding 48" but not longer than 66" will be assessed a $21.00 oversize surcharge. Packages exceeding 66" but not longer than 82" will be assessed a $32.00 oversize surcharge. DETERMINATION OF CHARGES FOR SHIPMENTS WEIGHING IN EXCESS OF ONE HUNDRED POUNDS: The charges on shipments which weigh over one hundred (100) pounds will be determined by multiplying the rate for a one-hundred (100) pound shipment by the number of pounds in the shipment and dividing the product by one hundred (100). When necessary, an amount will be added to make the Charge end on "0" or "5." GPX DIRECT SERVICE: Shipments rated with pick up and delivery charges inclusive in the express rate with a guaranteed delivery time at the consignee's address. Shipments are monitored through telephone notifications and confirmations at all "touch" points of the shipment. A proof of delivery call to the shipper can be requested at the customer's request. Standard Service Zone A shipments 0-125 miles 1 day service by 5pm Zone B shipments 126-275 miles 2 day service by 5 pm Zone C shipments 276-500 miles 3 day service by 5pm Zone D shipments 501-800 miles 4 day service by 5pm Zone E shipments 800+ miles 7 day service by 5pm PRIORITY EXPRESS SERVICE: Shipments shipped in Priority Express Service are guaranteed to be transported on the next scheduled departure to destination for zones A-D only. Priority service is not available for Zone E STANDARD EXPRESS SERVICE: Standard Express Service is available between all points served by the Carriers named herein. Shipments transported in Standard Express Service are on a space available basis with no guaranteed service commitment. Revised: December 11, 2013 Page 6
GREYHOUND LINES, INC. PACKAGE EXPRESS TARIFF AND SALES MANUAL LOT SHIPMENTS: Lot Shipments of up to ninety-nine (99) pieces will be accepted in both standard and priority service levels. Additional piece surcharges will apply to each additional piece after the first three (3) pieces for shipments rated Zones A thru D, and to each piece after the first piece for shipments rated Zone E as shown in the following table. Additional piece surcharges will apply to all pieces after the first piece for Zone E shipments. Dimensional Weight Surcharges will also apply to any oversize pieces. Declared Value limits will remain unchanged. SIZE, WEIGHT AND VALUE LIMITATIONS: SIZE: Packages will be accepted for transportation, provided the dimensions of the package are within the following maximum size limitation: 30 inches x 47 inches x 82 inches Shipments of Skis and/or Ski Poles will not be subject to the size limitations specified herein. The Carriers participating in these rates, rules and regulations reserve the right to refuse to accept a package if its dimensions, even though within the limits specified herein, exceed the size or capacity of the Baggage and Express Compartments of the available vehicles. Shipments more than 48" in length could take up to 15 business days in transit due to space constraints. Auto parts will must be tendered with OEM packaging. If manufacturing packaging does not exist Carrier will accept at the shipper’s risk or at no declared value. WEIGHT: No single Package will be accepted for transportation which exceeds one hundred (100) pounds in Actual Weight. Provisions for shipments weighing up to, but not exceeding, one hundred fifty (150) pounds apply in selected areas. Shipments over one hundred (100) pounds are limited to the routes of carriers with a (150) after the name. See next page for applicable areas. Xpress Baggage shipments may not exceed 75 pounds per piece. VALUE: No single shipment (Prepaid, Collect, or C.O.D.) will be accepted for transportation which exceeds one thousand dollars ($1,000) in actual or released value. Released or declared value is the value agreed upon between the shipper and the carrier as evidenced by the uniform receipt given to the shipper by the carrier at the time of shipment or within a reasonable time thereafter or as agreed upon. With the exception of Xpress Baggage Service shipments, excess value charges will be assessed for any shipment with value greater than one hundred dollars ($100). Xpress Baggage Service shipments will be assessed excess value charges for any shipment with value greater than two hundred, fifty dollars ($250). Revised: December 11, 2013 Page 7

PACKAGE EXPRESS TARIFF AND SALES MANUAL PERSONAL GOODS SHIPMENTS: Personal goods shipments are defined as shipments primarily made up of items meant to be used for personal or household use, These shipments may contain, but are not limited to, household goods, clothing, furniture and auto parts not being delivered to a commercial place of business. Greyhound Package Express delivers Personal Goods Shipments to ground level addresses only. In the event the recipient resides in a multi-story building, the shipment will be delivered to the ground floor entrance only. Personal Goods Shipments can be scheduled for pick-up or delivery on weekends or holidays as well as after normal business hours. These scheduling requests require a four hour pick-up or delivery window. There will be a surcharge of $100 for after hours, weekends and holidays pick-up and / or delivery request for Personal Goods Shipments. PACKAGE EXPRESS TARIFF AND SALES MANUAL EXCESS, OVERWEIGHT, OVERSIZE BAGGAGE IN EXPRESS SERVICE (XPRESS BAGGAGE): Shipments rated at a reduced express charge for customers traveling on a valid passenger ticket that have excess, oversize or overweight baggage as defined below. Shipments shipped in Xpress Baggage Service are to be transported on the same schedule for which the passenger is ticketed. Up to a maximum of 5 pieces of Excess, Overweight, or Oversize Baggage will be accepted in Xpress Baggage Service at reduced rates, under the following conditions. • Bag must not exceed size limit as listed above in the SIZE, WEIGHT AND VALUE LIMITATIONS section. • Bag must not exceed 75 pounds in weight. • Passenger must present proof of ticket purchase, to ship Xpress Baggage. Baggage may be shipped to destination shown on ticket only and at the same time as the passenger. Baggage sent ahead of the passenger will travel at normal express tariff rates. • Baggage transported in Xpress Baggage Service must be prepaid. • Actual rates for Xpress Baggage Service will be based on current Express Rate Zones. Baggage destined to Express Rate Zones A thru C, will be $30 per piece, while baggage destined to Express Rate Zone D will be $35 per piece and Express Rate Zone E will be $40 per piece. • Maximum value for Xpress Baggage Service is $1000 per shipment of up to 5 pieces. Free value allowance is $250. An additional charge as indicated above will be assessed for any value over and above the $250 free allowance. • Items shipped in Xpress Baggage Service are subject to the same definition of baggage as listed in the Passenger Fare Tariff and Sales Manual, Section 11.2. • Baggage not meeting these conditions may be sent via Greyhound Package Express Service at regular tariff rates and rules, or by another method of the passenger's choosing. • Items discovered in passenger baggage during security checks that are not permitted inside the bus may be shipped to destination for $10 per shipment. PACKAGE EXPRESS TARIFF AND SALES MANUAL PREPAID OR COLLECT SHIPMENTS: A shipment is considered PREPAID upon payment of applicable transportation charges by the consignor at the time the shipment is presented to the carrier. • Shipments of personal effects such as wearing apparel, housewares, books, blankets, or other articles for personal or household use when shipped by a person to another individual person or to himself, must be sent PREPAID. • Materials involving scheduled events, such as campaign literature, advertising posters, tickets and programs, and all dated materials, such as newspapers, magazines, pamphlets and advertising material, must be sent PREPAID. A shipment is considered COLLECT with the understanding that the applicable transportation charges will be paid by the consignee at the time the shipment is delivered. Upon request to, and approval by, the carrier, credit privileges may be extended to consignors and consignees COLLECT SHIPMENT CHARGE: A "Collection Fee" in the amount of three dollars ($3.00) per shipment will be assessed on all Express Shipments forwarded with Express Charges "Collect." PICK-UP AND DELIVERY SERVICE: Charges for pick-up and delivery service are in addition to the rates and charges herein. Pick-up and delivery service is not available at all locations. NOTICE OF ARRIVAL: Notice to consignee of arrival of a shipment at destination will be made either by telephone on in writing by mail. If notice by telephone, requires payment of toll charges, the notification will be made by "collect" telephone call when requested by the shipper. RECEIVING AND FORWARDING SHIPMENTS: • A receipt (copy of the busbill) must be given by the carrier to the shipper for each shipment received for transportation. • Packages received for shipments are forwarded on the first available schedule, unless Priority Service is requested. The priority shipment is then forwarded on the next schedule. • When transfer of an express shipment from one station to another is required the carrier delivering the shipment shall arrange to make the necessary transfer and deliver the shipment to the station served by the connecting outbound carrier. • Packages received too late to reach the destination before the destination station is closed may be held at the discretion of the carrier and forwarded so as to reach the destination when the station is open. • Shipments destined to a non-agency destination will be accepted only when the consignee or his agent is to be present at the time of arrival at the destination to acknowledge receipt thereof. If the consignee or his agent fails to meet the bus, the shipment will be carried to the next open agency station and additional transportation charges will be assessed at the applicable rate. When shipper prepays the charges and instructs the carrier to unload the shipment at the non-agency destinations it will be unloaded at the shipper's risk. Revised: December 11, 2013 Page 11

PACKAGE EXPRESS TARIFF AND SALES MANUAL REFUSED OR UNCLAIMED SHIPMENTS: • The receiving agent at destination will notify the consignor(shipper) at origin when a shipment has been on hand seventy-two (72) hours and is unclaimed or refused and will request instructions as to the disposition to be made of the shipment. A shipment which is unclaimed or refused for any reason, will be held at the destination for a period not in excess of thirty (30) days after notice, pending receipt of instructions from the consignor as to the disposition of such shipment. • Prepaid shipments returned to the shipper will be subject to return express charges, excess value charges, if any, plus any accrued storage charges. • Collect shipments returned to the shipper will be subject to round trip express charges, excess value charges, if any, plus any accrued storage charges. • An unclaimed or refused shipment will be reforwarded from original destination to final destination upon request of the consignor, provided payment is made of all accrued charges, plus express charges and excess value charges, if any. • A shipment which is unclaimed or refused for thirty (30) days after notice to consignor (shipper) will be forwarded to the Unclaimed Express Warehouse of the carrier on whose line the shipment is held. In the event the consignor later requests the return of the shipment (within ninety (90) days after the date of the shipment), the shipment will be returned upon payment of all accrued charges, plus express charges and excess value charges, if any, for transportation from original destination of the shipment to the Unclaimed Express Warehouse and from the Warehouse to the point where the shipment is returned. • Shipments unclaimed for a period of ninety (90) days after the date of shipment may be sold for accumulated charges in accordance with the state laws of the state in which sale is held. • When a shipment that contains perishable items is delayed in the possession of the carrier, or is unclaimed, refused, or threatened with deterioration, the carrier shall have the right immediately to take steps as it sees fit for the protection of the carrier and other parties in interest, including collect communications for instructions, or sale or other disposition of the perishable items without instructions. • No sale or disposal will discharge any liability or lien to a greater extent than the proceeds from the sale, less selling expenses, if any, and the shipper and consignee will remain liable, jointly and severally for any deficiency. PROOF OF DELIVERY: • When proof of delivery is requested a charge of five dollars ($5) will be assessed. This charge must accompany each request to the general office of the origin carrier to cover cost of records search for such proof of delivery. • When proof of delivery cannot be established, the accompanying proof of delivery charge shall be refunded. PACKAGE EXPRESS TARIFF AND SALES MANUAL STORAGE CHARGES: • Express shipments will be stored for up to 3 (three) business days following the first notification of arrival without charge. After the free storage time elapses, a storage charge of five dollars ($5) per day will be applied for each piece for a maximum of thirty days. • If unclaimed for 30 days, the package will be forwarded to the Unclaimed Baggage Warehouse. If the package is unclaimed for 90 days, the package will be sold for accumulated storage charges. • The allowable free storage time of seventy-two (72) hours will be computed from the first 7:00 A.M. after the day upon which notice of arrival is mailed or given to the consignee that the shipment has been received at the destination. In the computation of the free storage time, Saturdays, Sundays, and Legal Holidays (National, State, or Municipal), but not half-holidays, will be excluded. When a Legal Holiday falls on Saturday or Sunday, the following Monday will be excluded; any fractional part of twenty-four (24) hours will be considered as one (1) day. • If the quality or character of a shipment to be stored is such that the facilities of the carriers do not, in their opinion offer protection from injury, deterioration, damage or theft, the carrier reserves the right to place such shipment in a public warehouse at the expense of the consignee or consignor, as their interests may appear, in which case the regular charges of such public warehouse will be assessed. C.O.D. SHIPMENTS: C.O.D. (Collect on Delivery) express shipments, i.e., shipments forwarded on which the delivering agent is to collect an amount from the consignee to cover the stated value of the shipment, will be accepted ONLY from, to, and between or via points on the lines of carriers who authorize the acceptance of local and/or interline C.O.D. shipments. EXPRESS SHIPMENTS - RULES AND REGULATIONS: C.O.D. express shipments which do not exceed five hundred dollars ($500) in actual value will be accepted for transportation between agency stations in the United States. • C .O.D. means Collect on Delivery, I.e., collection from the consignee of the amount of the C.O.D. at the time of delivery of the shipment and remittance of such amount to the carrier for remittance to the consignor. • Shipments will be accepted C.O.D. when shipped from one firm or business to another firm or business only. • Only one C.O.D. amount may be shown in connection with a single shipment and may not be subject to change, dependent upon time or conditions of payment. • The shipper must have the letters C.O.D. legibly and durably marked on each piece of a C.O.D. shipment. • Shipments will NOT be accepted C.O.D. 1) when billed to one firm or business with instructions to collect charges from another firm or business, 2) when C.O.D. pieces are billed on the same busbill as pieces not moving C.O.D., and 3) when the shipment consists of personal effects unless being shipped from manufacturer or distributor to a commercial concern. • Shipment with a value exceeding five hundred dollars ($500) will NOT be accepted C.O.D. (This does not include C.O.D. fees, collect transportation charges, excess valuation charges, etc., which must also be collected from the consignee at the time of delivery. • No credit will be extended on the amount of the C.O.D. • No privilege of examination or trial will be extended prior to the collection of the C.O.D. amount. • No partial delivery of a C.O.D. shipment will be made, unless the full amount of the C.O.D. has been collected. • Unless the shipper declares a different value, the C.O.D. amount shall be considered to be the declared value, and excess value charges will be assessed if the shipment's declared value exceeds one hundred dollars ($100). C.O.D. EXPRESS SHIPMENTS VALUED OVER $500 C.O.D. express shipments which do not exceed one thousand dollars ($1,000) in actual value will be accepted for transportation between agency stations in the United States on the routes of the carriers showing the notation of COD1000 after the name subject to the following conditions: • C.O.D. Service will be offered to commercial shippers only. • C.O.D. customers must have a Greyhound charge account to ship C.O.D. • Check accepted up to five hundred dollars ($500) in accordance with pre established policy of check acceptance. • Cashier's check or certified check required up to one thousand dollars ($1,000) • Manager or supervisor must approve all C.O.D. shipments over three hundred dollars ($300) at both forwarding and receiving locations. • All C.O.D. shipments must be manifested and loaded by the selling agent. • All electronics/electronic media must have manifest faxed (or phoned) to receiving location and any transfer points (if applicable). All faxes must be acknowledged by return phone call. • Customers notified by direct mail. C.O.D. CHARGES: A charge in the amount of fifteen dollars ($15.00) for the collection and remittance of the amount of the C.O.D. will be assessed for each C.O.D. shipment. Revised: December 11, 2013 Page 14
GREYHOUND LINES, INC. PACKAGE EXPRESS TARIFF AND SALES MANUAL COLLECTION, FORM OF PAYMENT AND REMITTANCE OF C.O.D. AMOUNTS: • The amount of C.O.D. bills, including C.O.D. fees, collect transportation charges and fees, excess valuation charges, and all other applicable charges on C.O.D. shipments must be collected at the time such shipment is delivered to the consignee. • Only cash, certified check, money orders, or bank cashiers checks will be accepted in payment of C.O.D. amounts. No personal checks will be accepted from any person or company, except in instances where said person or company has established credit with the delivering carrier, or in instances where the person or company has made specific and prior arrangements with the delivering carrier in advance for the acceptance of a personal check. • Upon collection of the amount of the C.O.D. bill, the carrier collecting same shall remit each C.O.D. collection on package express shipments directly to the consignor (shipper) or other person designated by the consignor as payee, promptly and within forty-five (45) days after the delivery of the C.O.D. shipment to the consignee. REFORWARDING OF C.O.D. EXPRESS SHIPMENTS: C.O.D. express shipments, which are delivered to the initial destination as shown on the busbill and are then requested to be reforwarded to another destination, will only be reforwarded when the consignee accepts delivery at the initial destination and pays any collect express charges and C.O.D. amount. After all charges are paid the consignee may then reship the shipment under a new busbill, either collect or prepaid. If the express shipment is not claimed by the consignee at the initial destination, the carrier is authorized to return the shipment to the consignor. DISPOSITION OF REFUSED OR UNCLAIMED C.O.D. EXPRESS SHIPMENTS: • Not sooner than three (3) days, but not later than seven (7) days after notification to the consignee of the arrival of the shipment, the carrier's receiving agent will notify the shipper when a C.O.D. express shipment is refused or unclaimed by the consignee for any reason, and request instructions as to the disposition to be made of the shipment. In the absence of such instructions and within seven (7) days after the request, the shipment may be returned to the consignor (shipper) Collect for all accrued express and storage charges. Any shipment which is unclaimed for thirty (30) days after notification to the consignee may be returned to the consignor even though the consignor may have directed that the shipment be held for a longer period of time. • When a shipment containing perishable articles is delayed in the possession of the carrier, or is unclaimed, refused, or threatened with deterioration, the carrier shall have the right to immediately to take such steps it sees fit for the protection of the carrier and other parties in interest, including collect communication for instructions and the sale or other disposition of such perishable items without instructions. • No sale or disposal shall discharge any liability or lien to any greater extent than the proceeds thereof, less selling expenses, if any, and the shipper and consignee shall remain liable, jointly and severally, for any deficiency. • The disposition of refused or unclaimed C.O.D. shipments or the release of the C.O.D. amount, may be arranged for by the shipper only by written instructions noted on the busbill at the time of shipment, or by written order to the carrier at origin, who will transmit the instructions to the carrier at destination, at the expense of the shipper. Refunds must be applied for by the appropriate customer within 90 days from the date of shipment. No refunds will be made for standard service. If shipment is lost or damaged, reimbursement must be processed and requested through the claim process. Giving a customer their next shipment free is not to a valid refund procedure. If Greyhound fails to deliver the shipment as contracted in Priority or GPX Direct service, a refund of the total shipping charges and fees will be made to the shipper if the shipment was sent prepaid, or to the consignee if the shipment was sent collect. The Package Express Refund Department will process all refund requests except in cases of collect shipments, which are to be processed by the destination station. To request a refund • fill out GPX Form 4102U (rev. 2/99). • obtain a copy of the busbill. • select the desired method of refund. • FAX a copy of both the completed 4102U and the busbill to (214) 655-6321. • if no FAX is available call the GPX Refund Department at (800) 739-5020 to relay the information. • send the top copy of Form 4102U with a legible copy of the busbill via US Mail to Package Express Refunds P.O. PACKAGE EXPRESS TARIFF AND SALES MANUAL LIABILITY: Carriers shall not be liable for loss, damage or delay caused by: • The act or default of the shipper or owner • The nature of the property, or defect, or inherent vice therein. • Improper or insufficient packing, marking and labeling as set forth herein. • The Act of God, public enemies, authority of law, quarantine, riots, strikes, perils of navigation, the hazards or dangers incident to a state of war, or occurrence in customer's warehouse. • The examination of a shipment, or partial delivery to the consignee of C.O.D. shipments. • Accidents, breakdowns, bad condition of the roads, or other cause beyond the control of the carrier. • Delivery at a non-agency destination or closed station, under instructions of the shipper. • Difference in weight or quantity caused by shrinkage, leakage, or evaporation. • The death, injury, or escape of live express. • Loss or damage to express shipments which contain undisclosed prohibited items. • Carriers do not agree to deliver express shipments in time for any particular market, occasion, or event, or on any particular lines and to not guarantee to arrive at or depart from any particular point at a specific time. Time schedules published by the carriers are the schedules that they attempt to maintain, but same is not guaranteed. • In consideration of the rate charged for carrying said property, which is dependent upon its value and is based upon a released valuation, the carriers shall not be liable for more than one hundred dollars ($100), unless a greater value, not exceeding one thousand dollars ($1,000) is declared by the shipper at the time of shipment and excess value charges paid. In no event shall the carriers be liable for more than the actual damages sustained. • In the event that a claim, lawsuit, or other demand for payment, damages or recovery is made against a Carrier when the alleged loss, damage or injury occurred in transportation over the lines of another Carrier, such other Carrier agrees to indemnify and hold the first Carrier harmless from all such claims, lawsuits, or other demands for payment, damages or recovery, including reasonable attorney’s fees and other costs of defending such actions. CLAIMS: • Claims required to be filed in writing: • A Claim for Loss or Damage to Package Express will not be voluntarily paid by a Carrier unless filed in writing, with the Receiving or Delivering Carrier, or the Carrier issuing the Busbill or the Carrier on whose line the alleged Loss or Damage occurred, within the specified Time Limits. • Minimum filing requirement: A communication in writing from a Claimant, filed with a proper Carrier within specified Time Limits containing facts sufficient to identify the Shipment(s) of Property involved • asserting liability for an alleged loss or damage. • making claim for the payment of a specified or determinable amount of money, supported by receipts and/or invoices; and • a copy of the Busbill, in support of the Claim for Loss, Damage or Delay of the Shipment(s); will be considered as sufficient compliance with the provisions for filing Claims. PACKAGE EXPRESS TARIFF AND SALES MANUAL CLAIMS: (Concluded) • Time limits for filing claims: • As a condition precedent to recovery, Claims for lost Package Express Shipments must be filed in writing with the Originating or Delivering Carrier, or the Carrier on whose lines the loss occurred, within one-hundred eighty (180) days from the time the Express Shipment was made. • Carriers, parties to this Tariff, will be allowed a reasonable time in which to locate lost Package Express before making settlement, which will be not longer than sixty (60) days from the date of notice of such loss. The date on which the tracing form was received by the Carrier or Carriers' Agent will be considered as the first day commencing a sixty (60) day period before which a Claim will be settled by a firm offer or by a denial. • Upon receipt of a written Claim for Loss to Package Express transported, the Carrier will either (1) pay, (2) decline, or (3) make a firm compromise settlement offer in writing, within one hundred and twenty (120) days after receipt of the claim; provided, however, that if the Claim cannot be processed and disposed of within one hundred twenty (120) days after receipt thereof, the Carrier will, at that time and at the expiration of each succeeding sixty (60) day period while the Claim remains pending, advise the Claimant in writing of the status of the Claim and the reason for the delay in making final disposition thereof and the Carrier will retain a copy of such advice to the Claimant in its Claim File thereon. • Concealed and/or Exterior Loss or Damage shall be reported in writing to the Delivering Carrier at destination within seven (7) days after delivery of the Property, and the Carrier shall be given the privilege of making an inspection of the Property. A Claim involving concealed and/or exterior Loss or Damage must be filed within one-hundred eighty (180) days after delivery of the Property. • Carriers, shall have the full benefit of any insurance that may have been effected upon or on account of Package Express, which has been damaged or lost, insofar as this shall not void the policies or contracts of insurance. • Any suit or action at law to enforce a Claim must be instituted within two (2) years and one (1) day after the date of notice in writing is given by the Carrier to the Claimant that the Claim or any part of parts thereof have been disallowed by the Carrier. Where a Claim is not filed or a suit is not instituted thereon in accordance with the foregoing provisions, Carrier will not be liable, and such Claim will not be paid. • Documents not constituting claims: • Bad Order Reports, Appraisal Reports of Damage, notations of shortage or damage, or both, on Busbills, Delivery Receipts, or other documents, or Inspection Reports issued by Carriers or their inspection agencies, whether the extent of loss or damage is indicated in dollars and cents or otherwise, will not, standing alone, be considered by Carriers as sufficient to comply with the Minimum Filing Requirements. • Claims filed for uncertain amounts: • Whenever a Claim is presented against a Carrier for an uncertain amount, such as "$100 more or less," the Carrier, against whom such Claim is filed, will determine the condition of the Shipment involved at the time of delivery by it, if it was delivered and will ascertain, as nearly as possible, the extent, if any, of the loss or damage for which it may be responsible; however, the Carrier will not voluntarily pay a Claim under such circumstances unless and until a formal Claim in writing, for a specified or determinable amount of money. • Other claims: • If investigation of a Claim develops that one or more other Carriers has been presented with a similar Claim on the same Shipment, the Carrier investigating such Claim will communicate with each such other Carrier and, prior to any agreement entered into between or among them as to the proper disposition of such Claim or Claims, will notify all Claimants of the receipt of conflicting or overlapping Claims and will require further substantiation, on the part of each Claimant, of his title to the Property involved or his right with respect to such Claim. • Delayed express: • No claims will be paid on delayed express unless otherwise specifically provided in the tariff under which the shipment or baggage was handled. PACKAGE EXPRESS TARIFF AND SALES MANUAL QUARANTINE: • In the case of quarantine, a shipment may be discharged, at the risk and expense of the consignor, into a quarantine depot or elsewhere, as required by quarantine regulations or authorities, or for the carrier's dispatch at the nearest available point in the carrier's judgment, and in any such case the carrier's responsibility shall cease when the property is so discharged or the shipment may be returned by the carrier as refused or unclaimed. • Quarantine expenses of whatever nature or kind upon or in respect to shipments shall be borne by the consignor or be a lien thereon. • The carrier shall not be liable for loss or damage occasioned by fumigation or disinfection or other acts required or done by quarantine regulations or authorities even though the same may have been done by the carrier's officers, agents, or employees, nor for detention, loss, or damage or any kind occasioned by quarantine or the enforcement thereof. • The consignor shall hold the carriers harmless from any expense they may incur, or damages they may be required to pay, by reason of the introduction of a shipment into any place against the quarantine laws or regulations in effect at such place. ACCEPTANCE OF ELECTRONICS AND ELECTRONIC MEDIA: Electronics and Electronic Media items will be accepted for transportation under the following conditions: • All Electronics and Electronic Media items must be shipped in Priority Express Service. If shipment is destined greater than 800 miles, the Priority Express Service requirement is waived and a maximum declared value limit of $300 will apply (excluding CDs, Videos, and Cassette Tapes). • Maximum declared value of CD, Videos, and Cassette Tapes for all shippers will be $100. • All Electronics and Electronic Media items must be shipped in original factory packaging. PACKAGE EXPRESS TARIFF AND SALES MANUAL ARTICLES PROHIBITED OR SUBJECT TO SPECIAL CONDITIONS OF ACCEPTANCE: General Restrictions: • The carriers WILL NOT accept or transport express shipments which, because of character, size, or weight, are obnoxious to passengers, or which are likely to be, or to become, objectionable to passengers or prospective passengers, or which are liable to cause injury to personnel, to baggage, to other shipments, or to the carriers' equipment. • The carriers WILL NOT accept or transport any item, material, or substance, the possession of which or the transportation of which is unlawful. • The carriers WILL NOT accept or transport package express shipments which indicate that the consignee's address in an APO (Army Post Office) or FPO (Fleet Post Office) number. Explosives And Other Hazardous (Dangerous) Materials - Prohibited: • Packages or shipments which contain explosives or other hazardous (dangerous) materials, listed below, and any and all other types of explosives or hazardous (dangerous) materials that require a special diamond label WILL NOT be accepted for transportation.
