EUROVISION 2015 REGULATION I. GENERAL PROVISIONS 1. SRTV, in its Organizer capacity, a right granted by the European Broadcasting Union (E.B.U.), is organizing on a yearly basis, in the form of a contest, the National Selection for Eurovision. In 2015, the European final of the Eurovision contest will be conducted on 23.05.2015, Vienna, Austria. The National Selection for Eurovision 2015 contains a registration period, a preselection and a final, to designate the winning song which will represent Romania at Vienna. II. REGISTRATION PERIOD 2. In the period of registration in the contest 26.01.2015 – 08.02.2015 (the receipt date for materials, which may be proven by means of official documents: stamp, confirmation email, registration receipt), the authors of original songs (music and lyrics), which could represent Romania at Eurovision 2015, are invited to send to the address eurovision@tvr.ro or to the Romanian Television (Calea Dorobanţilor No. 191, Sector 1, Bucharest) or to submit to the Registry of SRTv, the following: a) an audio recording on CD or on wetransfer.com to the above email address, containing the final version of the song and an instrumental version, without the singer’s voice, but with backing vocals. Full information about the participating song: o Title o Name of composer (composers) o Name of author (authors) of the lyrics o Name of producer (publisher), if any b) an affidavit, according to the model from Annex No.1 to this Regulation, by which the author is taking responsibility that the song registered in the contest was not made public under the conditions provided in Art.6 of this Regulation in full or in part, by means of any audio or video media, by means of radio broadcasts on any public or private, national or local radio or television channel, by means of internet or by means of any public performance (including concerts) from Romania or abroad, whether or not it was officially recorded on any magnetic or digital medium, and in any other form of public communication, as well as the fact that the song was not commercially launched and/or publicly performed (in full or in part) before September 1, 2014, it is an original creation and it does not affect the rights held by third parties; c) the written agreement between the author and the performing artist(s) regarding the participation in the National Selection for Eurovision 2015, the model of which is formed Annex No. 2 to this Regulation;
d) the written authorization signed by the holders of copyright and related rights - author/artist/producer of the work/ owner of (ii) the (audio) recording, according to the model from Annex No. 3, regarding the assignment of patrimonial copyright and related rights over the work, (master) performance and registration, as well as the obligations regarding the promotion of the contest. e) the text of the song in the language in which it is performed and a translation into Romanian, ad literam, of the song, in case the text is in a foreign language; f) a copy of the identity document of the author/authors, artists and of the producer’s representative (if applicable); g) telephone number; h) proof of payment of the fee for the registration in the contest (a copy of the payment order). The fee for the registration in the contest is 45 euro for each submitted song and will be transferred into account RO31RNCB0072000506070006 opened with BCR Sector 1. This will be used for the organization of the National Selection. 3. By registering in the contest, the authors and the performers of the songs from the National Final undertake to conclude an agreement with SRTv, detailing the editorial, artistic, organizational obligations, as well as those related to public communication and conduct in connection with the participation in the Eurovision Contest 2015. 4. The songs will be submitted to SRTv Registry within the time interval: 8.00 a.m. – 20.00 p.m., and the dispatch by mail should be made so that the envelope should reach SRTv until 08.02.2015, 24.00 hours. In case the materials are sent by email, the deadline will be 08.02.2015, 24.00 hours. 4.1 The songs ad their performances cannot exceed 3 minutes, otherwise, they will be disqualified. No more than 6 performers will be admitted on stage. The performer should be at least 16 years of age, on the date of the international final, at the latest. 4.2 The text of the song must not have an obscene or political character, and it must contain any publicity messages. The songs admitted for the second phase in the contest (the live national selection) will be performed with the instrumental version, which cannot contain any backing vocals or computerized voice effects; the entire vocal part must be live. 4.3 In this stage, only the songs sent on a CD, in audio format (CDA) or to the email address eurovision@tvr.ro (on wetransfer.com) will be admitted. In case email is chosen as a sending method, the procedure is considered as concluded only after the sender has received a confirmation from the same address. 5. The envelopes or emails which will not contain the requested documents will not be taken into consideration at the preselection. All the materials from the registration file cannot be returned, whether they will be admitted or not in the subsequent stages of the contest. 6. The contest participants assume the mandatory and eliminatory condition that the song (music and/or text) should be original, should not affect any rights of any third
parties, should not have been edited on any audio or video media, and should not have been broadcasted on any radio, television or internet channel or made public in any way, in full or in part, until September 1, 2014. In case that, in any stage of the contest, there are proofs submitted by any third party with regard to the breach by a song of the mandatory and eliminatory condition from above, the respective song will be disqualified by the organizers. The analysis of the proofs (including accusations of plagiarism) will be made by a commission designated by SRTv, as the organizer. The final decision belongs exclusively to SRTv. Responsibility for any plagiarism charges belongs solely to the Author. 7. On 9, 10 and 11.02.2015 the envelopes will be opened and the documents sent by mail to the addresses: Calea Dorobanţilor No. 191, Sector 1, Bucharest and eurovision@tvr.ro or submitted to the Registry of SRTv will be verified by a reception commission and in the presence of a notary public. The respective notary will certify the existence/inexistence of all the documents requested by organizers, according to the Regulation of the Contest. III. PRESELECTION 8. The preselection will be carried out on February 9, 10 and 11, 2015. 9.1 The preselection of the songs entered into the contest shall be made by a specialized Jury, formed of an odd number of members, minimum 5 – maximum 7 which will hear all the songs entered into the contest in the presence of a notary public. 9.2. The members of the Jury, both for the preselection stage, and for the National Selection stage will be appointed by the Organizer (SRTv). 9.3. The members of the Jury take the responsibility for the conditions related to the performance of the contest, and any eventual appeals made by participants will be solved by the Organizer (commission for appeals), with the consultation of the Jury members. 9.4. Both for the preselection stage, and for the final stage of the National Selection, the members of the Jury will elect a Chairman. The Chairman of the jury will be elected with half plus one of the members’ votes and will supervise the proper proceeding of the judging process, including the operation of calculating the final rating, based on individual ratings. IV. VOTING SYSTEM 10.1 Of all the songs entered into the contest, the jury will select, in the preselection stage, for the national selection stage, maximum 12 songs. 10.1.1 Each jury member will receive a jury sheet, containing the songs entered into the contest, in the alphabetical order of the sing titles. 10.1.2. The songs will be appreciated on the basis of the rating from 1 to 10, and jury members can give the same rating to several songs.
10.1.3. A maximum number of 12 songs, which shall obtain the best ratings from the jury, in a decreasing sequence, will be admitted for the national selection stage; these songs will obtain the best rating from the jury. Only a single song made by a composer and only a single song performed by an artist can be selected. The performing artist cannot be replaced during the contest. 10.1.4. In case of a tie-vote, the song with the most numerous ratings of 10 will win. If a tie-vote is found again, the most numerous ratings of 9 will be taken into consideration, and so on and so forth until a differentiation can be made. If, however, equality between the graded songs is maintained, the organizer will decide the song that will be selected. 11. The members of the jury must sign both their own jury sheets, and the minutes drafted after the exact establishment, in the preselection stage, of those maximum 12 songs participating in the national final stage. 12. The winning composers in the preselection stage, which will enter the final, will be announced both on SRTv stations, and on SRTv websites, the results being sent for publication in the central press, as well. 13. In case that, for objective reasons, a composer withdraws his/her song from the contest, this will be made by an official application, signed, filed with the Registry of SRTv or sent by email to: eurovision@tvr.ro, signed and scanned, within 24 hours since the time when the finalists were announced. In case that the application for withdrawing the song is not communicated to SRTv within the abovementioned term of 24 hours, the provisions of Art. 6 of Annex 2, provided under item 2 letter c) will become applicable. 14. Any eventual appeals will be received at the Registry of SRTv, within 24 hours from the communication of the results of the preselection stage. The appeals will be solved by the Organizer (Commission for appeals), with the consultation of the Jury members. They will prepare and communicate a written answer to the address mentioned by the appellant. The term for solving every appeal is 72 hours from the expiry date of the submission deadline for appeals. V. NATIONAL SELECTION – THE FINAL: A) JUDGING: 15.1. A maximum number of 12 songs will take part in the final stage of the National Selection. 15.2. The judging method: 50 % Televoting and 50% National Jury composed of specialists, in an odd number, minimum 5, maximum 7 and two alternate members. Jury members must meet the following conditions: - they should have no interest whatsoever in connection with the song, the authors or the performer, that may be liable to affect the fairness of the voting exercise;
- They should fill in and send a form confirming that they will comply with the voting instructions set out in this Regulation, and a signed statement by which they undertake to vote in an independent manner. 15.2.1. The specialized jury will grant ratings from 1 to 12, as follows: 1, 2, 3, 4, 5, 6, 7, 8, 10, 12. Each rating will be granted only once to a song. 15.2.3. Each jury member, including the Chairman will sign the jury sheet and the jury minutes, and will deliver them at the end of the selection show to the secretariat of the jury. 15.2.4. The judging process must be completed before the closing of the televoting lines. Judging will be made without the Jury members knowing the final results of the televoting. 15.2.5. At the end of finding out the results from the jury, the song in the first place will receive a rating of 12, the second place – a rating of 10, the third place – a rating of 8, the fourth place – a rating of 7, the fifth place – a rating of 6, the sixth place – a rating of 5, the seventh place – a rating of 4, the eighth place – a rating of 3, the ninth place – a rating of 2, the tenth place – a rating of 1 , the eleventh place – a rating of 0,and the twelfth place – a rating of 0. B) TELEVOTING: 16.1. Each song will be assigned a telephone number which will be displayed during the song, equally for all the competitors. 16.2. Viewers may vote from the same telephone number for one or for several songs, but only once for each melody, from the time when the telephone lines are declared open. 16.3. The telephone lines will be opened after the performance of the last song in the contest, at the “START VOTING!” signal, and will be closed 30 minutes later, at the “STOP VOTING!” signal. 16.4. When the Televoting is closed, a second classification will be created, the song in the first place will receive a rating of 12, the second place – a rating of 10, the third place – a rating of 8, the fourth place – a rating of 7, the fifth place – a rating of 6, the sixth place – a rating of 5, the seventh place – a rating of 4, the eighth place – a rating of 3, the ninth place – a rating of 2, the tenth place – a rating of 1 , the eleventh place – a rating of 0,and the twelfth place – a rating of 0. 16.5. Winner of the National Selection for Eurovision 2015 – the final stage will be declared the composer whose song obtains the highest rating further to cumulating the ratings granted by the Jury and further to the Televoting. 16.6. In case of a tie-vote, the winner will be the person who obtained the most numerous ratings of 12 from the Jury. If the tie-vote is maintained, the most numerous ratings of 10, respectively 8 and so on and so forth will be se taken into consideration. 16.7. To ensure the fairness of the judging process at the final stage, SRTv will resort to the services of a public notary.
VI. LIMITATIONS AND RESERVATIONS 17. During the participation in the Eurovision contest, neither the performing artist, nor the composer may conclude any agreement with third parties regarding the rights assigned to SRTv. 18. During the performance of the international stage of the contest (the international semi-final and final), the management of the artist has the obligation to comply with the priorities and conditions imposed by SRTv regarding the promotion and preparation of the artist’s participation in the international stage as the Representative of Romania. VII. FINAL CLAUSES 19. Appeals will be received at the registry of SRTv within 48 hours from the communication of the results. Appeals will be solved by the Organizer (SRTv) and by the specialized Jury. The term for solving the appeals is 72 hours. 20. The failure by the authors/artists and holders of rights over the participating song to sign the 3 Annexes to this Regulation, as well as the agreement regarding the participation in the national or international final will constitute a reason for the disqualification of the song from the contest. 21. All the artists and other holders of rights undertake to authorize the use, reproduction, printing and publication of their names, images, voices, photographs and biographies in the context of promoting, broadcasting and/or of the commercial exploitation of the shows by all means and on any media channel, either from among the currently known channels, or from any subsequent ones, for an unlimited period of time. This involves also the use of the photographs and any other audio and video materials from press conferences, or recorded at rehearsals or backstage, for DVD compilations, for the websites of SRTv, Eurovision or their official partners, as well as of any other SRTv or Eurovision media product. 22. The artists have the obligation to take part in the press conferences organized by SRTv and EBU. The winning artist (artists) (i) have the obligation to participate in the official press conference after the national and international final, in promotion shows realized by SRTv with priority, to mutually agree with the Organizer on their participation in any show broadcasted on any other media channel, and to authorize the use of any recording on any media channel (including the Internet) without any limitations related to time and territory. 23. This Regulation is correlated with and is supplemented by the provisions of the International Regulation of EUROVISION SONG CONTEST 2015; 24. This Regulation, together with its 3 Annexes, the International Regulation for EUROVISION SONG CONTEST 2015, as well as any other information about the contest will be posted on website www.eurovision.tvr.ro, with a link to the official website of EUROVISION SONG CONTEST 2015( www.eurovision.tv). 25. The organizer reserves the right to make changes to this Regulation, informing the participants in due time.
