Introduction The City of Hays is requesting bids from companies interested in providing and installing (8) eight baseball/softball scoreboards at the City of Hays’ Bickle- Schmidt Sports Complex. Bids will be accepted until 3:00 P.M. local time, Tuesday February 16th, 2021 at the Finance Office located at 1507 Main St., P.O. Box 490, Hays, KS 67601. This written Request for Bid (RFB) states the scope of the City of Hays requirements and specifies general rules for preparing the bid. The bid should clearly demonstrate how the bidder can best satisfy the requirements of the City of Hays. The City of Hays shall reserve the right to award the purchase order which is most advantageous to the City of Hays. Rules of Preparation The submitted bids must follow the rules and format established within this RFB. Adherence to these rules will ensure a fair and objective analysis of all bids. Failure to comply with any portion of this request may result in rejection of the bid. Bidder Inquiries The City of Hays Parks Department has prepared this RFB and has designated Chris Smith, Parks Superintendent, as the manager in charge of the initial bid review and procurement of contractor for the project. Submission of Bids Please prepare and submit one (1) original bid form which is included in the bid packet. Completed bids should be sealed and clearly marked "Bickle-Schmidt Sports Complex Scoreboards" in bold or highlighted text with strict instructions not to open until the due date and be submitted to the Finance Director by the due date. Bids received after the above date and time will be considered late and will not be accepted. Bids will be evaluated objectively based on the bidder's responses to the RFB. The City of Hays will not pay costs incurred in the bid preparation including, but not limited to, the costs for printing and mailing services. All costs for the preparation of the bid shall be borne by the bidder. Notification of Withdrawal of Bid Bids may be modified or withdrawn by an authorized representative of the vendor or by formal written notice prior to the final due date and time specified for bid submission. Otherwise, bids will be considered valid for at least 45 days from the opening date. Submitted bids will become the property of the City of Hays after the bid submission deadline. Minimum Specifications and Scope of Project The successful bidder shall provide labor and materials to remove the existing scoreboards and install new baseball/softball scoreboards for the City of Hays in accordance with the terms of this RFB. The bidder will remove the existing eight (8) scoreboards and install eight (8) new LED scoreboards, including the related communications and electrical components, only upon the issuance and acceptance by bidder of a purchase order. The bidder shall accept all valid purchase orders. Payment for products will occur after they have been received by the City of Hays and upon receipt of invoice from the bidder. The City of Hays is tax exempt and will provide a tax-exempt form to the successful bidder. No material substitutions will be accepted unless the item is 100% equivalent to the item being requested. Exceptions must be noted on the bid form in the “exceptions section”. The following is for informational use only to prepare the bid and shall not be considered a complete projection of current or future needs. It is the bidder’s responsibility to ensure that they understand the needs of the City of Hays via communication with the Parks Superintendent. A site visit is recommended, but not required, for this project prior to RFB submission. Include all equipment, installation, line pulls, configuration, and training needed for this project to be a success and to be considered a “turnkey” event. Attachment (A) shows electrical conduit and communications conduit stub up on existing scoreboards. Attachment (B) shows communication wire conduit and junction box at home plate backstop. Attachment (C) shows the front view of existing scoreboards. Attachment (D) shows the back view of the existing scoreboards. Minimum specifications include: ➢ Scoreboard dimensions: must be a minimum of 14 feet wide by 5 feet in height. ➢ Scoreboards must be capable of being mounted to the existing I-beam posts without welding. The current posts are 8” X 8” X 3/8” and are on 10 feet centers. (See attachments A thru D) ➢ Scoreboard cabinet construction shall consist of: - 5052 aluminum, aluminum alloy or equivalent corrosion resistant material. Exceptions shall be noted in the exceptions section. - Front, back and side panels shall be a minimum of 1.5 mm thickness or greater. - Top and bottom panels shall be of 3.0 mm thickness or greater. ➢ Scoreboards display shall be all digits: HOME and GUEST scores to 99, INNING to 19, BALL to 3, STRIKE to 2, OUT to 2 and game TIME. ➢ Each scoreboard shall include a 14 ft. X 18-inch horizontally mounted ad/field identification panel. The panel shall have the field identification lettering in 12-inch captions. (Example: FIELD #1; FIELD #2… centered on the panel) ➢ Internal driver must be sealed to prevent corrosion. ➢ Digit sizes must be a minimum of 18 inches. ➢ Digits, front and back, must be sealed in a minimum of 1/8-inch of weather- tight conformal or silicone gel to completely seal out moisture. ➢ All digits shall be LED, red in color. ➢ All eight (8) Scoring Consoles: Shall be water resistant and include a power cord that plugs into a standard grounded outlet, and a control cable to connect to the communication line’s receptacle. Consoles should be interchangeable between the eight scoreboards and come with a carrying case. 5
➢ Communications Lines: Empty conduit is in place from the home plate backstop to the existing scoreboards. Successful bidder shall run and connect shielded communications wire between the scoreboard and backstop control receptacle junction box for each field/scoreboard. Staff estimates the distances to be between 480 feet and 560 feet per scoreboard. Approximately 10 feet of conduit will need to be added at each scoreboard. Installation shall include boxes, cover plates and jacks. (See attachments A and B) ➢ Upon completion, bidder shall provide training to field staff on equipment operations and capabilities. ➢ Manufacturer shall provide access to factory Service Technicians who are available seven (7) days a week for assistance and troubleshooting. ➢ Warranty: Five (5) years or greater on parts, components, and controllers. ➢ If sub-contractors are used to install the scoreboards the manufacturer must be on site to supervise the installation to ensure that the full warranty is intact upon completion. A detailed list of what items will be provided by the bidder and what items are required by the City of Hays to make this project operational should be included in this bid. A detailed list of warranty terms for all items should also be included in the bid along with any pertinent documentation regarding the project plans, addressing, configurations, reference manuals and cable paths. All travel, setup, configuration, and training is to be included. The company shall be fully qualified and licensed to provide installation and training for these services. All products provided under the terms of this contract shall be new and free from defects in material and workmanship. This shall not be an exclusive contract with the bidder for service and products. The City of Hays reserves the right to purchase like services or products from another vendor. It is the bidder’s responsibility to clearly list any exclusions to the minimum requirements listed above that they cannot meet. The bidder must also list anything that the City will need to provide in order to make this project a success. This does not guarantee a specific quantity of business. Purchases are to be made only as authorized by a purchase order issued by the City of Hays. This is not an exclusive contract. 6
Contractual Obligations The successful bidder will be required to accept a purchase order from the City of Hays in which the bidder will undertake certain obligations. These obligations include, but are not limited to, the following: Inclusion of Bid - The bid submitted in response to this RFB will be incorporated as part of the final purchase order with the selected bidder. Insurance - The successful bidder shall maintain and shall require all of its subcontractors to maintain general aggregate insurance with limits of not less than $1,000,000 per accident. Costs - All costs are to be stated in exact amounts. All costs must be detailed specifically in the vendor cost summary section of the bid; no additional charges (e.g. for sales tax, container packing, installation, training, out-of-pocket expenses, etc.) will be allowed unless so specified in the bid. Selection - The final award is subject to the City of Hays purchasing policy. Right of the City of Hays to Reject Bids The City of Hays reserves the right to reject any and all bids or any part of any bids, to waive minor defects or technicalities, or to solicit new bids on the same project or on a modified project which may include portions of the originally proposed project as the City of Hays may deem necessary in its best interest. The City also reserves the right to negotiate with any bidder, all or part of any bid that is in the best interest of the City. Evaluations The committee evaluating the Bids will base the evaluation on the Bid that will best serve the City of Hays at the lowest possible cost. Testing period required for this project? NO If so, length of testing period: N/A Non-limitations to RFB The format of the RFB must be followed and all requested information must be submitted as indicated; however, the City of Hays is receptive to any additional suggestions pertaining to bid requirements. Any exceptions to the RFB terms and conditions must be included in writing in the bid. 7
Interpretations and addenda No interpretation made to any respondent as to the meaning of the RFB shall be binding on the City of Hays unless repeated in writing and distributed as an addendum by the City of Hays. Interpretations and/or clarification shall be requested in writing from the City of Hays, Parks Superintendent, Chris Smith. Bid Response Format In order to facilitate the analysis of responses to this RFB, bidders are required to prepare their bid in accordance with the instructions outlined in this section. Each bidder is required to submit the bid documents in response to the RFB in a sealed envelope. Bidders whose bids deviate from these instructions may be considered nonresponsive and may be disqualified at the discretion of the City of Hays. Bids should be prepared as simply as possible and provide a straightforward, concise description of the bidder's capabilities to satisfy the requirements of the RFB. Expensive bindings, color displays, promotional material, etc., are not necessary or desired. EMPHASIS SHOULD BE CONCENTRATED ON ACCURACY, COMPLETENESS, AND CLARITY OF CONTENT. The Bid should be organized into the following major parts: Executive Summary - A brief and non-technical narrative describing the bid. Company Background - Information regarding the vendor's stability, length of time in business, past history, future plans, company size, organization. Responses to Functional Requirements - Responses to the requirements listed in this RFB must be provided. Notes of explanation or clarification must be included with specific reference to the item in question. Client References - Provide at least three client references that are similar in nature, size or complexity to that described in this RFB. Contract Terms and Conditions - This section is to contain the bidder's sample agreements initially and for ongoing maintenance and/or support. This section is intended to form the basis for the development of a purchase order to be awarded as a result of the RFB. Cost Quotations - All costs must be itemized and included in this section. Bidders must also complete the final page of this RFB document to be used as an additional summary document. 8
Confidentiality of Documents All responses to the RFB submitted by bidders shall be deemed public documents at the time opened by City of Hays. The RFB is intended to be worded in a manner so as not to elicit proprietary information from the bidder. If proprietary information is submitted as part of the bid, such information is to be labeled proprietary and be accompanied with a request that the information is to be returned by the City of Hays to the submitter. Any bid that is submitted with a blanket statement or limitation that would prohibit or limit such public inspection shall be considered non-responsive and shall be rejected. Legal Notice All City of Hays contracts are subject to the provisions of Section 2-576 through 2- 580 of the City of Hays, Kansas, Code of Ordinances. All parties doing business with the City of Hays should familiarize themselves with the provisions of the City of Hays Code, prior to proposing any contract to the City of Hays. To the extent any contract entered into by or on behalf of the City of Hays, Kansas, omits any of the contract provisions required by the City of Hays Code of Ordinances, the Code will prevail and the required contract provisions will be read into the contract. To the extent any contract entered into by or on behalf of the City of Hays, Kansas contains any of the contract provisions barred by the City of Hays Code of Ordinances, the Code will prevail and the offending provisions shall be null and void and shall be unenforceable as to the City of Hays, Kansas. All persons awarded and/or entering into purchase orders with the City of Hays shall be subject to and required to comply with all applicable City, State and Federal laws, including, without limitation the following provisions of the City of Hays Code of Ordinances: Sec. 2-576. - Required contractual provisions. Unless specifically waived in its request for bids or request for proposals, or included as alternate provisions to be bid or proposed, the City of Hays, Kansas, shall not award contracts nor let bids to individuals or entities unless the vendor, contractor or individual agrees to indemnify and hold the City of Hays, Kansas, harmless from any and all losses, damages or expenses of any kind arising out of any and all claims, demands, or causes of action initiated against the City of Hays, Kansas, by competing entities bidding on the project which is the subject of the contract. 9
Sec. 2-577. - Prohibited contractual provisions. Unless specifically waived in its request for bids or request for proposals, or included as alternate provisions to be bid or proposed, the City of Hays, Kansas, shall not award contracts nor let bids to individuals or entities which attempt to do any of the following or include any of the following in the proposed contract: Any diminishment of the common law or statutory standard of care, limitation of liability, or other attempt to reduce responsibility for mistake, error, or negligence of any type on the part of the vendor, contractor or individual. Attempt to limit liability for breach of contract or negligent performance to the amount of the payment to the contractor by the city. Attempt to claim ownership of intellectual property created during the performance of the contract with the city. Arbitration agreements. Provision for damages for breach by owner contrary to common law or statute including, but not limited to, any attempt to provide for attorney fees as part of recoverable damages. Attempt to designate any forum or venue for resolution of disputes other than Ellis County District Court, Kansas. Any other attempted reallocation of risk contrary to common law or statute. Any attempt to eliminate the city's ability to collect consequential, exemplary or punitive damages, or any other measure of damages permitted by law, in an action against the vendor, contractor or individual for breach of contract. Sec. 2-578. - Prohibited acts. Unless specifically permitted to do so by the request for bids or request for proposals, no vendor, contractor or individual submitting proposals or bids to the City of Hays, Kansas, shall attempt to insert any of the contractual provisions prohibited by Section 2-577 into any contracts or agreements proposed to the City of Hays, Kansas. Sec. 2-579. - Penalty for violation of article. Any vendor, contractor or individual who, without the express permission of the City Manager of the City of Hays, Kansas, proposes to enter into or enters into a contract with the City of Hays, Kansas, which omits any of the contract provisions required by Section 2-576 of this article or contains any of the contract provisions barred by Section 2-577 of this article, may be found by the City Manager of the City of Hays, Kansas, to be in violation of this article and vendors, contractors or individuals found to be in violation of this article may be barred from bidding on future contracts with the City of Hays, Kansas. Sec. 2-580. - Conflict between Article and contract. To the extent any contract entered into by or on behalf of the City of Hays, Kansas omits any of the contract provisions required by Section 2-576 of this article, the article will prevail and the required contract provisions will be read into the contract. To the extent any contract entered into by or on behalf of the City of 10
Hays, Kansas contains any of the contract provisions barred by Section 2-577 of this article, the article will prevail and the offending provisions shall be null and void and shall be unenforceable as to the City of Hays, Kansas. The City of Hays has an affirmative action program. Any firm will be required to include the following statement in any contract with the City of Hays: “Contractor shall not discriminate in the employment of persons engaged in the performance of this Agreement on account of race, color, national origin, ancestry, religion, sec, marital status, physical handicap, or medical condition, in violation of any federal or state law. Contractor shall comply with all requirements of the City of Hays pertaining to affirmative action with regard to employment while this Agreement is in effect.” At any time, the City may elect to abandon the project. At that time, the contractor would be compensated for all items previously completed. 11
